In accordance with your application received February 14, 2001, we are forwarding herewith
Permit No. WQ0019665, dated September 21, 2001, to Swan Quarter, North Carolina for the
construction and operation of the subject wastewater treatment and spray irrigation disposal system.
This permit shall be effective from the date of issuance until September 30, 2006, and shall
be subject to the conditions and limitations as specified therein. Please pay particular attention to
the monitoring requirements in this permit. Failure to establish an adequate system for collecting
and maintaining the required operational information will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable to you, you
have the right to an adjudicatory hearing upon written request within thirty (30) days following
receipt of this permit. This request must be in the form of a written petition, conforming to Chapter
150B of North Carolina General Statutes, and filed with the Office of Administrative Hearings, 6714
Mail Service Center, Raleigh, N. C. 27699-6714. Unless such demands are made, this permit shall
be final and binding.
Upon completion of construction and prior to operation of this permitted facility, a
certification must be received from a professional engineer certifying that the permitted facility has
been installed in accordance with the approved plans and specifications. Mail the Certification to
the Non -Discharge Branch, 1617 Mail Service Center, Raleigh, North Carolina 27699-1617.

One (1) set of final approved plans and specifications is to be forwarded to you, one (1) set
is being forwarded to your Engineer (AIE), one (1) set retained for the Washington Regional Office,
one (1) set retrained for the Construction Inspection Unit, and one (1) set retained for the Design
Management Unit.
A copy of the approved plans and specifications shall be maintained on file by the owner for
the life of the project.

SPRAY IRRIGATION SYSTEM PERMIT
In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North
Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO
Swan Quarter Sanitary District
Hyde County
FOR THE
construction and operation of a 125,000 GPD spray irrigation system which consists of the
following:
a wastewater treatment facility, consisting of an influent flow meter, a seven -acre facultative
treatment lagoon and a seven -acre storage lagoon, each with a 325,000 square foot synthetic
geomembrane 40 mil liner, chlorine contact tank with chlorine gas storage unit and feeder
system, an effluent flowmeter, an effluent irrigation pump station with two 900 gpm pumps, all
associated piping and appurtenances; and
distribution piping for spray irrigation of I25,000 GPD onto 58.1 acres, which consists of 5,300
linear feet of 8-inch force main, 21,960 linear feet of 6-inch sanitary sewer force main serving as
spray irrigation laterals and 333 sprinkler nozzles, all associated appurtenances; and
approximately 26,000 linear feet of field drainage ditches and approximately 7,000 linear feet of
collector canal, which drains to a dewatering lift station with two 5,500 gpm pumps and 70 linear
feet of 36-inch RCP pipe; to serve
the Swan Quarter Sanitary District with no discharge of wastes to surface waters, pursuant to the
application received February 14, 2001 and in conformity with the project plan, specifications,
and other supporting data subsequently filed and approved by the Department of Environment
and Natural Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until September 30, 2006, and shall
be subject to the following specified conditions and limitations:

I. PERFORMANCE STANDARDS
Upon completion of construction and prior to operation of this permitted facility, a
certification (see attached Certification Form) must be received from a professional
engineer certifying that the permitted facility has been installed in accordance with
this permit, the approved plans and specifications. Mail the Certification to the Non -
Discharge Branch, 1617 Mail Service Center, Raleigh, North Carolina 27699--1617.
2. The Washington Regional Office, telephone No. (252) 946-6481, shall be notified at
Ieast forty-eight (48) hours in advance of operation of the installed facilities so that
an in -place inspection can be made. Such notification to the regional supervisor
shall be made during normal office hours from 8:00 a.m. until 5:00 p.m. on Monday
through Friday, excluding State Holidays.
3. The spray irrigation facilities shall be effectively maintained and operated at all
times so that there is no discharge to the surface waters, nor any contamination of
ground waters which will render them unsatisfactory for normal use. In the event
that the facilities fail to perform satisfactorily, including the creation of nuisance
conditions or failure of the irrigation area to adequately assimilate the wastewater,
the Permittee shall take immediate corrective actions including those actions that
may be required by the Division of Water Quality (Division), such as the
construction of additional or replacement treatment and disposal facilities.
4. The issuance of this permit shall not relieve the Permittee of the responsibility for
damages to ground water or surface water resulting from the operation of this
facility.
5. The residuals generated from these treatment facilities must be disposed of in
accordance with General Statute 143-215.1 and in a manner approved by the North
Carolina Division of Water Quality.
6. Diversion or bypassing of the untreated wastewater from the treatment facilities is
prohibited.
7. The following buffers shall be maintained:
a) 400 feet between wetted area and any residence or places of public assembly
under separate ownership,
b) 150 feet between wetted area and property lines,
c) 100 feet between wetted area and wells,
d) 100 feet between wetted area and drainageways or surface water bodies,

e) 50 feet between wetted area and public right of ways,
f) 100 feet between wastewater treatment units and wells, and
g) 50 feet between wastewater treatment units and property lines.
II. OPERATION AND MAINTENANCE REQUIREMENTS
The facilities shall be properly maintained and operated at all times.
2. Upon classification of the facility by the Water Pollution Control System Operators
Certification Commission (WPCSOCC), the Permittee shall employ a certified
wastewater treatment plant operator to be in responsible charge (ORC) of the
wastewater treatment facilities. The operator must hold a certificate of the type and
grade at Ieast equivalent to or greater than the classification assigned to the
wastewater treatment facilities by the WPCSOCC. The Permittee must also employ
a certified back-up operator of the appropriate type and grade to comply with the
conditions of 15A NCAC 8G .0202. The ORC of the facility must visit each Class I
facility at least weekly and each Class II, III, and IV facility at least daily, excluding
weekends and holidays, and must properly manage and document daily operation
and maintenance of the facility, and must comply with all other conditions of I5A
NCAC 8G .0202. Once the facility is classified, the Permittee must submit a letter
to the WPCSOCC which designates the operator in responsible charge within thirty
days after the wastewater treatment facilities are 50% complete.
3. A 2-foot minimum freeboard shall be maintained below the top of the lagoon dikes.
4. A suitable year round vegetative cover over the spray irrigation fields shall be
maintained.
5. An agronomic plan shall be developed which maximizes the assimilative capacity of
the nutrients in the wastewater through crop growth, crop harvesting, etc.
6. Irrigation shall not be performed during inclement weather or when the ground is in
a condition that will cause runoff.
7. Adequate measures shall be taken to prevent wastewater runoff from the spray field.
8. The annual application rate shall not exceed a cumulative loading of 32.5 inches
over any twelve (12) month period. Wastewater shall be applied to spray fields 1 -
13 (totaling 51.8 acres) and shall not exceed the maximum instantaneous irrigation
loading rate of 0.25 inch/hour, and shall not exceed a maximum annual average

loading rate of 0.625 inches/week.
9. The facilities shall be effectively maintained and operated as a non -discharge system
to prevent the discharge of any wastewater resulting from the operation of this
facility.
10. The flow measurement device shall be calibrated annually by a representative of a
firm which is routinely engaged in the calibration of flow measurement devices.
Records of this calibration, including all information pertinent to the calibration,
shall be available during any inspection by Division staff.
11. The system of drainage ditches and canals which surrounds the spray fields and the
corresponding dewatering pump station shall be effectively maintained at all times,
to include regular maintenance of the ditch/canal side slopes and maintaining the
ditch/canal bottom elevation as established in the design. If ditch/canal erosion or
siltation becomes problematic, geotextiles or similar may be required for
stabilization purposes.
12. No type of wastewater other than that from the Swan Quarter Sanitary District's
sewer system shall be sprayed onto the irrigation area.
13. No traffic or equipment shall be allowed on the disposal area except while
installation occurs or while normal maintenance is being performed.
I4. Public access to the land application sites shall be controlled during active site use.
Such controls must include the posting of signs showing the activities being
conducted at each site.
III. MONITORING AND REPORTING REQUIREMENTS
Any monitoring (including groundwater, surface water, soil or plant tissue analyses)
deemed necessary by the Division of Water Quality to insure surface and ground
water protection will be established and an acceptable sampling reporting schedule
shall be followed.
2. Adequate records shall be maintained by the Permittee tracking the amount of
wastewater disposed. These records shall include, but are not necessarily limited to,
the following information:
a) date of irrigation,

b) volume of wastewater irrigated,
c) field irrigated,
d) length of time field is irrigated,
e) continuous weekly, monthly, and year-to-date hydraulic (inches/acre) loadings
for each field,
weather conditions, and
g) maintenance of cover crops.
3. The effluent from the subject facilities shall be monitored by the Permittee at the
point prior to irrigation every month for the following parameters:

The effluent pH shall not be less than 6.0 standard units nor greater than 9.0 standard
units.
If Groundwater sampling indicates or predicts problems with compliance with the
Groundwater Standards, this permit may be modified to include additional and/or

more restrictive limitations.
4. Three (3) copies of all operation and disposal records (as specified in condition 1II 2)
on Form NDAR- I shall be submitted on or before the last day of the following
month. Three (3) copies of all effluent monitoring data (as specified in condition III
3) on Form NDMR-1 shall be submitted on or before the last day of the following
month. All information shall be submitted to the following address:

5. A representative annual soils analysis (Standard Soil Fertility Analysis) shall be
conducted on each spray field and the results maintained on file by the Permittee for
a minimum of five years. The Standard Soil Fertility Analysis shall include, but is
not necessarily limited to, the following parameters:
Acidity Manganese Potassium
Calcium Percent Humic Matter Sodium
Copper pH Zinc
Magnesium Exchangeable Sodium Percentage Phosphorus
Cation Exchange Capacity Base Saturation (by calculation)
6. A record shall be maintained of all residuals removed from this facility. The record
shall include the name of the hauler, the permit authorizing the disposal or a letter
from a municipality agreeing to accept the residuals, the date the residuals were
hauled, and the volume of residuals removed.
7. A maintenance log shall be maintained at this facility including, but not limited to,
the following items:
a. Every day that wastewater is Iand applied via spray irrigation, the following
results should be recorded:

settleable matter
Volume of wastewater irrigation per field as recorded by the
effluent flowmeter;
b. Visual observations of the plant and plant site;

d. Date of calibration of flow measuring device.
8. NONCOMPLIANCE NOTIFICATION:
The Permittee shall report by telephone to the Washington Regional Office,
telephone No. (252) 946-6481, as soon as possible, but in no case more than 24
hours or on the next working day following the occurrence or first knowledge of the
occurrence of any of the following:
a. Any occurrence at the wastewater treatment facility which results in the
treatment of significant amounts of wastes which are abnormal in quantity or
characteristic, such as the known passage of a slug of hazardous substance
through the facility or any other unusual circumstances.
b. Any process unit failure, due to known or unknown reasons, that render the
facility incapable of adequate wastewater treatment such as mechanical or
electrical failures of pumps, aerators, compressors, etc.
Any failure of a pumping station, sewer line, or treatment facility resulting in a
by-pass directly to receiving waters without treatment of all or any portion of
the influent to such station or facility.
d. Any time that self -monitoring information indicates that the facility has gone
out of compliance with its permit limitations.
Persons reporting such occurrences by telephone shall also file a written report in
letter farm within fifteen (15) days following first knowledge of the occurrence.
This report must outline the actions taken or proposed to be taken to ensure that the
problem does not recur.
IV. GROUNDWATER REQUIREMENTS
Prior to beginning waste disposal operations, six (6) monitoring wells (MW-1
through MW-6) shall be installed to monitor groundwater quality. The surficial
aquifer wells shall be constructed such that the water level in the well is never above
or below the screened (open) portion of the well at any time during the year. The
general location and name for each well is marked on Attachment A. Each
monitoring well shall be constructed in accordance with this permit and approved by
the Washington Regional Office.

Monitoring wells MW-1 and MW-2 are to be constructed just inside the Compliance
Boundary and used for compliance purposes. Monitoring wells MW-3 and MW-4
are to be constructed on the Review Boundary and used for compliance purposes.
Monitoring wells MW-5 and MW-6 are inside the Review Boundary and are not to
be used for compliance purposes, but are to be used for overall spray field
groundwater performance indicators.
2. The monitoring wells must be constructed by either a North Carolina Certified Well
Contractor, the property owner, or the property lessee according to General Statutes
87-94.4(b)(2). if the construction is not performed by a certified well contractor, the
property owner or lessee must physically perform the actual well construction
activities, and the well(s) must be constructed according to the North Carolina Well
Construction Standards (15A NCAC 2C .0108) and the local county rules.
The six monitoring wells (MW-1 through MW-6) shall be secured to prevent
unauthorized access. This restriction of access may be accomplished by using a
padlock that would secure the well cap to the protective casing, or by some other
acceptable means to the Groundwater Section. The wells shall be further secured by
placing a compatible watertight cap or seal onto the riser pipe to prevent potential
contamination from entering the wells.
3. The Washington Regional Office, telephone No. (252) 946-6481, shall be notified at
least forty-eight (48) hours prior to the construction of any monitoring well so that
an inspection can be made of the monitoring well location. Such notification to the
regional groundwater supervisor shall be made during the normal office hours from
8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding state holidays.
4. Within sixty (60) days of completion of all monitoring wells, the permittee shall
submit two original copies of a scaled site map (scale no greater than 1 "=100');
however, special provisions may be granted upon prior approval for large properties.
The map(s) must include the following information:
a. The location and identity of each monitoring well.
b. The location of major components of the waste disposal system.
C. The location of property boundaries within 500 feet of the disposal area(s).
d. The latitude and longitude of the established horizontal control monument.
e. The elevation of the top of the well casing (which shall be known as the
"measuring point") relative to a common datum.
f: The depth of water below the measuring point at the time the measuring point
is established.
g. The location of Review and Compliance boundaries.
h. The date the map is prepared and/or revised.

Control monuments shall be installed in such a manner and made of such materials
that the monument will not be destroyed due to activities that may take place on the
property.
The maps and any supporting documentation shall be sent to the Permits and
Compliance Unit, Groundwater Section, 1636 Mail Service Center, Raleigh, NC,
27699-1636.
5. Within thirty (30) days of completion of all well construction activities, a
certification must be received from a professional engineer or a licensed geologist
certifying that the monitoring wells are located and constructed in accordance with
the Well Construction Standards (15A NCAC 2C) and this permit. This certification
should be submitted with copies of the Well Completion Form (GW-1) for each
well. Mail this certification and the associated GW-1 forms to the Permits and
Compliance Unit, Groundwater Section, 1636 Mail Service Center, Raleigh, NC,
27699-1636.
6. For the initial sampling of the well as specified elsewhere in the permit, the
permittee shall submit a copy of the GW-1 Form (Well Completion Form) with the
Compliance Monitoring Form (GW-59) for that well. Compliance Monitoring
Forms that do not include copies of the GW-1 form will be returned to the permittee
without being processed. Failure to submit these forms as required by this permit
may result in the initiation of enforcement activities pursuant to NC General Statutes
143-215.6.
7. Monitoring wells MW-I, MW-2, MW-3, MW-4, MW-5, and MW-6 shall be
sampled initially after construction (and prior to the lagoon waste disposal
operations) and thereafter every March, July and November for the following
parameters:

*The measurement of water levels must be made prior to sampling for the remaining
parameters. The depth to water in each well shall be measured from the surveyed
point on the top of the casing.
The measuring points (top of well casing) of all monitoring wells shall be surveyed
to provide the relative elevation of the measuring point for each monitoring well.

Monitoring wells MW-1 and MW-2 are to be constructed just inside the Compliance
Boundary and used for compliance purposes. Monitoring wells MW-3 and MW-4
are to be constructed on the Review Boundary and used for compliance purposes.
Monitoring wells MW-5 and MW-6 are inside the Review Boundary and are not to
be used for compliance purposes, but are to be used for overall spray field
groundwater performance indicators.
If TOC concentrations greater than 10 mg/l are detected in any downgradient
monitoring well (MW-1, MW-2, MW-3 and MW-4 only), additional sampling and
analysis may be required to identify the individual constituents comprising this TOC
concentration. If the TOG concentration as measured in the background monitor
well exceeds 10 mg/l, this concentration will be taken to represent the naturally
occurring TOC concentration. Any exceedances of this naturally occurring TOC
concentration in the downgradient wells shall be subject to the additional sampling
and analysis as described above.
The results of the sampling and analysis must be received on Form GW-59
(Groundwater Quality Monitoring: Compliance Report Form) on or before the last
working day of the month following the sampling month. Send all forms to Permits
and Compliance Unit, Groundwater Section, 1636 Mail Service Center, Raleigh,
NC, 27699-1636.
S. Drainage channel surface water (sampling points SW-1 and SW-2) shall be sampled
initially after construction (and prior to the lagoon waste disposal operations) and
thereafter every March, July and November for the following parameters:

*The depth to water shall be measured as the depth of the water surface in the
channel below the surveyed top of stake mark, as established by a permanent stake
in the channel.
SW-1 sampling point is located in the large collector canal just prior to the canal
dewatering pump station. SW-2 sampling point is located in the field ditch between
Spray Fields 6 and 7, about 100 feet prior to draining into the collector canal along
the eastern property boundary.

The measuring points (top of stake) of all surface water sampling points shall be
surveyed to provide the relative elevation of the measuring point for each surface
water sampling point.
The results of the sampling and analysis must be received on Form GW-59
(Groundwater Quality Monitoring: Compliance Report Form) on or before the last
working day of the month following the sampling month. Send all forms to Permits
and Compliance Unit, Groundwater Section, 1636 Mail Service Center, Raleigh,
NC, 27699-1636.
9, The COMPLIANCE BOUNDARY for the disposal system is specified by
regulations in 15A NCAC 2L, Groundwater Classifications and Standards. The
Compliance Boundary for the disposal system individually permitted after December
31, 1983 is established at either (1) 250 feet from the waste disposal area, or (2) 50
feet within the property boundary, whichever is closest to the waste disposal area.
An exceedance of Groundwater Quality Standards at or beyond the Compliance
Boundary is subject to immediate remediation action in addition to the penalty
provisions applicable under General Statute 143-215.6A(a)(1).
In accordance with 15A NCAC 2L, a REVIEW BOLMARY is established around
the disposal systems midway between the Compliance Boundary and the perimeter
of the waste disposal area. Any exceedance of standards at the Review Boundary
shall require remediation action on the part of the permittee_
V. INSPECTIONS
1. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee
to insure proper operation of the subject facilities.
2. The Permittee or his designee shall inspect the wastewater treatment and disposal
facilities to prevent malfunctions and deterioration, operator errors and discharges
which may cause or lead to the release of wastes to the environment, a threat to
human health, or a nuisance. The Permittee shall keep an inspection log or summary
including at least the date and time of inspection, observations made, and any
maintenance, repairs, or corrective actions taken by the Permittee. This log of
inspections shall be maintained by the Permittee for a period of three (3) years from
the date of the inspection and shall be made available upon request to the Division of
Water Quality or other permitting authority.

Any duly authorized officer, employee, or representative of the Division of Water
Quality may, upon presentation of credentials, enter and inspect any property,
premises or place on or related to the disposal site and facility at any reasonable time
for the purpose of determining compliance with this permit; may inspect or copy any
records that must be kept under the terms and conditions of this permit; or may
obtain samples of groundwater, surface water, or leachate,
VI. GENERAL CONDITIONS
1. This permit shall become voidable unless the facilities are constructed in accordance
with the conditions of this permit, the approved plans, specifications, and other
supporting data.
2. This permit is effective only with respect to the nature and volume of wastes
described in the application and other supporting data.
3. This permit is not transferable. In the event there is a desire for the facilities to
change ownership, or there is a name change of the Permittee, a formal permit
request must be submitted to the Division accompanied by an application fee,
documentation from the parties involved, and other supporting materials as may be
appropriate. The approval of this request will be considered on its merits and may or
may not be approved.
4. Failure to abide by the conditions and limitations contained in the permit may
subject the Permittee to an enforcement action by the Division in accordance with
North Carolina General Statute 143-215.6A to 143-215.6C.
5. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances which may be imposed by other
government agencies (local, state, and federal) which have jurisdiction.
6. A set of approved plans and specifications for the subject project must be retained by
the Permittee for the life of the project.
7. The annual administering and compliance fee must be paid by the Permittee within
thirty (30) days after being billed by the Division. Failure to pay the fee accordingly
may cause the Division to initiate action to revoke this permit as specified by 15
NCAC 2H .0205(c)(4).

8. The Permittee, at least six (6) months prior to the expiration of this permit, shall
request its extension. Upon receipt of the request, the Commission will review the
adequacy of the facilities described therein, and if warranted, will extend the permit
for such period of time under such conditions and limitations as it may deem
appropriate.
9. This permit shall become voidable unless the deed dated May 1, 2001 for the
purchase of the tract of land to the Swan Quarter Sanitary District on which the
WWTP and spray irrigation fields reside, recorded in the Office of Register of Deeds
of Hyde County, North Carolina, in Book 180, Page 62, and the agreements and
easements dealing with access and drainage described in the deeds of easements and
cross -easements dated April 9, 1976 and March 22, 1989, recorded in the Office of
the Register of Deeds of Hyde County, North Carolina, in Book 101, Page 112, 116,
197 and Book 133, Page 652 are in full force and effect.

ENGINEER'S CERTIFICATION
I, , as a duly registered Professional Engineer in
the State of North Carolina, having been authorized to observe (periodically/weekly/full time) the
construction of the Swan Quarter Sanitary Sewer System serving the Swan Quarter area, located
in Hyde County, hereby state that to the best of my abilities, due care and diligence was used in
the observation of the following construction:
a 125,000 GPD spray irrigation system which consists of the following:
a wastewater treatment facility, consisting of an influent flow meter, a seven -acre facultative
treatment lagoon and a seven -acre storage lagoon, each with a 325,000 square foot synthetic
geomembrane 40 mil liner, chlorine contact tank with chlorine gas storage unit and feeder
system, an effluent flowmeter, an effluent irrigation pump station with two 900 gpm pumps, all
associated piping and appurtenances; and
distribution piping for spray irrigation of 125,000 GPD onto 58.1 acres, which consists of 5,300
linear feet of 8-inch force main, 21,960 linear feet of 6-inch sanitary sewer force main serving as
spray irrigation laterals and 333 sprinkler nozzles, all associated appurtenances; and
approximately 26,000 linear feet of field drainage ditches and approximately 7,000 linear feet of
collector canal, which drains to a dewatering lift station with two 5,500 gpm pumps and 70 linear
feet of 36--inch RCP pipe; to serve
the Swan Quarter Sanitary District with no discharge of wastes to surface waters, pursuant to the
application received February 14, 2001 and in conformity with the project plan, specifications,
and other supporting data subsequently filed and approved by the Department of Environment
and Natural Resources and considered a part of this permit.
I certify that the construction of the above referenced project was observed to be built within
substantial compliance and intent of the approved plans and specifications.
