9. PROJECT DESCRIPTION
Land Management Group, Inc., on behalf of the County of Brunswick, has requested that the attached
application be processed under the Express Permit Review Program.
The subject property is located 2601 River Road (NC Highway 133), adjacent to Town Creek, in
Winnabow, Brunswick County. To access the project site from the Wilmington Regional office, turn left
onto Market Street (Hwy 17) from Cardinal Drive. Turn right onto Martin Luther King Boulevard (Hwy
74) and continue west merging right at the N. 3`d Street Bridge (Isabella Holmes Bridge). Turn left at the
intersection of the N. 3`d Street Bridge and Highway 421 and merge right on Highway 17 South.
Continue south along Highway 17, for approximately 1.5 miles, and turn left onto River Road (Highway
133 South) in Belville. The subject property will be located on the right hand side of the road,
approximately 7.1 miles from the intersection of Highway 133 and Highway 17, in Winnabow. Entry to
the property consists of a gated (yellow) dirt entrance drive that extends south to the shoreline of Town
Creek. In order to gain access to the property, anyone planning to make a site visit should contact
Michael Norton, with Compass Point Engineering at (910) 575-5872, at least 24 hours prior to
inspection. Once access to the property is gained, continue south along the entrance drive until you reach
the shoreline of Town Creek. The project area will be located immediately adjacent to the terminal end
of the road. The property is approximately 911 acres in size with approximately 16,000 linear feet of
water frontage. Elevation at the property varies from 0'-20' above normal high water. Residential,
commercial and rural agricultural properties border the site to the north, west and east and Town Creek
borders the property to the south. Overall, the property is densely vegetated and cut by a maze of dirt
logging roads. High ground/hard wood species include Live Oak (Quercus virginiana), Cypress (T.
distichum var. nutans), Long-leaf Pine (Pinus palustris), Sweet Gum (Liquidamber styraciflua)
Sycamore (Platanus occidentalis), Magnolia (Magnolia grandiflora) and Maple (Acer rubrum).
In 2004, the subject property was acquired by Brunswick County from the North Carolina Coastal Land
Trust (NCCLT). As part of the transaction, the NCCLT requested that all wetlands on the property
remain in conservation with the NCCLT. Currently, there are approximately 567 acres of wetlands on
the tract, consisting of mixed coastal and "404". According to correspondence between the NCCLT and
County of Brunswick, the NCCLT does not object to the proposed 0.08 acre wetland fill.
There is an existing 6' x 30' pier and 6' x 20' fixed platform located along the southern shoreline
bordering Town Creek. The pier originates from high ground, along the top of the bank, and extends
towards the south, terminating at the fixed platform. The existing platform is located over wetlands and
does not extend below the normal high water line. At this time, no improvements to this facility are
anticipated. There are no coastal wetlands in the vicinity of the existing pier and platform. All coastal
wetlands species are located west of the proposed kayak launch.
The waters of Town Creek, adjacent to the proposed project area, are classified "SC" by the Division of
Water Quality. This section of Town Creek is NOT designated as a Primary Nursery Area by the
Division of Marine Fisheries, and according to maps provided by Shellfish Sanitation, the area is
CLOSED to the harvesting of shellfish. Please note that this area is classified by the Division of Marine
Fisheries as "inland waters", and therefore the site is subject to the 30' Public Trust Area of
Environmental Concern (AEC).

PROPOSED PROJECT:
As proposed, the applicant is requesting approval to construct Phase I of the Brunswick Nature Park by
constructing an access road, gravel parking areas, picnic shelter, building (for public restrooms), a fixed
pier, floating dock and kayak launching pad/cradle.
Beginning at the intersection of the access road and River Road (Hwy 133), the applicant proposes to
construct a gravel access drive, approximately 24' wide by 4,800' long. The applicant indicates that
configuration of the access road has been designed to minimize any potential wetland impacts to the
maximum extent feasible. However, a small area comprising approximately 3,737 sq. ft. would be filled
in order to provide access to the facility from River Road. A 24" x 50' culvert would be installed, on
grade, beneath the road crossing in order to maintain adequate hydrology between the two wetland areas.
Beyond the culvert, the access road would extend toward the west and make a 90° turn at the restroom
facility, picnic shelter and parking area (additional parking would be located along the southern side of
the entrance road, approximately 1,700' from the property entrance). The restroom building (12' x 14'),
picnic and parking area would consist of a single story building; one 36' x 36' picnic shelter, multiple 4'
wide walking paths and two parking areas adjacent to the gravel turn around. The access road would
continue west and terminate in a turn-around cul-de-sac, or approximately 250' from the near shore edge
of Town Creek. A 10' wide by 280' long gravel path would extend from the proposed cul-de-sac, south
to the proposed 10' x 40' elevated wooden boardwalk. A gangway would straddle the Normal High
Water (NHW) line and provide access to the proposed 15' x 26' canoe/kayak launching platform. As
proposed, the canoe/kayak launch would consist of a 9' x 24' section of wood dock connected to a 6' x
24' canoe/kayak cradle. As proposed, the cradle would hold the canoe/kayak in place prior to, and during
launching.
As illustrated on the workplan drawings, the proposed pier and canoe/kayak launching facility would be
the only structures located within the 30' Public Trust Shoreline AEC. All remaining structures would be
located approximately 50' landward of the NHW line. A vast area of coastal and "404" wetlands is
located along the western side of the proposed launching facility, adjacent to Town Creek. Wetlands in
this area range from 60'-1,500' in width by 4,000' in length. The open water body of Town Creek, in the
immediate vicinity of the proposed project, averages approximately 100'. Water depths at the terminal
end of the proposed dock average approximately -14.0', relative to Normal Low Water (NLW).
As indicated in the application package, wastewater collection and treatment would be provided by an
on-site septic system. According to the applicant, they are currently in the process of receiving approval
to install the system. In addition, water would be supplied via and existing on-site shallow water well.
10. ANTICIPATED IMPACTS:
Phase I development (construction of access road, culvert installation/wetland crossing, bathroom facility,
picnic shelter, walking paths, parking and canoe/kayak launch) would result in the disturbance of
approximately 7.9 acres of high ground and approximately 3,737 sq. ft. of "404" wetland fill. Additionally,
the proposed pier and canoe/kayak launching facility would result in the incorporation of approximately 390
sq. ft. of public trust waters. Approximately 151,000 sq. ft. of impervious coverage (or 2.62% of the Phase I
development) is proposed, all of which would be located outside of the 30' Public Trust Shoreline AEC.
The applicant has submitted a Stormwater permit application (SW8090312), however a permit has not yet
been issued. The proposed development would not impact any Coastal Wetlands.

Purpose and Need:
The subject property is a 911-acre parcel owned by Brunswick County, NC, with planned development as a
public park. The property is situated on the western side of HWY 133 with its southern limit abutting more
than 16,000-Ift of shoreline along Town Creek. Specifically, this application contains Phase I of the park's
development which totals 132.35-acres in area and includes a public canoe and kayak dock on Town Creek.
The requested dock and associated features would provide public waterfront access to Town Creek.
Existinq Conditions:
The property is forested with existing dirt roads, logging roads which provide access to the adjacent property
to the west, and an existing fixed dock/viewing platform at the edge of Town Creek. Jurisdictional wetlands
have been delineated and were approved by the US Army Corps of Engineers on 8/10/2007 (Action ID
SAW-2001-1122). Of the 911-acre property, 567.66-acres are wetland. Wetland types on the property
range from flats in the northern portions of the property to freshwater swamp fringing Town Creek. All
wetlands on the property are held in conservation by the NC Coastal Land Trust.
Waters of Town Creek are classified as "inland waters" by the NC Marine Fisheries Commission (MFC) and
as "C, Sw waters" by the NC Environmental Management Commission (EMC). The property is zoned
"Conservation and Protection" by Brunswick County and the CAMA Land Use Plan classification is
"Conservation". Adjacent uses are forestry (to the west) and residential.
Proposed Development:
Phase I of development proposes: (1) a gravel access road (2) gravel parking (3) one picnic shelter (4) one
building with two public restrooms and (5) a fixed pier and a floating dock containing a canoe and kayak
cradle.
Development within CAMA Areas of Environmental Concern (AECs) is limited to the fixed wooden pier and
floating dock which are located within the 30' Public Trust Shoreline AEC and the Public Trust AEC. All
other development is located outside any AEC.
The majority of the proposed access road will be aligned along an existing dirt road to reduce new
impervious coverage. All road surfaces and parking will be gravel. Drivable portions of the road will end
approximately 250' inland of the proposed pier and dock. From that point, access to the dock will be
pedestrian only. The dock and pier are sited where an existing dirt ramp is currently located. There are no
"404 wetlands" or coastal marsh at this point on the shoreline. The elevated, wooden access pier will be
10'-wide to support handicap access which is necessary for public use. The floating dock will be 25'x 14.6',
of which the waterward 4' will be a boat cradle for canoe and kayak launching. Details of the launch portion
of the dock are included in the application figures. The dock will meet the'/4-width of the waterbody
limitation which is the most limiting factor. Town Creek is very deep, and depths at the end of the dock will
well exceed -5' normal low water (N LW).
Wetland Impacts, Avoidance and Minimization:
A minimal amount of wetland impact is requested for the road. As mentioned, an existing dirt road will be
improved, but this road does not extend all the way to HWY 133. In order to connect the road to HWY 133,
3,737-sft. of wetland impact is required. Another dirt road exists on the property which currently provides
access to HWY 133 through the northern end of the property. Utilizing this existing entrance off HWY 133

for access to Phase I of the park was not preferred for several reasons. the current entrance off HWY 133 Y='?/
occurs just pasta curve. Moving the entrance south where this curve doe not exi9fmik(e9if6ra;safer and
more usable entrance. Using the existing northern entrance would requir'ti?'tkavt¢1r(16fv rw
entire property to reach the southern property edge where the dock is proposed, Although there is an
existing dirt road along which much of that travel could occur, the road would have to be widened. Since the
northern half of the property is largely wetland, approximately 3,000-Ift of the road is abutted by wetland and
widening would create more wetland impact than the single proposed crossing. A northern entrance would
have also required much more road be improved and, therefore, the proposed road represents less new
disturbance and less new impervious cover. As mentioned, the adjacent property to the west is actively
used for forestry. Access into that property is currently through the Brunswick Nature Park property via the
existing northern road. While this use of the road exists, it is desirable to separate park traffic from forestry
traffic.
Wetland impacts could not be completely avoided given the way property lines intersect with HWY 133.
From the point at which the proposed road intersects HWY 133, the road curves south to avoid all other
wetland impacts and then joins the existing dirt road which also avoids any further wetland impact. The
entry off HWY 133 has been adjusted following initial comments from the US AOCE and NC DWQ to further
minimize wetland impacts. The road alignment at the crossing has been moved as far south as possible
and impacts were reduced from 4,154-sft. to 3,737-sft. The road itself could not be moved further south
because side slopes and grading along the road edge will extend to the property line. The total impact area
was moved as far south as possible without extending the grading onto the adjacent property.
No turn lane off HWY 133 is thought to be needed for this phase of development. It is possible that future
phases of development could require a turn lane be added. Funding for future phases of development is not
secured at this time, and it is unknown when such future development may take place. If future
development does require a turn lane, it is possible that the turn lane could be located completely within
HWY 133's existing right-of-way.
It is noted that the NC Coastal Land Trust has reviewed and approved the plan for Phase I of the park's
development. Although they hold the wetlands in conservation, the Land Trust has allowed for the minimal
impact necessary to develop the access road.
Concurrent Permit Applications:
A sedimentation and erosion control plan was submitted to the NC Land Quality on 6/16/09 for express
review. A low density stormwater management plan was submitted to the NC Division of Water Quality on
6/16/09 for express review. A driveway permit application is being also submitted to NC Division of
Transportation.

The property is owned by Brunswick County and will be a public park. The proposed dock will provide canoe and kayak
access to Town Creek as well as handicap access. Proposed road improvements will provide access to these water
dependent features. Proposed work outside the AEC will include road improvements, parking, a picnic shelter, and
bathrooms.

Standard construction equipment will be used such as dump trucks, back hoes, pile drivers, etc.
