With reference to our earlier comments on the two
subject applications, we have reconsidered the recommended
condition that live-aboards not be allowed. Both permits
should require that there be no overboard discharge of
sewage from boats using the marinas. If a requirement of no
sewage discharge is strictly enforced through the CAMA
permits, live-aboards would not be expected to be a problem
in and of themselves.

The Subject application has been reviewed for water
quality impacts and the following comments are offered:
a. The proposed project does not require a 401 Water
Quality Certification.
b. Broad Creek is a wide, relatively deep, creek
which is used extensively by commercial type
marinas. There are currently four large
commercial marinas located on the Creek. In
recent years, Broad Creek has experienced poor
water quality conditions such as low dissolved
oxygen levels, algal blooms, elevated nutrient
levels and higher chlorophylla values. These
conditions have contributed to the fish kill
incidents that occur on the creek, as well as in
Pamlico River. We are very concerned that the
proposed marina expansion may contribute to the
existing water quality problems in Broad Creek and
Pamlico River. It would be difficult to predict
water quality standard violations due to the
proposed expansion; however, the potential does
exist.
C., Should the permit be allowed, it will be important
to make the conditions restrict to lessen the
potential impacts. The facility should be
equipped with a pumpout facility for boats. The
marina should strictly enforce a "locked-head".
Live aboards should not be allowed. Signs should
be posted along the docks advising users of the
locked-head policy and the location of the sewage
pumpout facility.

The project site is located off SR 1300 near Washington, North Carolina. The
Washington Yacht and Country Club has an existing private marina with 150
boat slips, onshore bath houses and fueling facilities (no pumpout). The
marina is located on Broad Creek which is classified SB waters.
The applicant is proposing to expand the marina by constructing a 400 L.F.
wooden pier to accommodate an additional 48 boat slips. No high ground
development or dredging is proposed.
Broad Creek is a wide, relatively deep creek which is used extensively by
commercial type marinas. There are currently four large commercial marinas
located on the creek. In recent years, Broad Creek has experienced poor
water quality conditions such as low dissolved oxygen levels, algal blooms,
elevated nutrient levels and higher chlorophyll a values. These conditions
have contributed to the fish kill incidents that occur in the creek, as well
as the Pamlico River (personal communication with Barry Adams (PERT),
Washington Regional Office).
It is my opinion that the proposed marina expansion may contribute to the
existing water quality problems in Broad Creek and Pamlico River. It would
be difficult to predict water quality standard contraventions due to the
proposed expansion; however, the potential does exist. The Division's
position in similar cases has traditionally been to approve projects where a
contravention of standards cannot be predicted. The proposed project appears
to fit into this category.

8. Project summary Applicant proposes to build a 400' long by 6' wide pier and to build
15-24' long by 2'6" wide finger piers and to sink 66 mooring pilings adjacent to finger_
piers Also proposes to add four (4) new mooring pilings 20 feet off an existing
covered boathouse.
Environmental settin
The project is located in Beaufort County on Broad Creek at the end of SR 1300. The
project site is a private yacht and country club with a golf course, main club house,
bath houses, three covered boathouses, slips, boat ramp-and . fueling facilities. The
marina has slips for + 150 boats and is located in one.of the most heavily developed
marina areas, for a creek its size, on the North Carolina coast, including McCotter's
Marina, Pamlico Plantation and East Coast Yachts. Broad Creek, which has inland
waters designation, is approximately 900' wide and 4' deep at the proposed site of
the new pier, and approximately 600' wide at the site of the proposed addition of
pilings. There are no commercial shellfish resources in the area. The site is
vegetated with upland trees and grasses.
Project proposal
The applicant proposes to build a 140' long by 6' wide access pier connecting to a "
200' long by 6' wide docking pier with fifteen 24' long by 2'6" wide finger piers.
Placed adjacent to the finger piers will be 66 mooring pilings creating 48 new boat
slips. The applicant also proposes to place 4 new mooring pilings 20' waterward of
an existing boathouse. There is no proposed excavation associated with this project.
Environmental impacts
The proposed pier will commit an additional 9,500 sq.ft. of public trust area to the
Washington Yacht and Country Club whose docks and piers already occupy + 30,000 sq.ft.
of public trust area.
The proposed 48 boat slips, as with any marina expansion, increase the potential for
adverse water quality impacts.
No wetland vegetation will be dredged, filled or shaded.

A copy of the deed (with state application only) or
other instrument under which the applicant claims
title to the affected property. If the applicant is not
claiming to be the owner of said property, then for-
ward a copy of the deed or other instrument under
which the owner claims title, plus written permis-
sion from the owner to carry out the project.
An accurate work plat (including plan view and
cross sectional drawings) drawn to scale in black
ink on 8 Y2 x 11 white paper. (Refer to Coastal
Resources Commission Rule 7J.0203 for a detailed
description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.
(Contact the U.S. Army Corps of Engineers regard-
ing that agency's use of larger drawings.) A site or
location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the site. Include
county road (SR) numbers, landmarks, and the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit com-
ments on the proposed project to the Division of
Coastal Management. The applicant must advise
