Villari, Owner S & J Villari Livestock 892 Penny Branch Road Warsaw, North Carolina 28398 Subject: Permit No. WQ0022263 S & J Villari Livestock Pump and Haul Duplin County Dear Mr. Villari: Permit No. WQ0022263 dated January 28, 2003, and modified April 29, 2003, which was issued to The Pork Company for the temporary operation of a Pump and Haul operation of transporting 60,000 GPD of wastewater from the wastewater lagoon serving S&J Villari Livestock in Duplin County, expired on July 28, 2003. An application was received July 21, 2003, for reissuance of the permit and modification to allow the construction of a 2.1 MG wastewater storage tank and associated pumps and piping. This pump and haul activity is to be a short -tern action to allow repairs to be made to the waste treatment lagoon and to allow time to explore and implement suitable alternative treatment options. Upon expiration of this permit, the Permittee shall have either upgraded the treatment and disposal system to sufficient capacity or shall operate the production facility within the constraints of the treatment and disposal system. The Permittee shall request that the wastewater storage tank and associated pumps and piping be incorporated into Permit No. WQ0016376 when an application is submitted to modify that permit. This permit shall be effective from the date of issuance until January 31, 2004, shall void Permit No. WQ0022263 issued January 28, 2003, and modified April 29, 2003, and shall be subject to the conditions and limitations as specified therein. Please pay particular attention to the monitoring requirements in this permit. This request must be in the form of a written petition, conforming to Chapter 150B of North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Sincerely, Rick Shiver Water Quality Regional Supervisor eb: wg22263p&hmod.083 cc: Duplin County Health Department Non -:Discharge Permits Unit - Groundwater Regional Files Wilmington Regional Files Central Files NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES I'i�J_►Ttl�•WO a wa-FAI1WJ09► 111 In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations: PERMISSION IS HEREBY GRANTED TO S & J Villan Livestock Duplin County for the temporary operation of a Pump and Haul operation for transporting 60,000 GPD of wastewater from the wastewater lagoon serving S&J Villari Livestock to the City of Fayetteville Cross Creek Water Reclamation Facility, and the construction and operation of a 2.1 Million Gallon stainless steel wastewater storage tank with staff gage, 5 HP agitator, 7.5 HP submersible pump, and installation of a 10 HP pump with submersible intake in the lagoon, and associated controls and piping, with no discharge of wastes to the surface waters, and pursuant to the application submitted to the Department of Environment and Natural Resources and considered a part of this permit. This permit shall be effective from the date of issuance until January 31, 2004, and shall be subject to the following specified conditions and limitations: 1. This permit shall become voidable unless the subject pump and haul activities are carried out in a manner which has been approved by this Division. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. The facilities shall be properly maintained and operated at all times. 4. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as maybe appropriate. The approval of this request will be considered on its merits and may or may not be approved. 5. No type of wastewater other than wastewater from the treatment lagoon system serving S&J Villari Livestock shall be included in the Pump and Haul activities. 6. This permit shall become voidable unless the agreements between The Pork Company and Atlantic Coast Contracting, Inc., for hauling of the wastewater are in full force and effect. 7. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall cease operation of all Pump and Haul activities and take such immediate corrective action as may be required by this Division. 8. This Pump and Haul permit shall not be renewed. It shall be the responsibility of The Pork Company to ensure that the improvement to the Wastewater Treatment System is constructed and operational prior to the expiration date of this Permit. Upon expiration of this permit, the Permittee shall have either upgraded the treatment and disposal system to sufficient capacity or shall operate the production facility within the constraints of the treatment and disposal system. 9. The wastewater collected by this system shall be treated and disposed of at the City of Fayetteville Cross Creek Water Reclamation Facility. The handling and final disposal of the wastewater must be done in a manner that is in compliance with all applicable laws and regulations. 10. The Permittee is liable for any damages caused by a spill or failure of the Pump and Haul operations. 11. Adequate inspection, maintenance, and cleaning shall be provided by the Pcrmittee to insure proper operation of the subject facilities. 12. The Permittee or his designee shall inspect the wastewater collection facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall keep an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspection shall be maintained by the Permittee for as long as the Pump and Haul activities are being conducted and shall be made available upon request to the Division of Water Quality or other permitting authority. 13. Any duly authorized officer, employee, or representative of the Division of Water Quality may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the wastewater collection facilities at any reasonable time for the purpose of determining compliance with this permit and may inspect or copy any records that must be kept under the terms and conditions of this permit, and may obtain samples. 14. An accurate record of the Pump and Haul activities must be maintained by the Permittee indicating: a) date wastewater is removed from the facility. b) name of facility from which wastewater is removed. c) name of facility receiving wastewater. d) volume of wastewater removed. e) status of permanent disposal option. These records shall be submitted to the Wilmington Regional Office of the Division of Water Quality on or before the fifteenth (15) day of the following month. 15. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Water Quality in accordance with North Carolina General Statute 143-215.6A. 16. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 17. Noncompliance Notification: The Permittee shall report by telephone to the Wilmington Regional Office at telephone no.(910) 395-3900 as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any failure of equipment or storage or transportation facilities resulting in a by- pass directly or indirectly to waters of the State. Persons reporting such occurrences by telephone shall also file a written report in letter form within 15 days following first knowledge of the occurrence. This report must outline the actions taken to clean up the wastewater and ensure that the problem does not recur. 18. The annual administering and compliance fee must be paid by the Permittee within thirty (30) days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15 NCAC 2H. 0205. (c)(4).
