This office has received a request for project modification from Senator
Bill Barker, who is representing Mr. Silverthorne'in his, efforts to obtain, a
CAMA permit for his marina development. 'Mr. Silverthorne's original proposal
of a total of 18 slips on Brown Creek, an SA open body of water,-was`denied on
- - - - -February -5 1988. There--is--a pending appeal hearing request for .the original
proposal. The current proposal, as indicated on the attached plat, includes
only 10 slips on a 6.4' long pier extension.

Dear Mr. Silverthorne:
This letter is in response to your request for permits under the
Coastal Area Management Act to extend a pier and increase the number of
boat slips to 18 on Brown Creek off of SR 1325 near Whortonsville, Pamlico
County, N.C. Processing of your application, which was accepted as
complete on November 24, 1987, is now complete.
Based on this review, including onsite investigation by State and
Federal agencies, the Division of Coastal Management has made the following
findings:
(1) Increasing the number of slips from 6 to 18 will result in the
pier system being classified as a marina, according to Coastal
Resources Commission rules. This increase will also result in a
recommendation to the Division of Marine Fisheries for closure of
currently open, SA classified, shellfish waters by the Department
of Human Resources, Shellfish Sanitation Branch. Since these
waters are currently used for shel•lfishing by both commercial and
recreational fishermen, as reported by the Division of Marine
Fisheries, this closure would be a violation of the Environmental
Management Commission's Antidegradation Policy; and,
(2) The project, as proposed, is inconsistent with the following
listing of State Guidelines for Areas of Environmental Concern
(AECs):
a) 15 NCAC 7H.0206(c) Management Objective (for estuarine
waters). This rule established, as the highest priority,

the management and conservation of the important features of

biological values;
b) 15 NCAC 7H.0208(a)(2)(C). This standard states that
development shall not violate water and air quality

listens to the evidence and arguments of both parties and then makes a
recommendation to the Coastal Resources Commission. Your request for a

requirements of Chapter 1506 of the General Statutes of North Carolina, and
must be filed with the Office of Administrative Hearings, P.O. Drawer
11666, Raleigh, N.C. 27604, within twenty days of receipt of this letter.
A copy of the petition should be filed with this office.
Also, you should be advised that as long as this State permit denial
stands, your project must be deemed inconsistent with the N.C. Coastal
Management program, thereby precluding issuance of Federal permits for this
project. The Federal Coastal Zone Management Act of 1972 (CZMA) gives the
right to appeal this funding to the U.S. Secretary of Commerce, within 30
days of receipt-of this letter. Your appeal must be based on the grounds

purposes of the CZMA, or (2) is necessary in the interest of national
security, and thus, may be federally approved.

The Subject application has been reviewed for water
quality impacts and the following comments are offered:
a. The proposed project does require a water Quality
Certification, but does meet the requirements of
General Certification No. 1431 for boat ramp
construction.
b. Since the expansion to 18 boat slips is expected
to be defined by DCM as a marina, there is a
potential for violation of the Antidegradation
Policy of the EMC should granting the permit
result in an automatic closure of shellfish waters
and a shellfishing resource exists. Once DHS has
completed their review and provided comments
relative to closure, a final determination on
Antidegradation Policy can be made.

This permit, issued on , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) The existing tie pilings on the first original 86' of the pier shall be
removed and that portion of the-pier shall only ?be used for access to the
proposed slips.
(2) No more than 10 boats shall be tied up at the pier at any one time. Dockage
by more than 10 vessels shall constitute *a violation of this permit, and
State law. Additionally, more than 10 vessels will cause an automatic recommen-
dation of closure of adjacent waters to the taking of shellfish. Should
this recommendation be accepted by the Division of Marine Fisheries, the
closure would constitute a violation of the, Division of Environmental Manage-
ment's Antidegradation Policy of their Water Quality Standards, thereby
violating State law.
(3) Future development, including the simple placement of pilings will require
modification of this permit.
(4) The authorized structure and associated activity will not cause an unacceptable
interference with navigation.
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31. 1991
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

(6) Vegetated wetlands will not be excavated or filled.
(7) The permittee will maintain the authorized work in good condition and in
conformance with the terms and conditions of this permit. The permittee
is not relieved of this requirement if he abandons the structures without
having the permit transferred to a third party.
NOTE: The proposed project is certified under General Water Quality Certification
No. 1431, issued on October 16, 1980, for boat ramp construction.
NOTE: Signs should be posted on the pier informing potential users of the 10
vessel dockage limit.
NOTE: Permanent reflectors should be attached to the structure in order to
make it more visible during hours of darkness or inclement weather.

Reference the September 18, 1987, application of Mr. J. C.

The Subject revised application has been reviewed for
water quality impacts and the following comments are
offered:
a. The proposal to reduce the number of boat slips at
the pier has been reviewed. Since the proposal
now calls for no more than ten boats, the
automatic closure policy of Shellfish Sanitation
will not be in effect. Shellfish Sanitation has
advised that should more than ten boats be moored
at this site, the waters will be recommended for
closure. A closure of these waters would
constitute violation of the Antidegradation
Policy of our Water Quality Standards.
b. For the reasons stated above, it will be
imperative that the CAMA permit limit the number
of boats moored at any time to no more than ten
and that DCM enforce the restriction in order to
prevent loss of the use of these waters and
violation of our standards.

Mr. Silverthorne's project is a single family residential development
located on Brown Creek near Whortonsville, NC. In December 1987, Mr.
Silverthorne applied for a DF/CAMA permit to construct a boat ramp and
extend an existing 86 ft. wooden pier to 150 ft. (new addition 64 ft.).
The proposal would have increased the number of boat slips from 6
(existing) to 18 slips total. In keeping with CAMA's definition of a
commercial marina (greater than 10 slips), Mr. Silverthorne's project
was viewed as a marina. By memo dated 12-31=87, the Division indicated
that the location of a marina in SA waters, open to shellfishing may
violate the Antidegradation Policy of the EMC (assuming automatic
closure by DHS).
By letter dated February 5, 1988, CAMA denied the permit request. CAMA
then received a request to modify the project from Senator Bill Barker,
on behalf of Mr. Silverthorne. The proposed modification involved the
same 64 ft. pier extension; however the plat shows 10 boat slips, rather
than the 18 originally proposed.
Brown Creek is a designated Primary Nursery Area (DMF) and is classified
SA waters (DEM), which are currently open to shellfishing. The DMF has
conducted extensive survey recently to establish the importance of the
shellfish resource in Brown Creek. It is generally accepted that marina
development has the potential to degrade water quality. In light of the
fact that there are at least 2 other marinas being planned for Brown
Creek, there exists the real potential for water quality degradation, as
well as closures to shellfishing. Further water quality degradation in
Brown Creek could lead to contravention of water quality standards. In
addition, automatic closures by DHS due to marinas in Brown Creek will
likely occur. These closures would eliminate a "best use" of SA waters
and violate the Antidegradation Standard.
In general, it is felt that the location of marinas in Brown Creek will
cause the degradation of water quality and could violate water quality
standards.

Although the applicant has submitted a plat showing only 10 slips, the
length of the proposed pier addition remains the same. It is doubtful
the owner can guarantee the number of boats that might eventually dock
at the proposed pier system. The original application would certainly
indicate the potential for more than 10 boats using the pier at some
point in time.
It is recommended that the DCM coordinate a meeting between Mr.
Silverthorne, interested property owners in the area, and State and
Federal review agencies to discuss a reasonable and environmentally
acceptable means of development along Brown Creek. Any permit action
regarding marina development in the project area (Brown Creek) should be
held in abeyance until such a meeting can be held.

8. PROJECT SUMMARY: The applicant's proposed project is to add a 64'
pier section to an existing 86' pier and increase the number of
slips from 6 to 18. The applicant also proposes a 20' x 15'

9. NARRATIVE DESCRIPTION: The proposed project is located off
SR 1325, on Browns Creek, near Whortonsville, in the Sunset
Shores Subdivision, Pamlico County. Sunset Shores
Subdivision is a 24 lot subdivision with a few lots
containing homes at the present time. The applicant's
proposed project is to make a 64' by 6' addition to an
existing 86' pier on Browns Creek to provide slips for
residents of the subdivision. Eighteen (18) mooring
pilings, and ten (10) approximately 16' x 3' finger piers
will be constructed in association with the pier. Six (6)
slips are currently existing, and the proposed additional
twelve (12) slips would bring the total to eighteen (18).
In addition to the proposed pier addition, the applicant
also proposes a 20' x 15' boat ramp with 4" of concrete..
10. ANTICIPATED IMPACTS: The addition of a 64' x 6' section of
pier will cover 384 sq. ft. of estuarine waters. The finger
piers would cover approximately 480 sq. ft. of estuarine
waters. The construction of a 20' x 15' boat ramp will
cover 300 sq. ft. of shallow water bottom and will place 3.7
cubic yards of concrete below mean high water..
The waters of Browns Creek are classified as a primary
nursery area by the Division of Marine Fisheries, classified
as "SA" waters by the Division of Environmental Management,
and are designated as open to shellfishing by the Division
of Health Services.

A copy of the deed (with state application only) or
other instrument under which the applicant claims
title to the affected property. If the applicant is not
claiming to be the owner of said property, then for-
ward a copy of the deed or other instrument under
which the owner claims title, plus written permis-
sion from the owner to carry out the project.
An accurate work plat (including plan view and
cross sectional drawings) drawn to scale in black
ink on 8 V2 x 11 white paper. (Refer to Coastal
Resources Commission Rule 7J.0203 for a detailed
description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.
(Contact the U.S. Army Corps of Engineers regard-
ing that agency's use of larger drawings.) A site or
location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the site. Include
county road (SR) numbers, landmarks, and the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit com-
ments on the proposed project to the Division of
Coastal Management. The applicant must advise
the adjacent landowners of this opportunity by sen-
ding a copy of the permit application to them by
registered or certified mail. This notification is re-
quired by G.S. 113-229(d).

Reference the application of Mr. J. C. Silverthorrie for
Department of the Army authorization to extend a pier and
construct a boatramp cn Brown Creek, Sunset Shores, near
Whortonsville, Pamlico County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. The work will be accomplished in strict accordance with
permit plans.
b. Vegetated wetlands will riot be excavated or filled.
C. The authorized structure and associated activity will riot
cause an unacceptable interference with navigation.
d. The permittee will maintain the authorized work in good
condition and in conformance with the terms and conditions of this
permit. The permittee is not relieved of this requirement if he
abandons the permitted activity without having it transferred to a
third party.

On February 6, 1986, we renewed general permit No. SAWC080-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received December 10, 1987, for
Department of the Army authorization to extend a pier and
construct a boatramp on Brown Creek, Sunset Shores, near
Whortonsville, Pamlico County, North Carolina, indicates it to be
a candidate for Federal authorization under this general permit.
Accordingly, the administrative processing of your application
will be accomplished by the North Carolina Division of Coastal
Management. Comments from Federal review agencies will be
furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be written and informed of its
further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such

Creek, Sunset Shores, near Whortonsville, Pamlico County, North

a valid request for certification in accordance with Section
325.2(b)(ii) of our administrative regulations.
We are considering authorization of the proposed activity
pursuant to Section 404 of the Clean Water Act, and we have
determined that a water quality certification may be required
under the provisions of Section 401 of the same law. A Department
of the Army permit will not be granted until the certification has
been obtained or waived.
In accordance with our administrative regulations, 60 days
after receipt of a request for certification is considered a
reasonable time for State action. Therefore, if your office has
not acted on the request by February 16, 1988, the District
Engineer will deem that waiver has occurred.
