In accordance with your permit modification request received on May 12, 2010, we are
forwarding herewith a modified Attachment A, certified June 30, 2010, to the City of New Bern for the
subject Class A Exceptional Quality residuals management and distribution program.
On August 5, 2009, Session Law 2009-406, entitled "An Act to Extend Certain Government
Approvals Affecting the Development of Real Property Within the State," was enacted by the General
Assembly and signed . into law. The Act, known as the Permit Extension Act of 2009, extends the
expiration date of certain government approvals and permits. The subject permit falls within the scope
of this Act and is therefore being extended to January 31, 2017.
This certification is being issued to approve additional tonnage for the two approved residuals
sources, which are the New Bern Wastewater Treatment Plant and the New Bern Seven Water
Reclamation Facility. The tonnage from the New Bern Wastewater Treatment Plant is being increased
from 2,405 dry tons per year to 3,073 dry tons per year and the tonnage from the New Bern Seven Water
Reclamation Facility is being increased from 1 dry ton per year to 49 dry tons per year.
Please replace the existing Attachment A of Permit No. WQ0023306 that was previously
certified on February 10, 2009, with this modified Attachment A. It is the Permittee's responsibility
to ensure that a complete permit is created by inserting this modified Attachment A into Permit No.
WQ0023306, issued on February 10, 2009.
This modified Attachment A shall be effective from the date of certification; shall void
Attachment A of Permit No. WQ0023306 that was previously (most recently) certified on February 10,
2009; and shall be subject to the conditions and limitations as specified therein and well as those specified
in the above -referenced permit. As always, remember to take the time to review this modified
Attachment A thoroughly, as some of the conditions contained therein may have been changed since the
last certification. Note that this modified Attachment A is hereby incorporated by reference into Permit
No. WQ0023306, issued on February 10, 2009.

If any parrs, requirements, and/or limitations contained in this certification or modified
Attachment A are unacceptable, you have the right to request an adjudicatory hearing upon written
request within 30 days following receipt of the certification. This request shall be in the form of a written
petition, conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of
Administrative Hearings at 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such
demands are made, this permit shall be final and binding.
