BIO REPORT PAGE 2 SITE REPORT The applicant owns an approximate 6 acre tract of land at the end of S.R. 1164 off of U.S. 264 in Stumpy Point, Dare County, adjacent to Stumpy Point Bay. The property is a peninsula bordered on the south and southeast by Stumpy Point Bay and on the northwest by a man-made fishing harbor. On the south and southeast, the property now shows remnant spoil material from earlier. Corps of engineers dredging projects. The adjacent waters in Stumpy Point Bay are classified as SA Shellfishing by D.H.S. Along the harbor shoreline, the property has several old, in-need-of-repair docks, The southern dock is an "L" shaped dock going out approximately 12' , then having a 16' X 16' arm at its end. Another dock is located approximately 75' north of this dock and is approximately 81wide by 20' long. A number of pilings exist between and around these docks from previous construction projects. Between the harbor and Stumpy Point Bay, in almost the center of the peninsula is a shallow-water wetland pond. This pond is minimally connected to adjacent waters by a low drainage area just south of the "L" dock. Dare County owns a public dock just abutting the applicant's property on the north side and being located at the northern end of the.harbor. The harbor is also the site of several commercial fishing operations; the entire harbor is an established commercial fishing harbor. The applicant proposes to establish a commercial fishing center in the fishing harbor property through the construction of several marina facilities. First, the applicant proposes to construct a 6' wide dock approximately 150' long paralleling the shore, connecting and extending beyond the two existing docks.. Eleven mooring piles are planned to be placed 30' waterward of and parallel. to the aforementioned dock. This will provide dockage for 10 vessels up to 32' in length. The most waterward of these pilings will be approximately 50' waterward of NWL into the approximate 200' wide harbor. The dock and mooring piles will span 200' of the applicant's property. The applicant further plans to establish a 20' X 30' boat ramp on the southwest tip of his property, where the harbor joins Stumpy Point Bay. The.applicant plans no excavation or filling to create this boat ramp, but simply plans to utilize the existing shoreline. The planned location of this boat ramp is in an area of coastal wetlands consisting of black needlerush Juncus roemerianus), Spartina patens,-and Distichlis spicata. In addition, access to the boat ramp would require crossing the low drainage area from the pond. The applicant further plans to have gasoline and diesel fueling facilities just south of the existing "L" dock within an earthen diked area on his property. Finally, the FISHERMAN'S EXCHANGE, INC. SITE REPORT PAGE 3 applicant desires to construct an office/fishing store and a septic tank and drain field on the north end of his property near the end of S.R. 1164. These will be more than 75' from any shoreline and thus out of the estuarine shoreline A.E.C. ANTICIPATED IMPACTS Although no excavation or filling is planned for the boat ramp, the use of this area of shoreline will be detrimental to the coastal wetlands existing there. 'The fueling facilities through minor fueling spills will impact the quality of adjacent waters. The mooring pilings, although they will extend less than 1/3 the width of the harbor, may present a navigational obstruction to commercial vessels using the harbor. If the applicant is not claiming 'to be the owner of said property, then for- ward a copy of the deed or other instrument under which the owner claims title, plus written permis- sion from the owner to carry out the project. An accurate work plat (including plan view and cross sectional drawings) drawn to scale in black ink on 8 Yz x 11 white paper. (Refer to Coastal Resources Commission Rule 7J.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue-line prints or other larger plats are acceptable only if 16 high quality copies are provided by the applicant. (Contact the U.S. Army Corps of Engineers regard- ing that agency's use of larger drawings.) A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency per- sonnel unfamiliar with the area to the site. Include county road (SR) numbers, landmarks, and the like. A stormwater management plan, if applicable, that . may have been developed in consultation with the Division of Environmental Management. A list. of the names and complete addresses of the adjacent waterfront (riparian) landowners. These individuals have 30 days in which. to submit com- ments on the proposed project to the Division of Coastal Management. The applicant must advise the adjacent landowners of this opportunity by sen- ding a copy of the permit application to them by registered or certified mail.
