The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. All excavated materials will be confined landward of the normal water elevation contour and any vegetated wetlands. b. No excavated or fill materials will be placed at any time in any vegetated wetlands or waters. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. c. Vegetated wetlands will not be excavated or filled. d. Excavation will not exceed 4 feet below the elevation of normal water. -2- e. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. NARRATIVE DESCRIPTION: The applicant's property is a 5.5 acre tract located on a man-made canal off of Big Creek, which is a tributary of South River and the South River Community, in Carteret County. Man-made features on the tract include a two-story house, an existing man-made canal, two (2) boat basins, and small docks. The site is currently used as'a commercial fishing operation for the property owner's family. The applicant previously received Dredge and Fill Permit #44-77 to dig the canal and boat basins. The waters of Big Creek at the project site are classified as ".SAII.by the Division of Environmental Management and are open,to shellfishing by the Division of Health Services. Big 'Creek `several hundred yards upstream from the project site, is classified as a Primary Nursery Area by the Division of Marine Fisheries. The applicant's proposed project is to: perform maintenance dre'dging(by dragline) within the existing 750' x 20' man-made canal and basin; to expand into highground the existing man-made basin (currently 60' x 601) on the upper end of the canal by 60' x 60' x -4' NWL; and to expand the basin (currently 60' x 801) nearest to Big Creek into highground by a 5' x 80' x -4' cut. The spoils from the maintenance excavation and highground excavation are to be placed on highground adjacent to the canal. A small 1' fringe of Juncus roemerianus occurs in about a 50' strip on the upper end of the canal. 10.
