Thomas Rhodes, Secretary North Carolina Department of Natural Resources and Community Development Post Office Box 27687 Raleigh, North Carolina 27611-7687 Dear Mr. Rhodes: This letter amends my consistency determination for the Atlantic Intracoastal Waterway JAyIWW Topsail Inlet Crossing.,_Pender County, North Carolina, dated May 6, 1980, to include maintenance dredging of Old Topsail'Creek from its intersection with the AIWW to its intersection with the New Topsail Inlet channel, as shown on;,the enclosed map. The proposed maintenance work is'covered in the Final Environmental ..Im act Statement (FEIS). Maintenance _of Atlantic Intracoastal Waterway Side Channels, North Carolina, filed with the Council on Environmental Quality on,November 29,,1976. As described in the FEIS,.material.. consisting of medium to coarse sand with some''shell`will be removed by hydraulic pipeline dredge to a depth of -9 feet mean low water for a total distance of 1.42 miles, with disposal of material in uplanddiked disposal areas adjacent to the waterway or on Topsail Beach. Maintenance of Old Topsail Creek during FY 88 will consist of removal of about 90,000 cubic yards of material which will be disposed of on Topsail Beach. The work will be performed in conjunction with maintenance dredging of Banks Channel, which is scheduled to begin in late January 1988 and be completed by April 30, 1988.` If maintenance is required after April 30 with beach disposal, amonitoring program will be set up to avoid adverse impacts,to nesting loggerhead sea turtles. Future maintenance will involve placement of material on the beach or in upland diked disposal sites. Frequency of maintenance of this channel is approximately once every <3 to 5 years. The discharge of material,along,the ocean beach is covered under Section 401 (P.L. 95-217) General Water Quality Certificate No. 1264 issued on October 9, 1978, as amended April 5, 1983 (1264-R), and November 21, 1986 (1264-R2). The discharge of material in upland diked disposal sites is covered under Water Quality Certificate No. 1273, issued on November 10, 1978, and Nationwide Permit 33 CFR 330.5(x)(16). I Maintenance of Old Topsail Creek from its intersection with the AIWW to its intersection with the New Topsail Inlet Channel is consistent with the approved Coastal Management Program of the State of North Carolina. If you concur with my consistency determination, as amended, I request your approval to proceed rather than waiting the 90 days specified in 15 CFR 930.41(c).
