WQ0021863, dated May 21, 2003, to Town of Apex for the construction and operation of the subject wastewater treatment and reclaimed water utilization system. This permit shall be effective from the date of issuance until February 28, 2008, shall void Permit No. WQ0021863 issued March 28, 2003 and shall be subject to the conditions and limitations as specified therein. Please pay particular attention to the monitoring requirements in this permit. Failure to establish an adequate system for collecting and maintaining the required operational information will result in future compliance problems. Attached to this permit is the master copy of the monitoring report form for bulk reclaimed water distribution that is required in Condition 111(5). In addition, please note that throughout this permit the reclaimed water distribution system and the bulk reclaimed water distribution program shall be referred to as the Apex Reclaimed Water Program. Unless otherwise noted, each condition shall apply to both reclaimed systems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699- 6714. Reclaimed water, following treatment and testing according to the most recent issuance of the Middle Creek Water Reclamation Facility's NPDES permit and compliance with the conditions provided herein, may be diverted to the permitted reclaimed water treatment, storage, and distribution facilities for the purpose of supplying a reclaimed water demand not to exceed a monthly average of 100,000 gallons per day (GPD) to commercial, industrial, and institutional users. The Apex Reclaimed Water Program shall consist of: the reclaimed water treatment and storage facilities at the Middle Creek Water Reclamation Facility consisting of the following components: a continuous turbidity monitoring and recording device at the existing sulfur building, a tablet chlorinator with solution tank and hypochlorite feed system, an effluent transfer pump station consisting of two (2) 350 gallon per minute (GPM) pumps operating at 25 feet total dynamic head (TDM with audible and visual high water alarms, onsite standby generator, a flow meter, a 100,000 gallon reclaimed water storage tank and all meters, valves, fittings, piping, instrumentation/control systems, electrical items and other related appurtenances required to make a complete and operational reclaimed water treatment and storage system, the reclaimed distribution facilities .consisting of the following components: a high service pump station consisting of two (2) 625 GPM pumps operating at 260 feet TDH with audible and visual high water alarms, a flow meter, approximately 9,626 linear feet of eight -inch diameter reclaimed water force main, a 100,000 gallon elevated reclaimed water storage tank and all meters, valves, fittings, piping, instrumentationicontrol systems, electrical items and other related appurtenances required to .make a complete and operational reclaimed water distribution and offshe storage system, and a bulk reclaimed water distribution program and all associated facilities at the Middle Creek Water Reclamation Facility (NPDES Permit No. NC0064050). Bulk reclaimed water, following treatment and testing according to the water reclamation facility's existing NPDES permit and the conditions provided herein, may be manually distributed from an eight -inch quick connect male coupling and gate valve tapped onto a proposed eight -inch reclaimed water line that serves the water reclamation facility. All reclaimed water distributed must be measured and recorded by a flaw -metering device. Bulk reclaimed water may only be distributed to approved trucks and drivers for the following uses: sewer line flushing, street sweeping, irrigation of landscapes not intended for human consumption, and construction uses such as soil compaction, dust control, and asphalt reclamation. The Apex Reclaimed Water Program shall be operated such that no discharge of wastes to surface waters occurs, pursuant to the application received September 23, 2002 and in conformity with the project plans, specifications, and other supporting data subsequently filed and approved by the Department of Environment and Natural Resources and considered a part of this permit. This permit shall be effective from the date of issuance until February 28, 2008, shall void Permit No. WQ0021863 issued March 28, 2003, and shall be subject to the following specified conditions and limitations: 1. PERFORMANCE STANDARDS Upon completion of construction and prior to operation of the Apex Reclaimed Water Program and all associated facilities, a certification shall be received from a North Carolina-]icenscd professional engineer certifying that the facilities have been installed in accordance with this permit, the approved plans and specifications, and other supporting materials. If this project is to be completed in phases and partially certified the Permittee shall retain the responsibility to track further construction approved under_ the same permit, and shall provide a final certificate of completion once the entire proiect has been completed. Mail the Certification to the NCDENR-DWQ, Non -Discharge Permitting Unit, 1617 Mail Service Center, Raleigh, NC 27699-1617_ 2. The Raleigh Regional Office, telephone number (919) 571-4700, shall be notified at least 48 hours in advance of operation of the Apex Reclaimed Water Program and all associated facilities so that an inspection of the facilities can be made and operation of the program may be observed. Such notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. The Apex Reclaimed Water Program shall be effectively maintained and operated at all times so that there is no discharge to the surface waters, nor any contamination of ground waters which will render them unsatisfactory for normal use. In the event that the program and/or facilities fail to perform satisfactorily, including the creation of nuisance conditions or failure of the application areas to adequately assimilate the wastewater, the Permittee shall take immediate corrective actions including those actions that may be required by the Division of Water Quality (Division), such as the construction of additional or replacement reclaimed water treatment facilities or cessation of the operation of the reclaimed water distribution system and/or bulk reclaimed water distribution program. 4. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or groundwaters resulting from the operation of the Apex Reclaimed Water Program and all associated facilities. 5. The Permittee shall maintain a Spill Prevention, Countermeasures, and Control Plan for the water reclamation facility, and the Apex Reclaimed Water Program. 6. Diversion or bypassing of the untreated wastewater from the Apex Reclaimed Water Program and all associated facilities shall be strictly prohibited. 7. The Compliance Boundary and Review Boundary, as defined in 15A NCAC 2H .0219 (k)(2)(B)(i)(IV), shall be located at the property line of any use area receiving reclaimed water for irrigation purposes through Apex Reclaimed Water Program and all associated facilities. Public access to the application sites and contact with reclaimed water shall be controlled during reclaimed water distribution and use. Such controls may include public meetings, publication of notices in Iocal newspapers, notification through television and radio news programs, as well as distribution of the bilingual educational flyers_ 9. The bulk reclaimed water distribution main isolation / operating valve shall be located below grade and shall be labeled as being of non -potable quality. The facilities shall be accessible and operated by authorized personnel only. Ip. The Perrrnittee shall approve all tank trucks for participation in the bulk reclaimed water distribution program prior to distribution of reclaimed water. Tank trucks shall meet the following minimum criteria: a. Tanis trucks and other equipment used to distribute reclaimed water shall be clearly identified with advisory signs. b. Tank trucks used to transport reclaimed water shall not be used to transport potable water that is used for drinking or other potable purposes. c. Tank trucks used to transport reclaimed water shall not be filled through on -board piping or removable hoses that may subsequently be used to fill tanks with water from a potable water supply. d. Tank trucks used to transport septage, raw wastewater, or wastewater residuals shall not be used to transport reclaimed water. IL The Permittee shall approve tank truck drivers for participation in the bulk reclaimed water distribution program prior to distribution of reclaimed water. In addition, the Permittee shall provide bilingual (English and Spanish) training to all tanker truck drivers approved to participate in the bulk reclaimed water distribution program at a regular frequency. These sessions shall provide training on, but not limited to, the following topics: a. Reclaimed water description and safety, b. Approved and disapproved uses of reclaimed water, c. Procedures for the application (including buffer maintenance), uses, and storage of reclaimed water as well as the disposal of unused reclaimed water, d. Procedures for spill prevention, countermeasures, and control as well as notification requirements, e. Personal safety and hygiene issues, and f. Interaction with the general public. 12. The following uses of reclaimed water shall be strictly forbidden by the Permittee: a. Irrigation of direct food crops, b. Filling of swimming pools, hot tubs, or similar uses, c_ Use as a raw potable water supply, and d. Use after 72 hours of storage (bulk reclaimed water only, i.e., not including time spent in storage at the Apex Reclaimed Water Facility or in the reclaimed water'distribution system). The following uses of reclaimed water distributed through the bulk reclaimed water distribution program shall be approved: a. Sewer line flushing, b. Street sweeping, c. Landscape irrigation, and d. Construction uses such as soil compaction, dust control, and asphalt reclamation. All other uses for bulk reclaimed water shall not be allowed by the Permittee. In the event there is a desire for the permitting of additional uses, a formal permit modification request must be submitted to the Division accompanied by an application fee and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 3 13. The following buffers shall be maintained during application of reclaimed water distributed through the bulk reclaimed water distribution Program: a. 100 feet between wetted areas and water supply wells, b. 10 feet between wetted areas and non -potable well, c. 100 feet between wetted areas and waters classified as SA including wetlands as delineated and designated by the appropriate state or federal agency, and d. 25 feet between wetted areas and surface waters not classified as SA including wetlands as delineated or designated by the appropriate state or federal agency or any swimming pool. 14. The Permittee shall maintain an active cross -connection control program for the Apex Reclaimed Water Program and all associated facilities that shall have the following minimum requirements: a. No direct cross -connections shall be allowed between the reclaimed water and potable water systems. b. A reduced pressure principle backflow preventer, an approved air gap separation, or other device approved by the Division of Environmental Health shall be installed at the potable water service connection to the use area where both reclaimed water and potable water are supplied to a reclaimed water use area. The installation of the reduced pressure principle backflow prevention device shall allow proper testing. c. An air gap separation, approved and regularly inspected by the Permittee shall be provided betweenthe potable water and reclaimed water systems where potable water is used to supplement a reclaimed water system. 15. The following shall be requirements for the Apex Reclaimed Water Program and all associated facilities: a. All reclaimed water valves, storage facilities, and outlets shall be tagged or labeled to warn the public or employees that the water is not intended for drinking. Where appropriate, such warning shall inform the public or employees to avoid contact with the water. b. All reclaimed water piping, valves, outlets, and other appurtenances shall be color -coded, taped, or otherwise marked to identify the source of the water as being reclaimed water. L All reclaimed water piping and appurtenances shall be either colored purple (i.e., Pantone 522) and embossed or integrally stamped or marked "CAUTION: RECLADVIRD WATER — DO NOT DRINK" or be installed with a purple (i.e., Pantone 522) identification tape or polyethylene vinyl wrap. The warning shall be stamped on opposite sides of the pipe and repeated every three feet or less. ii. Identification tape shall be at least three inches wide and have white or black lettering on purple (i.e., Pantone 522) field stating "CAUTION: RECLAIMED WATER — DO NOT DRINK." Identification tape shall be -installed on top of reclaimed water pipelines, fastened at least every 10 feet to each pipe length and run continuously the entire length of the pipe. c. All reclaimed water valves and outlets shall be of a type, or secured in a manner, that permits operation by authorized personnel only. d. Above -ground hose bibs (i.e., spigots or other hand -operated connections) shall not be present. Hose bibs shall be located in locked below -grade vaults that shall be clearly labeled as being of non -potable quality. As an alternative to the use of locked below -grade vaults with standard hose bibs services, hose bibs, which can only be operated by a special tool or connected to a special hose connection may be placed in non -lockable underground services boxes clearly labeled as non -potable water. 4 e. Where reclaimed water is being used in an industrial process inside a plant, any above ground or otherwise exposed valve or reuse water outlet shall be marked with a warning sign reading, "CAUTION: RECLAIMED WATER -DO NOT DRINK OR USE FOR PERSONAL HYGIENE. OPERATION ALLOWED BY AUTHORIZED PERSONNEL ONLY." Below grade access points shall conform to the requirements of Condition I.15.d. f. Where reclaimed water is being used in an industrial process inside a plant, marking shall not be required for existing piping that is encased within walls, or within or beneath concrete floor slabs, or that is within or beneath other forms of pavement. However, warning signs shall be placed at any locations where some future effort to excavate and tap an existing line could reasonably be anticipated. Piping plans maintained by the industry shall be marked to clearly designate all such lines as having been converted to reuse lines. In addition, at the point at which such lines are uncovered for purposes of severing the lines from the potable water system, the lines shall be either painted in Pantone 522 or marked with Pantone 522 colored identification tape, and shall be labeled as reclaimed water lines not to be connected to potable water lines. All new reclaimed water lines shall constructed so as to meet the requirements of Conditions I.15.b. i & ii. Exposed existing plant piping converted for use with reclaimed water shall be painted, wrapped or marked with tape so as to conform to Conditions I.15.b. i & ii. 16. The following facilities are approved to accept reclaimed water from the Apex reclaimed water . distribution system: Tumbleweed Pottery Potters Industries MC Precast Concrete Ready Mix Concrete Plant #6 Cooper Tools Lufkin Tipper Tie Apex Fire Department Wake County Public Division I I I School System * * The reclaimed water distribution system may be constructed for the Wake County Public School System, however, the school may not utilize the reclaimed water without approval from the Division. Additional facilities may only be added to the reclaimed water distribution system once they have been approved in a permit modification. II. OPERATION AND MAINTENANCE RE UIREMENTS 1. The Apex Reclaimed Water Program and all associated facilities shall be properly maintained and operated at all times. 2. Upon classification of the reclaimed water facility by the Water Pollution Control System Operators Certification Commission (WPCSOCC), the Permittee shall employ a certified wastewater treatment plant operator to be in responsible charge (ORC) of the reclaimed water treatment facilities. The operator must hold a certificate of the type and grade at least equivalent to or greater than the classification assigned to the wastewater treatment facilities by the WPCSOCC. The Permittee must also employ a certified back-up operator of the appropriate type and grade to comply with the conditions of 15A NCAC 8G .0202. The ORC of the facility must visit each Class I facility at least weekly and each Class II, III, and IV facility at least daily, excluding weekends and holidays, and must properly manage and document daily operation and maintenance of the facility and must comply with all other conditions of 15A NCAC SG .0202. The ORC of the reclaimed water facility shall be responsible for the operation of the bulk reclaimed water distribution program and facilities as well. A certified operator of a grade equivalent or greater than the water reclamation facility shall be available on -call 24 hours per day. 4. Reclaimed water from the Apex Reclaimed Water Program and all associated facilities shall not be used for Iand-based activities during inclement weather or when the ground is in a condition that will cause runoff from the location of application or point of use. 5. The Permittee shall implement adequate measures to prevent reclaimed water runoff from the application areas. 6. The Apex Reclaimed Water Program and all associated facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any reclaimed water resulting from the operation of the program and the facilities. 7. No type of reclaimed water other than that from Middle Creek Water Reclamation Facility (i.e., NPDES Permit No. NC0064050) shall be distributed through the Apex Reclaimed Water Program and all associated facilities. 8. All wastewater shall either be routed to the headworks of the reclaimed water facility or discharged in strict accordance with the conditions of the facility's existing NPDES permit should the limit for fecal coliform (daily maximum concentration of 25 per 100 ml) or turbidity (instantaneous maximum of 10 NTU) be exceeded, until such time that the levels have stabilized below these maximum levels. III. MONITORING AND REPORTING REQUIREMENTS 1. Any monitoring (including groundwater, surface water, soil or plant tissue analyses) deemed Necessary by the Division to ensure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed. 2. Daily maximum shall be the maximum value of all samples collected during the reporting period. Reclaimed water utilized during fire fighting events shall be excluded from the monthly average distributed flow. The reclaimed water delivered through the Apex Reclaimed Water Program and all associated facilities shall be monitored by the Permittee at points of use throughout the reclaimed water distribution system (i.e., permanently -used sampling points representative of the reclaimed water distributed to users that have been selected at the Permittee's discretion) for the following parameters: Parameter Sampling Point sampling Frequency Type of Sample Fecal Coliform Point of Use Nos. 1 and 2 Monthly Grab Residual Chlorine Point of Use Nos. 1 and 2 Monthly Grab Samples shall be taken from a minimum number of two points of use or the number of points of use equivalent to 25 percent of the number of service connections to the reclaimed water distribution system, whichever is Iess. In no case, however, shall less than two points of use be sampled for the purpose of complying with this condition. The Permittee shall maintain applications of all approved tank trucks and drivers on file for the duration, not less than one year, that the driver participates in the bulk reclaimed water distribution program. 4. Adequate records shall be maintained by the Permittee that tracks the amount of reclaimed water distributed. These records shall include, but are not necessarily limited to the following information: a. Date and time of distribution, b. Volume of reclaimed water distribution, c. Intended uses of reclaimed water, d. Locations of intended uses, e. Names and approval status of truck operators, f. Approval status of trucks, g. Compliance status of the water reclamation facility, and h. Weather conditions. 5. Three copies of all operation and distribution records [as specified in Condition 11I(4)] shall be submitted on the "Town of Apex Reclaimed Water Distribution Program Daily Monitoring Report" form attached to this permit and made a part thereof on or before the last day of the month following the month that was monitored. Three copies of all effluent monitoring data [as specified in Condition 111(2)] on Form NDMR-1 shall be submitted on or before the last day of the month following the month that was monitored. Noncompliance Notification: The Permittee shall report by telephone to the Raleigh Regional Office, telephone number (919) 571- 4700, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence at the water reclamation facility which results in the treatment of significant amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a sludge digester; the known passage of a slug of hazardous substance through the facility; or any other unusual circumstances. b. Any process unit failure, due to known or unknown reasons, that render the facility incapable of adequate wastewater treatment such as mechanical or electrical failures of pumps, aerators, compressors, etc. c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. d. Any spill or runoff of reclaimed water from the reclaimed water distribution system and all associated facilities. e. Any spill of reclaimed water from the bulk reclaimed water distribution facilities during filling, from tank trucks during transport, or from tank trucks during application. f: Any time that self -monitoring information indicates that the facility has gone out of compliance with its permit limitations. Persons reporting such occurrences by telephone. shall also file a written report in letter form within five days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. IV. INSPECTIONS 1. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to ensure proper operation and management of the reclaimed water distribution system an bulk reclaimed water distribution program and facilities. 2. The Permittee or his designee shall inspect the reclaimed water distribution system, reclaimed bulk water distribution program and facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall keep an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for a period of three years from the date of the inspection and shall be made available upon request to the Division or other permitting authority. 3. Any duly authorized officer, employee, or representative of the Division may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the reclaimed water distribution system, bulk reclaimed water distribution program or facilities at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records that must be maintained under the terms and conditions of this permit, and may obtain samples of groundwater, surface water, or leachate; and may interview commercial, and/or industrial users approved into this program- V. GENERAL CONDITIONS 1. This permit shall become voidable unless the bulk reclaimed water distribution program and facilities are constructed and operated in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or ;may not be approved. 4. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 5. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 6. The annual administering and compliance fee must be paid by the Permittee within thirty days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15 NCAC 2H .0205 (c)(4). 7. The Permittee, at least six months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if warranted, will extend the permit for such period of time and under such conditions and limitations as it may deem appropriate. 0 8. The Permittee, within twelve (12) months following issuance of this permit, shall request modification of NPDES Permit Number NC0064050 issued to the Middle Creels Water Reclamation Facility. The modification shall amend the existing NPDES permit to allow the conjunctive use of reclaimed water as provided for in this permit. 9.
