Rivercross was approved through a Planned Development rezoning as a mixed-use development (see attached plan).
The three areas – single-family residential, apartments, and commercial – are now owned by different parties. The
streets are being designed to NCDOT specifications and would be turned to NCDOT once density requirements are met.
Lincoln County is a delegated program for erosion and sedimentation control and for water-supply watershed
protection, but not for stormwater. Only a small portion of the Rivercross site along Triangle Circle is located in a water-
supply watershed, and most of that area is designated on the approved plan as a buffer area.

Subject: Rivercross development
I received an application for a 401 for the subject site. My understanding is that the overall site is basically a mix use
development. Residential (single family) in the rear with commercial and multifamily in the front. The applicant is
attempting to separate the rear development from the front development (excluding the front from the 401
application). I believe the application is an attempt to prevent stormwater bmp requirements for the front of the
development. However, the roads at the site (Brookway Drive and River Cross Point Drive) are shared roads. Will these
become city streets upon completion? If so, stormwater requirement may be required for any development that access
the roads. The gained an “easement” for Brookway to the rear of the site, which is unusual. My understanding is that
Lincoln considers it a single site development?
Finally, is Lincoln county a delegated program? I think Chonticha from our Central office has been in contact regarding
SW.
