Norman, we are in need of your assistance. To build this
causeway requires a Federal Energy Regulatory Commission permit.
To obtain this permit we need either a permit from your -office,
or a letter stating that no permit is necessary.
Mr. James A. Jennings of Heronwood Associates previously cor-
responded with you for a similar scope of work in August 1983.
His permit was dismissed and a permit for an altered scope of

Reference your application for Department of the Army
authorization to place fill material in Lake Norman to construct a
causeway and bridge to provide access to an island near Troutman
in Iredell County, North Carolina.
Through coordination with the Iredell County Office of
Planning and Inspections and the Board of County Commissioners, we
have learned that you have not complied with County requests for
information necessary for a determination as to whether your
proposed work would comply with the County Zoning Ordinance.
Additionally, the U.S. Fish and Wildlife Service (USFWS) have
presented concerns and requested additional information (copies of
letters enclosed), and our public interest review disclosed
significant public concern.
Pursuant to our administrative regulations, you are hereby
informed that your application file has been retired and further
consideration for Federal authorization for your proposal will
depend upon your obtaining written approval from Iredell County
and providing the requested information to the USFWS. Information
regarding your appropriate coordination with Duke Power Company

lations of the Wildlife RResourres Commission, which fire exting;
uishers shall be at all times kept in condition for immediate and
effective use and shall be so placed as to be readily accessible.
(h) The provisions of subsections (d), (e), and (g) of this sectiol
shall not apply to motorboats while competing in any race con-
ducted pursuant to G.S. 75A44 or, if such boats be designed and
intended solely for racing, while engaged in such navigation as is
incidental to the tuning up of the boats and engines for the race.
(f) Every motorboat shall have the carburetor or carburetors of
every engine therein (except outboard motors) using gasoline as
fuel, equipped with such efficient flame arrestor, backfire trap, or
other similar device as may be prescribed by the regulations of the
Wildlife Resources Commission.
0) Every such motorboat and'every such vessel, except open
boats, using as fuel any liquid of a volatile nature, shall be provided
with such means as may be prescribed by the regulations of the
Wildlife Resources Commission properly and efficiently ventilating
the bilges of the eng?'ne and fuel tank compartments so as to remove
any explosive or inflammable gases.
(k) The Wildlife Resources Commission is hereby authorized to
make rules and regulations modifying the equipment requirements
contained in. this section to the extent necessary to keep these re-
quirements in conformity with the provisions of the federal naviga-
tion laws or with the navigation rules promulgated by the United
States coast guard.
(1) No person shall operate orgive permission for the operation of
a vessel which is not equipped as required by. this section or modifi-
cation thereof. ?.
. (m) In the event that any of the regulations of subsections (a),
(b), (c), (d), (e), (fl, (g), (h), (i), (j), (k), and (1) of this section are in
conflict with the equipment regulations of the Federal Boat Safety
Act of 1971 and the federal regulations adopted pursuant thereto,
the Wildlife Resources Commission is hereby granted the authority
to adopt such regulations as are necessary to conform with the
Federal Boat Safety Act of 1971 and the federal regulations adopted
pursuant thereto.
(n) All :boats propelled by machinery of 10 hp or less, which are
operated on the public waters of this State, shall carry at least one
life preserver, or life belt, or fing buoy, or other device of the sort'
prescribed by the regulations of the Wildlife Resources Commission
for each person on board, and from one-half hour after sunset to
one-half hour before sunrise shall carry a white light in the stern or
shall have on board a hand flashlight in good working condition,
which light shall be ready at hand and shall be temporarily dis-
played in sufficient time to prevent collision.
. (o) The Department of Human Resources is hereby authorized
and directed to prepare design standards that will be used as a
guide in approving sewage treatment devices and holding tanks for
marine toilets installed in boats operating on the inland fishing
waters of the State as designated by the Wildlife Resources Com-
mission and the inland lake waters of the State.
No vessel operating on the inland fishing waters of. the State as
designated by the Wildlife Resources Commission and the inland
lake waters of this State that is equipped with a marine toilet shall
be registered by the Wildlife Resources Commission unless such

vessel is provided with a sewage treatment device or holding tank
approved by the Commission for Health Services.

,. The protectors of the Wildlife Resources Commission shall
inspect vessels on the inland fishing waters of the State as desig-
nated by the Wildlife Resources Commission and the inland lake
waters to determine if approved treatment devices or. holding tanks
are properly installed and if they are operating in a satisfactory
manner.
. Any boat or vessel equipped with a sewage treatment device or
holding tank operated on the inland fishing waters of the State as
designated by the Wildlife Resources Commission and the inland
lake waters of North Carolina which does not meet the design stan-
dards and approval of the Commission for Health Services prior to
January 1, 1966, may continue to use such device or tank until
January 1, 1969.
A vessel registered, documented or otherwise licensed in another
state and equipped with a marine toilet not prohibited in such state
may be operated on the inland fishing waters of the State as desig-
nated by the Wildlife Resources Commission, without regard to the
provisions of this subsection while making an interstate trip. (1959,

§ 75A-7. Exemption from numbering require-
ments.
(a) A vessel shall not be required to be numbered under this
Chapter if it is:
(1) A vessel which is required to be awarded a number pursu-
ant to federal law or a federally approved numbering sys-
tem of another state, and for which a number has been so
awarded: Provided, that any such boat shall not have been
within this State for a period in excess of 90 consecutive
days.
(2) A vessel from a country other than the United States tem-
porarily using the waters of this State.
(3) A vessel whose owner is the United States, a state or a
subdivision thereof
(4) A ship's lifeboat.

PUBLIC NOTICE
HERONWOOD ASSOCIATES, 188 North Main Street, Mooresville, North
Carolina 28115 has applied for a Department of the Army permit TO PLACE FILL
MATERIAL WITHIN LAKE NORMAN TO CONSTRUCT A FILL CAUSEWAY AND BRIDGE IN ORDER
TO PROVIDE ACCESS TO AN ISLAND, NEAR TROUTMAN, in Iredell County, North
Carolina.
The following description of the work is taken from data provided by the
applicant and from observations made during an onsite visit by a
representative of the Corps of Engineers. Plans submitted with the
application show a fill causeway/bridge 760-feet-long and 90-feet (bottom
width) constructed to provide vehicular access from the mainland of Heronwood
Development to an island offshore. The island, currently undeveloped, is to
be incorporated into the residential development of Heronwood. Sides of the
causeway are to be stabilized by silt fencing, grassing, and granite riprap.
The 75-foot-long bridge is to be constructed within the fill causeway.
Approximately 10,000 cubic yards of fill material is to be placed below the
normal pool elevation (760.0 feet). The benthic substrate of the lake is
composed of clay material, and no aquatic or wetland vegetation will be filled
as a result of this work. This project had been previously reviewed and on
October 6, 1983, a Department of the Army permit was issued to the Heronwood
Associates to construct this causeway and bridge. Plans showing the work are
included with this public notice.
The State of North Carolina will review this public notice to determine
the need for the applicant to obtain any required State authorization. No
Department of the Army permit will be issued until the coordinated State
viewpoint on the proposal has been received and reviewed by this agency, nor
will a Department of the Army permit be issued until the North Carolina
Division of Environmental Management has determined the applicability of a
Water Quality Certificate as required by PL 92-500.
d. The issuance of an easement to fill or otherwise occupy State-owned
submerged land under North Carolina General Statute 143-341(4), 146-6, 146-11,
and 146-12 by the North Carolina Department of Administration and the North
Carolina Council of State.
e. The approval of an Erosion and Sedimentation Control Plan by the Land
Quality Section, North Carolina Division of Land Resources, pursuant to the
State Sedimentation Pollution Control Act of 1973 (NC G.S. 113 A-50-66).

The requested Department of the Army permit will be denied if any required
State or local authorization and/or certification is denied. No Department of
the Army permit will be issued until a State coordinated viewpoint is received
and reviewed by this agency. Recipients of this notice are encouraged to
furnish comments on factors of concern represented by the above agencies
directly to the respective agency, with a copy furnished to the Corps of
Engineers.
This application is being considered pursuant to Section 404(b) of the
Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within
the comment period specified in the notice, that a public hearing be held to
consider this application. Requests for public hearing shall state, with
particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of the
National Register of Historic Places for the presence or absence of registered
properties, or properties listed as being eligible for inclusion therein, and
this worksite is not registered property or property listed as being eligible
for inclusion in the Register. Consultation of the National Register
constitutes the extent of cultural resource investigations by the District
Engineer, and he is otherwise unaware of the presence of such resources.
Presently, unknown archeological, scientific, prehistorical, or historical
data may be lost or destroyed by work under the requested permit.
The District Engineer has determined, based on a review of data furnished
by the applicant and onsite observations, that the activity will not affect
species, or their critical habitat, designated as endangered or threatened
pursuant to the Endangered Species Act of 1973.
The decision whether to issue a permit will be based on an evaluation of
the probable impacts, including cumulative impacts, of the proposed activity
and its intended use on the public interest. Evaluation of the probable
impacts which the proposed activity may have on the public interest requires a
careful weighing of all those factors which become relevant in each particular
case. The benefits which reasonably may be expected to accrue from the
proposal must be balanced against its reasonably foreseeable detriments. The
decision whether to authorize a proposal, and if so the conditions under which
it will be allowed to occur, are therefore determined by the outcome of the
general balancing process. That decision should reflect the national concern
for both protection and utilization of important resources. All factors which
may be relevant to the proposal must be considered including the cumulative
effects thereof. Among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, cultural values, fish and wildlife values,
flood hazards, flood plain values, land use, navigation, shore erosion and
accretion, recreation, water supply and conservation, water quality, energy
needs, safety, food and fiber production, mineral needs, considerations of

property ownership, and, in general, the needs and welfare of the people. For
activities involving the placement of dredged or fill materials in waters of
the United States, a permit will be denied if the discharge that would be
authorized by such permit would not comply with the Environmental Protection
Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any
other applicable guidelines or criteria, a permit will be granted unless the
District Engineer determines that it would be contrary to the public interest.
Generally, the decision whether to issue this Department of the Army
permit will not be made until the North Carolina Division of Environmental
Management (DEM) issues, denies, or waives State certification required by
Section 401 of the Clean Water Act. The DEM considers whether or not the
proposed activity will comply with Sections 301, 302, 306, and 307 of the
Clean Water Act. The application and this public notice for the Department of
the Army permit serves as application to the DEM for certification.
Additional information regarding the Clean Water Act certification may be
reviewed at the offices of the Environmental Operations Section, North
Carolina Division of Environmental Management, Salisbury Street, Archdale
Building, Raleigh, North Carolina. Copies of such materials will be furnished
to any person requesting copies upon payment of reproduction costs.
The North Carolina Division of Environmental Management plans to take
final action in the issuance of the Clean Water Act certification on or after
December 1, 1987.
All persons desiring to make comments regarding the application for Clean
Water Act certification should do so in writing delivered to the North
Carolina Division of Environmental Management, Post Office Box 27687, Raleigh,
North Carolina 27611-7687, on or before November 25, 1987, Attention:
Mr. William Mills.
Written comments pertinent to the proposed work, as outlined above, will
be received in this office, Attention: Mr. Hugh Heine, until 4:15 p.m.,

W6 the undersigned request a public hearing on the Department of the Army
permit requested by Heronwood Associates to fill material within Lake Norman
to construct a fill causeway and bridge in order to provide access to an island
by marker 21, near Troutman, in Iredell county North Carolina.
Objections
I. Causeway type bridge and bridge section design are a major block to
navigation of an established boat route and navigational hazard to
safe boating.
A. Boat traffic would be diverted to the Catawba County side of the
island creating greater safety risks.
B. Free use of a waterway would be obstructed reducing the recreational
value of fishing, skiing, boating, and permanently scarring aesthetic
value of the lake.
C. Safety concerns about bridge and causeway design which prevent
safe boat access need to be identified.
1. Inadequate height clearance
2. Inadequate width clearance
3. Causeway design obstructs vision of oncoming boats.
4. Narrow design of bridge section obstructs vision.
5. Narrow design and support structures with rip-rap prevents
boats from passing.
II. Causeway and bridge design will cause a major impact on envir6nment
and bottle-neck restrict river flow. This will obstruct one third of
the Catawba River width.

Dear Mr. Heine:
We are in receipt of PUBLIC NOTICE dated OCtober 22, 1987, concerning
the above referenced proposed project.
This notice was received by the office of the Lake Norman Marine
Commission (LNMC) prior to its meeting of October 26, 1987, and was called to
the attention of commissioners at that meeting. Due to limited notice and lack
of information no action was taken. Our next meeting is scheduled for November
23, 1987, at 7:30 P.M. (after the deadline for comments as stated in the
notice).
Local media, in reporting on LNMC, publicized the notice, and since
that time we have had numerous calls from private citizens, other media and
public officials seeking details. Since no applications have been made to the
LNMC, and since we are without even basic information, we request that further
explanation be made before your agency takes action. At this point, the
procedure is publicly unsatisfactory in that the PUBLIC NOTICE begs attention
without supplying information, and the citations and reference contained in the
notice add to the confusion, resulting in mistrust of the system.
. In general, Lake Norman has experienced intense growth in the past
fifteen years, and many citizens fear and reasonably question additional growth
without adequate preparation and facilities. No agency has supplied data to
show the impact of this project and the public appears concerned that no data
has been compiled.
The public is relying on your agency for protection and for
information, and obviously feels a need to express their concerns to you and to
hear from you the possible steps taken for protection of the lake.
LNMC believes that a locally convened public hearing is the best way to
address public concerns, and has had an established policy for more than ten
years to insist upon protection of the PUBLIC'S RIGHT TO KNOW. I have polled my
commission, who represent the four counties bordering on Lake Norman and the
policy is unanimously affirmed.

At this point, LNM C has not expressed a position on the current
proposal, and maintains a neutral position on the merits of the matter so it can
be impartial to act or advise when officially involved; however, we believe it
is not practicable for delegations of private interests to be expected to travel
hundreds of miles to Raleigh or Wilmington to address a local public issue. It
is also not practicable to expect private concerned citizens (without reliable
sources of information) to address such concerns in writing and in detail to a
distant governmental agency.
LNMC urges that you give this request for a local forum serious
consideration, and if we can assist your agency in any way we will make every
effort to do so.

I am in receipt of the Heronwood Associates application for a new
bridge on Lake Norman which is being considered by the Corps of
Engineers. The purpose of this letter is vehement objection to
the proposed causeway across an area that nearby neig ors of
Heronwood refer to as "the cut" and the reasons are as follows:
1. As proposed, the causeway would restrict virtually all boat
traffic through the existing "cut" thereby causing the
balance of the Lake in this particular area to be even more
crowded with boat traffic. The north/south channel connecting
Bill's Marina and the upper reaches of the Catawba River to
the north with the Highway 150 bridge area on the south is
heavily used by boaters and the "cut" is an acceptable
boating detour from the main channel of the Lake which
alleviates boating congestion. In summary, basic boating
safety caused by more boats in a concentrated area is my
first objection.
2. Fishing along the "cut" is excellent and it is a major
hatching area for crappie and bass in the spring,
particularly along the points. In my opinion, a causeway
would be detrimental to fish habitat.
3. If for some reason, the request for a bridge should be
granted, it should certainly be with two stipulations:
a. As a part of the approval for a bridge, approval should
also include the site plan for development of the island
as well as pertinent utility information including water
and sewer.
b. Bridge construction should not be as proposed but
instead, should incorporate long spans so that boat
traffic is minimally affected.

Dear Mr. Mills:
As a concerned resident of Lake Norman, I am writing in
response to Heronwood Associates application for a fill causeway
and bridge; to provide access to a mid-channel island. I am
extremely opposed to this project, as I believe it would severely
effect the recreational quality of the lake, as well as cause
deterioration of water quality, and boating. safety.
Unlike the more open areas of Lake Norman to the South, the
adjacent lake channels to the Heronwood property are very narrow,
and should be considered as river, rather than lake frontage. As
boating congestion has already become a problem in this end of
the lake, development of a mid-channel island should not ever be
considered.
As the bridge is proposed, it would all but eliminate
boating traffic on one side of the island, which is now, heavily
used.
From an environmental standpoint, the bridge and fill areas
will have a detrimental impact on the quality of fishing, by
destroying a major spring spawning ground for Crappie and Bass.
Like other residents of the northern end of Lake Norman, I
am very concerned about boating congestion, water quality and
safety; because of the very limited surface area of the lake.
Lake Norman is much too precious an asset for North Carolina to
be ruined by poor planning, and overdevelopment.

As a nearby resident, I object to the Heronwood Associates proposed
bridge on Lake Norman, which you now have under review. This private
bridge sets an undesirable precedent which can spread to other islands
within the lake. Proliferation of such construction will damage the
visual beauty as well as the economic viability of surrounding proper-
ties.
A better approach to the development of this island, and others like
it, would be to establish a mainland dock which the owners would use
to get to their island home. True island living!
Please know that there is going to be considerable opposition to this
type of private bridge development.

PUBLIC NOTICE
HERONWOOD ASSOCIATES, 188 North Main Street, Mooresville, North
Carolina 28115 has applied for a Department of the Army permit TO PLACE FILL
MATERIAL WITHIN LAKE NORMAN TO CONSTRUCT A FILL CAUSEWAY AND BRIDGE IN ORDER
TO PROVIDE ACCESS TO AN ISLAND, NEAR TROUTMAN, in Iredell County, North
Carolina.
The following description of the work is taken from data provided by the
applicant and from observations made during an onsite visit by a
representative of the Corps of Engineers. Plans submitted with the
application show a fill causeway/bridge 760-feet-long and 90-feet (bottom
width) constructed to provide vehicular access from the mainland of Heronwood
Development to an island offshore. The island, currently undeveloped, is to
be incorporated into the residential development of Heronwood. Sides of the
causeway are to be stabilized by silt fencing, grassing, and granite riprap.
The 75-foot-long bridge is to be constructed within the fill causeway.
Approximately 10,000 cubic yards of fill material is to be placed below the
normal pool elevation (760.0 feet). The benthic substrate of the lake is
composed of clay material, and no aquatic or wetland vegetation will be filled
as a result of this work. This project had been previously reviewed and on
October 6, 1983, a Department of the Army permit was issued to the Heronwood
Associates to construct this causeway and bridge. Plans showing the work are
included with this public notice.
The State of North Carolina will review this public notice to determine
the need for the applicant to obtain any required State authorization. No
Department of the Army permit will be issued until the coordinated State
viewpoint on the proposal has been received and reviewed by this agency, nor
will a Department of the Army permit be issued until the North Carolina
Division of Environmental Management has determined the applicability of a
Water Quality Certificate as required by PL 92-500.
d. The issuance of an easement to fill or otherwise occupy State-owned
submerged land under North Carolina General Statute 143-341(4), 146-6, 146-11,
and 146-12 by the North Carolina Department of Administration and the North
Carolina Council of State.
e. The approval of an Erosion and Sedimentation Control Plan by the Land
Quality Section, North Carolina Division of Land Resources, pursuant to the
State Sedimentation Pollution Control Act of 1973 (NC G.S. 113 A-50-66).

The requested Department of the Army permit will be denied if any required
State or local authorization and/or certification is denied. No Department of
the Army permit will be issued until a State coordinated viewpoint is received
and reviewed by this agency. Recipients of this notice are encouraged to
furnish comments on factors of concern represented by the above agencies
directly to the respective agency, with a copy furnished to the Corps of
Engineers.
This application is being considered pursuant to Section 404(b) of the
Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within
the comment period specified in the notice, that a public hearing be held to
consider this application. Requests for public hearing shall state, with
particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of the
National Register of Historic Places for the presence or absence of registered
properties, or properties listed as being eligible for inclusion therein, and
this worksite is not registered property or property listed as being eligible
for inclusion in the Register. Consultation of the National Register
constitutes the extent of cultural resource investigations by the District
Engineer, and he is otherwise unaware of the presence of such resources.
Presently, unknown archeological, scientific, prehistorical, or historical
data may be lost or destroyed by work under the.requested permit.
The District Engineer has determined, based on a review of data furnished
by the applicant and onsite observations, that the activity will not affect
species, or their critical habitat, designated as endangered or threatened
pursuant to the Endangered Species Act of 1973.
The decision whether to issue a permit will be based on an evaluation of
the probable impacts, including cumulative impacts, of the proposed activity
and its intended use on the public interest. Evaluation of the probable
impacts which the proposed activity may have on the public interest requires a
careful weighing of all those factors which become relevant in each particular
case. The benefits which reasonably may be expected to accrue from the
proposal must be balanced against its reasonably foreseeable detriments. The
decision whether to authorize a proposal, and if so the conditions under which
it will be allowed to occur, are therefore determined by the outcome of the
general balancing process. That decision should reflect the national concern
for both protection and utilization of important resources. All factors which
may be relevant to the proposal must be considered including the cumulative
effects thereof. Among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, cultural values, fish and wildlife values,
flood hazards, flood plain values, land use, navigation, shore erosion and
accretion, recreation, water supply and conservation, water quality, energy
needs, safety, food and fiber production, mineral needs, considerations of

property ownership, and, in general, the needs and welfare of the people. For
activities involving the placement of dredged or fill materials in waters of
the United States, a permit will be denied if the discharge that would be
authorized by such permit would not comply with the Environmental Protection
Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any
other applicable guidelines or criteria, a permit will be granted unless the
District Engineer determines that it would be contrary to the public interest.
Generally, the decision whether to issue this Department of the Army
permit will not be made until the North Carolina Division of Environmental
Management (DEM) issues, denies, or waives State certification required by
Section 401 of the Clean Water Act. The DEM considers whether or not the
proposed activity will comply with Sections 301, 302, 306, and 307 of the
Clean Water Act. The application and this public notice for the Department of
the Army permit serves as application to the DEM for certification.
Additional information regarding the Clean Water Act certification may be
reviewed at the offices of the Environmental Operations Section, North
Carolina Division of Environmental Management, Salisbury Street, Archdale
Building, Raleigh, North Carolina. Copies of such materials will be furnished
to any person requesting copies upon payment of reproduction costs.
The North Carolina Division of Environmental Management plans to take
final action in the issuance of the Clean Water Act certification on or after
December 1, 1987.
All persons desiring to make comments regarding the application for Clean
Water Act certification should do so in writing delivered to the North
Carolina Division of Environmental Management, Post Office Box 27687, Raleigh,
North Carolina 27611-7687, on or before November 25, 1987, Attention:
Mr. William Mills.
Written comments pertinent to the proposed work, as outlined above, will
be received in this office, Attention: Mr. Hugh Heine, until 4:15 p.m.,

Construction of a Fill Causeway/Bridge

Iredell County, North Carolina
This Office has reviewed the Public Notice (dated October
22, 1987) and other material received on November 6, 1987,
pertaining to the subject project. Based on our review, we do
not foresee any long term or irreversible impact resulting from
the construction. There will be disturbance of fish/wildlife
habitats in the immediate area of construction, however, this
should not be of significance.
It should be noted that a similar proposal was reviewed in
1983. Comments were submitted to Bob Teulings via memo dated
March 3, 1983. At that time we also had no objections to the
project.
