(1) In order to protect juvenile shrimp and fan fish populations, no excavation or filling will beypermitted between February 1 and April 30 of any year without the prior approval of the Division of Coastal Management. (2) Excavation dimensions will adhere strictly to submitted plans. (3) No excavated or fill materials will be placed at any time in any vegetated wetlands or waters of the State. The temporary placement or double-handling of excavated or fill materials withig waters or vegetated wetlands is not authorized. (4) Vegetated wetlands will not be excavated or filled. No vascular submerged aquatic vegetation will be excavated. (5) Excavation will not exceed 5 feet below the elevation of normal water. (6) All excavated materials will be confined landward of the normal water elevation (See attached sheet for Additional Cond This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. (7) The terminal end of the dredge pipeline should be positioned at a distance sufficient to preclude erosion of the containment dike and a maximum distance from spillways to allow adequate settlement of suspended solids. (8) Effluent from diked areas receiving disposal from hydraulic dredging operations must be contained by pipe, trough, or similar device to a point waterward of emergent vegetation or, where local conditions require, below mean low water. (9) A water control structure will be installed at the intake end of the effluent pipe leading from the retention area in order to ensure maximum settlement of suspended solids. (10) The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the water body is 50 NTUs or less are not considered significant. (11) The exterior slopes of the dredge spoil area must be at an angle no steeper than 2H:IV. (12) A ground cover sufficient to restrain erosion must be provided within thirty working days of completion of dike construction and within thirty working days or 120 calendar days, whichever is shorter, on all other exposed areas. (13) A buffer zone, either natural or mechanical (silt fence), must be provided between the toe of the dike and the new canal or basin. NOTE: This project may result in a moderate mosquito control problem. The permittee. should contact the Vector Control Branch at 733-6407 regarding appropriate mosquito control measures. Project summary Applicant proposes to maintenance excavate a 200' X 70' boat basin, a 370' X 40' access canal and a 900' X 40' channel out into Pamlico y Sound. COASTLAND DEVELOPMENT CONSULTANTS - 14ILLIAM S. QUIDLEY BIO REPORT PAGE 2 SITE DESCRIPTION The applicant owns a 4.3 acre tract of land across from Quidley Trailer Park, south of Buxton, adjacent to the Pamlico Sound, Dare County. The tract is the site of an old spoil disposal area providing the applicant with a high- ground area measuring approximately 150' wide by 600' deep. A 40' wide access canal runs along the north side of the highground off of the Pamlico Sound in 370' to a 200' X 70' boat basin. The property to the north of this canal is coastal wetlands consisting of Spartina alterniflora and Juncus roenerianus; the property south of the highground is similar. F20' X 30' fish house currently exists on the highground adjacent to the boat basin which is used regularly by a limited number of fishermen. The applicant proposes to maintenance excavate the existing 4?0' wide by 370' long access canal and the 70' wide by 200' long boat basin to a 5' depth. This will be accomplished by a dragline with the spoil used to build a 10' high dike around a 214' X 60' disposal area on the highground. The applicant further proposes to excavate a 40' wide by 900' long access channel to 5' deep, from the existing canal out into Pamlico Sound. This will be done using a hydraulic dredge with the spoil pumped up into the diked disposal area on the highground. Spartina alterniflora coastal wetlands exist on either side of the access canal as it joins Pamlico Sound. The proposed excavation will not involve dredging of this or any other coastal wetland areas. Submerged grasses do exist in this area of the Pamlico Sound; as of this report, it has not been possible to determine whether or not submerged grasses exist in the proposed path of the 900' X 40' access channel in Pamlico Sound. Approximately 2100 cubic yards are planned to be excavated from the existing basin and canal; this will be used to build the disposal dikes. Approximately 4000 cubic yards are planned to be excavated and pumped into the diked disposal area; the disposal area will hold 4,755 cubic yards of fill. AI TICIPATED IMPACTS No coastal wetlands will be impacted from this project; submerged grasses may be lost or disturbed depending on their presence in the proposed path of the access channel. Even so, the shallow water habitat of Par.lico Sound is extremely importanto commercial fisheries and this project would be destroying approximately 36,000 ft. of prime shallow-water habitat. The excavation would also cause short- termed turbidity in the immediate vicinity of the project.
