On February 6, 1986, we renewed general permit No. SAWC080-N-
000-0291 (copy enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received August 2, 1988, for
Department of the Army authorization to construct a 64-slip marina
on Bogue Sound approximately 0.7 mile west of Broad Creek, to
support residential development, White Oak Township, Carteret
County, North Carolina, indicates it to be a candidate for Federal
authorization under this general permit. Accordingly, the
administrative processing of your application will be accomplished
by the North Carolina Division of Coastal Management. Comments
from Federal review agencies will be furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be informed regarding its further
management. If there are no unresolved differences in State-
Federal positions or policies, the final action taken on your
application by the State will result in your receiving written
notice from us that your application is consistent with the
general permit and you may commence your activity. Only after
receiving such confirmation should you begin work.
Your application, pursuant to Section 10 of the River and
Harbor Act, has been assigned No. SAWC088-N-016-0468 and will be

Reference the application of Blue Heron Bay, represented by
Mr. R. H. Messmer, for a Department of the Army permit to excavate
a channel, canal and basin and construct a boatramp, bulkheads,
piers and docks establishing a 64-slip residential marina on Bogue
Sound, west of Broad Creek, White Oak Township, Carteret County,
North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
By letter of August 26, 1988 (copy enclosed), the National Marine
Fisheries Service (NMFS) recommended that the application be
denied because of the proposed distrubance of approximately 1/2
acre of shallow, subtidal habitat, including excavation within an
area vegetated by a mixture of ellgrass and shoalgrass. Also, the
NMFS expressed concern regarding the probability that
accomplishment of the work would result in degradation of water
quality and closure of "SA" waters currently open to the
harvesting of shellfish. Also, we understand that accomplishment
of the work, as proposed, would be inconsistent with the Carteret
County Land Use Plan. We concur with NMFS's recommendation that
the application be denied.

9. NARRATIVE DESCRIPTION: The applicant, Mr. Roy H. Messmer,
from Sparta, New Jersey, has recently acquired a 51.9 ac.
tract of land off Highway 24, formerly known as the Archie
Page Farm, located about 1 mile west of the Broad Creek, on
Bogue Sound, in Carteret County. Another familiar landmark
to most of the review agencies is the highground basin at
Bogue Sound Yacht Club immediately east of the project site.
The Messmer property consists of a rectangular tract of land
measuring about 600' wide x 3750' long, extending from the
highway to the sound. Both the 1976 and 1984 aerial
photography, referenced on the cover sheet of this report,
both accurately show the project site and the surrounding
geography. The property, and the focus of this permit
request, includes a small highground boat basin (100' x 751)
and a narrow access channel (500' x 251) leading to the Bogue
Sound shoreline. That work appears to have been authorized
by a State Dredge and Fill Permit #529-71, issued to Mr.
Barrington Leo Page in 1971. The applicant contends that an
offshore entrance channel measuring approximately 475' long
x 30' wide was dredged during the original development of
the small basin back in the mid-1970's. As of this date,
the Division of Coastal Management has no documentation to
support the contention that the entrance channel was ever
dredged, or that the original permit authorized the channel
work. The 1978 aerial photography shows the highground
basin and access channel, but no offshore entrance channel.
The 1984 photography, however, does show a ribbon-thin
entrance channel, the type of channel that is created by
boat traffic and prop wash, using the same alignment over
several years. Nevertheless, as the project plans show, the
new channel will require dredging through a large bed of
submerged aquatic vegetation dominated by eelgrass (Zostera
marina) and some lesser amounts of shoalgrass (Halodule
wrightii). The accurate workplat drawings have allowed this
office to calculate an impact area of 5700 sq. ft. to the
grass beds that is derived from an area measuring about 190'
long x 30' wide. Additional displacement within the
entrance channel will impact other shallow water bottoms
averaging in depth from 2-3' deep. Approximate 8500 sq. ft.
of unvegetated bottomland will be displaced over a total
area of 280' x 30' wide. As proposed, the entrance channel
will intersect with the existing channel leading into the
Bogue Sound Yacht Club.
The 425' long highground access channel will be slightly
widened to a width of about 301. The expansion will involve
excavating a narrow strip of highground property about 5' to
8' wide for a distance of 200' long. The large pocket marsh
on the east side of the access channel will remain
undisturbed. As proposed, the small existing highground

basin will be significantly increased. The new basin will
measure approximately 240' x 320' with an overall depth of
-4' on MLW. Land elevations in the highground basin area
average +5' to +61. Excavation within the basin will
generate approximately 25,000 cu. yds. of sandy dirt. This
material will be used throughout the development for
landscaping, road construction, and other purposes.
The interior shoreline of the basin and the access channel
will be bulkheaded. Approximately 1100 ln. ft. of bulkhead
will be installed. Within the basin, the developers will
construct 3 primary docks and piers offering a total of 63
boat slips and 1 slip for sewer pumpout services. In the
northwest corner of the basin, a concrete boat ramp (15' x
201) will allow trailer access in and out of the basin.
Other than off-street parking for 24 cars, the developers
will provide no amenities at the basin other than a small
gazebo (25' x 251) near the boat ramp.
The applicant has provided, on the workplat drawing, a list
of the impervious surface areas throughout the development.
Only 24.8% of the CAMA 75' estuarine shoreline Area of
Environmental Concern will be covered with concrete and
asphalt surfaces. This calculation also includes the
maximum allowable surfaces for individual house
construction on Lots 55 through 64 which border the basin
and Bogue Sound.
10. ANTICIPATED IMPACTS: The surface waters of Bogue Sound are
classified as 'SA' and are open to the harvesting of
shellfish. Clams and scallops are abundant in this area of
Bogue Sound in the shallow water and the shallow water grass
beds immediately in front of the project site. At this
time, a 100' shellfish closure zone exists around the
entrance to Bogue Sound Yacht Club. The closure does not,
-however, appear to overlap with the proposed project.
The direct and possible indirect impacts of the entrance
channel on the submerged grass beds will be significant to
the local ecology. In addition, the 64 new boat slips may
require further closure of the active clam grounds in Bogue
Sound. This will significantly impact the public trust and
the availability to the general public for shellfishing.
The proposed highground basin, and the development of the
subdivision, should have no direct impacts on the estuarine
resources if water quality issues associated with the number
of boats and the flushing capability are satisfied.

CANA REVIEW SECTION: The Carteret County Land Use Plan
Update of 1985 classifies the highground property site as
"Community". The private, non-commercial community type
marina basin is considered an acceptable type of development
in those areas defined as "Community". The same has been
true in other cases with residential type developments with a
unit density of 1 to 23, or where lot sizes of 20,000 sq.
ft. are proposed.
The proposed project meets with an inconsistency in the
conservation class which does not allow for the displacement
of submerged eelgrass beds when and where it is inconsistent
with the CAMA use standards for development. Therefore,
dredging the offshore entrance channel must be considered
inconsistent with the Carteret County Land Use Plan.

sion from the owner to carry out the project.

cross sectional drawings) drawn to scale in black
ink on 8 V2 x 11 white paper. (Refer to Coastal
Resources Commission Rule 7).0203 for a detailed
description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.
(Contact the U.S. Army Corps of Engineers regard-
ing that agency's use of larger drawings.) A site or
location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the site. Include
county road (SR) numbers, landmarks, and the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit com-
ments on the proposed project to the Division of
Coastal Management. The applicant must advise
the adjacent landowners of this opportunity by sen-

The Subject application has been reviewed for water
quality impacts and the following comments are offered:
a. The proposed project does require Water Quality
Certification but meets the requirements of
General Certifications No. 1272, 1273, and 1431
for bulkhead construction, discharge of liquid
effluent from upland diked disposal areas, and
boat ramp construction, respectively.
b. Due to changes in the impervious areas in these
modified plans, additional stormwater management

The project has been reviewed to determine impacts to water
quality. The following comments are provided.
The project will require a 401 certification, and that
certification should include the following condition for the
construction of the boat ramp.
a. That all wet concrete poured below MHW be poured at low
tide and that the forms be completely dewatered No wet
concrete shall be placed in the surface waters.
b. That turbidity increase shall not exceed 25 NTU due to the
project.
The project should meet the requirements of the general 401
certification #1272 for bulkhead construction and #1273 for the
discharge of liquid effluent from a diked disposal area resulting
from hydraulic dredging.
Due to changes in impervious areas, additional stormwater
management information has been requested by this office.
The project appears to be excluded from the DHS Marina Policy's
definition of marinas due to the fact that only 29 slips and no

Mr. Peter Williamson, working with Paton/Zucchino & Associates,
has put together a set of revised plans for development of the
subdivision and marina to be located off of Highway 24 and Bogue
Sound, in Carteret County. In addition, Mr. Williamson's cover
letter dated October 28, 1988, outlines clearly the effective
changes in the project. These revisions should answer those
specific concerns identified by the various agencies during the
course of our initial review.
As the letter states, the highground basin has been greatly
reduced in size and in the number of boats. The new community
basin will accommodate only 29 boats, as opposed to 64 boats.
The letter further explains that the boats will be 21' in length
and under and none will have onboard heads. This is an attempt
to meet the exclusion criteria set forth by Health Services. The
offshore entrance channel has been realigned away from the
submerged aquatic vegetation. The revised workplat drawing shows
the new channel alignment following close to the shoreline before
intersecting with the existing entrance channel to Bogue Sound
Yacht Club.
Please feel free to distribute this brief narrative, as well as,
Mr. Williamson's cover letter as part of the revised information
packet. I will present further comments and permit
recommendations and conditions on this project in a separate
memorandum.

Accompanying this letter are the revised plans for the Blue
Heron Bay Marina. The revisions to the Marina plans address
the major objections of the various State and Federal
agencies that reviewed the initial submittal. In order to
expedite your review I will briefly highlight these changes.
1.) The basin itself has been reduced in size. It is now
designed for 29 boats less than 21 feet in length with no on
board heads. This is in keeping with the Division of Health
Services Shellfish Sanitation Section's policy excluding such
basins from the "Marina" definition. The first slip is now
430 feet away from the mouth of the existing channel.
2.) The channel connecting the Blue Heron Bay project to the
Bogue Sound Yacht Club channel has been realigned according
to the suggestions of the N.C. Division of Community
Assistance, N.C. Division of Wildlife Resources and N.C.
Division of Marine Fisheries. As currently proposed, it will
avoid the submerged aquatic vegetation (SAV) which fronts the
existing channel by turning sharply east just outside the
channel mouth. Dredging limits will be a minimum of five
feet away from the edges of the existing Coastal Marsh and
the SAV. No dredging in the SAV is proposed.
Consider this letter a request to reopen the agency review of
the Blue Heron Bay Marina put on administrative hold by our
office September 20. Please contact me if you require any
further documentation or need clarification of any revisions
shown on the plans.
