Your proposal has been reviewed and found to be consistent with the provisions and objectives of general permit No. SAWC080- N-000-0291. Therefore, you may commence construction activity in strict accordance with applicable State authorization and the enclosed plan. Failure to comply with the State authorization or conditions of the general permit could result in a violation of Federal law. If any change in your work is required because of unforeseen or altered conditions or for any other reason, plans revised to show the change must be sent promptly to this office and the North Carolina Division of Coastal Management prior to performing any such change or alteration. A. ) as requested in the permittee's application MU schedule as described in condition No. 1. This permit, issued.on /???G?? is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) The project must be carried out in keeping with: a) application for maintenance dredging dated April 2, 1987 including attached plats, sheets 1 and 2 o TdaUed' received 4/7/87; b) application for boat hoist piers dated 12/8/86 including attached plats, sheets-1-3 of 3 dates-12 3 86; and c) application for building addition dated 5/15/87, including attached plat, no date. Maintenance Dredging (2) In -order to protect juvenile shrimp populations, no excavation or filling will be permitted between the dates of April 1 and September 30 of any year without the prior approval of the N. C. Division of Coastal Management. (3) All excavated materials will be confined landward of the mean high water (MHW) elevation contour within adequate dikes or othe retaining structures to prevent spillover of solids into any vegetated wetlands or surrounding waters. (4) The terminal end of the pipeline from the dredge into the diked retention area will be positioned at or greater than 50 feet from any part of the (See attached sheet for Additional Conditions This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1990 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Permit 9138-87 Page 2 ADDITIONAL CONDITIONS dike and at a maximum distance from spillways to prevent dike erosion and to allow adequate settlement of suspended solids. (5) A water control structure will be installed at the intake end of the effluent pipe leading from the retention area in order to ensure maximum settlement of suspended solids. (6) Flow from the diked retention area will be confined by pipe, trough, or similar device- to a point at or below the mean low water (MLIJ) elevation contour to prevent gully erosion and resultant unnecessary siltation. (7) Vegetated wetlands will not be excavated or filled. (8) Excavation will not exceed 8 feet below the elevation of mean low water (MLW). (9), This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage or injury to the authorized structure or work which may be caused from existing or future operations undertaken by the United States in the public interest. (10) Prior %to use of the- Federal excavated material retention area adjacent to the AIWW across-from the marina,-the permittee will request and obtain specific, written permission from the Navigation Branch, llilmington District, Corps of Engineers, telephone (919) 343-02A. (11) Any -material required to be removed by dragl i ne will be trucked to and .contained . cn- an approved highground disposal area. Maintenance Clause The Division of Coastal Management will be notified in writing at least two (2) weeks in advance of any maintenance work (after Dec. 31, 1987) authorized by this permit and that notification include: A. the number of the original permit. B. a statement that no dimensional changes are proposed. C. A copy of the original permit plat(s) with cross-hatching indicating the area to be maintained, the area to be used for spoil, and the estimated amount of material to be removed. D. the date of map revision and the permittee's signature shown anew on the original plat. Marina Operation (12) The marina shall prominently post and enforce a no sewage discharge policy within the basin. (13) The marina will maintain, for the life of the project, a pumpout service for boats equipped with holding tanks. A sign will be posted at the marina indicating the availability of the pumpout. Permit-#138-87 Page 3 ADDITIONAL CONDITIONS (14) All floating structures, other than boats, used for habitation or commerce (as defined in 15 NCAC 7M.0602) shall be in conformance with local regulations for onshore sewage treatment. NOTE: The proposed project is certified under General Water Quality Certification No. 1273 issued on November 10, 1978, for discharges of liquid effluent from diked upland disposal areas. NOTE: This permit supercedes permit 5-75. It, however, authorizes all aspects of project maintenance and new work covered therein. Brunswick County The applicant proposes to perform maintenance dredging of an existing boat basin. The project is located adjacent to the AIWW, classified SC and closed to shellfishing. The project will use a hydraulic dredge, dredging to a depth of -8' MLW. The project has been reviewed to determine impacts to water quality. The project requires a 401 Water Quality Certification, but should meet the conditions of a General 401 Certification for discharge of liquid effluent from a diked disposal area. Box 10578 Southport, NC 28461 Dear Mr. Benson: The Division of Coastal Management hereby acknowledges receipt of your request for permit modification pertaining to Permit #5-75 to include maintenance dredging of a basin east of the harbor measuring approximately 1400' x 400' to an original depth of 8' MLW. This request was received on April 7, 1987 and appears to be adequate for processing at this time. The projected deadline for making a decision is June 22, 1987. An additional 75-day review period may be necessary and if so, you will be advised of the extension and the new deadline. NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the site of your proposed project. You should post this card at a conspicuous point along your property where it can be observed from a public road. Some examples would be: nailing the notice card to a telephone pole or tree along the road right-of-way fronting your property, or at a point along the road right-of-way where a private road would lead one into your property. Failure to post this Notice could result in an incomplete application. A field report has been prepared and is in the process of being circulated to the various state and federal review agencies for their comments. Page 2 9. PROJECT DESCRIPTION-: The proposed project is located in the Town of Southport Boat Harbor at the end of West Street. The site consists of a 500' wide by approximately 1400' long boat basin or boat harbor owned by the State of North Carolina and operated by Southport Marina, Inc. The basin lies adjacent to the AIWW and is connected to the waterway via a 250' wide "opening" between the waterway and the harbor. The North (Inland) side of the harbor houses the Marina office building and the adjacent high ground (approximately 8 acres) serves as a storage area for numerous boat and various scattered machinery. Four main pier provides facilities for approximately 25" finger piers" forming slips for dockage. In the initial construction of the harbor "wave barriers" of marshland and fill material (some 100' wide) were left between the harbor and the AIWW to provide protection from passing boat traffic. The applicant proposes to maintain the harbor to its original depth of 8' MLW and to include that portion on the east of the harbor which was dredge at the inception of the total basin. This portion of the basin measure approximately 300' long x 200' wide. Its maintenance was never permitted by the original Permit Number 5-75 or by any modification or renewal of that permit. Approximately 20,000 cubic yards of material is to be removed via a hydraulic dredge and pumped across the AIWW to a permanent spoil area just south of the harbor. No new work is proposed. 10. ANTICIPATED IMPACTS: The project appears to be strictly maintenance with no new work to be done. The proposed area appears to be diked and well suited for the project. Apparently the disposal site has previously been used by the Port Authority and the Corps of Engineers for routine maintenance.
