Reference the application of Mr. Joseph P. Singletary for
Department of the Army authorization to extend a dock on the
Atlantic Intracoastal Waterway (AIWW) at commercial fishhouse
facilities, Holden Beach, Brunswick County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. This permit does not authorize the interference with any
existing or proposed Federal project, and the permittee will not
be entitled to compensation for damage or injury to the authorized
structure or work which may be caused from operations undertaken
by the United States in the public interest.
b. This permit does not authorize interference with any
existing or proposed Federal project.
c. The permittee will maintain the authorized work in good
condition and in conformance with the terms and conditions of this
permit. The permittee is not relieved of this requirement if lie
abandons the permitted activity without having it transferred to a
third party.

d. Approval of the structure was based on determination that
there would be no obstruction to navigation. Under conditions
existing in the Atlantic Intracoastal Waterway (AIWW), a
possibility exists that the structure may be damaged by wavewash
from passing vessels. Unreasonable slowing down of vessel traffic
cannot be required because it would tend to nullify the
navigational benefits on which the AIWW was justified. Issuance
of this permit should not be construed as relieving the permittee
of taking proper steps to ensure the structure and moored boats
will not be damaged by wavewash normally to be expected in the
AIWW.

On February 6, 1986, we renewed general permit No. SAWC080-N-
000-0291 (copy enclosed), which provides Federal authorization for
construction act?-vities that receive authorization from the State
of North Carolina.
A review of you.- application received February 25, 1988, for
Department of the Army authorization to extend a deck at
commercial fishhouse facilities on the Atlantic Intracoastal.
Waterway (AIWW), Holden Beach, Brunswick County, North Carolina.,
indicates it to be a candidate for Federal authorization under
this general permit. Accordingly, the administrative processing
of your application will be accomplished by the North Carolina
Division of Coastal Management. Comments from Federal review
agencies will be furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be informed regarding its further
management. If there are no unresolved differences in State-
Federal positions or policies, the final action taken on your
application by the State will result in your receiving written
notice from us that your application is consistent with the
general permit and you may commence your activity. Only after
receiving such confirmation should you begin work.
Your application, pursuant to Section 10 of the River and
Harbor Act, has been assigned No. SA14C088-N-010-0196 and will be
coordinated by Mr. Ernest Jahnke. He is available at telephone

Community Development letter to you of October 13, 1987, we have
been inforned that your application for State authorization to
enlarge co=ercial fish house facilitiies over the Atlantic
Intracoastal Waterway (AII-Ai), Holden Beach, Brunswick County,
North Carolina, has been denL!d. The State found your proposal to
be inconsistent with the Coastal Area Management Act because of
the Coastal Resources Commission rule which requires that uses
which are not water dependent not be permitted in estuarine or
public waters. Under the administrative rules of our regulatory
program, denial of required State authorization precludes
favorable consideration of a Federal permit. Accordingly, your
Department of the army application is hereby denied, and your file
has been retired.
Additionally, the Corps of Engineers also has a longstanding
policy against construction of non-water dependent structures over
navigable waters of the United States. This policy prevents any
undue infringeent of the public's right to navigate upon State
waters. We agree with the State that upland alternatives are
available; and therefore, authorization of your work would be
contrary to the interests of the general public.

This letter is in response to your application request for a Coastal Area
Management Act (CAMA) permit to construct additional closed space facilities
over the waters of the AIWW at your fish processing business at Holden Beach
in Brunswick County. Processing of your application, under a joint state and
Federal review, is now complete. The application was accepted as complete on
June 19 and required review extension on September 14.
Based on the review, including assessment by cooperating state agencies
and onsite investigation, the Division of Coastal Management has made the
following findings:
1) The proposed development would take place on existing decking located
over the estuarine, public trust waters of the state;
2) The proposed closed structure development is determined to be non-water
dependent;
3) The long standing policy of the Corps of Engineers prevents that agency
from finding favorably on non-water dependent structures over water;
4) The proposed development is found to be inconsistent with Coastal
Resources Commission Rule NCAC 7H.0208(2)(1) which requires that uses
which are not water dependent not be permitted in estuarine or public
trust waters.
Given the foregoing findings, it is necessary that your request for a
CAMA permit be denied. This denial is pursuant to N.C.G.S. 113A-120(8) which
requires denial of a permit request found to be inconsistent with State
Guidelines for Areas of Environmental Concern.

While alternatives have not been discussed, it is possible that similar
facilities could be constructed adjacent to the existing decks over your high
ground property. Division of Coastal Management personnel are available to
discuss this matter with you.
If you wish to appeal this denial, you are entitled to a hearing. The
hearing will involve appearing before an Administrative Law Judge who listens
to the evidence and arguments of both parties and then makes a recommendation
to the Coastal Resources Commission. Your request for a hearing must be in
the form of a written petition, complying with the requirements of Chapter
150B of the General Statutes of North Carolina, and must be filed with the
Office of Administrative Hearings, P. 0. Drawer 11666, Raleigh, N. C. 27604,
within twenty days of receipt of this letter. A copy of the petition should
be filed with this office.
Also, you should be advised that as long as this State permit denial
stands, your project must be deemed inconsistent with the N. C. Coastal
Management program, thereby precluding issuance of Federal permits for this
project. The Federal Coastal 'Lone Management Act of 1972 (CZMA) gives the
right to appeal this finding to the U. S. Secretary of Commerce, within 30
days of receipt of this letter. Your appeal must be based on the grounds that
the proposed activity is (1) consistent with the objectives or purposes of the
CZMA, or (2) is necessary in the interest of national security, and thus, may
be federally approved.

Federal and State to enlarge commercial fish house facilities over

We have completed review of the proposal as presented by the
application and your field investigation report. The activity to
be conducted within the proposed facility is not dependent upon
being located over navigable waters of the United States. Since
1968, we have maintained a strong and consistent policy regarding
the construction of non-water dependent structures over navigable
waters. We have consistently denied Federal permits for
restaurants, offices, storage facilities, dwellings and other such
structures, the use of which did not require their location over
navigable waters. Neither State nor Federal authorization should
be made available for this proposal.

8. Project Summary The applicant proposes to enclose the existing, deck of his
business and to add an additional story over the enclosure.

9. PROJECT DESCRIPTION
The project is located on the south shore of the AIWW within Holden Beach. The
applicant has an existing business (fish house) a portion of which was built
over the water prior to the CAMA permits program. This building measures
approximately 39' x 50' and has two stories. There have been bulkheading and
docking added to the property which were added by permit.
The applicant proposes to add a tow-story addition to the existing building by
enclosing the area over the open deck. This addition will measure
approximately 20' wide x 38.6' long. An elevated deck would be added to the
second story along the AIWW. The dimensions of this feature are approximately
8' wide x 40' long. it would attach to the existing building as well as the
new addition.
10. ANTICIPATED IMPACTS
The building as proposed is not consistent with current regulations found in 7H
.0206(d) since the structure being proposed is not water dependent and could be
placed on high ground.

Dear Mr. Singletary:
On February 6, 1986, we renewed general permit No. SAWC080-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received April 23, 1987, for a
Department of the Army permit to enlarge commercial fishhouse
facilities on an existing dock on the Atlantic Intracoastal
Waterway (AIWW) at Holden Beach, Brunswick County, North Carolina,
indicates it to be a candidate for Federal authorization under
this general permit. Accordingly, the administrative processing
of your application will be accomplished by the North Carolina
Division of Coastal Management. Comments from Federal review
agencies will be furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be written and informed of its
further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the River and
Harbor Act, has been assigned No. SAWCO87-N-010-0336 and will be
coordinated by Mr. Ernest Jahnke. He is available to address
