9. NARRATIVE DESCRIPTION: The applicant proposes to develop a
26 acre tract of land in the Town of Cape Carteret, on Yucca
Loop Road, off Youpon Drive, on Deer Creek, in Carteret
County. This is one of the last remaining undeveloped
residential areas in the original section of Cape Carteret,
located east of Highway 58,.south of Highway 24, and north
of the Intracoastal Waterway, on Bogue Sound.
The applicant proposes to develop 18 individual
single-family lots fronting on Deer Creek and an existing
man-made canal.. The project plans include construction of a
20' wide paved loop road with a 60' right-of-way. The road
is currently undergoing a name change from Yucca Road to
Deer Creek Road. Only a small portion (approximately 1%) of
the overall road bed will fall within the CAMA 75' estuarine
shoreline. A man-made canal borders the property on the
south side. The existing canal runs east and west and
connects Youpon Drive with Deer Creek. The canal is
approximately 1200' long and averages 1' to 1J' deep on the
west end. However, as the workplat drawings indicate, the
applicant will maintenance excavate a 750' section of the
canal closest to Youpon Drive. The onste field
investigation revealed that no coastal wetlands occur along
the canal. This is due in part to the sharp banks and tree
covered shorelines. The excavation will be limited to a
width of 35' and the adjusted water depths to -21' on MLW.
The excavation will be accomplished by a dragline or
backhoe, and the spoils some 2,430 cu. yds. of sand will be
trucked to the center of the property for landscaping
purposes. This method will also require removal of the
large trees along the north side of the canal. A series of
1,150 ln. ft. of bulkhead will be installed along both sides
of the canal on the applicant's property. The applicant has.
also provided detailed drawings on two (2) temporary
sediment and drainage basins that will intersect the
proposed road with the adjacent surface waters. In both
cases, a berm of riprap will be constructed on the landward
side of the MHW shoreline to help contain potential runoff.

In terms of resource information gathered by this office, it
has been determined that there is a known archaeological site
near the proposed project. The surface waters of the canal
and Deer Creek are classified 'SA' and are opened to the
harvesting of shellfish.
10. ANTICIPATED IMPACTS: The proposed maintenance excavation
will directly displace approximately 1/2 acre of bottomland
composed primarily of sand covered by a thin layer of fine

silt. If the applicant utilizes silt curtains across the
canal during actual time of excavation, impacts to
downstream resources shall be minimal. The estimated 2400
cu. yds. of spoil can be easily trucked to the highground
disposal site and adequately contained. Construction of the
1,150' long bulkhead will help stabilize the canal
shoreline. The bulkhead installation will not involve the
displacement of any marsh vegetation. Construction of the
two (2) riprap revetments or sediment basins will also have
no significant impacts on the estuarine resources and will
help reduce the adverse affects of sediment runoff.
CANA REVIEW: The 1987 Cape Carteret Land Use Plan Update
classifies the highground property as Transition-Residential
which is consistent with the Cape Carteret Zoning
designation of R-20 where the individual lot sizes will be
at least 20,000 sq. ft. in size. The surface waters of Deer
Creek and the man-made canal are classified as Conservation.
The proposes excavation and bulkhead construction appears to
be consistent with the Land Use Plan where the same activity
is consistent with the CANA Use Standards for Development.

In addition to the completed application form, the
following items must be submitted:
A copy of the deed (with state application only) or
other instrument under which the applicant claims
title to the affected property. If the applicant is not
claiming to be the owner of said property, then for-
ward a copy of the deed or other instrument under
which the owner claims title, plus written permis-
sion from the owner to carry out the project.

Resources Commission Rule 7j.0203 for a detailed
description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.
(Contact the U.S. Army Corps of Engineers regard-
ing that agency's use of larger drawings.) A site or
location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the site. Include
county road (SR) numbers, landmarks, and the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit com-
ments on the proposed project to the Division of
Coastal Management. The applicant must advise
the adjacent landowners of this opportunity by sen-
ding a copy of the permit application to them by
registered or certified mail. This notification is re-
quired by G.S. 113-229(d).
