This permit, issued on , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
Construction
(1) Installation of the spray irrigation system on the ocean dune section of
the project will not take place between April 1 - November 15 of any year
in order to protect nesting sea turtles.
(2) All dune area construction will be*.accomplished with minimum disturbance
type equipment and dune disturbance wi17 be kept to a minimum.
(3) AlI disturbed areas on 'the dunes will - be sprigged with indigenous dune vege-
tation and stabilized against water erosion prior to operation of the system.
(4) All other disturbed areas will be provided a ground cover sufficient to
restrain erosion within 30 days of project completion.

(5) In order to determine if the discharge from the impact type sprinkler system
(See attached sheet for Additional Conditions

This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department

carries any bacterial or other contaminants that could pose a threat to
public health, the permittee will, starting on April 1, 1988 collect samples
from the pump station wet well on or about the 1st and 15th day of each
month through October 15, 1988 and have coliform test results from a certified
laboratory submitted to the Division of Coastal Management on a regular
basis following collection. Within 30 days of the final report, the Division
of Coastal Management, after consultation with the Division of Health Services
and the Division of Environmental Management, will notify the permittee
if additional testing or project modification is necessary to protect public
health. Upon appropriate notification to Sands Investments or their successor,
the well shall also be made available periodically to state agencies so
that additional water quality tests may be conducted.
(6) The pump shall operate only from 9:00 p.m. to 6:00 a.m. throughout the sampling
period, except under extremely wet conditions when, additional pumping may
be necessary to comply with the Non-Discharge Permit #7076P issued by the
Division of Environmental Management. For the purpose of this requirement, con-
ditions will be considered unusually wet if there is standing water at
the well site. Further nightime pumping may be required, depending on test
results carried out in condition 5 above.
(7) If results of the above testing indicate the discharge from the sprinklers
is contaminated, the permittee shall, at the direction of DCM, post the
dune area cautioning the public against using the sprinkler field for recrea-
tion and shall take any other steps that become necessary, including fencing
the area, to prevent;all public contact with the area of discharge.

Carteret County
On July 15, 1987, you requested that I provide you with
comments as to what special conditions should be contained
in a CAMA permit for the subject system if issued by your
agency. Of special interest was my comments on two Health
Services memos dated May 27, 1987 and June 26, 1987. I have
discussed these issues with Mr. Preston Howard of our
Wilmington Regional office and my comments are as follows:
1. On March 5, 1987, Sands Investments, Inc. received an
extension of its non-discharge permit for its
wastewater treatment system. At the time of this
renewal, the permit was modified to include the
construction and operation of a 500,000 gallon storm
water collection and disposal facility. This permit
requires the construction of five (5) monitoring wells
and groundwater and treatment plant effluent
monitoring. It does not require monitoring of the
water from stormwater collection and disposal system,
prior to spraying. A copy of this permit which expires
on March 31, 1992 is attached.
2. The two memos from Health Services express concern
that:
a) The stormwater drainage system may pump wastewater
from the rotary distributors.
b) A 100-foot setback to residences should be
required.
c) The spraying should only occur at night.
d) Signs should be posted in buildings that
wastewater is sprayed.
e) Additional monitoring should be required to
determine the quality of the water being sprayed.

The Department of Human Resources is the public health
agency for the state and we have no objections to their
request for additional safeguards. It should, however, be
pointed out that some of the request may not be as
appropriate for this wastewater since it should contain
mostly groundwater and stormwater.
I agree that if this was a new site that it would
preferable to design the development around the wastewater
treatment system. Unfortunately the development is already
there and the applicant appears to have done a reasonable
job of providing buffers between the spray site and the
dwellings. obviously if the samples of the water to be
sprayed showed signs of contamination from the rotary
distributor, this issue would have to be evaluated; however,
at least initially the buffers for spraying stormwater would
appear adequate as designed.
With regard to spraying only at night, this would
appear to be a reasonable request at least until the
sampling data is reviewed. However, posting signs that
wastewater is being sprayed is probably premature until, or
if, this is substantiated by sample results.
The request for sampling of the groundwater prior to
spraying as proposed by the N.C. Coastal Federation and
supported by the Division of Health Services is reasonable.
There would, however, not appear to be a need to install a
mechanism in the pipe for water sample collection since
samples could be collected from the pump station wet well.
As stated previously, the DEM permit already requires the
construction of five wells and groundwater and treatment
plant effluent monitoring.
If there is a need for any additional information or
clarification, please do not hesitate to contact me.

Dear Mr. Hill:
This letter is with reference to the application request that you
submitted on behalf of Sands Investment for a permit under the Coastal Area
Management Act (CAMA) to construct a stormwater/groundwater management system
to serve "A Place At The Beach, III", an existing condominium complex located
near Atlantic Beach in Carteret County. Processing of the application,
including onsite investigation by cooperating agencies, is now complete.
Based on the foregoing review, the Division of Coastal Management has
made the following findings:
1) Construction of the stormwater management system is, according to the
Division of Environmental Management, necessary to prevent malfunctioning
of the existing rotary distributor sewage treatment plant;
2) The spray irrigation site for the stormwater management system is located
in the Ocean Hazard Area of Environmental Concern;
3) Rules of the Coastal Resources Commission require that only non-essential
development be allowed in front of the oceanfront setback in 7H.0306(a);
4) Essential development is that which is not required for the "continued
existence and/or use of an associated principal development";
5) The stormwater management system is determined to be essential and such
construction or development is, therefore, determined to be inconsistent
with CRC Rule 15 NCAC 7H.0309(a).

Given the foregoing findings, it is necessary that your request for
permits under the CAMA be denied. This denial is pursuant to N.C.G.S.
113A-220(8) which requires denial when the project proposal is determined to
be inconsistent with the State Guidelines for Areas of Environmental Concern.
In addition to permit denial due to a finding of inconsistency with
7H.0306 and 7H.0309, above, it is important to note that the Division of
Health Services is concerned about the operation of the spray fields in close
proximity to boardwalks, within the condominium development, and the public
beach. Because this issue is not considered, at this point in time, a finding
which would cause permit denial, further details on this matter will be
presented at a later date.
If you wish to appeal this denial, you are entitled to a quasi-judicial
hearing to challenge the factual findings or legal conclusions regarding this
denial. A hearing is similar to a trial, involving appearing before a hearing
officer who listens to the evidence and arguments of both parties and then
makes a recommendation to the Coastal Resources Commission. A decision by the
Commission, adverse to you, may be appealed in the courts. Your request for
such a hearing must be in the form of a written petition, complying with the
requirements of Chapter 1508 of the General Statutes of North Carolina, and
must be filed with the Office of Administrative Hearings, P. 0. Drawer 11666,
Raleigh, N. C. 27604. The request for a hearing must be submitted to the
Office of Administrative Hearings within twenty days of receipt of this
letter. A copy of this petition should be filed with this office. Enclosed,
please find a petition which may be used for your hearing request.
If you request a hearing, you may have a cho.ice of hearing officers,
either a hearing officer of the Office of Administrative Hearings, or a
hearing officer selected by the CRC (usually a member of the CRC). Unless you
waive your right to a hearing before the Office of Administrative Hearings,
the hearing will be conducted by a hearing officer of that agency. If you
prefer to have your hearing before a hearing officer of the CRC, you must sign
the "Waiver" contained in the enclosed petition form.
Also, you should be advised that as long as this State permit denial
stands, your project must be deemed inconsistent with the N. C. Coastal
Management program, thereby precluding issuance of Federal permits for this
project. The Federal Coastal Zone Management Act of 1972 (CZMA) gives the
right to appeal this finding to the U. S. Secretary of Commerce, within 30
days of receipt of.this letter. Your appeal must be based on the grounds that
the proposed activity is (1) consistent with the objectives or purposes of the
CZMA, or (2) is necessary in the interest of national security, and thus, may
be federally approved.

8., Project summary Applicant proposes to install sprinkler system
for stormwater disposal on the ocean dune at A Place at the Beach III
in the Town of Atlantic Beach, Carteret County
Existing Treatment plant
9. Narrative description
Applicant's property is approximately 19 acres in size located
off East Fort Macon Road next to the Atlantic Ocean in the Town
of Atlantic Beach in Carteret County. The project was
constructed approximately 7 years ago landward of CAMA
jurisdiction. Presently, existing physical features at the site
include two three story condominium buildings containing a total
of 246 units and being sold under time-share agreements. Other
features include a sales unit, two swimming pools, tennis courts
and asphalt parking. A package. treatment facility exists on the
northwest corner of the property. Various decks and walkways
surround the pools and one dune crosswalk extends to the beach.
The dune system has features typical of dunes and is vegetated by
American beachgrass and Sea Oats. Barren areas exist where foot
traffic is obvious. This system blends into the
characteristically barren areas which were nourished with dredge
materials in 1986 which presently make up the ocean beach.
The applicants have had a history of waste treatment system
failure during the summer months due to high use of these units
and stormwater runoff from buildings and paved areas. This has
caused serious discussions between the applicant and the Division
of Environmental Management on how to resolve this potential
public health problem.
In consultation with Environmental Management the applicant is
modifying his non-discharge waste water treatment permit and has
designed a system that will collect the groundwater and pump this
to a .spray irrigation system on the existing dunes: This system
will involve sub-surface collection drains in the vicinity of the
rotary distributors and west parking lot, a pump and pipeline to
the spray field and the spray field located on the dune.
10. Anticipated Impacts
This project will involve the disturbance of 7500 sq. ft. of
highground area in the construction.of the sub-surface drain,
1875 sq. ft. in the pipeline installation to the spray field and
3000 sq. ft. of dune area in constructing the spray field. Water
will be distributed waterward of the dune vegetation line,
however, no spray heads will be positioned waterward of this
line. All fittings associated with the spray field will be
located within 100' of the first line of stable natural
vegetation.. A swale.will be cleared, grubbed and graded on the
northwest corner of the property in the vicinity of rotary
distributors 42 and 13. This land disturbance will involve
14,000 sq. ft. of highground area.

8., 'Project summary Applicant proposes to install sprinkler system
for stormwater disposal on the ocean dune at A Place at the Beach III
in:the Town of Atlantic Beach, Carteret County

9. Narrative description
Applicant's property is approximately 19 acres in size located
off East Fort Macon Road next to the Atlantic Ocean in the Town
of Atlantic Beach in Carteret County. The project was
constructed approximately 7 years ago landward of CAMA
jurisdiction. Presently, existing physical features at the site
include two three story condominium buildings containing a total
of 246 units and being sold under time-share agreements. Other
features include a sales unit, two swimming pools, tennis courts
and asphalt parking. A package. treatment facility exists on the
northwest corner of the property. Various decks and walkways
surround the pools and one dune crosswalk extends to the beach.
The dune system has features typical of dunes dnd is vegetated by
American beachgrass and Sea Oats. Barren areas exist where foot
traffic is obvious. This system blends into the
characteristically barren areas which were nourished with dredge
materials in 1986 which presently make up the ocean beach.
The applicants have had a history of waste treatment system
failure during the summer months due to high use of these units
and stormwater runoff from buildings and paved areas. This has
caused serious discussions between the applicant and the Division
of Environmental Management on how to resolve this potential
public health problem.
In consultation with Environmental Management the applicant is
modifying his non-discharge waste water treatment permit and has
designed a system that will collect the groundwater and pump this
to a spray irrigation system on the existing dunes. This system
will involve sub-surface collection drains in the vicinity of the
rotary distributors and west parking lot, a pump and pipeline to
the spray field and the spray field located on the dune.
10. Anticipated Impacts
This project will involve the disturbance of 7500 sq. ft. of
highground area in the construction of the sub-surface drain,
1875 sq. ft. in the pipeline installation to the spray field and
3000 sq. ft. of dune area in constructing the spray field. Water
will be distributed waterward of the dune vegetation line,
however, no spray heads will be positioned waterward of this
line. All fittings associated with the spray field will be
located within 100' of the first line of stable natural
vegetation.. A swale. will be cleared, grubbed and graded on the
northwest corner of the property in the vicinity of rotary
distributors 02 and #3. This land disturbance will involve
14,000 sq. ft. of highground area.
