Any violation of these terms may subject permittee to -4 fine, imprisonment or civil action; or may cause the permit to be null and void. (1) The bulkhead must not extend waterward more than 15' below the mean high water at any given point along its alignment at the time of construction. (2) All backfili materials will be obtained from a highground source and confined landward of the permitted bulkhead. (3) The fill material will be clean and free of any pollut4nts, except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. (4) No vegetated wetlands will be filled. (5) The proposed pier will be constructed in strict accordance with the permit plans. (6) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other.qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspectzd for compliance: , Any maintenance work or project modification not covered hereunder requires further Departmental approval. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. The bulkhead will be positioned in strict accordance with permit plans. It will not be aligned farther waterward than 15 feet from the mean high water (MEW) elevation contour at any point along its alignment. b. All backfill materials will be obtained from a highground source and confined landward of the permitted bulkhead. c. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. d. The authorized structure and associated activity will not cause an unacceptable interference with navigation. g. Increases such that the turbidity in the waterbody is 50 NTU's or less are not considered significant. The Application provides adequate assurance that the discharge of fill material into a wetlands area adjacent to the waters of Mason's Channel in conjunction with the proposed bulkhead construction in New Hanover County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction- related discharge (increases such that the turbidity in the Stream is 25 NTU's or less are not considered significant). 2. That the fill material be clean, free from any toxic material. 3. That erosion controls be in place prior to filling. 4. That the approach embankment should be stabilized with vegetation soon after completion. 5. That the total area filled below Mean High Water be less•than one-half acre. Violations of any condition herein set forth shall result in revocation of this Certification. Project Summary The applicant proposes to construct a bulkhead approximately 1J below mean high water, 80' in length. Also proposed is a 90' pier with a floating dock and five (5) mooring piles to accommodate a 28 foot boat Clifton L. Benson, Jr. Page 2 9. PROJECT DESCRIPTION The project site is located on Short Water Road (Lot 2) along Mason's Channel, Figure Eight Island, New Hanover County. It is reached by taking SR 1402 off US 17 North. The private vacant lot has an area of approximately 19.561 sqf. It is void of any sort of vegetation. There is a gentle sandy slope along the waterward edge of the property. According to Marine Fisheries, the waters in the project area are classified as SA waters, secondary nursery and are open to the taking of shellfish. The applicant proposes to construct an 80 foot bulkhead and tie into the face of the existing bulkhead on the north side of his lot. This bulkhead would extend approximately 15' below the mean high water (mhw). The applicant also proposes to construct a pier approximately 90' x 6' with a T at the waterward end measuring approximately 8' x 16' and a floating dock 8' x 20', also proposed are 5 (five) mooring piles to accommodate a 28 foot boat. 10. ANTICIPATED IMPACT This project will consume approximately 1200 sqf of moderately productive sand/silt intertidal shoreline. There is evidence that the lot has taken a beating from erosion processes occurring from the adjoining bulkhead as well as the December-January 1986-87 storms.
