(2) A 30-foot vegetated buffer shall be maintained along the marsh. (3) Collection of stormwater shall be limited to grassy swales. (4) Permanent sediment control measures must be utilized at waterward ends of swales to prevent sediment from washing into the marsh and/or adjacent waters of Ware Creek. (5) No marsh may be excavated or filled. (6) No ditches may be excavated in the marsh. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel whenthe project is inspected-for-compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1991 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Tinsley Carteret County The Subject application has been reviewed for water quality impacts and the following comments are offered: a. This project was originally reviewed in October and November of1987 under the requirements of stormwater regulations in effect at that time. Since CAMA permit was not issued before January 1, 1988, those parts of the project that are in the CAMA permit must adhere to the requirements now found in 2H .1000. b. In order to assure that the buildout of the residential lots adheres to the maximum of 25% built-upon area required for such projects, restrictive covenants could be required that would restrict the total built-upon area to no more than 25%. (Built-upon area means that portion of an individual development that is covered by impervious or partially pervious cover including buildings, pavements, recreation facilities, etc. but not including decking.) Tinsley Application, Carteret County DATE: February 12, 1988 On or about January 8 we discussed this project as related to your Division's comments of November 16 and the apparent absence of any discussion of stormwater controls. My file notes that during our January 8 discussion, you informed me that the project was "deemed permitted under the new rules" and that your office need not make further comment. Based on those comments, a permit was drafted. It has been brought to my attention that our CAMA record should contain information as to how that decision was reached, what criteria was used and if your final action could be used as a standard or guideline on this type of project, i.e., relatively small subdivision with minor development and residences to be built by individuals who purchase lots. This is not unlike the pending Hardesty Farms project. Would you also consider conditions that might be included in the permit covering, e.g., buffer zones. Inasmuch as this office delayed getting back to you, a comment by February 24 is requested. Our final statutory deadline is March 4. Box 27687 Raleigh, NC 27611 RE: HERON POINT SUBDIVISION Dear Dave: The Coastal Federation has been asked to review the permit application submitted by Mr. John Tinsley for Heron Point Subdivision off of Ware Creek in Carteret County. In reviewing this application, it appears to me that the application is incomplete in that it does not show the location of units that will be built as part of this development. In order to determine compliance with stormwater regulations and impervious cover rules it is vital that complete plans for this development be provided. At this stage in the permit process, the Division has the opportunity to review the total project and assure that its final design is appropriate. There is no reason to conduct a piecemeal permit review by permitting the road, and then relying upon Carteret County to review 13 minor permits that make it difficult to evaluate cumulative impacts. Given the large amount of wetlands and the relatively little amount of land outside of AEC jurisdiction for this project, it is appropriate and vital to request the applicant to show the complete layout for units, driveways, and other structures to be built within the subdivision. One example of a permit application that supplied this level of detail was the last request for a permit to subdivide Permuda Island. With an environmentally sensitive design and thorough permit review, it is likely that the Coastal Federation would have no objections to this project. NARRATIVE DESCRIPTION: The applicant's proposed project is a 19.4 acre subdivision with thirteen (13) lots located at the end of SR 1164 on Ware Creek, in Carteret County. The area was formerly farmland, and currently, the land is idle and has one (1) small garage structure on the western edge of the property. The property is bordered on the east side by Ware Creek with a 5' to 100' fringe of Spartina alterniflora. •A Spartina alterniflora marsh also exists on the western edge of the property. Ware Creek is a primary nursery area as designated by the Division of Marine Fisheries, and is open to shellfishing as designated by the Division of Health Services and the waters are classified as "SA" by the Division of Environmental Management. The proposed subdivision road partially falls into the 75' estuarine shoreline AEC which is the reason for a major permit being required. A Sediment and Erosion Control Plan has been approved by the Division of Land Quality. 10. ANTICIPATED IMPACTS: Of the 45,000 sq. ft. of total land disturbance for the road, approximately 4800 sq. ft. falls within the 75' estuarine shoreline AEC. This is about 2.3% of impervious surface in the AEC. The road is to be constructed of stone and asphalt and the driveways in the subdivision will be marl. In addition to the road, four (4) drainage easements, each 20' wide will drain surface water from the subdivision.
