Dear Mr, Greenwood:
In accordance with your permit application received May 27, 2003, we are forwarding
herewith Permit No. WQ0022711, dated March 13, 2007, to the Macon County for the
construction and operation of the subject reclaimed water generation and utilization facility.
This permit operates in conjunction with NPDES Permit NC0021547.
This permit shall be effective from the date of issuance until March 12, 2012, and shall be
subject to the conditions and limitations as specified therein.. Please pay particular attention to
the monitoring requirements in this permit, Failure to establish an adequate system for collecting
and maintaining the required operational information will result in future compliance problems.
The Division of Waste Management, Solid Waste Section has issued. Permit 57-03 for the
operation of the Macon County Landfill. The Solid Waste Section has approved the modification of
Permit 57-03 to allow for spray irrigation of reclaimed wastewater onto certain identified fields in the
landfill (see attached letter frons the Solid Waste Section dated October 26, 20O6). This permit shall
become void if the Solid Waste Section terminates the spray irrigation modification of Permit 57-03.
This permit cannot be altered in any way (with the exception of simple permit renewal) without prior
approval from the Solid Waste Section.
The conjunctive use permit application and supporting documentation has been evaluated
by the Division, and it has been deten-nined that flow equalization at the Town of Franklin
wastewater treatment facility is not required to meet the limitations of Section 111.3 in Permit No.
WQ0022711. Accordingly, this permit.is issued pursuant to t 5 NCAC 02T. 0105(n), with the
inclusion of condition VIA.

If any parts, requirements, or limitations contained in this permit are unacceptable, you
have the right to request an adjudicatory hearing upon written request within thirty (30) days
following receipt of this permit. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. Unless such
demands are made this permit shall be final and binding.
One (1) set of final approved plans and specifications is to be forwarded to you, one (1)
set is being forwarded to your Engineer (A/E)one (1) set retained for the Asheville Regional
Office, one (1) set retained for the Construction Inspection Group, and one (1) set retained for
the Design Management Unit.
A copy of the approved plans and specifications shall be maintained on file by the owner
for the life of the project.

RECLAIMED WATER GENERATION, DISTRIBUTION AND UTILIZATION PERMIT
In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North
Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
construction and operation of a 164,866 gpd reclaimed water generation facility at the Town of
Franklin WWTP consisting of an effluent transfer pump station located at the chlorine contact
basin consisting of dual 229 gpm, 5 Hp pumps; a 114 ftp traveling bridge filter with a backwash
pump station consisting of dual 110 gpm, 2 Hp pumps; a flowmeter; a turbidity meter; associated
yard piping; a reclaimed water irrigation pump station consisting of three 1 15 gpm, 15 Hp pumps;
approximately 4,000 linear feet of 8 -inch reclaimed water force main; and an irrigation system
consisting of 48 fixed 57-gpm sprinkler nozzles with irrigation onto 42.62 acres at the Macon
County Landfill, to serve Macon County with no discharge of wastes to the surface waters of the
State, pursuant to the application received May 27, 2003, and subsequent additional information
received by the Division, and in conformity with the project plan, specifications, and other
supporting data subsequently filed and approved by the Department of Environment and Natural
Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until March 12, 2012, and shall be subject
to the following specified conditions and limitations:
I. PERFORMANCE STANDARDS
Upon completion of constnlction and prior to operation of this permitted facility, a
certification must be received from a professional engineer certifying that the
permitted facility has been installed in accordance with this permit, the approved
plans and specifications, and other supporting materials. If this project is to be
completed in phases and partially certified, you shall retain the responsibility to
track further construction approved under the same pennit, and shall provide a final
certificate of completion once the entire project has been completed. Mail the

2. The following offices shall be notified at least forty-eight (48) hours in advance of
operation of the installed facilities so that an in-place inspection can be made. Such
notification to the regional supervisor shall be made during the normal office hours
from 8.00 a.m. until 5:00 p.m. on Monday through Friday, excluding State
Holidays.

3. The reclaimed water utilization facilities shall be effectively maintained and operated at
all times so that there is no discharge to the surface waters, nor any contamination of
ground waters, which will render them unsatisfactory for normal use. In the event that
the facilities fail to perform satisfactorily, including the creation of nuisance conditions or
failure of the irrigation area to adequately assimilate the wastewater, the Permittee shall
take immediate corrective actions including those actions that may be required by either
the Division of Water Quality or the Division of Waste Management, Solid Waste
Section, such as:
a. the ternporary or permanent termination of those spray irrigation zones not
performing satisfactorily, causing nuisance conditions, or failing to assimilate
the wastewater, and
b. the construction of additional or replacement wastewater treatment and
disposal facilities.
4. The .issuance of this permit shall not relieve the Permittee of the responsibility for
damages to groundwater or surface water resulting from the operation of this
facility.
The residuals generated frorn these treatment facilities must be disposed of in
accordance with General Statute 143-215.1 and in a manner approved by the North
Carolina Division of Water Quality.
6. Diversion or bypassing of the untreated wastewater from the treatment facilities is
prohibited.

7. The following buffers shall be maintained:
a. 100 feet between wetted areas and water supply wells,
b. 100 feet between wetted areas and waters classified as SA,
C. 25 feet between wetted areas and surface waters not classified as SA,
d. 100 feet between wastewater treatment units and wells,
C. 50 feet between reclaimed water storage/irrigation ponds and property lines, and
f. 50 feet between wastewater treatment units and property lines.
Public access to the irrigation sites shall be controlled during active site use. Such
controls may include the posting of signs showing the activities being conducted at
each site. A sign shall be posted in plain sight showing these activities.
9. This permit shall become void if the Division of Waste Management, Solid Waste
Section terminates the spray irrigation modification of Permit 57-03_ This permit in no
way alleviates the Permittee from any additional spray irrigation restrictions and/or
obligations placed on them by the Solid Waste Section in the form of future pen -nit
modifications.
10. This permit cannot be altered in any way (with the exception of simple permit
renewal) without prior approvals from the Division of Water Quality and from the
Division of Waste Management, Solid Waste Section.
11. All reclaimed water valves, storage facilities, outlets shall be tagged or labeled to
warn the public or employees that the water is not intended for drinking. Where
appropriate, such warning shall inform the public or employees to avoid contact
with the water.
12. All reclaimed water piping, valves, outlets and other appurtenances shall be
color -coded, taped, or otherwise marked to identify the source of the water as being
reclaimed water.
a. All reclaimed water piping and appurtenances shall be either colored purple
(i.e., Pantone 522) and embossed or integrally stamped or marked
"CAUTION: RECLAIMED WATER DO NOT DRINK" or be installed
with a purple (i.e., Pantone 522) identification tape or polyethylene vinyl
wrap. The warning shall be stamped on opposite sides of the pipe and
repeated every three feet or less.
b. Identification tape shall be at least three inches wide and have white or black
lettering on purple (Le., Pantone 522) field stating "CAUTION:
RECLAIMED WATER DO NOT DRINK." [dentification tape shall be
installed on top of reclaimed water pipelines, fastened at least every 10 feet
to each pipe length and run continuously the entire length of the pipe.
Existing underground distribution systems retrofitted for the purpose of
distributing reclaimed water shall be taped or otherwise identified as ill

items a. or b. above. This identification need not extend the entire length of
the distribution system but shall be incorporated within 10 feet of crossing
any potable water supply line or sanitary sewer line.
13. All reclaimed water valves and outlets shall be of a type, or secured in a manner,
that pennits operation by authorized personnel only.
1.4. Above -ground hose bibs (i.e., spigots or other hand -operated connections) shall not
be present. Hose bibs shall be located in locked below -grade vaults that shall be
clearly labeled as being of non -potable quality. As an alternative to the use of
locked below -grade vaults with standard hose bibs services, hose bibs, which can
only be operated by a special tool may be placed in non -lockable underground
services boxes clearly labeled as non -potable water.
15. The Permittee shall maintain an active cross -connection control program that shall
have the following minimum requirements:
a. No direct cross -connections shall be allowed between the reclaimed water
and potable water systems.
b. A reduced pressure principle backflow preventer, an approved air gap
separation, or other device approved by the Division of Environmental
Health shall be installed at the potable water service connection to the use
area where both reclaimed water and potable water are supplied to a
reclaimed water use area. The installation of the reduced pressure principle
backflow prevention device shall allow proper testing.
An air gap separation, approved and regularly inspected by the potable
water supplier, shall be provided between the potable water and reclaimed
water systems where potable water is used to supplement a reclaimed water
system.
I1. OPERATION AND MAINTENANCE REQUIREMENTS
The facilities shall be properly maintained and operated at all times.
2. Upon classification of the wastewater treatment and irrigation facilities by the
Water Pollution Control System Operators Certification Commission (WPCSOCC),
the Permittee shall designate and employ a certified operator to be in responsible
charge (ORC) and one or more certified operator(s) to be back-up ORC(s) of the
facilities in accordance with 15A NCAC SG .0201. The ORC shall visit the
facilities in accordance with 15A NCAC 8G .0204 or as specified in this permit and
shall comply with all other conditions specified in these rules.
The Permittee shall install all appropriate flow measurement devices consistent with
approved engineering and scientific practices to ensure accuracy and reliability of
influent flow measurement. Flow measurement devices selected shall be capable of
measuring flows with a maximum deviation of less than 10 percent from true flow,

accurately calibrated at a minimum of once per year, and maintained to ensure that
the accuracy of the measurement is consistent with the accepted capacity of that
type of device. Records of flow measurement device calibrations shall be kept on
file by the Permittee for a period of at least three years. At a minimum, data to be
included in this documentation shall be:
a. Date of flow measurement device calibration.
b. Name of person performing calibration.
C. Percent from true flow.
4. A suitable year round vegetative cover over the drip irrigation fields shall be
maintained.
5. An agronomic plan shall be developed which maximizes the assimilative capacity
of the nutrients in the wastewater through crop growth, crop harvesting, etc.
6. Irrigation shall not be performed during inclement weather or when the ground is in
a condition that will cause runoff.
7. The facilities shall be effectively maintained and operated as a non -discharge
system to prevent the discharge of any wastewater resulting from the operation of
this facility, unless authorized by an NPDES permit.
8. The application rate shall not exceed a cumulative loading over any twelve ( 12)
month period as given by the following table. The instantaneous application rate
shall not exceed 1.0 inch per hour.
`The minimum annual cumulative loading rate is established to assure a
minimum level of irrigation onto the drip irrigation facility. If the annual total
rainfall exceeds the 80`, percentile rainfall calculated for Franklin in Macon
County (58 inches/year), then this minimum annual cumulative loading rate
requirement will be adjusted by the Division.
9. if a spray irrigation field has been modified such that the ground topography has been
altered (from borrow operations, for example) compared to the approved Plans, then
spray irrigation activities may only be reinstated at the altered field with permit
modification because of the altering of the ground topography. Such a permit
modification application must be accompanied by a re-evaluation of the soils and
groundwater of the altered field.

10. No type of wastewater other than that from the Town of Franklin's wastewater
treatment plant shall be irrigated at the Macon County Reclaimed Water Spray
Irrigation Facility.
11. No traffic or equipment shall be allowed on the disposal area except while
installation occurs or while normal maintenance is being performed.
12. All wastewater shall be discharged in strict accordance with the conditions of the
facility's existing NPDES permit should the limit for fecal coliform (daily
maximum concentration of 25 per 100 ml) or turbidity (instantaneous maximum of
10 NTU) be exceeded, until such time that the levels have stabilized below these
maximum levels.
III. MONITORING AND REPORTING REQUIREMENTS
Any monitoring (including groundwater, surface water, soil or plant tissue analyses)
deemed necessary by the Division to insure surface and ground water protection will
be established and an acceptable sampling reporting schedule shall be followed.
2. WWTP reuse effluent flow shall be continuously monitored and daily flow values
shall be reported on Form NDMR-1. Irrigation at the Reclaimed Water Spray
Irrigation Facility shall be continuously monitored and daily flow values shall be
reported on Forrn NDAR- l .
3. As an indicator of proper operation and maintenance, the facility shall produce an
effluent in compliance with the following limitations:

a. Monthly averages for all but fecal coliforin shall be the arithmetic mean of all

The effluent from the subject facilities shall be monitored, by the Permittee, at the point
prior to discharge to the Reclaimed Water Spray Irrigation Facility for the following

The effluent pH shall not be less than 6.0 standard units nor greater than 9.0
standard units.
* 2/Month sampling frequency only during the months of April through
October. During the remainder of the year, these parameters shall be
monitored monthly.
** Triannually sampling shall be conducted during March, July, and .
November.
If Groundwater sampling indicates or predicts problems with the compliance with
Groundwater Standards, this permit will be modified to include additional and/or
more restrictive lin-litations.
4. Adequate records shall. be mainLaIned by the Permittee tracking the amount of
wastewater disposed at the Reclaimed Water Spray Irrigation Facility_ These
records shall include, but are not necessarily limited to, the following information
(and reported on Form NDAR-1):
a. date of irrigation,
b. volume of wastewater irrigated,
C. field irrigated,
d. length of time field is irrigated,
e. continuous weekly, monthly, and year-to-date hydraulic (inches/acre)
loadings for each field,
f. weather conditions, and
g. maintenance of cover crops.
5. Copies of all monitoring data (as specified in condition Ill 3) on Form NDMR- I
and three (3) copies of all operation and disposal records (as specified in condition
III 4) on Form NDAR-I shall be submitted monthly on or before the last day of the
following month. All information shall be submitted to the following two

6. A maintenance log shall be maintained at this facility including but not limited to
the following items:
a. Visual observations of the plant and plant site.
b. Visual observations of the spray irrigation site.
C. Record of preventative maintenance (changing of filters, adjusting belt
tensions, alarm testing, diffuser inspections and cleanings, irrigation pump
maintenance, repairing broken drip irrigation lines, etc.).
d. Date of calibration of flow measurement device.
e. Date and results of power interruption testing on alternate power supply.
7. Noncompliance Notification:
The Permittee shall report by telephone to the Asheville Regional Office, telephone
number (828) 296-4500, as soon as possible, but in no case more than 24 fours or
on the next working day following the occurrence or first knowledge of the
occurrence of any of the following:
a. Any occurrence at the wastewater treatment facility which results in the
treatment of significant amounts of wastes which are abnormal in quantity
or characteristic, such as the dumping of the contents of a sludge digester,
the known passage of a slug of hazardous substance through the facility; or
any other unusual circumstances.
b. Any process unit failure, due to known or unknown reasons, that render the
facility incapable of adequate wastewater treatment such as mechanical or
electrical failures of pumps, aerators, compressors, etc.
Any failure of a pumping station, sewer line, or treatment facility resulting
in a by-pass directly to receiving waters without treatment of all or any
portion of the influent to such station or facility.
d. Any time that self-monitoring information indicates that the facility has
gone out of compliance with its permit limitations.
Occurrences outside normal business hours may also be reported. to the Division's
Emergency Response personnel at telephone number (800) 662-7956, (800) 858-
0368, or (919) 733-3300. Persons reporting such occurrences by telephone shall

also file a written report in letter form within five (5) days following first
knowledge of the occurrence. This report must outline the actions taken or
proposed to be taken to ensure that the problem does not recur.
IV. GROUNDWATER REQUIREMENTS
Prior to beginning waste disposal operations, two (2) monitor wells (named DWQ-
MW- I and DWQ-MW-2) shall be installed to monitor groundwater quality_ The
wells shall be constructed such that the water level in the well is never above or
below the screened (open) portion of the well at any time during the year. The
general location and name for each well is marked on Attachment 1. Each
monitoring well shall be constructed in accordance with this permit, and approved
by the Asheville Regional Office/Aquifer Protection Section and by the Division of
Waste Management, Solid Waste Sect ion/Hydrogeo I ogist.
2. All wells that are constructed for purposes of groundwater monitoring shall be
constructed in accordance with 15A NCAC 2C .0108 (Standards of Construction
for Wells Other than Water Supply) and any other state and local laws and
regulations pertaining to well construction.
The following offices shall be notified at least forty-eight (48) hours prior -to the
construction of any monitoring well so that an inspection can be made of the monitoring
well location. Such notification shall be made during the normal office hours from 8:00
a.m. until 5:00 p.m_ on Monday through Friday, excluding state holidays.

4. Within sixty (60) days of completion of all monitoring wells, the permittee shall submit
original copies of a scaled site map (scale nob eater than 1 "=200'). The map(s) must
include the following information:
a. The location and identity of each monitoring well.
b. The location of major components of the waste disposal system_
c. The Iocation of property boundaries within 500 feet of the disposal area(s).
d. The latitude and longitude of the established horizontal control monument.
e. The elevation of the top of the well casing (which shall be known as the
"measuring point") relative to a common datum.
f. The depth of water below the measuring point at the time the measuring point is
established.
g. The location of Review and Compliance boundaries.
h. The date the map is prepared and/or revised.

Control monuments shall be installed in such a manner and made of such materials that
the monument will not be destroyed due to activities that may take place on the property.
The permittee is responsible for the geographic accuracy of any map submitted, however
produced.
Two original maps and all supporting documentation shall be mailed to the Division of

5. For the initial sampling of the wells, the permittee shall submit a copy of the GW -1 Form
(Well Construction Record) with the Compliance Monitoring Form (GW -59) for each
well to the addresses listed above. Initial Compliance Monitoring Forms that do not
include copies of the GW -1 form may be returned to the permittee without being
processed. Failure to submit these forms as required by this permit may result in the
initiation of enforcement activities pursuant to NC General Statutes 143-215.6A.
6. Groundwater monitor wells DWQ-MW-1 and DWQ-MW-2 shall be sampled initially
after construction of the wells, and thereafter every March, July and November for
the following parameters:

"The measurement of water levels must be made prior to sampling for the remaining
parameters. The depth to water in each well shall be measured from the surveyed
point on the top of the casing.
The measuring points (top of well casing) of all monitoring wells shall be surveyed to
provide the relative elevation of the measuring point for each monitoring well.
For Volatile Organic Compounds (VOCs) sampled in November, use only one of the
following methods:
a. Standard Method 6230D, Practical Quantitation Limit (PQL) at 0.5 ug/L or less
K Standard Method 6210, PQL at 0.5 ug/L or less
C. EPA Method 8021, Low Concentration, PQL at 0.5 ug/L or less
d. EPA Method 8260, Low Concentration, PQL at 0.5 ug/L or less

Another method with prior approval by the Aquifer Protection Section Chief.
Any of the referenced methods used for VOCs must at a minimum, include all the
constituents listed in Table VIII of Standard Method 6230D. Any method used must
provide a PQL of 0.5 ug/L or less, which must be supported by laboratory
proficiency studies as required by the DWQ Laboratory Certification Unit. Any
constituents detected above the Method Detection Limit (MDL) but below the PQL
of 0.5 ug/L must be qualified (estimated) and reported.
Any laboratory selected to analyze parameters must be Division of Water Quality
(DWQ) certified for those parameters required.
The results of the sampling and analysis must be received on Form GW -59
(Groundwater Quality Monitoring. Compliance Report Form) on or before the last
working day of the month following the sampling month. Send one copy of all

7. The compliance boundary and review boundary for wastewater disposal systems are
specified by 15A NCAC 21- For systems utilizing reclaimed water, 15A NCAC
02T .0910(a)(5) specifies that both the compliance boundary and review boundary
shall be established at the irrigation area boundaries. An exceedance of
groundwater quality standards at or beyond the compliance boundary is subject to
immediate remediation action in addition to the penalty provisions under North
Carolina General Statute 143-215.6A(a)(1).
8. Any groundwater quality monitoring, as deemed necessary by the Division, shall be
provided.
V. INSPECTIONS
Adequate inspection, maintenance, and cleaning shall be provided by the Permittee
to insure proper operation of the subject facilities.
2. The Permittee or his designee shall inspect the wastewater treatment and disposal
facilities to prevent malfunctions and deterioration, operator errors and discharges
which may cause or lead to the release of wastes to the environment, a threat to
human health, or a nuisance. The Permittee shall keep an inspection log or
summary including at least the date and time of inspection, observations made, and
any maintenance, repairs, or corrective actions taken by the Permittee. This log of
inspections shall be maintained by the Permittee for a period of three years from the

date of the inspection and shall be made available upon request to the Division or
other permitting authority.
Any duly authorized officer, employee, or representative of the Division may, upon
presentation of credentials, enter and inspect any property, premises or place on or
related to the disposal site or facility at any reasonable time for the purpose of
determining compliance with this permit; may inspect or copy any records that must
be maintained under the terms and conditions of this permit, and may obtain
samples of groundwater, surface water, or leachate.
Vt. GENERAL CONDITIONS
This permit shall become voidable unless the facilities are constructed in
accordance with the conditions of this permit, the approved plans and
specifications, and other supporting data.
This permit is effective only with respect to the nature and volume of wastes
described in the application and other supporting data.
This permit is not transferable. In the event there is a desire for the facilities to
change ownership, or there is a name change of the Permittee, a formal permit
request must be submitted to the Division accompanied by an application fee,
documentation from the parties involved, and other supporting materials as may be
appropriate. The approval of this request will be considered on its merits and may
or may not be approved.
4. This permit is issued pursuant to 15A NCAC 02T. 0105(n) for the construction and
operation of a reclaimed water utilization facility without flow equalization. In the
event that non-compliance with any permit limitation results from the absence of
flow equalization, this permit may be administratively reopened, and a requirement.
for the construction of a flow equalization basin may be incorporated into the
permit_
5. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to an enforcement action by the Division in accordance with
North Carolina General Statute 143-215.6A to 143-215.6C.
6. The issuance of this permit does not exempt the Permittee from complying with any
and all statutes, rules, regulations, or ordinances which may be unposed by other
government agencies (local, state, and federal) which have jurisdiction, including
but not limited to applicable river buffer rules in 15A NCAC 2B .0200, erosion and
sedimentation control requirements in 15A NCAC Chapter 4 and under the
Division's General Permit NCG010000, and any requirements pertaining to
wetlands under 15A NCAC 213.0200 and 2H.0500,

7. A set of approved plans and specifications for the subject project must be retained
by the Permittee for the life of the project.
8. The annual administering and compliance fee must be paid by the Permittee within
thirty (30) days after being billed by the Division. Failure to pay the fee
accordingly may cause the Division to initiate action to revoke this permit as
specified by 15A NCAC 02T .0105(e)(3).
9. The Permittee, at least six (b) mouths prior to the expiration of this permit, shall
request its extension. Upon receipt of the request, the Commission will review the
adequacy of the facilities described therein, and if warranted, will extend the permit
for such period of time and under such conditions and limitations as it may deem
appropriate.
10. This permit in no way negates, precludes, or invalidates the most recent reissuance of
NPDES Permit No. NC0021547, and the Permittee shall continue to comply with all
conditions provided for therein.
It. This permit shall become voidable unless the agreement between Macon County and the
Town of Franklin for the transfer of treated wastewater is in frill force and effect.

the State of North Carolina, having been authorized to observe (periodically/weekly/full time)
the construction of the Macon County Reclaimed Water Spray Irrigation Facility serving the
Macon County Landfill area, hereby state that to the best of my abilities, due care and diligence
was used in the observation of the following construction:
construction of 164,866 gpd reclaimed water generation facility at the Town of Franklin
WWTP consisting of an effluent transfer pump station located at the chlorine contact
basin consisting of dual 229 gpm, 5 Hp pumps; a 114 ft' traveling bridge filter with a
backwash pump station consisting of dual 110 gpm, 2 Hp pumps; a flowmeter; a turbidity
meter; associated yard piping; a reclaimed water irrigation pump station consisting of
three 115 gpm, 15 Hp pumps; approximately 4,000 linear feet of 8 -inch reclaimed water
force main; and an irrigation system consisting of 48 fixed 57-gpm sprinkler nozzles with
irrigation onto 42.62 acres at the Macon County Landfill, with no discharge of wastes to
the surface waters of the State, and in conformity with the project plan, specifications,
and other supporting data subsequently filed and approved by the Department of
Environment and Natural Resources.

Dear Mr. Grecnwood:
This letter is in response to your request to modify the permit for the referenced landfill to allow
the spray irrigation of wastewater from the adjacent Town of Franklin Wastewater Treatment
Plant. The plan is to utilize only future Cell 3 for the spray irrigation site and not to use any
portions of the active Cells 1 or 2. The portable spray irrigation system will be installed above
ground and will be removed prior to use of this area as a landfill.
By copy of this letter, the Solid Waste Section (Section) hereby issues the Modification to the
Permit to allow the use of the portable spray irrigation system in accordance with the Approved
Plan.
Please note that from the Section's perspective, Macon County as the landfill owner/operator is
responsible for ensuring compliance with 15A NCAC 13B, Section .1600 Requirements for
Municipal Solid Waste Landfill Facilities. Under these rules, any increase above background
detected in the ground water monitoring wells for the landfill automatically trigger assessment
monitoring and, if required, corrective action, If Macon County as owner/operator of the landfill
believes that the contamination is from the spray irrigation system, a demonstration will have to
be made that a source other than the landfill caused the increase above background or the County
will be required to initiate assessment monitoring in accordance with 15A NCAC 13B Rules
.16-34-.1638.
It is important to note that the use of the spray irrigation system in an area proposed for future
landfill disposal could effect the development of that phase. A significant part of the permit
application for landfill expansion into Cell 3 will be a site characterization, which will include an
assessment of the ground water quality in Cell 3. If the spray irrigation system has impacted

groundwater in the proposed area, an assessment will be required. It is important to note that the
results of this assessment could significantly impact the use of this cell for landfill expansion.
