This permit, issued on '/ 3 K 44l is subject to compliance with the application (where consistent

with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) In order to protect juvenile shrimp, no excavation or filling will be permitted
between the dates of April 1 and September 30 of any year without the prior
approval of the N. C. Division of Coastal Management.
(2) Excavation will not exceed 6 feet below the elevation of mean low water
(MLW). -
(3) Vegetated wetlands will not be excavated or filled.
(4) All excavated materials will be cdnfined landward of the mean high water
(MHW) elevation contour within adequate dikes or other retaining structures
to prevent spillover of solids into any vegetated wetlands or surrounding
waters.
(5) The terminal end of the pipeline from the dredge into the diked retention
area will be positioned at or greater than 50 feet from any part of the
dike and at a maximum distance from spillways to prevent dike erosion and
to allow adequate settlement of suspended solids.
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
perscnnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 1991
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

(6) A water control structure will be installed at the intake end of the effluent
pipe leading from the retention area in order to endure maximum settlement
of suspended solids.
(7) Flow from the diked retention area will be confined by pipe, trough or similar
device to a point at or below the mean low water (MLW) elevation contour
to prevent gully erosion and resultant unnecessary siltation.
(8) The diked spoil disposal area, and any additional areas of land disturbance,
will be properly graded and provided with a ground cover sufficient to restrain
erosion within 30 days of completion of the project.
(9) The activity will be conducted in such a manner as to prevent significant
increases in turbidity outside the area of construction or construction-related
discharge.
(10) Any changes in the proposed plans will require a reevaluation by the Division
of Coastal Management and a modification of this permit.
NOTE: The permittee, and/or his contractor, is urged to meet with a representative
of the Division of Coastal Management prior to project initiation.
NOTE: The proposed project is certified under General Water Quality Certification
No. 1273 issued on November 10, 1978, for discharges of liquid effluent
from diked upland disposal areas.
NOTE: The proposed bulkheads shown on the approved plats are exempt from CAMA
permitting requirements provided that their alignment averages 2', and
not more than a maximum of 5', from MHW at the time of construction.

Your proposal has been reviewed and found to be consistent
with our general permit No. SAWC('80-N-000-0291. Therefore, you
may commence construction in strict accordance with your State
authorization and the enclosed plan. Failure to comply with your
State authorization or conditions of the general permit could
result in a violation of Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, revised plans must
be sent to us and the North Carolina Division of Coastal
Management prior to accomplishing any such change or alteration.
Such action is necessary as revised plans must be reviewed and the
authorization modified.

Dear Mr. Parker:
Reference the application of Sound View Park Association,
Incorporated, represented by Mr. Jessie W. Davis, for Department
of the Army authorization to maintain a channel and canal and
construct and backfi.ll bulkheads off Bogue Sound, Sound View Park,
Newport, Carteret County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. The three bulkheads will be positioned in strict
accordance with permit plans.
b. All backfill materials will be obtained from an upland
source and confined landward of the permitted bulkhead.
c. The fill material will be clean and free of any pollutants
except in trace quantities. Metal products, organic materials, or
unsightly debris will not be used.
d. In order to protect juvenile shrmip, no excavation or
filling will be permitted between the dates of April 1 and
September 30 of any year without the prior approval of the North
Carolina Division of Coastal Management.

e. All excavated materials will be confined landward of the

Dear Mr. Mills:
Enclosed is the application of Sound View Park Association,
Inc. for a Department of the Army permit and a State Water Quality
Certification to construct a bulkhead and maintenance dredge off
of Bogue Sound at Sound View Park canals in Newport, Carteret
County, North Carolina.
We are considering authorization of the proposed activity
pursuant to Section 404 of the Clean Water Act, and we have
determined that a water quality certification may be required
under the provisions of Section 401 of the same law. A Department
of the Army permit will not be granted until the certification has
been obtained or waived.
In accordance with our administrative regulations, 60 days
after receipt of a request for certification is considered a
reasonable time for State action. Therefore, if your office has
not acted on the request by February 4, 1988, the District
Engineer will deem that waiver has occurred.

Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.

ing that agency's use of larger drawings.) A site or
location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the site. Include

On February 6, 1986, we renewed general permit No. SAWC080-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received November 27, 1987, for a
Department of the Army permit to constru,:t a bulkhead and
maintenance dredge off of Bogue Sound at Sound View Park on
Highway 24 west of Morehead City, in Carteret County, North
Carolina, indicates it to be a candidate for Federal authorization
under this general permit. Accordingly, the administrative
processing of your application will be accomplished by the North
Carolina Division of Coastal Management. Comments from Federal
review agencies will be furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be written and informed of its
further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such

9. NARRATIVE DESCRIPTION: Sound View Park Subdivision is
located off Highway 24 west of Morehead City, on Bogue
Sound, just east of Ho-Ho Village. This 52 acre
single-family subdivision with its series of highground
canals is the site of the proposed maintenance dredging
project as submitted by Mr. Jesse W. Davis, on behalf of the
Homeowners Association.

Although the permit request involves the interior canal
system, the most immediate need for maintenance dredging
occurs in the offshore access channel leading in from the
Intercoastal Waterway. Approximately 1900 cubic yards of
sandy spoil material will be removed from the access channel
which measures 300' long x 60' wide. This same area was
last maintenance dredged about 6 years ago. A small
hydraulic dredge will be used to pump the spoils to the
highground disposal site located on the west side of the
entrance canal. Messrs. Jesse Davis and John Stackhouse
will utilize their front yards as the disposal site. The
total area will measure about 250' long x 80' wide. Earthen
containment dikes will be pushed up around the perimeter,
and the effluent discharge will be emptied into the canal
entrance.
After the access channel has been cleared, the applicant
will, according to time and money, send a hydraulic dredge
up the interior canal system. It has been pointed out that
the association is responsible for the main leg of the
canal. Maintenance excavation of the remaining 5 finger
canals is the responsibility of the individual homeowners.
Nevertheless, State and Federal authorization for
maintenance within the finger canals is being included
through this permit request. Only a minor amount of
maintenance dredging will actually take place within the
main leg of the canal, and little to no dredging will take
place at this time in the finger canals.
The Homeowners Association is also proposing to construct 3
separate bulkheads in 3 different areas along the interior
canal system. Bulkhead #1 with a length of 40' will be
installed along the back end of Canal "B" as shown on the
workplat drawings where Holly Lane Road intersects with the
canal. The second bulkhead, 60' in length, will be
constructed adjacent to Sunset Boulevard, near the back end
of canal "E". The community boat ramp and recreational area
will be used as a spoil disposal site for future dredging
requirements. It is here on the north side of Canal "E"
that the third bulkhead of 160' in length will be
constructed. The proposed bulkheads will finish the job of

stabilizing the interior shoreline and will help protect the
highground banks nearest the two paved roads.
Background information gathered on this project indicates
that no submerged aquatic vegetation, occurs within the
project alignment. The "SA" surface waters of Bogue Sound
are closed to the taking of shellfish.
10. ANTICIPATED IMPACTS: The proposed maintenance dredging of
approximately 1900 cubic yards of sandy material from the
existing access channel should generate little to no
significant impacts on the estuarine resources of Bogue
Sound. It is hoped that the work can be accomplished during
the winter months when the biological activity of Bogue
Sound is lower than during the shrimping seasons.
Construction of the 3 bulkheads, and individual needs to
maintenance excavate the finger canals, all meet the
criteria for CAMA general permits. If necessary, individual
general permits can be issued to property owners as the
association's project passes through time. However, a total
review of Sound View Park's maintenance requirements
indicate that a unified approach to dredging is the best.
The proposed project does not involve the excavation or
filling of any coastal wetlands vegetation.

9. NARRATIVE DESCRIPTION: Sound View Park Subdivision is
located off Highway 24 west of Morehead City, on Hogue
Sound, just east of Ho-Ho Village. This 52 acre
single-family subdivision with its series of highground
canals is the site of the proposed maintenance dredging
project as submitted by Mr. Jesse W. Davis, on behalf of the
Homeowners Association.
Although the permit request involves the interior canal
system, the most immediate need for maintenance dredging
occurs in the offshore access channel leading in from the
Intercoastal Waterway. Approximately 1900 cubic yards of
sandy spoil material will be removed from the access channel
which measures 300' long x 60' wide. This same area was
last maintenance dredged about 6 years ago. A small
hydraulic dredge will be used to pump the spoils to the
highground disposal site located on the west side of the
entrance canal. Messrs. Jesse Davis and John Stackhouse
will utilize their front yards as the disposal site. The
total area will measure about 250' long x 80' wide. Earthen
containment dikes will be pushed up around the perimeter,
and the effluent discharge will be emptied into the canal
entrance.
After the access channel has been cleared, the applicant
will, according to time and money, send a hydraulic dredge
up the interior canal system. It has been pointed out that
the association is responsible for the main leg of the .
canal. Maintenance excavation of the remaining 5 finger
canals is the responsibility of the individual homeowners.
Nevertheless, State and Federal authorization for
maintenance within the finger canals is being included
through this permit request. Only a minor amount of
maintenance dredging will actually take place within the
main leg of the canal, and little to no dredging will take
place at this time in the finger canals.
The Homeowners Association is also proposing to construct 3
separate bulkheads in 3 different areas along the interior
canal system. Bulkhead #1 with a length of 40' will be
installed along the back end of Canal "B" as shown on the
workplat drawings where Holly Lane Road intersects with the
canal. The second bulkhead, 60' in length, will be
constructed adjacent to Sunset Boulevard, near the back end
of Canal "E". The community boat ramp and recreational area
will be used as a spoil disposal site for future dredging
requirements. It is here on the north side of Canal "E"
that the third bulkhead of 160' in length will be
constructed. The proposed bulkheads will finish the job of

stabilizing the interior shoreline and will help protect the
highground banks nearest the two paved roads.
Background information gathered on this project indicates
that no submerged aquatic vegetation, occurs within the
project alignment. The "SA" surface waters of Bogue Sound
are closed to the taking of shellfish.
10. ANTICIPATED IMPACTS: The proposed maintenance dredging of
approximately 1900 cubic yards of sandy material from the
existing access channel should generate little to no
significant impacts on the estuarine resources of Bogue
Sound. It is hoped that the work can be accomplished during
the winter months when the biological activity of Bogue
Sound is lower than during the shrimping seasons.
Construction of the 3 bulkheads, and individual needs to
maintenance excavate the finger canals, all meet the
criteria for CAMA general permits. If necessary, individual
general permits can be issued to property owners as the
association's project passes through time. However,.a total
review of Sound View Park's maintenance requirements
indicate that a unified approach to dredging is the best.
The proposed project does not involve the excavation or
filling of any coastal wetlands vegetation.

location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
