Therefore, you may commence construction activity in strict accordance with applicable State authorization and the enclosed plan. Failure to comply with the State authorization or conditions of the general permit could result in a violation of Federal law. If any change in your work is required because of unforeseen or altered conditions or for any other reason, plans revised to show the change must be sent promptly to this office and the North Carolina Division of Coastal Management prior to performing any such change or alteration. Thorne, 213 Kimrob Lane, Matthews, NC 28105 Permit Number 124-87 authorizing development in Perquimans County at the Perquimans River, off Ai nsley Rd.. Matthews Beach as requested in the pemiittee's application dated 4/27/87 including attached plats, 3, plan view, cross section and location dated 4/27/87. This, permit, issued on June 29, 1987 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. 1) The bulkhead will be positioned in strict accordance with permit plans. It will not be placed farther waterward than an average of 3 feet from the normal water elevation contour. 2) All backfill materials will be obtained from an upland source and confined landward of the permitted bulkhead. 3) Vegetated wetlands will not be excavated or filled. 4) All fill material to be placed below normal water level will be confined behind the permitted bulkhead. 5) The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. (See attached sheet for Additional Conditions) This permit action may be appealed by the pemiittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31. 1990 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Increases such that the turbidity in the waterbody is 50 NTU's or less are not considered significant. NOTE: The proposed project is certified under General Water Quality Certification No. 1272 issued on November 10, 1978, for bulkhead construction. A review of your application received May 7, 1987, for a Department of the Army permit to construct and backfill a bulkhead on the Perquimans River, Matthews Beach, Perquimans County, North Carolina, indicates it to be a candidate for Federal authorization under this general permit. Accordingly, the administrative processing of your application will be accomplished by the North Carolina Division of Coastal Management. Your receipt of this letter verifies your acceptance of a valid request for certification in accordance with Section 325.2(b)(ii) of our administrative regulations. We are considering authorization of the proposed activity pursuant to Section 404 of the Clean Water Act, and we have determined that a water quality certification may be required under the provisions of Section 401 of the same law. A Department of the Army permit will not be granted until the certification has been obtained or waived. In accordance with our administrative regulations, 60 days after receipt of a request for certification is considered a reasonable time for State action. C. 28105 Dear Mr. Thorne: Upon inspection of the large pine tree on your property on the Perquimans River9 it seems to me that the tree has been there for at least 100 years and has had the soil washed from around the roots over the last ten years. I would recommend that a permit be issued for a bulkhead to be built at least ten-feet around the waterside of the tree. This would not only provide structural support for the tree9 but eventually life support from the roots in the future. My background includes a degree "from North Carolina State in Agronomy and twenty-seven years as owner-manager of Luther Greenhouses in Elizabeth City, N. C. We are wholesale growers of bedding and pot plants and also deal in nursery stock. Your receiving such a permit and, therefore, saving this very old and historic tree would,seem appropriate for preserving the beauty of the shoreline and would be most appreciated by all landowners of the area. C. 28204 Dear Jim, After looking at the pine tree you are concerned with, I contacted Mr. Jim Kea, Area Forestry Agent with the North Carolina Agricultural Extension Service based in Williamston. After explaining to Mr. Kea how the tree was situated next to the river, with-the trunk extending down to the water and the support roots high above the water line extending into the bank, he made the following observations: 1) The roots in the water are providing no life support for the tree. 2) They do provide some structural support. He suggests that you place your bulkhead at least 10 feet away 'from the tree to minimize damage to these roots. 3) Avoid driving over the roots in the bank when filling in behind the bulk- head. Project ztimmary The applicant prop oses to construct a bulkhead along the shoreline of property located in Perquimans County at Matthew' s Beach on the Perquimans River. JAMES R. THORNE BIO REPORT PAGE 2 SITE DESCRIPTION The applicant's property is located in Perquimans County at Matthew's Beach on the Perquimans River. The existing shoreline has a high bank approximately 14 feet above NWL. An old large pine tree is located at N14L and has an extensive root system waterward of NWL. A single family residence is located on the property. The applicant proposes to bulkhead his lot, following the contour of the shoreline except at the location of the large pine tree. The applicant wishes to try to save this tree, and after contacting five experts, the consensus is to bulkhead approximately 10' out from the tree trunk. Letters are attached to the application verifying this recommendation. The applicant proposes to use salt treated timbers to bulkhead his 222 feet of shoreline, with it averaging 3' waterward of (JLJL, with the 10' out from the tree being the maximum distance waterward of NWL. The applicant proposes to connect to an adjacent bulkhead to the west, and to a staked general permit alignment to the east of his property. The maximum water depth is -2' at 10' out from the pine tree. ANTICIPATED IMPACTS The project as proposed will result in the filling of 666 square feet, resulting in 148 cubic yards of fill, with 12 of these being below NWL. The project as proposed will result in increased levels of turbidity during construction, however, these effects will be short-termed and localized. C. 28105 Dear Mr. Thorne: Upon inspection of the large pine tree on your property on the Perquima.ns River, it seems to me that the tree has been there for at least 100 years and has had the soil washed from around the roots over the last ten years. I would recommend that a permit be issued for a bulkhead to be built at least ten feet around the waterside of the tree. This would not only provide structural support for the tree, but eventually life support from the roots in the future. My background includes a degree from North Carolina State in Agronomy and twenty-seven years as owner-manager of Luther Greenhouses in Elizabeth City, N. C. We are wholesale growers of bedding and pot plants and also deal in nursery stock. Your receiving such a permit and, therefore, saving this very old and historic tree would seem appropriate for preserving the beauty of the shoreline and would be most appreciated by all landowners of the area.
