An informal consultation with Mr. David Baker of your Regulatory Branch and Mr. Steve Benton of the North Carolina Division of Coastal Management has been conducted. PROJECT DESCRIPTION. MCAS Cherry Point, is planning to improve a marina on Slocum Creek in Craven County. The project includes the construction of two floating piers and a boat storage building. Pier "A" will be approximately 172' long. Pier "B" will be approximately 162' long. Both piers will be 8' wide with an 8' x 42" tee on the end. Each pier will have eight 4' x 12' finger piers,and approximately 40 mooring pilings to accomodate 20 boats. Construction will be of treated wood decking and stringers on foam-type floatation billets wrapped with filter fabric. Both piers will tie into an existing bulkhead. Three existing, deteriorating wooden piers will be removed. The boat storage building will be a 40' x 100' metal building to be constructed on an upland site previously occupied by a building. The project will not involve any dredging or filling of any wetlands. Some fill will be placed in an upland area adjacent to a forested wetland during site preparation for the boat storage building. Sedimentation and erosion control measures will be used to prevent impact on the wetland area. 2. AREAS OF ENVIRONMENTAL CONCERN AEC'S. The project will take place in the Estuarine System and will affect the Public Trust Area AEC of Slocum Creek. The project is defined as an acceptable use of the general and specific use standards contained in 15NCAC 7H.208, the following apply: a. 7H.208(a)(1) - The project is water dependent. b. 7H.208(a)(2)(A) The location, design, and need for the project is consistent with the management objective for the Public Trust Area (AEC). C. 7H.208(a)(2)(B) - The project design will not impact on the productivity of any marshland, fish, shellfish, or wildlife area. No suitable alternative exists. d. 7H.208(a)(2)(B) - Water and air quality standards wil not be violated. e. 7H.208(a)(2)(D) - An archaeological survey completed in 1984 lists the area as low probability for undiscovered cultural resources. No known archaeological or historical resources are present. f. 7H.208(a)(2)(t) - Siltation will be controlled during; construction. g. 7H.208(a)(2)(F) - Stagnant water will not be created. Rnr.l sure I ,l h. 7H.208(a)(2)(G) - Although the project has not been planned for any specific time of year, and may take place during peak biological activity, the small scale of the project should not affect the life cycles of estuarine resources. i. 7H.208(a)(2)(H) - Navigation and access to public trust areas will not be impeded. j. 7H.208(b)(5)(B) - The marina is being developed on a deepwater site, and will not disturb shallow water areas or wetlands. k. 7H.208(b)(6)(A) - The piers will not interfere with waterflow. 1. 7H.208(b)(6)(C) - The project will not affect navigation and public use of waters. LAND USE PLANS. The project, is consistent with the Craven County Land Use Plan classification of Marine Corps Air Station as "developed". 4. GENERAL POLICIES. The project is consistent with the general policies for coastal water quality. 5. OTHER STATE POLICIES. A review of the state policies outlined in the Coastal Management Program indicates that the project is consistent with the policies on water and air, wetlands preservation, recreation, and federal consistency and national interest. A Water Quality Certification should not be required due to absence of any fill in wetlands or water. Less than one acre of ground will be disturbed during construction, therefore, a sedimentation and erosion control plan should not be required. It should be noted that sedimentation and erosion control measures >.i1.1 he _mplemented. 6. CONCLUSION. I 0 ; 1 4 DEPARTMENT OF THE ARMY ~ Wilmington District, Corps of Engineers Post Office Box 1890 Wilmington, North Carolina 28402-1890 SAWC088-N-025-0369 June 9, 1988 PUBLIC NOTICE U.S. MARINE CORPS AIR STATION, CHERRY POINT, North Carolina 28533-5000, has applied for a Department of the Army permit TO CONSTRUCT MARINA FACILITIES ON SLOCUM CREEK, U.S. Marine Corps Air Station, Cherry Point, Craven County, North Carolina. The following description of the work is taken from data provided by the. applicant and from observations made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application show the proposed removal of two piers and the construction of two floating piers. Pier "A" is to be approximately 172 feet long and Pier "B" is to be approximately 162 feet long. Both piers are to be 8 feet wide and have 8-foot-wide by 42-foot-long "T's" at their waterward ends. Each pier is to have eight 4-foot-wide by 12-foot-long finger piers and 40 mooring piles to provide moorings for 20 boats. Treated wood is to be used for stringers and decking and floating structures are to be supported by foam-type floatation billets wrapped with filter fabric. Both piers are to tie into an existing bulkhead. The purpose of the work is to provide recreational marina facilities for military personnel. Plans showing the work are included with this public notice. The applicant has determined that the proposed work is consistent with the North Carolina Coastal Zone Management Plan and has submitted this determination to the North Carolina Division of Coastal Management for their review and concurrence. This proposal shall be reviewed for the applicability of other actions by North Carolina agencies such as: a. The issuance of a Water Quality Certification under Section 401 of the Clean Water Act by the North Carolina Division of Environmental Management. b. The issuance of a permit to dredge and/or fill under North Carolina General Statute 113-229 by the North Carolina Division of Coastal Management. c. The issuance of a permit under the North Carolina Coastal Area Management Act (CAMA) by the North Carolina Division of Coastal Management or their delegates. . d. The issuance of an easement to fill or otherwise occupy State-owned submerged land under North Carolina General Statute 143-341(4), 146-6, 146-11, and 146-12 by the North Carolina Department of Administration and the North Carolina Council of State. -2- e. The approval of an Erosion and Sedimentation Control Plan by the Land Quality Section, North Carolina Division of Land Resources, pursuant to the State Sedimentation Pollution Control Act of 1973 (NC G.S. 113 A-50-66). The application for Department of the Army authorization will be denied, if any required State or local authorization and/or certification is denied. No Department of the Army permit will be issued until a State coordinated viewpoint is received and reviewed by this agency. Recipients of this notice are encouraged to furnish comments on factors of concern represented by the above agencies directly to the respective agency, with a copy furnished to the Corps of Engineers. This application is being considered pursuant to Section 10 of the River and Harbor Act of 1899 (33 U.S.C. 403). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted-the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer has determined, based on a review of data furnished by the applicant and onsite observations, that the activity will not affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which-reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general -3- environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest.
