This permit is being issued to modify the Groundwater Monitoring Conditions in Section 1V. This permit shall be effective from the date of issuance until May 31, 2007, shall hereby void Permit Number WQ0020122 issued June 7, 2002, and shall be subject to the conditions and limitations as specified therein. Please pay particular attention to the monitoring requirements in this permit Failure to establish an adequate system for collecting and mailntaining the required operational information will .result in future compliance problems. ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT' OF ENVIRONMENT AND NATURAL RESOURCES RALEIGH RECYCLE SYSTEM PERMIT In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION 1S HEREBY GRANTED TO Lampe & Malphrus Lumber Company Johnston County WOMB .construction .and -operation of a 120,000 GPD wastewater recycle system consisting of a bark screen., a 34, 410 gallon-sedimcntation basin, a 374,024 gallon water supply reservoir (recycle pond),.and-all pumps, controls, and irrigation equipment to serve the log wet deck area with. recycle wastewater to serve Peedin Road Lag Yard with no discharge of wastes to the surface waters, pursuant to the application received Tune 17, 2002, _ and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Environment and Natural Resources and considered a part of this permit. This permit shall be effective from the date of issuance until May 31, 2007, and shall be subject to the following specified conditions and limitations: I. PERFORMANCE STANDARDS 1. Upon completion of construction and prior to operation of this. permitted facility, a certification must be received $om a professional engineer certifying that the permitted facility his been installed in accordance with this permit, the approved plans and specifications, and other supporting materials. If this project is to be. completed in phases and partiall,� fled, you shall retain the gyres nsibility to track further construction approved under the same rmi and shall pvide a final certifcate of completion once the entirero ect has been cmpleted_ Mail the Certification to the Non -Discharge Permitting Unit, Division of Water Quality, 1617 Mail Service Center, Raleigh, NC 27699-1617. 2. The Raleigh Regional Office, telephone number (919) 571-4700, shall be in advance of operation of the installed facilities so that an in place inspection can be made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays_ 7-15-02;10=30AM;LAMPE & MALPHRUS 919 934 0134 * 4/ 10 3. The recycle facilities shall be effectively maintained and operated at all times so that there is no di barge to the surface waters, nor any contamination of ground waters which will render them satisfactory for normal use. in the event that the facilities fail to perform satisfactorily, including the creation, of nuisance conditions or failure of the collection or recycle system to adequately accomodate the wastewater, the Permittee shall take immediate: corrective actions including those actions that may be required by the Division of Water Quality (Division), such as the construction of additional or replacement wastewater treatment and disposal facilities. 4. /,The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or oundwaters resulting from the operation of this facility. 5. a residuals generated from these treatment facilities roust be disposed in accordance with General Statute 143-215.1 and in a manner approved by the Division. b. W ewater may be utilized for dust control throughout the Peedin Log Yard facilities. Equipment for this purpose shall be clearly labeled as recycled wastewater, not for potable use. Signs or other educational material must be provided for the purposes .of notifying employees of the use of recycled wastewater for dust control. 7. Wvversjon or bypassing of the untreated wastewater from the treatment facilities is prohibited 8. following buffers shall be maintained: l00 feet between wastewater tream0ent units and wells, and b} SO feet between wastewater treatment units and property lines_ II. OPERATION AND MAINTENANCE REQUIREMENTS 1_ T facilities shall be properly maintained and operated at all times. 2. Upon classification of the facility by the Water Pollution. Control System Operators Certification Commissi (WPCSOCC), the Permittee shall employ a certified wastewater treatment plant operator to be i sponsible charge (ORC) of the wastewater treatment facilities. The operator must hold a certif to of the typo and grads at least equivalent to or greater than the classification assigned to the w water treatment facilities by the WPCSOCC. The Permittee must also employ a certified back u operator of the appropriate type and grade to comply with the conditions of 15A NCAC 8G .02(M e ORC of the facility mast visit each Class I facility at least weekly and each Class II, III, and IV facility at least daily, excluding weekends and holidays, and must properly manage and. document daily operation and maintenance of the- facility and must comply with all -other conditions of 15A NCAC 8G _0202. Freeboardhn the water supply reservoir shall not be Iess than four feet at any time. This freeboard is necess;r to manage the accumulation in the lagoon during storm events equal or greater than a 25- year, 2411 our storm. 7. A waste-lev gauge, to monitor waste levels in the storage pond, shall b, installed within 30 days of issuance of this permit. This gauge shall have readily visible permanent markings indicating the maximum 'quid level at the top of the temporary liquid storage volume, minimum liquid level at the bodom o the temporary liquid storage volume, and top of the dam elevations. Caution must be taken not to I ge the integrity of the liner when installing the gauge. M. MONITORING AND REPORTING REOUIREMENTS 1. Any /blebsampling ning (including groundwater, surface water, soil or plant tissue analyses) deemed . necesthe Division to insure stuface and ground water protection will be established and an accep reporting schedule shall be foRowed. 2. Adequate records shall be maintained by the Permittee tracking the amount of wastewater utilized for dust con"l. These records shall include, but are not necessarily limited to, the following a. dple of use, -. b. Xolume of wastewater utilized, and c. location of facilities wastewater was utilized 3. Noncompliance Notification: The Pertnittee shall report by telephone to the Raleigh Regional Office, telephone number (919) 571- 4700, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence at the wastewater treatment facility which results in the treatment of significant amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a basin or tank, the known passage of a slug of hazardous substance through the facility, or any other unusual circumstances; b. Any process unit failure, due to known or unknown reasons; that renders the facility incapable of adequate wastewater treatment, such as mechanical or electrical failures of pumps, aerators, compressors, etc.; c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility; or d. Any time that self -monitoring information indicates that the facility is not in compliance with its permit limitations. Persons reporting such occurrences by telephone shall also file a written report in letter form within five (5) days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. 3 7-15-02;10:30AM;LAWIE & MALPHRUS ;919 934 0134 # 6/ 10 IV. GROUNDWATER RE UIItEMENTS Within ninety (90) days of pernut issuance, two monitor wells shall be installed to monitor groundwater quality. The weII(s) shall be constructed such that the water level in the well is never above or below the screened (open) portion of the well at any time during the year. The general location and name for each well is marked on Figure 3. Each monitoring well shall be located at the Review boundary, constructed in accordance with this permit, and approved by the Raleigh Regional Office. 2. The well(s) must be constructed by either a North Carolina Certified Well Contractor, the property owner, or the property lessee according to General Statutes 87-98.4(bx2). if the construction is not performed by a certified well contractor, the property owner or lessee must physically perform the actual well conshuction activities, and the well(s) must be constructed according to the North ,. Carolina Well Construction Standards (15A NCAC ZC .0108) and the local county rules. 3. Within sixty (60) days of permit issuance, the three water supply wells shall be permanently abandoned and a new water supply established by either a new deep well outside of the Compliance Boundary or a hook -tip to the public water line. Within thirty (30) days of abandonment, a Well Abandonment Record (GW-30 form) shall be completed and mailed to the address listed in the "Reporting / Documentation" section of the Groundwater Requiremats. The well(s) must be abandoned by either a North Carolina Certified Well Contractor, the property owner, or the property lessee according to General Statutes 87-98.4(b)(2). If the abandonment is not performed by a certified well contractor, the property owner or lessee must physically perform the actual well abandonment. activities and the well(s) must be abandoned according to the North Carolina Well Construction Standards (15A NCAC 2C .0113) and local county Hiles. 4.. The water supply well situated approximately 155 feet east of the water supply reservoir (see Fi&m 3) shall be labeled as "Non -potable" and shall be used, exclusively for wet decking and dust control purposes. The well shall have visible precautions/labels at the well source and at all distribution points/spigots. The warning label(s) shall state, "Not for human consumption", and shall state the precautions if there is a potential for contact with human skin. 5. The Raleigh Regional Office, telephone number (919) 5714700, shall be notified at least forty-eight (48) hours prior to the construction of any monitoring well so that an inspection can be made of the monitoring well location. Such notification to the regional groundwater supervisor shall be made dotting the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding state holidays. 6. Within thirty (30) days of completion of all well construction activities, a certification must be received from a professional engineer or a licensed geologist certifying that thefmonitoring wells are located according to this permit. 7. Monitoring wells MW-1 and MW-2 shall be sampled 'initially after construction and thereafter every March, July and November for the parameters listed below. Prior to sampling the parameters, the measurement of water levels must be taken. The depth to water in each well shall be measured from the surveyed point on the top of the casing. The measuring points (top of well casing) of all monitoring wells shall be surveyed relative to a common datum. Water Level pH Phenols COD TDS Chlorides Any laboratory selected to analyze parameters must be Division of Water Quality (DWQ) certified for those parameters required. 4 7-15-02;10:30AM;LAMPE & MALPHRUS ;919 9S4 0124 # 7/ 10 9. Within sixty (60) days of permit issuance, the water supply well situated approximately 155 feet east of the water supply reservoir shall be sampled for the following parameters: Water Level pH Phenols COD TDS Chlorides Volatile Organic Compounds by Standard Method 6230D The water supply well shall also be sampled prior to permit renewal, and the results submitted on or before the last working day of the mouth following the sampling month. For Volatile Organic Compounds (VOCs) use only Standard Method 6230D. Any constituents detected above the Method Detection Limit but below the PQL of 0.5 }rg/L must be qualified (estimated) and reported. 10. All reports and documentation (GW-1, GW-30, GW-59) shall be mailed to the following address: Groundwater Section Permits and Compliance Unit 1636 Mail Service Center Raleigh., NC Z7699-1636 Updated -blank forces (GW-1, GW-30 GW-59) may be downloaded from the Groundwater Section's website at bft./1gW.ebnr.state.nc.us/ or requested from the address mentioned.above. 11. For the initial sampling -of the -well(s), the permittee shall - submit a. copy of the GW-1 Form (Well Construction Record) with the Compliance Monitoring Form (GW-59) for each well to the address listed in the "Reporting / Documentation" section of the Groundwater Requirements. Initial Compliance Monitoring Forms that do not include copies of the GW-1 force may be returned to the petmittee without being processed. Failure to submit these forms as required by this permit may result in the initiation of enforcement activities pursuant to NC General Statutes 143-215.6A. 12. The results of the sampling and analysis must be received on Form GW-59 (Groundwater Quality Monitoring Compliance Report Form) by the Groundwater Section (address listed in the "Reporting / Documentation," section of the Groundwater Requirements), on or before the last working day of the month following the sampling month. The data of all groundwater sampling analyses required by the permit conditions must be reported using the most recent GW-59 form along with attached copies of the laboratory analyses. 13. Within sixty (60) days of completion of all monitoring well(s), the permittee. shall submit two original copies of a scaled site map (scale no greater than 1"=100'); however, special provisions may be granted upon prior approval for large properties. The map(s) trust include the following information: 1. The location and identity of each monitoring well. 2_ The location of major components of the waste disposal system. 3. The location of property boundaries within 500 feet of the disposal area(s). 4. The latitude and longitude of the established horizontal control monument. 5. The elevation of the top of the well casing (which shall be known as the "measuring paint") relative to a common datuns. 6. The depth of water below the measuring point at the time the .measuring point is established. 7. The location of Review and Compliance boundaries. 8. The date the neap is prepared and/or revised. 5 7-1 5-02 ; 1 0 = 30AM; LAMPE & MALPHRUS ; 91 9 934 0134 # 8/ 10 Control monuments shall be installed in such a manner and made of such materials that the monument will not be destroyed due to activities that may take place on the property. Maps and any supporting documentation shall be sent to the Groundwater Section as addressed in the "Reporting Documentation" above. The permittee is responsible far the geographic accuracy of arty map submitted, however produced 14. The COMPLIANCE BOUNDARY for the disposal system is specified by regulations in 15A NCAC .2L. Groundwater Classifications and Standards. The Compliance Boundary for the disposal system individually permitted on or after December 30, 1983 is established at either 250 feet from the waste disposal area, or 50 feet within the property boundary, whichever is closest to the waste disposal area. An exceedance of Groundwater Quality Standards at or beyond the Compliance Boundary is subject to inunediate remediation action according to 15A NCAC 2L A106(d)(2). 15. The REVIEW BOUNDARY is established around the disposal systems midway between the Compliance Boundary and the -perimeter -of the waste disposal area -Any exoeedance of standards at the Review Boundary shall require action in accordance with 15A NCAC 2L .0106(d)(1). 16. In the event that the sampling of either of the two new monitor wells (MW-1 or MW 2) or the non - potable water supply well situated approximately 155 feet east of the water supply reservoir indicates analyte concentrations above the Groundwater Quality Standards (15A NCAC 2L .0202), the non - potable, water supply well shall be pemmnently abandoned and a new water supply established by either a new deep well outside of the Compliance Boundary or a hook-up to the public water line. , 17. Any additional groundwater duality monitoring, as deemed necessary by tllc Di-Asion, shall be provided. V. INSPECTIONS 1. Adequate inspection, maintenance, and cleaning shall be provided by the Perniittee to insure proper operation of the subject facilities. 2. The Pern ittee or his designee shall inspect the wastewater treatment and disposal facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance_ The Permittee shall keep an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs; or corrective actions taken by the Permittee. This log of inspections shall maintained aintained by the Permitteo for a period of three years from the date of the inspection and shall be made available upon request to the Division or other permitting authority. 3. Any duly authorized officer, employee, or representative of the Division may, upon presentation of credentials, enter and inspect any property, premises or place on or related to. the disposal site or facility at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records that roust be maintained under the terms and conditions of this permit, and may obtain samples of groundwater, surface water, or leachate. VI. GENERAL CONDITIONS 1. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 7-15-02;10:30AM;LAMPE & MALPHRUS ;919 934 0134 # 9/ to 3. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a .formal permit request must be submitted to the Division accompanied by an application fee, documentation from, the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 4. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statute 143- 215.6A to 143-215.6C. 5. The issuance of this permit does not exempt the Permittee from cornplying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal)• which have jurisdiction, including but not limited to applicable river buffer rules in 15A NCAC 2B .0200, erosion and sedimentation control requiretnents in 15A NCAC Chapter 4 and under the Division's General Permit NCG010000, and any requirements pertaining to wetlands under 15A NCAC 2B _0200 and 2H .05(l0. 6. A set of approved plans and specifications for the subject project must be retained by the permittee for the life of the project. 7. The annual administering and compliance fee must be paid by the Permittee within thirty (30) days after being billed by the Division. Failure to pay the fee accordingly may cause ft Division to initiate action to revolve this permit as specified by 15A NCAC 2H .0205 (c)(4). S. The Pexmiuee,-at least six (6)-months prior Io-the,expiration- ofthis hermit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if warranted, will extend the petmi.t for such period of time and under such conditions and limitations as it may deem appropriate.
