Subject:B-4501 Permit Application Brad, there was error in our application for B-4501. Since the development of the NRTR, the Atlantic Sturgeon has been listed by NOAA and Duplin Bridge 325 is at the upper reach of Critical Habitat designation for this species. Therefore, our application was not correct in stating that there are no Federal listed species or critical habitat within the project limits and notification to and written approval from the US Army Corps of Engineers is required for this project. Based on the fact that this bridge replacement project is at the very upper reach of the critical habitat for this species, the proposed bridge is a single span 70 ft. bridge with no interior bents and the only in-water work is the removal of the existing interior bent; NCDOT is proposing a “No Effect” determination and no “in-water work” moratorium. We realize the Corps of Engineers has the authority to make the final determination. The current proposed LET for this project is November 2018 with a likely availability of January 7, 2019. Please accept my apology for this error, this project was turned over to the Division from Central late in the process and some information was not up to date. The Division is taking steps to prevent this from reoccurring by creating a database for all NRTR’s so that re-evaluations can be completed within the required timeframes and prior to application submittal.
