This permit, issued on t , , , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) In order to-,protect juvenile shrimp populations, the- temporary earthen plug may not be removed between Apri I I 'and September 30 of any year without the prior approval of the Division of Coastal Management. (2) No borrow material will fill any marsh grass area which surrounds the entrance channel during damiconstruction or removal activities. (3) Adequate dikes or other retaining structures will "be constructed to prevent spoil materials from spilling over into the surrounding waters. .` (4) Prior to flooding, the bottom of the existing basin and entrance channel landward of the dam will be graded so as to raise the bottom elevation to -8 feet mean low water level.' with a gradual slope to -10 feet mean low water level where it joins Cal-abash Creek. (5) Prior to flooding, the new basin extension measuring 840 feet in length will start with a bottom depth of -6.5 feet mean low water at its farthest northern point and be so constructed- to-taper to a bottom depth of -7.5 This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31. 1988 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. (6) All filled, graded or other disturbed land areas will be progressively provided a ground cover sufficient to restrain erosion within four (4) weeks of the completion of such activities. (7) All graded impermeable surfaces will be designed to direct runoff to grassed areas or to the sediment traps. (8) At least three large sediment traps with metal grates will be installed. NOTE: A representative from the Division of Coastal Management should be contacted after grading activities have been completed to recommend the placement of the sediment traps. (9) A marine pumpout system will be installed and operable for boats with holding tanks prior to occupancy by any boats at the marina. (10) The marina shall prominently post and enforce a no sewage discharge policy. (11) All floating structures, other than boats, used for habitation or commerce (as defined in 15 NCAC 7M.0602) shall be in conformance with local regulations for onshore sewage treatment. (12) In order to protect water quality, runoff from the construction area must not visibly increase the amount of suspended sediments in adjacent waters. NOTE: It is recommended that the lowest portion of the structural member of the lowest floor (excluding the pilings or columns) be elevated to or above 13.3 feet mean sea level. NOTE: A 401 Water Quality Certification was issued 6/18/82 by the Division of Environmental Management. NOTE: Prior to any discharge of domestic wastewater, the applicant needs to apply for and obtain: (a) A non-discharge permit for the extension of sewers to the Carolina- Blythe Utilities Wastewater Treatment Plant. (b) A letter from Carolina-Blythe accepting the proposed domestic strength wastewater resulting from this project. NOTE: Prior to the construction of wastewater extension lines to Carolina-Blythe Utilities Wastewater Treatment Plant, a modification to this permit incor- porating the sewer:extension:lines must.be.obtained. e 1 - 106 Marsh Harbor Yacht & Golf Links, Inc. C. Division of Coastal Management Wilmington Office, 256-4161. NOTE: A Mining Permit is required for this project. The applicant should contact the Division of Land Resources, Wilmington Regional Office, 256-4161. NOTE: The permittee and/or his contractor is urged to meet with a representative of the Division of Coastal Management prior to project initiation or initiation of another permitted phase of construction. In accordance with your written request of September 11, 1987, your Department of the Army authorization has been reviewed and found to be consistent with the provisions and objectives of general permit No. SAWC080-N-000-0291 (copy enclosed). Therefore, you may continue construction activity in strict accordance with applicable State authorization. Subsequently, the expiration dates of your State and Federal authorizations now coincide. Failure to comply with the State authorization or conditions of the general permit could result in a violation of Federal law. If any change in your work, including further extension of the expiration date, is required because of unforeseen or altered conditions or for any other reason, plans revised to show the change must be sent promptly to this office and the North Carolina Division of Coastal Management prior to performing any such change or alteration.
