Dear Ms. Burdette:
On June 29, 2009, at your request, Amy Chapman conducted an on-site determination to review three
stream features located on the subject property for applicability to the Neuse Buffer Rules (15A NCAC
213.0233).
Lauren Witherspoon from the Division of Water Quality (DWQ) Raleigh Regional Office had previously
conducted an on-site determination of the streams. In your letter dated May 7, 2009 to the Director
received by DWQ on May 7, 2009, you requested an appeal of her determinations as provided within 15A
NCAC 02B.0233(3)(a).
At your request, Amy Chapman conducted an appeal of Lauren Witherspoon's previous determinations as
stated above.
The features are labeled as "H", "Z" and "Z1" on the attached maps initialed by Amy Chapman on June
30, 2009. The Division of Water Quality (DWQ) has determined that the following:
Feature "H" is subject to the Neuse Buffer Rule from a point off the property and becomes
perennial at the flag labeled "761".
Feature "Z" labeled as flag "Z" is subject to the Neuse Buffer Rule at the flag labeled "Z". This
feature is intermittent.
• Feature "Z1" is not subject to the Neuse Buffer Rule.
The owner (or future owners) should notify the DWQ (and other relevant agencies) of this decision in any
future correspondences concerning this property.
This letter only addresses the applicability to the buffer rules and does not approve any activity within the
buffers. Nor does this letter approve any activity within Waters of the United States or Waters of the
State. If you have any additional questions or require additional information
