Point as requested in the permittee's application dated - 9/4/87 including
attached plats, sheets 1-3 of 3, dated 9/4/87.
This permit, issued on is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) In order to protect juvenile shrimp populations, no excavation or filling
will be permitted between the dates of April 1 and September 30 of any
year without the prior approval of the N. C. Division of Coastal Management.
(2) All excavated materials will be confined landward of the mean high water
(MHW) elevation contour and any regularly or irregularly flooded vegetated
wetlands.
(3) The dike around the spoil area located on the eastern side of the access
channel must be repaired prior to its' use to contain any excavated materials.
(4) Excavation will not exceed 6 feet below the elevation of mean low water
(MLW). .
(5) The temporary placement or double handling of excavated or fill materials
within waters or vegetated wetlands is not authorized.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31. 1990 -
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

ADDITIONAL CONDITIONS
(6) The activity will be conducted in such a manner as to prevent a significant
increase in turbidity outside the area of construction or construction
related discharge.
(7) The permittee will maintain the authorized work in good condition and in
conformance with the terms and conditions of this permit. The permittee
is not relieved of this requirement if he abandons the permitted activity
without having it transferred to a third party.
(8) This permit does not authorize interference with any existing or proposed
Federal project.
NOTE: The permittee and/or his contractor is urged to meet with a representative
of the Division of Coastal Management prior to project initiation.
NOTE: Section 401 Water Quality Certification No. 2187 was issued on December
15, 1987 for this project by the Division of Environmental Management.
NOTE: Minor mosquito problems may result from this project. The permittee
should contact the Vector Control Branch at (919) 733-6407 regarding
appropriate mosquito control measures.

Reference your application for Department of the Army
authorization to maintain a canal and basin and construct a
boatlift structure off the Atlantic Intracoastal Waterway (AIT?94),
Shallotte Point, Brunswick County, North Carolina.
Your proposal has been reviewed and found consistent with the
provisions and objectives of general permit No. SAWC080-N-000-
0291. Therefore, you may commence construction activity in strict
accordance with applicable State authorization and the enclosed
plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the North
Carolina Division of Coastal Management prior to performing any
such change or alteration. Such action is necessary as revised
plans must be reviewed and the authorization modified.

Reference the application of Mr. D. E. Tripp for a Department
of the Army permit to maintain a canal and basin and construct a
boatlift structure off the Atlantic Intracoastal Waterway (AIWW),
Shallotte Point, Brunswick County, North Caroliona.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. In order to protect juvenile shrimp populations, no
excavation or filling will be permitted between the dates of
April 1 and September 30 of any year without the prior approval of
the North Carolina Division of Coastal Management.
b. All excavated materials will be confined landward of the
mean high water (MI1W) elevation contour and any regularly or
irregularly flooded vegetated wetlands.
c. Excavation will not exceed 6 feet below the elevation of
mean low water (MLW).
d. The temporary placement or double handling of excavated or

THIS CERTIFICATION is issued in conformity with the requirements of
Section 401 Public Laws 92-500 and 95-217 of the United States and
subject to the North Carolina Division of Environmental Management
Regulations in 15 NCAC 2H, Section .0500 to D.E. Tripp pursuant to an
application filed on the 10th day of September, 1987 to maintain an
existing channel and basin, and construct a boat lift.
The Application provides adequate assurance that the discharge of
fill material into a wetlands area adjacent to the waters of Atlantic
Intracoastal Waterway in conjunction with the proposed modifications in
Brunswick County will not result in a violation of applicable Water
Quality Standards and discharge guidelines. Therefore, the State of
North Carolina certifies that this activity will not violate Sections
301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in
accordance with the application and conditions hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner as to prevent
significant increase in turbidity outside the area of
construction or construction related discharge (increases such
that the turbidity in the Stream is 25 NTU's or less are not
considered significant).
2. That fill behind the bulkhead should be clean and free of any
toxic materials.
3. That erosion control measures shall be in place prior to
filling behind the bulkhead.
4. That the approach embankment should be stabilized with
vegetation soon after completion.
5. That all wet concrete placed below MHW be placed at low tide
and that the forms be completely dewatered. No wet concrete
should be placed in the surface waters.
6. That a permanent sewage pumpout facility be installed and
maintained.
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the above
conditions are made conditions of the Federal Permit.

Project Description: The applicant proposes to maintain an existing channel

The project has been reviewed to determine impacts to water quality. The
following comments are provided.
The project will require a 401 Certification and that certification should
include the following conditions:
1) Construction of the bulkhead
a. That the fill be clean, free from any toxic material;
b. That erosion control measures be in place prior to filling;
c. That the approach embankment should be stabilized with vegetation
soon after completion;
d. That all wet concrete poured below MHW be poured at low tide and
that the forms be completely dewatered. No wet concrete shall be
placed in the surface waters;
e. That the turbidity outside the immediate construction area not
exceed 25 NTUs.
2) That a permanent pumpout facility be installed and be maintained
throughout the life of the marina.
3) This office has no objection to the projects proposed.

9. PROJECT DESCRIPTION
The project site is located on an approximately 10 acre tract of land at
Shallotte Point off of SR 1145 along the AIWW. The site can be reached by
taking SR 130 to SR 1154 East then South on SR 1145 to Shallotte Point. Permit
ll 47-78 and SAWCO 78-N-010-003-0013 provided for the construction of the marina
basin and the development of the high ground property.
The high ground development consist of a boat repair shop, a fish house and a
storage building located on the north side of the marina basin. There are 7
(seven) existing piers within the basin that provide dockage for approximately
20 boats.
There is also a boat ramp next to the fish house located at the north east
corner of the basin. Presently there are 3 sites disposal areas with another
planned on high ground (see plat sheet lit of 3). The largest disposal site
labeled as 'B' on the plat located on the east side of the basin has experience
severe erosion problem along the dike bordering the shoreline.
The basin area measures approximately 200' x 200' and the access channel
"measures approximately 200' x 100'. The average depth range from -4' mlw at
the basin end to approximately -6' mlw at the entrance channel end. The
adjacent waters are classified as SA open and are designated as a secondary
nursery area.
The applicant proposes to renew his permit ll 47-78 and modified it to include
the construction of a travel-lift landing (see enclosed plat sheet ll 3 of 3)
and the maintenance dredging of the basin area to its original depth of -5 mlw.
No additional boat slips are proposed. Approximately 2000 cubic yards of
silt/sand material is to be excavated from the basin, and approximately 420
cubic yards of silt and upland sand will be excavated from the proposed
travel-lift site. The spoil material will be contained within the designated 4
spoil areas (see plat ll 2 of 3). However, because of the failing condition of
spoil area 'B', we recommend that a bulkhead be placed along the shoreline of
this spoil area to stop further erosion of material into the adjacent coastal
waters.
10. ANTICIPATED IMPACTS
This project as proposed will cause to be consumed approximately 50 sqf of
smooth cordgrass (Spartina alterniflora) also 450 sqf of open water. There
will be some short term turbidity. If the project is timed so as to avoid
records of peak biological activities and proper control is used on the dredge
spoil effluent, no significant impact is expected on coastal resources.

NOTICE OF FILING OF
APPLICATION FOR CAMA MAJOR DEVELOPMENT
PERMIT AND WATER QUALITY CERTIFICATION
The Department of Natural Resources and Community Development hereby gives
public notice as required by NCGS 113A-119(b) and 143-215 3(a)(1)(c) that
D. E. Tripp of Shallotte Point
filed an application on October 19, 1987 for a permit from
the Division of Coastal Management to develop in an Area of Environmental Concern
and for certification from the Division of Environmental Management that a discharge
of fill material in project wetlands will not violate applicable water quality standards.
According to said application the applicant proposes to maintain an
existing channel and basin, and construct a boat lift- located nn the AT1,,1147
off SR 1145 at Shallotte Point Brunswick County.
A copy of the entire application and additional information may be examined (or
copies furnished upon request and payment of reproduction costs) during normal
business hours of the Division of Coastal Management and/or the Division of
Environmental Management, Regional Office 7225 Wrightsville Avenue, Wilmington,
North Carolina 28403.
The Division of Environmental Management proposes to take final action on this
water quality certification on or before . December 34, 1987
The issuance of the CAMA Major Development Permit and the Section 401 Certification
may deviate from this projected date depending upon the nature of the comments
submitted and subsequent hearings that may arise.

Owens, Director, Division of Coastal Management, P.O. Box 27687, Raleigh, North
Carolina 27611 prior to December 9, 1987 for
consideration in the CAMA permit decision, and to Mr. Bill Mills, Division of
