Reference the application of Mr. Ned T. Grady for Department of the Army
authorization to construct a boatramp on Spooners Creek, Spooners Creek North
Subdivision, west of Morehead City, Carteret County, North Carolina.
The Federal agencies have completed review of the proposal as presented by
the application and your field investigation report.
We recommend that the following conditions be included in the State
authorization:
a. The boatramp will be positioned in strict accordance with permit
plans.
b. Vegetated wetlands will not be excavated or filled outside of the
alignment indicated on the permit plans.
c. All excavated materials will be placed and retained landward of the
mean high water (MHW) elevation and any regularly or irregularly flooded marsh
vegetation.
d. The temporary placement or double handling of excavated or fill
materials within waters or vegetated wetlands is not authorized.
e. The activity will be conducted in such a manner as to prevent a
significant increase in turbidity outside the area of construction or
construction-related discharge. Increases such that the turbidity in the
waterbody is 50 NTU's or less are not considered significant.

(1) In order to reduce the loss of saltmarsh cordgrass, the width of the boat
ramp will be reduced to 15'.
(2) The location and construction of the concrete ramp will take place in accor-
dance with the permitted work plat drawings and condition #1 above.
(3) Vegetated wetlands will not be excavated or filled outside of the alignment
indicated on the permit plans.
(4) All excavated materials will be 'confined on the highground property in
such a way as to prevent their erosion and reentry into adjacent marsh
or waterways of Spooners Creek.
(5) The temporary placement or double handling of excavated or fill materials
within waters or vegetated wetlands is not authorized.

Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWC080-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the North
Carolina Division of Coastal Management prior to performing any

8. PROJECT SUMMARY: Mr. Ned T. Grady proposes to construct a
community boat ramp 22' wide x 25' long for the residences of'
of Spooners Creek North Subdivision. The project will involve the
direct loss of 110 sq. ft. of saltmarsh cordarass.

9. NARRATIVE DESCRIPTION: Mr. Ned T. Grady was issued a CAMA Permit
#194-84 in early December of 1985. That permit authorized the
comprehensive development of a 30 acre subdivision known as
Spooners Creek North. This single-family residential
community is located on the western branch of Spooners
Creek, off Highway 24 and Harbor Drive, just west of
Morehead City, in Carteret County. The various construction
elements of that permit included bulkheading the shoreline,
maintenance excavation of the creek, and installation of
several docks, piers and mooring pilings. That work has
been completed in accordance with the established permit
conditions.
Today, the applicant proposes to construct a concrete boat
ramp for community access within the subdivision. The
actual ramp will measure 22' wide by 25' long and will be
located on Lot #15 at the end of Hinson Court. The ramp
will be positioned in the middle of Lot #15 which measures
100' wide on this bulkheaded shoreline. The position of the
ramp is dictated by the fact that existing piers and mooring
piles already occupy both sides of this lot location.
Unfortunately, a narrow fringe of saltmarsh cordgrass
measuring 3' to 8' wide will be displaced by the proposed
ramp. The contractor has expressed a sincere desire to
transplant the vegetated marsh peat (approximately 110 sq.
ft.) to a vacant section of bulkheaded shoreline immediately
east of the proposed ramp. In addition to the ramp, the
project plans call for a marl driveway and parking lot
measuring about 90' long x 60' wide. The applicant has
carefully designed the highground activities in such a way
as to maintain a 20' wide grassy buffer zone between the
creek and the parking lot area. The project will also
preserve a narrow fringe of saltmarsh cordgrass and drainage
gut that runs north and south between Harbor Drive and Lot
#15. This area will not be filled in the course of
developing the highground portions of Lot #15.
10. ANTICIPATED IMPACTS: Installation of the 22' wide concrete
boat ramp will directly displace approximately 110 sq. ft.
of saltmarsh cordgrass and about 220 sq. ft. of intertidal
bottomland. The contractor intends to transplant the
vegetated marsh peat. Although his efforts will probably be
successful, the proposal is not being processed as an
official mitigation plan through the State's system of
review. The applicant's design to maintain a 20' wide
vegetated buffer zone should control potential runoff
pollutants from entering Spooners Creek.

location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the site. Include

A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.

individuals have 30 days in which to submit com-

Coastal Management. The applicant must advise
the adjacent landowners of this opportunity by sen-

Section 325.2(b)(ii) of our administrative regulations.
We are considering authorization of the proposed activity pursuant to
Section 404 of the Clean Water Act, and we have determined that a water
quality certification may be required under the provisions of Section 401 of
the same law. A Department of the Army permit will not be granted until the
certification has been obtained or waived.
In accordance with our administrative regulations, 60 days after receipt
of a request for certification is considered a reasonable time for State
action. Therefore, if your office has not acted on the request by March 26,
1988, the District Engineer will deem that waiver has occurred.

9. NARRATIVE DESCRIPTION: Mr. Ned T. Grady was issued a CAMA Permit
#194-84 in early December of 1985. That permit authorized the
comprehensive development of a 30 acre subdivision known as
Spooners Creek North. This single-family residential
community is located on the western branch of Spooners
Creek, off Highway 24 and Harbor Drive, just west of
Morehead City, in Carteret County. The various construction
elements of that permit included bulkheading the shoreline,
maintenance excavation of the creek, and installation of
several docks, piers and mooring pilings. That work has
been completed in accordance with the established permit
conditions.
Today, the applicant proposes to construct a concrete boat
ramp for community access within the subdivision. The
actual ramp will measure 22' wide by 25' long and will be
located on Lot #15 at the end of Hinson Court. The ramp
will be positioned in the middle of Lot #15 which measures
100' wide on this bulkheaded shoreline. The position of the
ramp is dictated by the fact that existing piers and mooring
piles already occupy both sides of this lot location.
Unfortunately, a narrow fringe of saltmarsh cordgrass
measuring 3' to 8' wide will be displaced by the proposed
ramp. The contractor has expressed a sincere desire to
transplant the vegetated marsh peat (approximately 110 sq.
ft.) to a vacant section of bulkheaded shoreline immediately
east of the proposed ramp. In addition to the ramp, the
project plans call for a marl driveway and parking lot
measuring about 90' long x 60' wide. The applicant has
carefully designed the highground activities in such a way
as to maintain a 20' wide grassy buffer zone between the
creek and the parking lot area. The project will also
preserve a narrow fringe of saltmarsh cordgrass and drainage
gut that runs north and south between Harbor Drive and Lot
#15. This area will not be filled in the course of
developing the highground portions of Lot #15.
10. ANTICIPATED IMPACTS: Installation of the 22' wide concrete
boat ramp will directly displace approximately 110 sq. ft.
of saltmarsh cordgrass and about 220 sq. ft. of intertidal
bottomland. The contractor intends to transplant the
vegetated marsh peat. Although his efforts will probably be
successful, the proposal is not being processed as an
official mitigation plan through the State's system of
review. The applicant's design to maintain a 20' wide
vegetated buffer zone should control potential runoff
pollutants from entering Spooners Creek.
