Marine Fisheries advises that there is an existing shellfish resource in the waters which would be closed. Therefore, approval of the proposed marina would cause a violation of the Antidegradation Policy of the EMC Water Quality Standards by elimination of the existing shellfish use due to closure. The marina would be constructed with a 540-foot by 8-foot "T" extending from a 230-foot by 8-foot,.pier from the bank. The "T" would have 33 four-foot wide finger piers and 97 tie pilings. No dredging is proposed as part of this project. In addition to the proposed docks, the applicant is also proposing to construct 455 feet of wooden bulkhead with backfill, approximately 3 feet below the ordinary water level. It should be noted that the subject project site is located on Browns Creek which is classified as a primary nursery area by the-Division of Marine Fisheries, designated as "SA" by the Division of Environmental Management and open to shellfishing by the Division of Health Services. The Division of Marine Fisheries has determined there is a significant oyster resource in Browns Creek that would be closed to harvesti.ug if the subject marina was permitted. Proposed activities in and around the marina, including waste disposal systems, will have an adverse effect on the quality and quantity of shellfish. The effects would include the disturbance of existing shellfish beds, the suitability of the shellfish to be harvested, larval settling rates, and the introduction of pollutants (fecal bacteria, gasoline and oil) into the waters in and near the marina. SANTORO PAGE #2 9. NARRATIVE DESCRIPTION: The applicant's property is a 24 acre tract of land located off SR 1326, on Browns Creek, in Whortonsville, in Pamlico County. The land consists mostly of cleared farmland with a few small areas of Juncus marsh. Man-made features currently on the tract include a mobile home, a septic tank, small cemetery, an access road, ditches, and a small pier. An old Permit #139-78 (R. D. Fabrizio) exists on the site which was for excavation. The proposed new project is located on Browns Creek which is classified as a Primary Nursery Area by the Division of Marine Fisheries, designated as "SA" by the Division of Environmental. Management, and open to shellfishing by the Division of Health Services. A large border (approximately 50') of widgeon grass extends out along the shoreline. The Division of Marine Fisheries has determined there is a significant oyster resource in the creek and a recent permit application for a marina, (J. C. Silverthorne) just upstream from this proposed site, was denied by the Division of Coastal Management. The applicant's proposed project is a 61 slip commercial marina with a 540' x 8' 'T' extending from a 230' x 8' pier from the bank. The 'T' head would have thirty-three (33) 4' wide finger piers and ninety-seven (97) tie pilings.. Water_ depths at the outer-. proposed--slips--is --about -5' - NWL No dredging .is proposed. Sanitary facilities within the existing dwelling are proposed for use by patrons of the marina. In addition to the proposed docks, the applicant is also proposing to construct 455' of wooden bulkhead with backfill, approximately 3' below NWL. Proposed highground development consists of adding a 20 car marl parking lot located about 60' from NWL. No other highground development is planned at this time according to the applicant. There is only about 4,500 sq. ft. of impervious surface existing and proposed for the entire 24.3 acre site. 10. ANTICIPATED IMPACTS: The project, as proposed, will cover approximately 45,900 sq. ft. of public trust waters with piers. The proposed bulkhead will require placing 50 cu. yds. of sandy clay backfill below MHW and will cover 1,365 sq. ft. of estuarine waters. FIELD INVESTIGATION REPORT - NICHOLAS J. NARRATIVE DESCRIPTION: The applicant's property is a 24 acre tract of land located off SR 1326, on Browns Creek, in Whortonsville, in Pamlico County. The land consists mostly of cleared farmland with a few small areas of Juncus marsh. Man-made features currently on the tract include a mobile home, a septic tank, small cemetery, an access road, ditches, and a small pier. An old Permit #139-78 (R. D. Fabrizio) exists on the site which was for excavation. The proposed new project is located on Browns Creek which is classified as a Primary Nursery Area by the Division of Marine Fisheries, designated as "SA" by the Division of Environmental Management, and open to shellfishing by the Division of Health Services. A large border (approximately 501) of widgeon grass extends out along the shoreline. The Division of Marine Fisheries has determined there is a significant oyster resource in the creek and a recent permit application for a marina, (J. C. Silverthorne) just upstream from this proposed site, was denied by the Division of Coastal Management. The applicant's proposed project is a 61 slip commercial marina with a 540' x 8' 'T' extending from a 230' x 8' pier from the bank. The _T' head would have thirty-three (33) 4' wide finger piers and ninety-seven (97) tie pilings. Sanitary facilities within the existing dwelling are proposed for use by patrons of the marina. Proposed highground development consists of adding a 20 car marl parking lot located about 60' from NWL. No other highground development is planned at this time according to the applicant. There is only about 4,500 sq. ft. of impervious surface existing and proposed for the entire 24.3 acre site. 10. ANTICIPATED IMPACTS: The project, as proposed, will cover approximately 45,900 sq. ft. of public trust waters with piers. Mr. Santoro's original proposal for a 61 slip commercial marina was denied on July 22, 1988. This proposal consists of a 10 slip pier and all of the other, appurtenances as originally proposed.
