Your receipt of this letter verifies your acceptance of a valid request for certification in accordance with Section 325.2(b)(ii) of our administrative regulations. We are considering authorization of the proposed activity pursuant to Section 404 of the Clean Water Act, and we have determined that a water quality certification may be required under the provisions of Section 401 of the same law. A Department of the Army permit will not be granted until the certification has been obtained or waived. In accordance with our administrative regulations, 60 days after receipt of a request for certification is considered a reasonable time for State action. Therefore, if your office has not acted on the request by September 7, 1988, the District Engineer will deem that waiver has occurred. Include county road (SR) numbers, landmarks, and the like. A stormwater management plan, if applicable, that may have been developed in consultation with the Division of Environmental Management. A list of the names and complete addresses of the adjacent waterfront (riparian) landowners. These individuals have 30 days in which to submit com- ments on the proposed project to the Division of Coastal Management. The applicant must advise the adjacent landowners of this opportunity by sen- ding a copy of the permit application to them by registered or certified mail. A review of your application received August 24, 1988, for a Department of the Army permit to excavate a boat basin, and construct and backfill a bulkhead, off of the Pasquotank River, at the end of SR 1230 (Bateman Drive), in the Bateman Estates subdivision, near Elizabeth City, Pasquotank County, North Carolina, indicates it to be a candidate for Federal authorization under this general permit. Accordingly, the administrative processing of your application will be accomplished by the North Carolina Division of Coastal Management. Comments from Federal review agencies will be furnished to the State. If your application must be withdrawn from this general permit process for any reason, you will be written and informed of its further management. If there are no unresolved differences of State-Federal positions or policy, the final action taken on your application by the State will result in your receiving written notice from us that your application has been successfully processed under our general permit. PROJECT SUMMARY: Applicant proposes to dredge an "L" shaped boat basin and access channel in 404 wetlands and deposit the s oil on an: upland lot and a 100 sq. ft. wetland. Applicant also nronoses a 15' x 251 boat ramp in the basin, a 153' X 10' pier over the swamp and a 436' bulkhead around the interior of the basin. Project will result in the dredging of 6123 sq. ft. and the filling of 100 sg ft. of 404 wetlands. KENNETH A. BATEMAN BIO REPORT PAGE 2 SITE REPORT The applicant currently owns the cypress swamp at the end of Bateman Drive, SR 1230. The area was recently logged but still contains dominant overstory of bald cypress Taxodium distchum and red maple Acer rubrum. Ground cover has responded to the sudden increase in light and the area now has a dense underbrush' of Smilax sp. and climbing hemp weed Mikania scandens. The upland area between the road and the proposed boat basin is dominated by lawn grasses. No archaeological sites were found in this area. Applicant proposes to dredge a canal through the swamp (78' X 16' X -6') and construct an "L" shaped boat basin within the swamp (75' X 65' X -61). Applicant also proposes to fill a small. portion of wetland (10' X 101) adjacent to the upland area. A boardwalk 153' X 10' will be constructed along the basin, over the swamp out to the Pasquotank River.
