In keeping with your request, this office has circulated to interested
state review agencies U. S. Army Corps of Engineers Public Notice .... 0085
dated December 24, 1987, which describes a project carried out by Pronto_
Development Services,, Inc., of Raleigh. The project, involving the placement
of fill in wetlands to cover a utility line, is `located '''adjacent` to Poplar.
Creek near Knightdale in Wake County.
The cooperating review group was less vocal than expected on this
particular case. However, by copy of the February 15 letter to your office
from the Division of Environmental Management, the writer has learned of a
violation of a DEM permit. DEM, as you know, has recommended that an
after-the-fact permit not be issued. This viewpoint position supports the DEM
position and, likewise, recommends permit denial.
Should you require additional input from the state on this matter, do not
hesitate to contact this office or the Division of Environmental Management.

Reference your November 16, 1987, application for an
after-the-fact Department of the Army permit to authorize the
placement of fill material.,in wetlands adjacent Poplar Creek,
associated with installation of a sewer line in the Ashley Hills
Subdivision, near Knightdale, Wake County, Nortb Carolina.
We have completed our public interest review of your
application, and we have determined that to authorize the work
would be contrary to the interests of the general public.". By
letter of February 8, 1988, we informed you that the U.S. Fish and
Wildlife Service, objecting to the loss of forested wetlands,
recommended that your application be denied and the area be
restored to pre-work conditions. By letter of February 4, 1988
(copy enclosed), Wake County informed us that your unauthorized
fill has disrupted and degraded area drainage and commented that
"positive drainage must be restored." By letter of February 15,
1988 (copy enclosed), the North Carolina Division of Environmental
Management informed us that the installation of your sewer line
contradicted their authorization. Therefore, your application for
after-the-fact Department of the Army authorization is denied.
You are hereby requested to provide your plan to restore
preconstruction elevation contours and reestablish previously
exisiting surface drainage not less than 20 days from your receipt
of this letter. This plan must be submitted to Mr. Ken Jolly,
Regulatory Branch, telephone (919) 846-1217.

This letter is in response to your request of January
4, 1988 that 401 Water Quality Certification be processed
for an after-the-fact COE permit for a utility line through
a wetland area adjacent to Poplar Creek. Since the fill has
already been placed and the permitting is being considered
on an after-the-fact basis, there is no Section 401 Water
Quality Certification required prior to Corps issuance of
the permit.
However, it should be noted that the manner of
construction of this sewer line was in contradiction with
the permit issued by this Division for sewer lines on this
project. The permit required that sewer line in this
specific area (between manholes #7'and #10) be constructed
on pillars, above ground. The sewer line has been built and
covered in violation of the permit. Significant flooding
has resulted and a citizen's complaint has been submitted to
our office. Enforcement actions for violations of our
permit are presently under consideration.

PUBLIC NOTICE
PRONTO DEVELOPMENT SERVICES, INC., 4911 Departure Drive, Raleigh, North
Carolina 27604, has applied for a Department of the Army after-the-fact
permit TO AUTHORIZE THE PLACEMENT OF 146 CUBIC YARDS OF FILL MATERIAL IN
WETLANDS ADJACENT TO POPLAR CREEK,..IN THE ASHLEY HILLS NORTH SUBDIVISION,
PHASE III, NEAR KNIGHTDALE, WAKE County, North Carolina.
This public notice does not imply, on the parts of the Corps of Engineers
or other agencies, either favorable or unfavorable opinion of the work
performed; but it is issued to solicit comments on the factors.listed above on
which a final decision will be based. Legal action has been suspended pending
the outcome of this consideration.
The following description of the work is taken from data provided by the
applicant and from observations made during an onsite visit by a
representative of the Corps of Engineers. Plans submitted with the
application show that the fill material presently covers a wetland area of
approximately 70 feet long by 20 feet wide,,._and._is about.,3 feet thick. When
the wetlands jurisdiction line was being flagged by aCorps of Engineers
representative, the fill area in wetlands was larger, but the applicant stated
that he would restore the entire area to the pre-project wetland elevation
except for that material being applied for in this public notice.
The site is a permanently inundated palustrine emergent wetland, vegetated
with species including cattail (Typha sp); willow (Sali' sp), red maple (Acer
rubrum), tulip poplar (Liriodendron tulipifera), royal fern (Osmunda re alis),
and ash (Fraxinus sp). The purpose of the work is to cover-a previously
permitted utility line through the area. Plans showing the work are included
with this public notice.
The State of North Carolina will review this public notice to determine
the need for the applicant to obtain any required State authorization. No
Department of the Army permit will be issued until the coordinated State
viewpoint on the proposal has been received and reviewed by this agency, nor
will a Department of the Army permit be issued until the North Carolina
Division of Environmental Management has determined the applicability of a
Water Quality Certificate as required by PL 92-500.
This application is being considered pursuant to Section 404(b) of the
Clean Water Act (33 U.S.C. 1344). Arty person may request, in writing within
the comment period specified in the notice, that a public hearing be held to
consider this application. Requests for public hearing shall state, with
particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of the
National Register of Historic Places for the presence or absence of registered
properties, or properties listed as being eligible for inclusion therein, and
this worksite is not registered property or property listed as being eligible
for inclusion in the Register. Consultation of the National Register
constitutes the extent of cultural resource investigations by the District
Engineer, and he is otherwise unaware of the presence of such resources.
Presently, unknown archeological, scientific, prehistorical, or historical
data may be lost or destroyed by work under the requested permit.
The District Engineer has determined, based on a review of data furnished
by the applicant and onsite observations, that the activity will riot affect
species, or their critical habitat, designated as endangered or threatened
pursuant to the Endangered Species Act of 1973.
The decision whether to issue a permit will be based on an evaluation of
the probable impacts, including cumulative impacts, of the proposed activity
and its intended use on the public interest. Evaluation, of the probable
impacts which the proposed activity may have on the public interest requires a
careful weighing of all those factors which become relevant in each particular
case. The benefits which reasonably may be expected to accrue from the
proposal must be balanced against its reasonably foreseeable detriments. The
decision whether to authorize a proposal, and if so the conditions under which
it will be allowed to occur, are therefore determined by the outcome-of the
general balancing process. That decision should reflect the national concern,
for both protection and utilization of important resources. All factors which
may be relevant to the proposal must be considered including the cumulative
effects thereof. Among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, cultural values, fish and wildlife values,
flood hazards, flood plain values, land use, navigation, shore erosion and
accretion, recreation, water supply and conservation, water quality, energy
needs, safety, food and fiber production, mineral needs, considerations of
property ownership, and, in general, the needs and welfare of the people. For
activities involving the placement of dredged or fill materials in waters of
the United States, a permit will be denied if the discharge that would be
authorized by such permit would not comply with the Environmental Protection
Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any
other applicable.guidelines or criteria, a permit will be granted unless the
District Engineer determines that it would be contrary to the public interest.
Generally, the decision whether to issue this Department of the Army
permit will riot be made until the North Carolina Division of Environmental
Management (DEM) issues, denies, or waives State certification required by

Section 401 of the Clean Water Act. The DEM considers whether or not the
proposed activity will comply with Sections 301, 302, 306, and 307 of the
Clean Water Act. The application and this public notice for the Department of
the Army permit serves as application to the DEM for certification.
Additional information regarding the Clean Water Act certification may be
reviewed at the offices of the Environmental Operations Section, North
Carolina Division of Environmental Management, Salisbury Street, Archdale
Building, Raleigh, North Carolina. Copies of such materials will be furnished
to any person requesting copies upon payment of reproduction costs.
The North Carolina Division of Environmental Management plans to take
final action in the issuance of the Clean Water Act certification on or after
January 19, 1988.
All persons desiring to make comments regarding the application for Clean
Water Act certification should do so in writing delivered to the North
Carolina Division of Environmental Management, Post Office Box 27687, Raleigh,
North Carolina 27611-7687, on or before January 13, 1988, Attention:

Dear Jeff:
As we discussed over the phone last week,.Wake County has one concern
as regards your permitting of the fill material placed in the wetlands
caused by_r?ewprline construction in the above referenced subdivision. As

placed on piers in areas where it would be above natural ground. The fill
material which was used to cover the lines has blocked drainage which would
have otherwise been unimpeded, it the approved plans had been followed.
The single family lots affected by this no longer have positive
drainage. We foresee that this may (at its worst) cause flooding of future
homes to be built on these lots. In any case, it is certain that an
undesirable drainage condition has been created that may contribute to
mosquito breeding, snakes, etc.
We would prefer that the original approved plans be adhered to on this
site, but if the fill is permitted and allowed to remain, positive drainage
must be restored. This would require the addition of culverts through the
fills or the filling of the lower portion of the lots in question. I have
enclosed materials showing the location of the affected lots for your
reference. Thank you for your attention to this matter.

The Raleigh Regional Office has reviewed the request by Pronto Develop-
ment in order to provide comments for issuance of State Water Quality Certifi-
cation in accordance with Section 401 of the Clean Water Act.
In October 1987, this office responded to a citizen's complaint concern-
ing backf ill in a wetland area. Investigation of the construction of the
sewer line project revealed that backfill material had already been placed in.
the area this project covers.
A sewer line permit issued by this Division for the sewer line project
required that this specific area (between manhole #7 and #10) be constructed
on pillars, above ground. This was not done. Instead, the entire sewer line
was covered and has resulted in significant flooding in upstream areas. A
"Notice of Violation" is pending for the Director's signature.
Therefore, this office recommends denial of State Certification as signi-
ficant adverse impact has already been demonstrated. This office is planning
to proceed with requiring Pronto Development to construct the sewer line in
accordance with the project permit issued by this Division.

Enclosed is the application of Pronto Development Services,
Incorporated, for an after-the-fact Department of the Army permit
and a State Water Quality Certification to authorize the placement
of fill material in wetlands adjacent Poplar Creek, Ashley Hills
North'Subdivision, near Knightdate, Wake'County, North Carolina.
Your receipt of this letter verifies your acceptance of a valid
request for certification in accordance with Section 325.2(b)(ii)
of our administrative regulations.
We are considering authorization of the proposed activity
pursuant to Section 404 of the Clean Water Act, and we have
determined that a water quality certification may be required
under the provisions of Section 401 of the same law. A Department
of the Army permit will not be granted until the certification has
been obtained or waived.
In accordance with our administrative regulations, 60 days
after receipt of a request for certification is considered a
reasonable time for State action. Therefore, if your office has
not acted on the request by March 4, 1988, the District Engineer
will deem that waiver has occurred.

Gentlemen:
Reference your application of November 16, 1987, for
Department of the Army authorization to place fill material in
wetlands adjacent Poplar Creek associated with the installation of
an 8-inch diameter sewerline, near Knightdale, Wake County, North
Carolina.
For the purposes of the Corps of Engineers' Regulatory
Program, Title 33, Code of Federal Regulations (CFR), Part 330,
published.: in the= Federal Register"'on"November- 13, 1986, lists
nationwide permits. Authorization was provided for the discharge
of material for backfill or bedding for utility lines provided
there is no change in pre-construction bottom contours and all
excess material is removed to an upland disposal area.
Your work is authorized by nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions.
Please be aware that this authorization does not relieve you of
the responsibility to obtain any required State or local approval.

.? CONDITIONS
a. Any discharge of dredged or fill material will not occur in the
proximity of a public water supply.
b. The activity will not jeopardize a threatened or endangered species as
identified under the Endangered Species Act, or destroy or adversely modify
the critical habitat of such species.
c. The activity will not significantly disrupt the movement of those
species of aquatic life indigenous to the waterbody.
d. Any discharge of dredged or fill material will consist of suitable
material free from toxic pollutants.
e. Any structure or fill will be properly maintained.
f. An individual state water Qualitv certification must be obtained or
waived. Conditions of certification will be considered to be special
conditions of the Federal nationwide pemit. Please contact Mr. William
Mills, North Carolina Division of Coastal Management, telephone (919) 733-
5083.
g. The following management practices will be followed to the maximum
extent practicable:
(1) Discharges of dredged or fill material into waters of the United
States will be avoided or minimized through the use of other practical
alternatives.
(2) Discharges in spawning areas during spawning seasons will be
avoided.
(3) Discharges will not restrict or impede the movement of aquatic
species indigenous to the waters or the passage of normal or expected high
flows or cause the relocation of the waters.
(4) If the discharge creates an impoundment of water, adverse impacts
on the aquatic system caused by the accelerated passage of water and/or the
restriction of its flow will be minimized.
(5) Discharge in wetland areas will be avoided.
(6) Heavy equipment working in wetlands will be placed on mats.
(7) Discharges into breeding areas for migratory waterfowl will be
avoided.
(8) All temporary fills will be removed in their entirety.
