In accordance with your change of ownership request received November 18, 2002 and additional
information received May 30, 2003, we are forwarding herewith Permit No. WQ0019964, dated July 7,
2003, to Thomas Gipson Homes, Inc. for the construction and operation of the subject single family
wastewater treatment and surface irrigation facilities. This modification is issued to change the owner of
record from Honeycutt Properties, LLC to Thomas Gipson: Homes, Inc.
This permit shall be effective to the date of issuance until July 31, 2006, shall void Permit No.
WQ0019964 issued July 23, 2001, and shall be subject to the conditions and limitations as specified therein.
Please pay particular attention to the monitoring requirements in this permit. Failure to establish an adequate
system for collecting and maintaining the required operational information will result in future compliance
problems.
Please also pay particular attention to the peat biofilter conditions (1(5) and I1(13)). Please note that
failure of this experimental wastewater treatment system shall result in the required replacement of the peat
biofilter with a more conventional form of filtration.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this
permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North
Carolina General Statutes, and filed with the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, NC 27699-6714. Unless such demands are made this permit shall be final and binding.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended,
and other applicable Laws, Rules, and Regulations

Continued construction and operation of a 600 gallon per day (GPD) drip irrigation wastewater treatment and
disposal system consisting of a 1,500 gallon baffled septic tank with effluent filter, a 1,500 gallon pump tank with
a 67.0 gallon per minute (GPM) pump with check valve and audible and visual hi h -water alarms, five (5) bog
peat biof lter modules with a combined surface loading area of approximately 162 ft , a tablet chlorinator, a 4,000
gallon storage/pump tank with a 15.0 GPM pump with audible and visual high-water alarms, rain sensor and
check valve, a 15,765 square foot drip irrigation area with 5,255 feet of drip irrigation line, approximately 2,630
emitters, and all associated piping, valves, and appurtenances to serve the Faircroft Subdivision Lot #9, with no
discharge of wastes to the surface waters, pursuant to the application received November 18, 2002, and in
conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the
Department of Environment and Natural Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until July 31, 2046, shall void Permit No.
WQ0019964 issued July 23, 2001 and shall be subject to the following specified conditions and limitations:
I. PERFORMANCE STANDARDS
1. Upon completion of construction and prior to operation of this permitted facility, a certification must
be received from a professional engineer certifying that the permitted facility has been installed in
accordance with this permit, the approved plans and specifications, and other supporting materials. If
this project is to be comp feted in phases and partially certifiedyou shaIl retain the res onsibilit to
track further construction approved under the same permit, and shall provide a final certificate of
completion once the entire project has been completed. Mail the Certification to the Non -Discharge
Permitting Unit, 1617 Mail Service Center, Raleigh, NC 27699-1617.
2. The Raleigh Regional Office, telephone number (919) 571-4700, shall be notified at least forty-eight
(48) hours in advance of operation of the installed facilities so that an in-place inspection can be
made. Such notification to the regional supervisor shall be made during the normal office hours from
8:00 a. m. until 5:00 p.m. on Monday through Friday, excluding State Holidays.
The surface irrigation facilities shall be effectively maintained and operated at all times so that there
is no discharge to surface waters, nor any contamination of ground waters which will render them
unsatisfactory for normal use. In the event that the facilities fail to perform satisfactorily, including
the creation of nuisance conditions or failure of the irrigation area to adequately assimilate the
wastewater, the Permittee shall take immediate corrective actions including those actions that may b
required by the Division of Water Quality (Division), such as the construction of additional or
replacement wastewater treatment and disposal facilities.
4. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface
or ground waters resulting from the operation of this facility.
The peat biofilter shall be properly installed and a leakage test shall be performed to insure that any
exfiltration occurs at a rate that does not exceed 2% of the modules capacity per twenty-four (24)
hours. The engineer's certification will serve as proof of compliance with this condition.
6. A leakage test shall be performed on the septic tank and storage/pump tank(s) to insure that any
exfiltration occurs at a rate which does not exceed twenty (20) gallons per twenty-four (24) hours per
1,000 gallons of tank capacity. The Engineer's Certification will serve as proof of compliance with
this condition.
7. If excavation into bedrock is required for the installation of the septic tank or sand filter, the pit shall
be lined with a 10 -mil synthetic liner.
S. A sanitary tee and filter shall be installed on the effluent pipe of the septic tank. The Engineer's
Certification will serve as evidence that these specifications have been met.
9. The residuals generated from these treatment facilities must be disposed in accordance with General
Statute 143-215.1 and in a manner approved by the Division.
10. Diversion or bypassing of the untreated wastewater from the treatment facilities is prohibited.
11. The following buffers shall be maintained:
a. 100 feet between wetted area and any residence or places of public assembly under separate
ownership,
b. 50 feet between wetted area and property lines,
c. 100 feet between wetted area and wells,
d. 50 feet between wetted area and drainage ways or surface water bodies,
e. 50 feet between wetted area and public right of ways,
f. 100 feet between treatment/storage units and any wells, and
g. 50 feet between treatment units and property lines.
12. The pump tank(s) shall have functional audible and visual high water alarms that are external to any
structure.
13. The disposal system shall be connected to a rain or moisture sensor that shall indicate when
wastewater application is not appropriate in accordance with Condition 11(4).
II. OPERATION AND MAINTENANCE REQUIREMENTS
I. The facilities shall be properly maintained and operated at all times.
2. Upon classification of the wastewater treatment and surface irrigation facilities by the Water Pollutic
Control System Operators Certification Commission (WPCSOCC), the Permittee shall designate ai
employ a certified operator to be in responsible charge (ORC) and one or more certified operator(s)
be back-up ORC(s) of the facilities in accordance with 15A NCAC 8G.0201. The ORC shall vi;
the facilities in accordance with 15A NCAC 8G .0204 or as specified in this permit and shall comp
with all other conditions specified in these rules.
3. A suitable year round vegetative shall be maintained.
4. Irrigation shall not be performed during inclement weather or when the ground is in a condition tk
will cause runoff.
5. Adequate measures shall be taken to prevent wastewater runoff from the drip irrigation field.
G. The application rate shall not exceed a cumulative loading of 22.84 inches over any twelve (1
month period at an instantaneous application rate not to exceed 0.35 inches per hour.
7. The facilities shall be effectively maintained and operated as a non -discharge system to prevent t
discharge of any wastewater resulting from the operation of this facility.
8. No type of wastewater other than that from the Faircroft Subdivision, Lot 9 residence shall be emitt
onto the irrigation area.
9. No traffic or equipment shall be allowed on the disposal area except while installation occurs or wh
normal maintenance is being performed.
10. The drip irrigation field shall be fenced with at least a two -strand wire fence.

12. The Permittee is responsible for the operation and maintenance of the entire treatment and dispo
system including, but not limited to, the following items:
a. The septic tank shall be checked annually and pumped out as needed. The septic tank efflux
Efilter shall be checked and cleaned at the same frequency of the septic tank.
i b. The tablet chlorinator shall be checked every week. Tablets shall be added to provide pro]
chlorination.
c. The storage, pump, and alarm systems shall be inspected monthly. The scum layer shall
removed at the same interval as the septic tank is cleaned out.
d. The drip system shall be inspected monthly to make certain of the proper operation of the d
line, that the vegetative growth allows a proper drip pattern, that the soil is assimilating
disposed treated wastewater with no surface runoff, and that no objectionable odors are be
generated.
13. The Permittee is responsible for the operation and maintenance of the peat biofilter. If at any time
experimental peat biofilter fails to perform at the minimum design criteria, the Permittee shall sub:
an application for modification of the treatment facilities to the Division for the replacement of
peat biofilters with another acceptable form of filtration.

III. MONITORING AND REPORTING REQUIREMENTS
Any monitoring deemed necessary by the Division to insure surface and ground water protection w
be established and an acceptable sampling reporting schedule shall be followed.
2. The Permittee shall maintain records of all maintenance performed on the system and irrigation are
as required in Condition U(12) for a minimum of five years. This information shall be provided to t:
Division upon request.
Noncompliance Notification:
The Permittee shall report by telephone to the Raleigh Regional Office, telephone number (919) 57
4700, as soon as possible, but in no case more than 24 hours or on the next working day following t
occurrence or first knowledge of the occurrence of any of the following:
a. Any process unit failure, due to known or unknown reasons, that renders the facility incapable
adequate wastewater treatment, such as mechanical or electrical failures of pumps, emitters, et
or
b. Any failure of a pumping station or treatment facility resulting in a by-pass directly to receivi
waters without treatment of all or any portion of the influent to such station or facility.
Occurrences outside normal business hours may also be reported to the Division's Emerge"
Response personnel at telephone number (800) 858-0368 or (919) 733-3300. Persons reporting su
occurrences by telephone shall also file a written report in Ietterform within five (5) days followi
first knowledge of the occurrence. This report must outline the actions taken or proposed to be tak
to ensure that the problem does not recur.
IV. INSPECTIONS
Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure prof
operation of the subject facilities.
2. Any duly authorized officer, employee, or representative of the Division may, upon presentation
credentials, enter and inspect any property, premises or place on or related to the disposal site
facility at any reasonable time for the purpose of dctermining compliance with this permit, n
inspect or copy any records that must be maintained under the terms and conditions of this peri
and may obtain samples of groundwater, surface water, or leachate.
V. GENERAL CONDITIONS
This permit shall become void unless the facilities are constructed in accordance with the conditii
of this permit, the approved plans and specifications, and other supporting data.
2. This permit is effective only with respect to the nature and volume of wastes described in
application and other supporting data.
3. This permit is not transferable. In the event there is a desire for the facilities to change ownership
there is a name change of the Permittee, a formal permit request must be submitted to the Divis
accompanied by documentation from the parties involved, and other supporting materials as may
appropriate. The approval of this request will be considered on its merits and may or may not
approved.

4. Upon the availability of a municipal or regional sewerage collection system, the subject wastewater
treatment facilities shall be abandoned and all wastewater discharged into the municipal or regional
sewerage system.
5. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee
to an enforcement action by the Division in accordance with North Carolina General Statute 143-
215.6A to 143-215.6C.
6. The issuance of this permit does not preclude the Permittee from complying with any and all statutes,
rules, regulations, or ordinances which may be imposed by other government agencies (local, state,
and federal) which have jurisdiction.
7. This permit may be revoked if the Permittee fails to abide by the conditions of the "Operation and
Maintenance Agreement" previously signed by the Permittee.
8. A set of approved plans, specifications and operation and maintenance manual for the subject project
must be retained by the Permittee for the life of the project.
9. The annual administering and compliance fee must be paid by the Permittee within 30 days after
E being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate
action to revoke this permit as specified by 15A NCAC 2H.0205 (c)(4).
10. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension.
Upon receipt of the request, the Commission will review the adequacy of the facilities described
therein, and if warranted, will extend the Permit for such period of time and under such conditions
and limitations, as it may deem appropriate.

vegetative growth does not interfere with the system inspection or operation, that the soil is
assimilating the disposed treated wastewater with no surface runoff, and that no objectionable
odors are being generated.
2) Failure of the Permittee to properly operate this system is subject to a penalty up to $25,000 per day.
3) Failure to meet the permit conditions or violation of the State's surface or groundwater regulations
will require evacuating the dwelling and may void the permit.
