Klimek, P.E., Director Subject: Permit No. WQ0019098 Emergency Approval Town of Holly Springs Town of Holly Springs Residuals Land Application Program Land Application of Residual Solids (503) Wake County On July 23, 2004, the Division of Water Quality (Division) received a telephone request from Mr. Carl Dangerfield regarding the above -referenced permit. Specifically, Mr. Dangerfield described the Permittee's current situation with respect to its residuals land application program and requested the Division's consideration to approve acreage not presently permitted to receive residuals by Permit No. WQ0019098, issued on June 1, 2001, or the modified Attachment B, certified on November 12, 2002, for immediate use on an emergency basis only. This request for emergency approval has come about as the result of several occurrences. On December 31, 2003, a permit modification application package was received by the Division to approve additional land application sites as well as to increase the volume of residuals permitted for land application. The approval of the modified permit would help alleviate the current situation, but it is still pending as of this time. All existing sites are currently unavailable due to cropping restrictions or the fact that they have already received an agronomic application of residuals. The Permittee has been contracting with McGill Environmental Services of North Carolina, Inc. to dewater and haul residuals for composting; however, the contract has been very expensive and has depleted the operating budget for such emergency situations. The Perrmittee now has a full inventory of solids at the wastewater treatment plant that are in need of removal. Mr. Dangerfield requested that eight land application sites in Harnett County onto which the Permittee's residuals may be land applied be approved for emergency use. The sites are currently approved for use under the Town of Erwin's residuals land application program (i.e., Permit No. WQ0006119, issued on March 8, 2002) and are being proposed for transfer into the Permittee's residuals land application program in a permit modification application package received by the Division on July 10, 2004. Total 210.20 Mr. Grady Dobson of the Aquifer Protection Section of the Division's Fayetteville Regional Office, has previously investigated these land application sites when the sites were approved to receive residuals under the Town of Erwin's residuals land application program and determined that they were (1) adequately depicted in the attached maps and (2) suitable for residuals land application activities year- round. Note, however, that Site Nos. NC-HA-307-07, NC-HA-307-10, and NC-HA-307-11 do have seasonal water tables that are not well defined, so the actual depth to the water table shall be verified by soil borings within 24 hours prior to any residuals land application event. Residuals shall not be applied to any site when the vertical separation between the depth of application and the water table is less than three feet. Under these very special circumstances, the Division will allow the commencement of emergency residuals land application activities on the above -listed land application sites. The activities shall be limited to the application of up to 215 dry tons of residuals that need immediate removal from the Permittee's wastewater treatment plant (i.e., NPDES Permit No. NC0063096). All activities shall occur within 90 calendar days of the date of this correspondence. Mr. Thomas E. Tillage August 6, 2004 Page 3 Note that all other conditions and limitations of Permit No. WQ0019098, issued on June 1, 2001, and the modified Attachment B, certified on November 12, 2002, shall be valid and binding to these emergency residuals land application activities. Be aware that this approval is a one-time occurrence in that land application sites approved for use by this approval shall not receive additional residuals once this approval expires until the formal permit modification is approved by the Division. Finally, the Division requests that the Permittee notify its residuals management company that, as of this date, the sites are not to receive residuals from any other residuals source -generating facility (i.e., the Town of Erwin's wastewater and water treatment plants).
