Box 33331 St. Paul, Minnesota 55133-3331 Subject: Modified Permit Number WQ0020808 3M Company Pittsboro, NC Plant Wastewater Treatment and Reclaimed Water Utilization Facilities Chatham County Dear Ms. Krueger; In accordance with your permit application received April 12, 2005, we are forwarding herewith Modified Permit No. WQ0020808, dated November 23, 2005, to 3M Company, Pittsboro, NC Plant for the construction and operation of the subject reclaimed water generation and utilization system. This permit shall be effective from the date of issuance until November 22, 2010, and shall be subject to the conditions and limitations as specified therein. Please pay particular attention to the monitoring requirements in this permit. Failure to establish an adequate system for collecting and maintaining the required operational information will result in future compliance problems. Also, mare note of this permit's expiration date and the fact that a permit renewal application is due to the Division of Water Quality (Division) no later than six months prior to that date (i.e., see Condition V1. 8.), as the Division does not send reminders to you to apply for permit renewal. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. Unless such demands are made this permit shall be final and binding. One (1) set of final approved plans and specifications is to be forwarded to you, one (1) set is being forwarded to your Engineer (A/E), and one (1) set retained for the Raleigh Regional Office. SRG NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES WASTEWATER TREATMENT and RECLAIMED WATER UTILIZATION PERMIT In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION IS HEREBY GRANTED TO 3M Company, Pittsboro, NC Plant Chatham County Construction and operation of a 300,000 GPD reclaimed water utilization system (reclaimed water received from the Town of Pittsboro WWTP Reclaimed Water Generation and Distribution System, permit WQ0024838), consisting of a flowmeter, and 6 -inch and 4 -inch piping internal to the 3M, Pittsboro, NC Plant, with the reclaimed water directed to two uses internal to the Plant: evaporative coolers and wetting of fines in the pug mill area, with no discharge of wastes to the surface waters, pursuant to the application received April 12, 2005, and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Environment and Natural Resources and considered a part of this permit. All piping for this reclaimed water utilization system shall be separate from the reclaimed water utilization system associated with the 5,900 gpd domestic wastewater treatment facility (see below), Continued operation of 5,900 -gallon per day wastewater treatment and reclaimed water utilization facilities to treat and use domestic wastewater generated by 3M Company's Pittsboro, NC Plant that is located at 4191 North Carolina Highway 87 in Moncure, North Carolina at an approximate latitude and longitude of 35°39'35" and 79°09'55", respectively. The wastewater treatment and reclaimed water utilization facilities shall be operated with no discharge of wastes to surface waters, and shall consist of the following minimum components: one equalization tank, approximately 10,500 gallons in capacity (i.e., 7,000 -gallon equalization chamber and 3,500- gallon ,500gallon influent pump chamber), with two 40 -gallon per minute wastewater transfer pumps; a meter to monitor and record influent wastewater flows continuously; a ZeeWeed°/ZenoGemo Wastewater Treatment System manufactured by Zenon Environmental, Inc. (Oakville, Ontario CANADA) consisting of a 3,000 -gallon aerobic reactor chamber, a 3,000 -gallon anoxic chamber 3M Company, Pittsboro, NC Plant Permit WQ0020808 November 23, 2005 Page 2 with pH adjustment system, and a filter chamber with two cassettes of immersible 0.1 -micron hollow fiber membranes for the bioreaction and subsequent filtration of the influent wastewater as well as a soak tank for the cleaning of the filter membrane cassettes; a sludge holding tank approximately 1,000 gallons in capacity; two 91 -cubic foot per minute blowers to provide aeration to the facilities; two 15 -gallon per minute pumps to convey permeate from the filter chamber to the backpulse system or the disinfection system; a backpulse system to effect periodic cleaning (i.e., backwashing) of the membrane filters and consisting of one 100 -gallon backpulse tank, two 30 - gallon per minute pumps, and a 15 -gallon hypochlorite tank as well as a 0.5 -gallon per minute metering pump to chlorinate the backpulse water; a disinfection system consisting of two ultraviolet disinfection units and two 15 -gallons per minute pumps to recirculate reclaimed water stored in the storage tank through the disinfectionn system; and a meter to continuously monitor and record turbidity of the wastewater effluent prior to being conveyed to the storage tank or the headworks of the facilities for retreatment. The reclaimed water utilization facility (for this internal domestic wastewater treatment facility) shall consist of the following minimum components: one storage tank approximately 32,000 gallons of capacity; two six-gallon per minute pumps to distribute reclaimed water to the pug mill area and/or evaporative coolers for use; and a meter to monitor and record reclaimed water use flows continuously. In addition to the above-described components, the combined wastewater treatment and reclaimed water utilization facilities shall be provided with all-weather access; fencing, signs, tags, labels, and other means to restrict access to the facilities; audible and visual alarms for each control panel; a system that continuously (i.e., while the Pittsboro, NC Plant is staffed and/or operational) monitors and records the status of the facilities' function, alarms, as well as commercial power availability; power reliability (i.e., standard response procedures, on-site response staff while the Pittsboro, NC Plant is staffed and/or operational, and a quick -connect receptacle for an on-site portable power generation unit); and all associated piping, valves, electrical and instrumentation/control systems, and other appurtenances required to make complete and functional wastewater treatment and reclaimed water utilization facilities. This permit shall be effective from the date of issuance until November 22, 2010, and shall be subject to the following specified conditions and limitations: I. PERFORMANCE STANDARDS Upon completion of construction and prior to operation of this permitted facility, a certification must be received from a professional engineer certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting materials. If this project is to be completed in phases and partially certified, you shall retain the responsibility to track further construction approved under the same permit, and shall provide a final certificate of completion once the entire project has been completed. The Raleigh Regional Office, telephone No. (919) 791-4200, shall be notified at least forty-eight (48) hours in advance of operation of the installed facilities so that an in-place inspection can be made. Such notification to the regional supervisor shall be made during normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. 3. The 3M Company, Pittsboro, NC Plant is authorized to utilize reclaimed water from the following facilities: Reclaimed Water Generating Facility County Permit Maximum Flown Number ( d) 3M Cam an , Pittsboro, NC Plant Chatham WQ0020808 5,900 Town of Pittsboro WWTP Chatham WQ0024838 300,000 Should reclaimed water quality result in non-compliance with reclaimed water utilization requirements, then the 3M Company shall take corrective actions to identity which source of reclaimed water is non-compliant, then either restore and/or improve the quality of the its generated reclaimed water at its own internal domestic wastewater treatment facility (Permit WQ0020808), or contact the Town of Pittsboro to initiate restoration of the reclaimed water generated at the Town of Pittsboro WWTP (Permit WQ0024838). 4. A temporary variance from 15A NCAC 2H.0219 (k)(1)(A)(viii) has been granted for these wastewater treatment and reclaimed water utilization facilities in that an automatically -activated stand-by power generation source shall not be required for construction and operation at this time. The granting of this temporary variance is dependent upon the Permittee installing a system that continuously (i.e., while the Pittsboro, NC Plant is staffed and operational) monitors and records the status of the facilities' function, alarms, as well as commercial power availability; installing a quick -connect receptacle; maintaining a portable power generation unit of sufficient size to operate all essential units at the facilities on site at all times; maintaining on- site response staff while the Pittsboro, NC Plant is staffed and/or operational; and developing and implementing standard procedures to respond to a loss in commercial power. The extension of this temporary variance shall be reevaluated at the time of permit renewal (i.e., see Condition VI. 8.) for continued applicability to these facilities. At that time, data regarding the date, time, and duration of any power interruptions at the facilities as well as the correlation of this data to any performance or operational problems at these facilities (i.e., including spills and overflows) shall be provided to the Division for review. This temporary variance shall be considered to be revoked at any time that the Division notifies the Permittee that the absence of the automatically -activated stand-by power generation source at the facilities has been detrimental to water quality or public health. Within 90 days of this notification, the Permittee shall formally apply for a permit modification to allow for the construction and operation of an appropriately- 3M Company, Pittsboro, NC Plant Permit WQ0020808 November 23, 2005 Page 4 designed automatically -activated stand-by power source at the facilities. The automatically -activated stand-by power source shall be installed and made operational within 30 days of receipt of the modified permit from the Division. 5. A variance from 15A NCAC 2H .0219 (k)(1)(A)(v) has been granted for these wastewater treatment and reclaimed water utilization facilities in that a five-day side -stream detention pond/tank shall not be required for construction and operation at this time. The granting of this temporary variance is dependent upon the Permittee making provisions to route all wastewater effluent that does not meet the reclaimed water quality limits (i.e., see Condition II. 6.) to the equalization tank of the wastewater treatment facilities automatically for retreatment. In addition, the Permittee shall ensure that the installed monitoring system monitors for such non- compliant reclaimed water generation events. The extension of this variance shall be reevaluated at the time of permit renewal (i.e., see Condition VI. 8.) for continued applicability to these facilities. At that time, data regarding the date, time, and duration of any non-compliant reclaimed water generation events at the facilities as well as the correlation of this data to any performance or operational problems at these facilities (i.e., including spills and overflows) shall be provided to the Division for review. This variance shall be considered to be revoked at any time that the Division notifies the Permittee that the absence of the five-day side - stream detention pond/tank at the facilities has been detrimental to water quality or public health. Within 90 days of any of this occurrence, Permittee shall formally apply for a permit modification to allow for the construction and operation of an appropriately -designed five-day side -stream detention pond/tank at the facilities. The five-day side -stream detention pond/tank shall be installed and made operational within 30 days of receipt of the modified permit from the Division. 6. The wastewater treatment and reclaimed water utilization facilities shall be effectively maintained and operated at all times so that there is no discharge to the surface waters, nor any contamination of ground waters, which will render them unsatisfactory for normal use. In the event that the facility fails to perform satisfactorily, including the creation of nuisance conditions or failure of the irrigation area to adequately assimilate the wastewater, the Permittee shall take immediate corrective actions including those actions that may be required by the Division of Water Quality (Division), such as the construction of additional or replacement treatment and disposal facilities. 7. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface waters or groundwater resulting from the operation of the wastewater treatment and reclaimed water utilization facilities. 8. The Permittee shall maintain a spill prevention, countermeasures, and control plan for the wastewater treatment and reclaimed water facilities. 3M Company, Pittsboro, NC Plant Permit WQ0020808 November 23, 2005 Page 5 9. Diversion or bypassing of untreated or treated wastewater/reclaimed water from the wastewater treatment and/or the reclaimed water utilization facilities shall be strictly prohibited. 10. The residuals generated from these treatment facilities must be disposed of in accordance with General Statute 143-215.1 and in a manner approved by the North Carolina Division of Water Quality. 11. The following buffers shall be, maintained: a. 50 feet between wastewater treatment units and any property line; b. 100 feet between wastewater treatment units and any private or public water supply source (i.e., including wells); and C. 50 feet between the reclaimed water storage tank and any property line. 12. All reclaimed water valves, storage facilities, outlets shall be tagged or labeled to warn the public or employees that the water is not intended for drinking_ Where appropriate, such warning shall inform the public or employees to avoid contact with the water. 13. All reclaimed water piping, valves, outlets and other appurtenances shall be color -coded, taped, or otherwise marked to identify the source of the water as being reclaimed water. a. All reclaimed water piping and appurtenances shall be either colored purple (i.e., Pantone 522) and embossed or integrally stamped or marked "CAUTION: RECLAIMED WATER DO NOT DRINK" or be installed with a purple (i.e., Pantone 522) identification tape or polyethylene vinyl wrap. The warning shall be stamped on opposite sides of the pipe and repeated every three feet or less. b. Identification tape shall be at least three inches wide and have white or black lettering on purple (i.e., Pantone 522) field stating "CAUTION: RECLAIMED WATER DO NOT DRINK." Identification tape shall be installed on top of reclaimed water pipelines, fastened at least every 10 feet to each pipe length and run continuously the entire length of the pipe. C, Existing underground distribution systems retrofitted for the purpose of distributing reclaimed water shall be taped or otherwise identified as in items a. or b. above. This identification need not extend the entire length of the distribution system but shall be incorporated within 10 feet of crossing any potable water supply line or sanitary sewer line. 14. All reclaimed water valves and outlets shall be of a type, or secured in a manner, that permits operation by authorized personnel only. 3M Company, Pittsboro, NC Plant Permit WQ0020808 November 23, 2005 Page 6 15. Above -ground hose bibs (i.e., spigots or other hand -operated connections) shall not be present. Hose bibs shall be located in locked below -grade vaults that shall be clearly labeled as being of non -potable quality. As an alternative to the use of locked below -grade vaults with standard hose bibs services, hose bibs, which can only be operated by a special tool may be placed in non -lockable underground services boxes clearly labeled as non -potable water. 16. The Permittee shall maintain an active cross -connection control program that shall have the following minimum requirements: a. No direct cross -connections shall be allowed between the reclaimed water and potable water systems. b. A reduced pressure principle backflow preventer, an approved air gap separation, or other device approved by the Division of Environmental Health shall be installed at the potable water service connection to the use area where both reclaimed water and potable water are supplied to a reclaimed water use area. The installation of the reduced pressure principle backflow prevention device shall allow proper testing. C. An air gap separation, approved and regularly inspected by the potable water supplier, shall be provided between the potable water and reclaimed water systems where potable water is used to supplement a reclaimed water system. 17. The following uses of the reclaimed water are approved: a_ Dust suppression in the pug mill area. b_ Cooling water in the evaporative coolers. All other uses for reclaimed water shall not be allowed by the Permittee. In the event there is a desire for the permitting of additional uses, a formal permit modification request shall be submitted to the Division accompanied by an application fee and other supporting materials as may be appropriate. The approval of this request shall be considered on its merits and may or may not be approved. 18. Public access to the reclaimed water utilization facilities and contact with reclaimed water shall be controlled during active use. Such controls may include the posting of signs that describe the activities being conducted at the facilities. Signs shall state that reclaimed water is utilized and provide subsequent guidance about avoidance of contact with the reclaimed water, the fact that the reclaimed water is not intended for drinking, etc. 3M Company, Pittsboro, NC Plant Permit WQ0020808 November 23, 2005 Page 7 19. The Permittee shall develop, implement, and maintain an on-going, comprehensive educational program for its employees and contractors regarding the wastewater treatment and reclaimed water facilities. Educational programming and materials may be in the form of formal training sessions, safety meetings, as well as the distribution of flyers or any combination thereof. The following is a non-inclusive list of topics that may be included in educational programming and materials: a. Reclaimed water description and safety; b. Approved and disapproved uses of reclaimed water; C. Procedures for spill prevention, control, and notification requirements; d. Personal safety and hygiene issues; e. Description of labeling requirements and security measures (i.e., special hose fittings, locked valve boxes, special pipe color, etc.); and f. Cross -connection control program description. II. OPERATION AND MAINTENANCE REQUIREMENTS The wastewater treatment and reclaimed water utilization facilities shall be properly maintained and operated at all times. 2. Upon classification of the wastewater treatment and reclaimed water utilization facilities by the Water Pollution Control System Operators Certification Commission (WPCSOCC), the Permittee shall designate and employ a certified operator to be in responsible charge (ORC) and one or more certified operator(s) to be back-up ORC(s) of the facilities in accordance with 15A NCAC 8G.0201. The ORC shall visit the facilities in accordance with 15A NCAC 8G .0204 or as specified in this permit and shall comply with all other conditions specified in these rules. 3. The Permittee shall install all appropriate flow measurement devices consistent with approved engineering and scientific practices to ensure accuracy and reliability of influent flow measurement. Flow measurement devices selected shall be capable of measuring flows with a maximum deviation: of less than 10 percent from true flow, accurately calibrated at a minimum of once per year, and maintained to ensure that the accuracy of the measurement is consistent with the accepted capacity of that type of device. Records of flow measurement device calibrations shall be kept on file by the Permittee for a period of at least three years. At a minimum, data to be included in this documentation shall be: a. Date of flow measurement device calibration. b. Name of person performing calibration. C. Percent from true flow. 4. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater, treated or untreated, resulting from the operation of these facility. 3M Company, Pittsboro, NC Plant Permit WQ0020808 November 23, 2005 Page 8 5. As an indicator of proper operation and maintenance, the domestic 5,900 gpd wastewater treatment facility shall produce a wastewater effluent/reclaimed water in compliance with the following limitations: Parameter Monthly Average a vera e$ Dail Instantaneous Maximum" Flow 0.0059 MGD Ammonia as Nitrogen 4 mg/L 6 mg/L BODS (5 -day, 20°C) 10 mg/L 15 mg/L Fecal Coliform 14 per 100 mL 25 per 100 mL Total Suspended Solids 5 mg/L 10 mg/L Turbidity 10 NTU pH shall not be less than 6.0 standard units nor greater than 9.0 standard units. u Monthly averages for all parameters except fecal coliform shall be the arithmetic mean of all samples collected during the reporting period. The monthly average for fecal coliform shall be the geometric mean of all samples collected during the reporting period. The daily maximum shall be the maximum value of all samples collected during the reporting period. 6. All wastewater shall be routed to the equalization tank of the wastewater treatment facilities for retreatment should the limit for fecal coliform or turbidity, as established in Condition 11. 5., be exceeded following treatment in the wastewater treatment facilities. Wastewater shall be diverted to this tank until such time that the problems associated with the treatment capability of the wastewater treatment facilities have been corrected and the limits are no longer exceeded. 7. No type of reclaimed water other than that from 3M Company's Pittsboro, NC Plant and the Town of Pittsboro's wastewater treatment plant shall be used in the reclaimed water utilization facility. III. MONITORING AND REPORTING _REQUIREMENTS 1. Any monitoring (including groundwater, surface water, soil or plant tissue analyses) deemed necessary by the Division to insure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed. 3M Company, Pittsboro, NC Plant Permit WQ0020808 November 23, 2005 Page 9 2. The reclaimed water generated by the 3M Company, Pittsboro, NC Plant domestic 5,900 gpd wastewater treatment facility shall be monitored by the Permittee at the specified sampling points for the following parameters, and recorded on Form NDMR- l : 3. A log of all maintenance activities performed at the wastewater treatment and reclaimed water utilization facilities shall be kept. This log shall include, but shall not be limited to, the following items: a. Daily sampling results including pH, settleable matter, and dissolved oxygen in the aeration tank. b. Visual observations of the wastewater treatment and reclaimed water utilization facilities. C, Record of all preventative maintenance (e.g., changing of filters, adjusting belt tensions, alarm testing, diffuser inspections and cleanings, membrane cleaning, etc.). d. Date of calibration of the flow measurement device(s). e. Date of calibration of the turbidity device. f. Date and volume of residuals removed from the wastewater treatment facilities, including the name of the hauling firm as well as a permit authorizing the disposal or a letter from the entity agreeing to accept the residuals. 4. Adequate records shall be maintained by the Permittee to track the amount of reclaimed water used in the reclaimed water utilization facilities. These records shall include, but shall not necessarily be limited to, the following items: a. Date of use; b. Volume of reclaimed water used; C. Location of reclaimed water use; and d. III. 2.) on Form. NDMR-1 shall be submitted monthly on or before the last day of the following month. All information shall be submitted to the following address: NC DENR/DWQ Information Processing Center 1617 Mail Service Center Raleigh, North Carolina 27699-1617 6. Noncompliance Notification: The Permittee shall report by telephone to the Raleigh Regional Office, telephone number (919) 791-4200, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence at the wastewater treatment facility which results in the treatment of significant amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a sludge digester; the known passage of a slug of hazardous substance through the facility; or any other unusual circumstances. b. Any process unit failure, due to known or unknown reasons, that render the facility incapable of adequate wastewater treatment such as mechanical or electrical failures of pumps, aerators, compressors, etc. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. d. Any time that self-monitoring information indicates that the facility has gone out of compliance with its permit limitations. Occurrences outside normal business hours may also be reported to the Division's Emergency Response personnel at telephone number (800) 662-7956, (800) 858- 0368, or (919) 733-3300. Persons reporting such occurrences by telephone shall also file a written report in letter form within five (5) days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. IV. GROUNDWATER REQUIREMENTS 1. The compliance boundary and review boundary for wastewater disposal systems are specified by 15A NCAC 2L. For systems utilizing reclaimed water, 15A NCAC 2H .0219(k) specifies that both the compliance boundary and review boundary shall be 3M Company, Pittsboro, NC Plant Permit WQ0020808 November 23, 2005 Page 11 established at the property line. An exceedance of groundwater quality standards at or beyond the compliance boundary is subject to immediate remediation action in addition to the penalty provisions under North Carolina General Statute 143-215.6A(a)(1). 2. Any groundwater quality monitoring, as deemed necessary by the Division, shall be provided. V. INSPECTIONS 1. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. 2. The Permittee or his designee shall inspect the wastewater treatment and reclaimed water utilization facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall keep an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for a period of three years from the date of the inspection and shall be made available upon request to the Division or other permitting authority. 3. Any duly authorized officer, employee, or representative of the Division may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the disposal site or facility at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records that must be maintained under the terms and conditions of this permit, and may obtain samples of groundwater, surface water, or leachate. VI. GENERAL CONDITIONS This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. A set of approved plans and specifications as well as the approved as -built plans for the wastewater treatment and reclaimed water utilization facilities shall be retained by the Pennittee for the life of the project. 4. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit 3M Company, Pittsboro, NC Plant Permit WQ0020808 November 23, 2005 Page 12 request must be submitted to the Division accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 5. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 6. The issuance of this permit does not exempt the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction, including but not limited to applicable river buffer rules in 15A NCAC 2B .0200, erosion and sedimentation control requirements in 15A NCAC Chapter 4 and under the Division's General Permit NCGO10000, and any requirements pertaining to wetlands under 15A NCAC 2B .0200 and 2H .0500. 7. The annual administration and compliance fee must be paid by the Permittee within thirty (30) days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15A NCAC 21-1.0205 (c)(4). The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Division will review the adequacy of the facilities described therein, and if warranted, will extend the permit for such period of time and under such conditions and limitations as it may deem appropriate_ 9. This reclaimed water utilization permit shall become voidable unless the agreement between the 3M Company and the Town. of Pittsboro for the provision of reclaimed water is in full force and effect.
