This permit, issued on 3L Z , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) In order to protect juvenile shrimp and fin fish populations, no excavation or filling will be permitted between April 1 and September 30 of any year without the prior approval of the Division of Coastal Management. (2) Excavation will not exceed 8' below the normal water level. (3) No excavated or fill materials will be placed at any time in any vegetated wetlands or waters. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. (4) Vegetated wetlands will not be excavated or filled. (5) All excavated materials will be confined above the normal water level and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1991 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. (7) _A ground cover sufficient to restrain erosion will be required within 30 working days or 120 calendar days, whichever is shorter, of-project completion. (8) No attempt will be made by the permittee to prevent the full and free use by the public of 'all navigable waters at or. adjacent to the authorized work. (9) In no case will - the pier be constructed closer than 85 feet to the near bottom edge of the federally maintained navigation channel. NOTE: If at all possible, the excavation should be performed with equipment that would minimize impacts to the estuarine tributary, such as hydraulic dredges, rather,; than with the aquadozer as proposed. NOTE: To prevent further erosion of the shoreline adjacent to the project, decreasing the slope of the dredge cut or bulkheading of the shoreline is recommended A modification of this permit will be required for bulk- heading or any other changes in the project plans. NOTE: The proposed project is certified under General Water Quality Certification No. 1273 issued on November 10, 1978, for discharges of liquid effluent from diked upland, disposal areas. An open 16' x 30' shed will be constructed onshore and a boat basin will be dredged with spoils being placed on hiahground.. Environmental setting The project is located on the inland waters of Wrights Creek and on highground property owned by Mr. Foster. The proposed boat access channel and basin will be dug adjacent to a Corps of Engineers maintained channel 8' in depth. The bottom to be dug is soft mud with depths ranging from shoreline to 4' in depth. The highground property is a residence with a bermuda and fescue lawn and telephone poles lying along the shoreline. Wrights Creek is used by a number of commercial fishermen for docking and offloading catch in the area of the proposed project. No designated primary nursery areas will be impacted. Spoil materials are to be confined to adjacent highground. Project iDrooosal Mr. Foster proposes to dredge an access channel and boat basin 144' x 80' by 8' deep to.alloow access to a proposed pier 59' long by 6' wide by 4' high and an open shelter 16' x 30' built on highground for the purpose of docking, and offloading a comercial fishing operation. The pier as proposed will be 85' from the near edge of the Corps channel as required by the regulations. The proposed dredging will provide him access to the Corps of Engineers maintained channel that runs in front of the property. Materials will be dredged with an aqua dozer and loaded on a trailer for disposal on adjacent highground property owned by Mr. Foster. Environmental impact The proposed project will impact shoreline shallow water habitat in Wrights Creek, and there will be increased short term turbidity. If the applicant is not claiming to be the owner of said property, then for- ward a copy of the deed or other instrument under which the owner claims title, plus written permis- sion from the owner to carry out the project. An accurate work plat (including plan view and cross sectional drawings) drawn to scale in black ink on 8 V2 x 11 white paper. (Refer to Coastal Resources Commission Rule 7j.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue-line prints or other larger plats are acceptable only if 16 high quality copies are provided by the applicant.
