personnel when the project is inspected for compliance.

not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 1991

agrees that your project is consistent with the North
Carolina Coastal Management Program.

ADDITIONAL CONDITIONS
(6) The bulkhead must be constructed with return walls so as to prevent the
seepage of backfill into the adjacent wetlands.
(7) The breakwaters will be constructed in strict accordance with the submitted
plats, dated 11/11/87 and will not extend waterward more than 2 feet beyond
NWL at any point along its alignment at the time of construction.
(8) The disturbed areas will be properly graded and provided a ground cover
sufficient to restrain erosion within thirty (30) days of project completion.
(9) The activity will be conducted in such a manner as to prevent significant
increases in turbidity outside the area of construction or construction-related
discharge.
NOTE: The permittee should be advised that a favorable review for future modifi-
cations requesting the filling of wetlands is unlikely.
NOTE: The breakwater should have at least 6" spacing between every two boards
to allow for adequate water circulation.
NOTE: The proposed project•.is certified under General Water Quality Certification
No. 1272 issued on November 10, 1978, for bulkhead construction.

On February 6, 1986, we renewed general permit No. SAWC080-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received January 29, 1988, for
Department of the Army authorization to construct a breakwater
structure and construct and backfill a bulkhead on Shallowbag Bay,
near Manteo, Dare County, North Carolina, indicates it to be a
candidate for Federal authorization under this general permit.
Accordingly, the administrative processing of your application
will be accomplished by the North Carolina Division of Coastal
Management. Comments from Federal review agencies will be
furntstred to e State.
If your application must be withdrawn from this general permit
process for any reason, you will be written and informed of its
further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the River and
Harbor Act and Section 404 of the Clean Water Act, has been

SITE DESCRIPTION
The applicant's property is located in Dare County in Manteo off U.S. 264/64
on Shallowbag Bay. The property is adjacent to a single family residence and is
approximately 10 acres in size. The site is joined to the south by an existing
bulkhead at the site of the single family residence. "404" wetlands extend
approximately 150' north of the existing bulkhead. Then for 440', there is high-
ground where a bulkhead is proposed to be constructed. A 270' breakwater will
connect to the proposed breakwater and continue along the shoreline of a.11404"
wetland. The site has native vines, grasses and trees (pines and cedars) on the
highground. The "404" wetlands include some interpersed coastal wetland species
('uncus, patens).
The applicant proposes to construct breakwaters and a bulkhead with salt-
treated timbers along the existing shoreline. The 440' of bulkhead will be an
average of 6' beyond NWL,. with the maximum distance being 12' at an eroded pocket.
The proposed 274' breakwater is to be located in front of "404" and coastal wetland
areas and is proposed to be constructed approximately 2' beyond NWL.
ANTICIPATED IMPACTS
e proposed bulkhead will result in the filling of 2640 square feet of
Bay bottom, resulting in 391 cubic yards of fill with 120 of these being below
NWL. Both the breakwater and bulkhead will result in increased levels of
turbidity, however, these effects will be short-termed and localized. These
waters are classified as "SC" by DEM.

cross sectional drawings) drawn to scale in black
ink on 8 Vh x 11 white paper: (Refer to Coastal
Resources Commission Rule 7J.0203 for a detailed

Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.

ing that agency's use of larger drawings.) A site or
location map is a part of plat requirements and it
..must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the site. Include

Enclosed is the application of Mr. Harry Schiffman and
Ms. Camille Schiffman for a Department of the Army permit and a
State Water Quality Certification to construct a breakwater
structure and construct and backfill a bulkhead on Shallowbag Bay,
near Manteo, Dare County, North Carolina. Your receipt of this

certification in accordance with Section 325.2(b)(ii) of our
ve re lations.
We are considering authorization of the proposed activity
pursuant to Section 404 of the Clean Water Act, and we have
determined that a water quality certification may be required
under the provisions of Section 401 of the same law. A Department
of the Army permit will not be granted until the certification has
been obtained or waived.
In accordance with our administrative regulations, 60 days
after receipt of a request for certification is considered a
reasonable time for State action. Therefore, if your office has
not acted on the request by April 4, 1988, the District Engineer
will deem that waiver has occurred.

In addition' to the completed application form, the
following items must be submitted:
A copy of the deed (with state application only) or
other instrument under which the applicant claims
title to the affected property. If the applicant is not
claiming to be the owner of said property, then for-
ward a copy of the deed or other instrument under
which the owner claims title, plus written permis-
sion from the owner to carry out the project.
An accurate work plat (including plan view and
cross sectional drawings) drawn to scale in black
ink on 8 Vh x 11 white paper. (Refer to Coastal
Resources Commission Rule 7].0203 for a detailed
description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.
(Contact the U.S. Army Corps of Engineers regard-
ing that agency's use of larger drawings.) A site or
location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the site. Include
county road (SR) numbers, landmarks, and the like.

of their property near Manteo in Dare County, N.C. It was received on January
19, 1988 and appears to be adequate for processing at this time. The projected

NCGS 113A-119(b) requires that Notice of an application be posted at the
location of the proposed development. Enclosed you will find a "Notice of Permit
Filing" postcard which must be posted at the property of the proposed development.
You should post this notice at a conspicuous point along the property where it can
be observed from a public road. Some examples would be: nailing the notice card
to a telephone pole or tree along the road right-of-way fronting the property, or
at a point along the road right-of-way where a private road would lead one into the
property. Failure to post this notice could result in an incomplete application.
