WQ0019331, dated December 19, 2003, to NCDENR, Aquarium Division for the construction and operation of the subject /tivastewater treatment and reclaimed water utilization system. This permit shall be effective from the date of issuance until November 30, 2009, and shall be subject to the conditions and limitations as specified therein. Please pay particular attention to the monitoring requirements in this permit. Failure to establish an adequate system for collecting and maintaining the required operational information will result in future compliance problems. Please note Conditions I 2., I 8., 1 13.,1I 8., which address deficiencies in the permit application, and Conditions III 4 through III 6 which include additional monitoring conditions for this facility. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. Internet http1lh2o.enr.nc.state.us/ndpu Telephone (919)733-5083 Fax (919)715-6048 Telephone 1 800 623-7748 50% recyc led/ 10% post -con sumer paper ga NC DENR DENR Customer Service Center An Equal Opportunity Action Employer NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES RALEIGH W e S rr. «rATER TREAT"I NT AND RECLAIMED WATER UTILIZATION PERMIT In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION IS HEREBY GRANTED TO NCDENR, Aquarium Division Carteret County FOR THE construction and operation of a 25,000 GPD wastewater treatment, disposal, and reclaimed water utilization system consisting of a 10,000 gallon aerated equalization tank, duplex grinder pumps to transfer waste to two 12,500 gallon Mebrane Bioreactor Systems each consisting of an anaerobic reactor chamber, aerobic digestion chambers with continuous aeration, and duplex centrifugal pumps drawing wastewater through three 5,000 gpd ultrafiltration modules, a backwash storage tank, an ozonation system with ozone gas proivded by two 4 lb/day ozone gas generators, a UV disinfection system, a turbidimeter with valving to properly direct effluent to approprate storage tank, a 10,000 gallon effluent storage tank, a 10,000 gallon turbid and excess effluent storage tank, a 14,000 gallon fiberglass reinforced plastic tank with aeration for residuals holding, use of effluent that meets the reclaimed wastewater standards as listed in this permit for toilet flushwater within the aquarium building, and disposal of excess wastewater to fields 1 through 4 of a rapid rate infiltration system, to serve the NC Aquarium at Pine Knoll Shores with no discharge of wastes to the surface waters, pursuant to the application received November 20, 2000 and subsequent additional information received on October 22, 2003, and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Environment and Natural Resources and considered a part of this permit. This permit shall be effective from the date of issuance until November 30, 2008, and shall be subject to the following specified conditions and litxzitations: I. PERFORMANCE STANDARDS Upon completion of construction and prior to operation of this permitted facility, a certification must be received from a professional engineer certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting materials. If this project is to be completed in phases and partially certified, you shall retain the responsibility to track further construction approved under the same permit, and shall Qrovide a final certificate of completion once the entire project has been completed. Mail the Certification to the Non -Discharge Permitting Unit, 1617 Mail Service Center, Raleigh, NC 27699-1617. 2. The Division of Water Quality (Division) has not reviewed detailed engineering calculations for the design of the wastewater treatment system. It shall be the Permittee's responsibility to ensure that all treatment units, pumps, pipes and other equipment and appurtenances are designed and sized to properly treat the wastewater to reclaimed water standards as required by this permit. The Permittee shall maintain a copy of all engineering calculations signed and sealed by a professional engineer on file for the life of this system.. 3. The Wilmington Regional Office, telephone number (910) 395-3900, shall be notified at least forty- eight (48) hours in advance of operation of the installed facilities so that an in -place inspection can be :Wade. Such notification to the regional supervisor shall be made during the normal office hours from 8.00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. 4. This permit shall become voidable if the soils fail to adequately assimilate the wastes and may be rescinded unless the facilities are installed, maintained, and operated in a manner which will protect the assigned water quality standards of the surface waters and ground waters. The ponding of wastewater on the surface of the distribution field when the dosing cycle commences shall be considered as evidence of failure of the soils to adequately assimilate the wastewater. Additionally, such failure shall be interpreted as a violation of this permit condition. 5. The wastewater treatment and disposal system shall be effectively maintained and operated at all times so that there is no discharge to the surface waters, nor any contamination of ground waters which will render them unsatisfactory for normal use. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, failure to protect public health, or failure of the infiltration area to adequately assimilate the wastewater, the Permittee shall take immediate corrective actions including those actions that may be required by the Division of Water Quality (Division), such as the construction of additional or replacement wastewater treatment and disposal facilities. b. Adequate measures shall be taken to divert stormwater from the rapid rate infiltration area and to prevent wastewater runoff. 7. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or groundwaters resulting from the operation of this facility. The residuals generated from these treatment facilities must be disposed in accordance with General Statute 143-215.1 and in a manner approved by the Division. Prior to operation of this system the NC Aquarium at Pine Knoll Shores will acquire a contract for services from a properly permitted residuals management firm. 9. Diversion or bypassing of the untreated wastewater from the treatment facilities is prohibited. 10. The following buffers shall be maintained: a. 100 feet between infiltration areas and water supply wells, b. 100 feet between infiltration areas and waters classified as SA, c. 50 feet between infiltration areas and surface waters not classified as SA, and the 50 foot buffer area shall be maintained as a properly vegetated and maintained riparian buffer, d. 100 feet between wastewater treatment units and wells, e. 50 feet between wastewater treatment units and property lines. Approval of the above buffers shall be considered as the Division granting variances to buffers cited in 15A NCAC 211.02190)(5). The Permittee is advised that any modifications or expansions to the existing facilities will require a permit modification and may be required to meet additional buffers at the time of design of the modification or expansion. 11. Public access to the infiltration area shall be controlled during active site use. Such controls may include the posting of signs showing the activities being conducted at the site. 12. A leakage test shall be performed on all subsurface tanks to insure that any exfiltration occurs at a rate which does not exceed twenty (20) gallons per twenty-four (24) hours per 1,000 gallons of tank capacity. The engineer's certification will serve as proof of compliance with this condition. 13. Buoyancy calculations shall be conducted for all buried tanks. Water table elevation shall be assumed at ground elevation and tanks shall be assumed empty for all calculations. Preventative measures shall be taken as necessary to ensure proper security of all buried tanks. 14. A usable green area shall be maintained for wastewater disposal. The green area shall have the capability of accommodating the average daily flow of the facility being served without exceeding the loading rates of the green area. A "green area", as defined in 15A NCAC 2H .0404 (g)(7), is an area suitable for waste disposal, either in its natural state or which has been modified by planting a vegetative cover of grasses or low growing shrubbery. 15- All reclaimed water valves, storage facilities and outlets shall be tagged or labeled to warn the public or employees that the water is not intended for drinking. Where appropriate, such warning shall inform the public or employees to avoid contact with the water. 16. All reclaimed water piping, valves, outlets and other appurtenances shall be color -coded, taped, or otherwise marked to identify the source of the water as being reclaimed water. a. All reclaimed water piping and appurtenances shall be either colored purple (Pantone 522) and embossed or integrally stamped or marked "CAUTION: RECLAIMED WATER — DO NOT DRINK" or be installed with a purple (Pantone 522) identification tape or polyethylene vinyl wrap. The warning shall be stamped on opposite sides of the pipe and repeated every three (3) feet or less. b. Identification, tape shall be at least three (3) inches wide and have white or black lettering on purple (Pantone 522) field stating "CAUTION: RECLAIMED WATER - DO NOT DRINK". Identification tape shall be installed on top of reclaimed water pipelines, fastened at least every 10 feet to each pipe length and run continuously the entire length of the pipe. c. All installations using reclaimed water for toilets and/or urinals shall be identified with signs and shall contain the following text: "TO CONSERVE WATER, THIS BUILDING USES RECLAIMED WATER TO FLUSH TOILETS AND URINALS. DO NOT DRINK." d. Each equipment room shall be identified with the following sign: "CAUTION, RECLAIMED WATER, DO NOT DRINK. DO NOT CONNECT TO DRINKING WATER SYSTEM." The equipment room shall also be identified with the following sign: "NOTICE: CONTACT BUILDING MANAGEMENT BEFORE PERFORMING ANY WORK ON THIS WATER SYSTEM." The sign shall be visible to anyone working on or near reclaimed water equipment. 17. All reclaimed water valves and outlets shall be of a type, or secured in a manner, that permits operation by authorized personnel only. 18. Above -ground hose bibs (i.e., spigots or other hand -operated connections) shall not be present. Hose bibs shall be located in locked below -grade vaults that shall be clearly labeled as being of non -potable quality. As an alternative to the use of locked below -grade vaults with standard hose bibs services, hose bibs, which can only be operated by a special tool or connected to a special hose connection may be placed in non -lockable underground services boxes clearly labeled as non -potable water. 19. There shall be no direct cross -connections between the reclaimed water and potable water systems. An initial and subsequent annual cross -connection inspection and test shall be performed on both the potable and reclaimed water systems. 20. Where both reclaimed water and potable water are supplied to a reclaimed water use area, a reduced pressure principle backflow prevention device or an approved air gap separation shall be installed at the potable water service connection to the use area. The installation of the reduced pressure principle backflow prevention device shall allow proper testing. 21. Where potable water is used to supplement a reclaimed water system, there shall be an air gap separation, approved and regularly inspected by the potable water supplier, between the potable water and reclaimed water systems. 22. To the extent permitted by structural conditions, all reclaimed water risers within the toilet room, including appurtenances such as air/vacuum relief valves, pressure reducing valves, etc., shall be installed in the opposite end of the room containing the served fixtures from the potable water risers, or opposite walls as applicable. To the extent permitted by structural conditions, reclaimed water headers and branches off of the risers shall not be run in the same wall or ceiling cavity of the toilet room where potable water piping is run. 23. The reclaimed water system and the potable water system within the building shall be provided with the required appurtenances (valves, air/vacuum relief valves, etc.) to allow for deactivation or drainage as may be required. 24. Any other requirements of the North Carolina Plumbing Code and the Department of Insurance shall be met for the reclaimed water system. 25. OPERATION AND MAINTENANCE REQUIREMENTS The facilities shall be properly maintained and operated at all times. 2. Upon classification of the wastewater treatment and irrigation facilities by the Water Pollution Control System Operators Certification Commission (WPCSOCC), the Permittee shall designate and employ a certified operator to be in responsible charge (ORC) and one or more certified operator(s) to be back-up ORC(s) of the facilities in accordance with 15A NCAC 8G .0201. The ORC shall visit the facilities in accordance with 15A NCAC 8G .0204 or as specified in this permit and shall comply with all other conditions specified in these rules. 3. Adequate measures shall be taken to prevent wastewater runoff from the irrigation field. 4. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. The application rates for the rapid rate infiltration system shall not exceed 1.5 GPDIs?. 6. An automatically activated standby power source shall be on site and operational at all times. If a generator is employed as an alternate power supply, it shall be tested weekly by interrupting the primary power source. 4 7. No type of wastewater other than that from the NC Aquarium at Pine Knoll Shores shall be irrigated onto the infiltration area. 8. The wastewater treatment system shall be properly maintained by the Permittee. The Division has concerns that documentation of performance of this type of wastewater treatment system has not been provided to indicate that treatment will be consistent with reclaimed water standards. Should the wastewater treatment system fail to routinely perform satisfactorily the Permittee may be required by the Division to modify the wastewater treatment system. 11CI. MONITORING AND REPORTING REQUIREMENTS Any monitoring (including groundwater, surface water, soil or plant tissue analyses) deemed necessary by the Division to insure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed. 2. Influent flow (as represented by effluent flow) shall be continuously monitored and daily flow values shall be reported on Form NDMR. The Perrnittee shall install an appropriate flow measurement device consistent with approved engineering and scientific practices to ensure the accuracy and reliability of influent or effluent flow measurement. Flow measurement devices selected shall be capable of measuring flows with a maximum deviation of less than 10 percent from true flow, accurately calibrated at a minimum of once per year, and maintained to ensure that the accuracy of the measurements is consistent with the accepted capability of that type of device. Records of flow measurement device calibration shall be kept on file by the Permittee for a period of at least three years. At a minimum, data to be included in this documentation shall be: a. Date of flow measurement device calibration b. Name of person performing calibration c. Percent from true flow 3. As an indicator of proper operation and maintenance, the facility shall produce an effluent in compliance with the following limitations: Parameter _ _ Monthly Averao Daily (Instantaneous) Maximum Flow 25,000 GPD BOD5 (5-day, 20°C) 10 mg/l 15 mg/l NH3 as N 4 mgll 6 mg/l TSS 5 mg/l 10 mg/l Fecal Coliform 14 per 100 mlb 25 per 100 ml Turbidity 10 NTU The effluent pH shall not be less than 6.0 standard units nor greater than 9.0 standard units. a Monthly averages for all but fecal coliform shall be the arithmetic mean of all samples collected during the reporting period. b Monthly average for fecal coliform shall be the geometric mean of all samples collected during the reporting period. Daily maximum shall be the maximum value of all samples collected during the reporting period. Effluent flow shall be measured to be representative of total flow treated in the wastewater treatment system. 2/Month sampling frequency only during the months of April through October. During the remainder of the year, these parameters shall be monitored monthly. *** Triannually sampling shall be conducted during March, July, and November. 4. A record of all exceedances of the effluent limits set forth in Condition 1113 shall be kept by the Permittee and shall be reported to the Division in accordance with Condition Ill 7. 5. The flow of reclaimed wastewater utilized as flushwater in the Aquarium shall be continuously monitored and daily flow values shall be reported as "flushwater flow" on Form NDMR. The Pei nittee shall install an appropriate flow measurement device consistent with approved engineering and scientific practices to ensure the accuracy and reliability of flow measurement. Flow measurement devices selected shall be capable of measuring flows with a maximum deviation of less than 10 percent from true flow, accurately calibrated at a minimum of once per year, and maintained to ensure that the accuracy of the measurements is consistent with the accepted capability of that type of device. Records of flow measurement device calibration shall be kept on file by the Permittee for a period of at least three years. At a minimum, data to be included in this documentation shall be; a. Date of flow measuremcnt device calibration b. Name of person performing calibration C. Percent from true flow G. Adequate records shall be maintained by the Permittee to track the amount of wastewater effluent applied onto the rapid rate infiltration units of the non -discharge disposal facilities. These records shall include, but shall not necessarily be limited to, the following items: a. Date of flow measurement device calibration b. Date and time of application; C. Volume of wastewater effluent applied; d. Rapid rate infiltration field irrigated; e. Length of time rapid rate infiltration Field is irrigated; f: Continuous daily, monthly, and year-to-date hydraulic loadings in gallons per day per square foot for each rapid rate infiltration field; and 6 g. Weather conditions. Fields shall be reported using the identifiers and acreage~ shown in Condition I. 25, 7. Three (3) copies of all monitoring data (as specified in condition Ill 2 and III 3) on Form NDMR-1 and three (3) copies of all operation and disposal records (as specified in condition III 4,11I 5, and III 6) on Form NDAR-2 shall be submitted monthly on or before the last day of the following month. A record shall be maintained of all residuals removed from this facility. This record shall include the name of the hauler, permit authorizing the disposal or a letter from a municipality agreeing to accept the residuals, date the residuals were hauled, and volume of residuals removed. 9. A maintenance log shall be maintained at this facility including but not limited to the following items: a. Daily sampling results of dissolved oxygen in the aeration basin and at the effluent weir. b. Visual observations of the plant and plant site. c. Record of preventative maintenance (changing of filters, adjusting belt tensions, alarmtesting, diffuser inspections and cleanings, etc.). d_ Date of calibration of flow measurement device. e. Date and results of power interruption testing on alternate power supply. 10. Noncompliance Notification: The Permittee shall report by telephone to the Wilmington Regional Office, telephone number (910) 395-3900, as soon as possible, but in no case msore than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence at the wastewater treatment facility which results in the treatment of significant amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a sludge digester; the known passage of a slug of hazardous substance through the facility; or any other unusual circumstances. b. Any process unit failure, due to known or unknown reasons, that render the facility incapable of adequate wastewater treatment such as mechanical or electrical failures of pumps, aerators, compressors, etc. c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. d. Any time that self -monitoring information indicates that the facility has gone out of compliance with its permit limitations. e. Any occurrence of wastewater effluent not meeting reclaimed wastewater limits as set forth in this Permit for more than five consecutive days. Occurrences outside normal business hours may also be reported to the Division's Emergency Response personnel at telephone number (800) 662-7956, (800) 858-0368, or (919) 733-3300. Persons reporting such occurrences by telephone shall also file a written report in letter form within five (5) days following first knowledge of the occurrence, This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. IV. GROUNDWATER REQUIREMENTS 1. Any groundwater quality monitoring, as deemed necessary by the Division, shall be provided 2. The Compliance Boundary for the disposal system is specified by regulations in 15A NCAC 2L, Groundwater Classifications and Standards. The Compliance Boundary for the disposal system individually permitted after December 31, 1983 is established at either (1) 250 feet from the waste disposal areas, or (2) 50 feet within the property boundary, whichever is closest to the waste disposal area. And exceedance of Groundwater Quality Standards at or beyond the Compliance Boundary is subject to immediate remediation action in addition to the penalty provisions applicable under General Statute 143-215.6A(a)(1). In accordance with 15A NCAC 2L, A Review boundary is established around the disposal systems midway between the Compliance Boundary and the perimeter of the waste disposal area. Any exceedance of standards at the Review Boundary shall require remediation action o the part of the Permittee. V. INSPECTIONS L Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. 2. The Permittee or his designee shall inspect the wastewater treatment and disposal facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall keep an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for a period of three years from the date of the inspection and shall be made available upon request to the Division or other permitting authority. 3. Any duly authorized officer, employee, or representative of the Division may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the disposal site or facility at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records that must be maintained under the terms and conditions of this permit, and may obtain samples of groundwater, surface water, or leachate. VI. GENERAL CONDITIONS 1. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 4. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 5. The issuance of this permit does not exempt the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction, including but not limited to applicable river buffer rules in 15A NCAC 2B.0200, erosion and sedimentation control requirements in 15A NCAC Chapter 4 and under the Division's General Permit NCG010000, and any requirements pertaining to wetlands under 15A NCAC 2B .0200 and 2H .0500. C. A set of approved plans and specifications for the subject project must be retained by the Permittee for the life of the project. 7. The annual administering and compliance fee must be paid by the Permittee within thirty days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15 NCAC 2H .0205 (c)(4). 8. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if warranted, will extend the permit for such period of time and under such conditions and limitations as it may deem appropriate.
