Griffin SUBJECT: COMPANY STORES CAMA PERMIT APPLICATION MODIFICATION DATE: September 12, 1988 On September 4, 1987, Company Stores Development Corporation submitted an application for a CAMA major development permit to develop a shopping center on 23.1 acres adjacent Roanoke Sound near Whalebone Junction, Dare County (see attached bio report for description of setting and original construction plans). Numerous problems and concerns were encountered which caused the applicants to place their request on hold. The applicant has altered his plans hoping to address and/or alleviate the problems earlier identified. On September 7, 1988, the applicants submitted their revised plans which will be discussed below. The applicant still desires to construct a shopping center with associated parking on this'property. Instead of culverting and filling the drainage ditch which bisects the property, the applicant now seeks to bridge and build over approximately '205' of the ditch. No coastal wetlands exist in the area proposed to be bridged. A bulkhead/ retaining wall is proposed along„both sides of the remaining 180' of the ditch. (see accompanying blue-line drawing for bulkhead and bridge location and detail). No ponds are proposed at this time to be constructed. A retaining wall/bulkhead is still proposed waterward of the shopping center but landward of 11404" or coastal wetlands across the entire tract. A waste water treatment plant and accompanying subsurface drain field are planned for the southeast corner of the property. Impacts anticipated for this modification include the shading of 3075 sq. ft. of shallow ditch habitat. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. By letters of October 22 and October 27, 1987 (copies enclosed), the O.S. Fish and Wildlife Service and the National Marine Fisheries Service recomnended denial of authorization. The agencies recommended that the projected loss of 0.7 acre of mixed wetlands would be detrimental to wildlife and fishery resources. The applicant states that the purpose of placing the fill material in wetlands is to accommodate construction of a shopping center. We do not agree that it is necessary to fill these wetlands to provide the shopping complex; the facility is not dependent upon being located upon these wetlands. Other practical, less environmental damaging, alternatives are available. Authorization of this work would result in the degradation of water quality. The authorization o= this proposal would be contrary to the overall public interest, and we agree with the Federal review agencies that the application should be denied. C' ' N OAF/ 81,98 COMPANY STORES DEVELOPMENT CORPORATION BIO REPORT PAGE 2 SITE DESCRIPTION The applicant owns 23.1 acres between U.S. 158 and the Roanoke Sound near Whalebone Junction in Nags Head. The property can be generalized as a rolling sandy topography, five feet above sea level sloping gently to the Sound. The sandy high ground along U.S. 158 is vegetated with yaupon, wax myrtle, poison ivy and jumping cactus. The sandy high ground gives way to a COE "404" wetland area vegetated with Baccharis and marsh elder, with an understory of three square, salt meadow grass and black needlerush. This 404 area is delineated on the plat as the Corps' jurisdictional line. The property grades lower toward the Sound into a coastal wetlands consisting of salt reed grass (S_ c nosuroides), cattails (Typha spp.), salt meadow grass (S. patens) and black needlerush J. roemerianus). The property is transected by a drainage ditch 15 feet wide which runs approximately 750 feet from the Sound to the right-of-way of U.S. 158. The water in the ditch is approximately 1 foot deep and the sides of the ditch are vegetated with Baccharis, wax myrtle, and black needlerush. The applicant proposes to build a shopping center consisting of four buildings totaling 85,428 square feet. To accomplish this, the drainage ditch transecting the property will be culverted from U.S. 158 to the coastal wetlands line. A pond approximately 6/10 of an acre is proposed to be dredged in 404 wetlands. The excavated material will be placed directly on high ground and used as fill. A retaining wall (bulkhead on plat) will be built to hold the fill from sloughing off into the 404 area. Parking areas are planned to have a 1% slope toward U.S. 158, so that stormwater run-off from buildings and parking areas will be directed to planned retention areas east of the parking areas. ANTICIPATED IMPACTS The proposed project will result in the destabilization of 11.5 acres of vegetated sandy barrier island. The dredging of a pond will result in the loss of approximately 26,000 sq. ft. (6/10 acre) of Corps' 404 wetlands. Plans appear to be in order for adequate control of stormwater runoff. The culverting of the drainage ditch will result in the loss of approximately 5600 sq. ft. of shallow water habitat and its accompanying scattered coastal wetlands and 404 wetlands.
