Box 27687, Raleigh, North Carolina 27611-7687 Telephone 919-733-7015 NORTH CAROLINA McDowell County CERTIFICATION THIS CERTIFICATION is issued in conformity with the requirements of Section 401 Public Laws 92-500 and 95-217 of the United States and subject to the North Carolina Division of Environmental Management Regulations in 15 NCAC 2H, Section .0500 to Cumberland Gravel and Sand Company pursuant to an application filed on the 7th day of October, 1988 to fill a wetland area with material from the settling basins. The Application provides adequate assurance that the discharge of fill material into a wetlands area adjacent to the waters of North Fork Catawba River in conjunction with the proposed mining operation in McDowell County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction- related discharge (increases such that the turbidity in the Stream is 50 NTU's or less are Apt considered significant). Violations of any condition herein set forth shall result in revocation of this Certification. OPE SUBJECT: 401 Comments Cumberland Sand and Gravel Company McDowell County Mr. Roy Davis and the writer visited the Cumberland Gravel and Sand Company site adjacent to the North Fork Catawba River in McDowell County on October 13, 1988, and were accompanied by Mr. Mike Poplin of Cumberland. Inspection of the site revealed that the areas now considered wet lands are sites which were formerly mined and left undisturbed for a number of years. The Company proposes to fill the former mine sites with sediment from the inorganic solids settling basins serving the present sand and gravel operation. To compensate for the destruction of the present man-made wetlands which are approximately 6 acres in size, Cumberland Sand and Gravel proposes tc restore as wetland approximately 14 acres of the area which is currently being mined. Inspection of the site suggested that there would be no measurable short term adverse impacts to the environment as a result of the proposed action. In the long run the proposed project will probably be of advantage environmentally due to fact that the destroyed wetlands will be replaced with new wetlands at a ratio of greater than 2:1. ROBERT-M. POPLIN, Post Office Box 425, Swannanoa, North Carolina 28778, has applied for a Department of the Army permit TO PLACE FILL MATERIAL IN APPROXIMATELY 5.4 ACRES OF WETLANDS ADJACENT THE NORTH FORK CATAWBA RIVER IN CONJUNCTION WITH GRAVEL MINING OPERATIONS OFF S.R. 1553, NORTH OF HANKINS, in McDowell County, North Carolina. The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application show the construction of six individual diked sections within a 1,325-foot-long by 200-foot-wide, irregularly shaped wetland area adjacent the southwest side on the river. The wetland area, dominated by Typha sp. (cat- tails), Salix nigra (black willow) and Juncus effusus (rushes), is a historic mining borrow area which has become established with wetland species. The area is to be filled with sand and silt waste materials resulting from gravel washing operations. As mitigation for the wetland losses, the applicant is voluntarily proposing to create approximately 14 acres of wetlands on the north side of the river when mining operations are terminated. The mitigation area is to be graded to an appropriate slope and elevation and covered with the originally stripped topsoil overburden. The purpose of the work is to provide a waste area for gravel mining operations. Plans showing the work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a Department of the Army permit be issued until the North Carolina, Division of Environmental Management has determined the applicability of a Water Quality Certificate as required by PL 92-500. ' This application is being considered pursuant to Section 404(b) of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application show the construction of six individual diked sections within a 1,325-foot-long by 200-foot-wide, irregularly shaped wetland area adjacent the southwest side on the river. The wetland area, dominated by Typha.sp.. (cat- tails), Salix ni ra (black willow) and Juncus effusus (rushes), is a historic mining borrow area which has become-established with wetland species. The area is to be filled with sand and silt waste materials resulting from gravel washing operations. As mitigation for the wetland losses, the applicant is voluntarily proposing to create approximately 14 acres of wetlands on the north side of the river when mining operations are terminated. The mitigation area is to be graded to an appropriate slope and elevation and covered with the originally stripped topsoil overburden. The purpose of the work is to provide a waste area for gravel mining operations. Plans showing the work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization.
