In accordance with your application received July 17, 2000, we are forwarding herewith Permit Number.
WQ0018755, dated July 2, 2001, to R.L. Blanton & Co., Inc. for the construction and operation of the subject
wastewater treatment reclaimed water utilization system.
This permit shall be effective from the date of issuance until June 30, 2006, and shall be subject to the
conditions and limitations as specified therein. Please pay particular attention to the monitoring requirements in
this permit. Failure to establish an adequate system for -collecting and maintaining the required operational
information will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to
request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This
request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General
Statutes, and filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714.
Unless such demands are made this permit shall be final and binding.

amended, and other applicable Laws, Rules, and Regulations

construction and operation of a 100,000 GPD wastewater treatment and reclaimed water utilization system
consisting of a 25,000 gallon flow equalization tank with 85 CFM blower; dual 50 GPM flow equalization
pumps; one flow splitter box with bar screen and adjustable weirs; a 15,000 gallon aerated sludge holding
tank; dual 62,500 gallon coarse bubble aeration basins each with 500 CFM blower; dual 8,333 gallon
clarifiers; dual 35 square foot tertiary filter beds with 140 CFM blower; dual 525 GPM filter backwash pumps;
dual 90 GPM backwash surge (mudwell) pumps; dual 89 GPM effluent pumps; dual 90 GPM ultraviolet
disinfection units; turbidity sensor; flow sensor; 500,000 gallon detention upset pond; permanent standby
generator; and
a 13,000,000 effluent storage pond (130 days storage), 35 acres of spray irrigation area with sprayheads
located as noted on the attached drawings; to serve Castle Bay Reclaimed Water System with no discharge of
wastes to the surface waters, pursuant to the application received July 17, 2000 and in conformity with the
project plan, specifications, and other supporting data subsequently filed and approved by the Department of
Environment and Natural Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until June 30, 2006, and shall be subject to the
following specified conditions and limitations:
L PERFORMANCE STANDARDS
Upon completion of construction and prior to operation of this permitted facility, a certification
must be received from a professional engineer certifying that the permitted facility has been
installed in accordance with this permit, the approved plans and specifications, and other
supporting materials. If this project is to be completed in phases and partially certified, you shall
retain the responsibility to track further construction approved under the same permit, and shall

2. The Wilmington Regional Office, telephone number (910) 395-3900, shall be notified at least
forty-eight (48) hours in advance of operation of the installed facilities so that an in -place
inspection can be made. Such notification to the regional supervisor shall be made during the
normal office hours from -8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State
Holidays.
The reclaimed water utilization facilities shall be effectively maintained and operated at all times
so that there is no discharge to the surface waters, nor any contamination of ground waters which
will render them unsatisfactory for normal use. In the event that the facilities fail to perform
satisfactorily, including the creation of nuisance conditions or failure of the irrigation area to
adequately assimilate the wastewater, the Permittee shall take immediate corrective actions
including those actions that may be required by the Division of Water Quality (Division), such as
the construction of additional or replacement wastewater treatment and disposal facilities.
4. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to
surface or groundwaters resulting from the operation of this facility.
5. The residuals generated from these treatment facilities must be disposed in accordance with
General Statute 143-215.1 and in a manner approved by the Division.
6. Diversion or bypassing of the untreated wastewater from the treatment facilities is prohibited.
7. The following buffers shall be maintained:
a) 100 feet between wetted areas and water supply wells,
b) 100 feet between wetted areas and waters classified as SA,
c) 25 feet between wetted areas and surface waters not classified as SA,
d) 100 feet between wastewater treatment units and wells,
e) 50 feet between reclaimed water storage/irrigation ponds and property lines, and
f) 50 feet between wastewater treatment units and property lines.
8. Public access to the irrigation sites shall be controlled during active site use. Such controls may
include the posting of signs showing the activities being conducted at each site. A sign shall be
posted in plain sight in the club house showing these activities.
9. Effluent shall not be discharged into the 9,000,000 gallon irrigation pond or otherwise allowed to
commingle with irrigation (fresh) water.
II. OPERATION AND MAINTENANCE REQUIREMENTS
The facilities shall be properly maintained and operated at all times_
2. Upon classification of the facility by the Water Pollution Control System Operators Certification
Commission (WPCSOCC), the Permittee shall employ a certified wastewater treatment plant
operator to be in responsible charge (ORC) of the wastewater treatment facilities. The operator
must hold a certificate of the type and grade at least equivalent to or greater than the classification
assigned to the wastewater treatment facilities by the WPCSOCC. The Permittee must also
employ a certified back-up operator of the appropriate type and grade to comply with the
conditions of 15A NCAC 8G ,0202. The ORC of the facility must visit each Class I facility at
least weekly and each Class II, III, and IV facility at least daily, excluding weekends and holidays,
and must properly manage and document daily operation and maintenance of the facility and must
comply with all other conditions of 15A NCAC 8G .0202. Once the facility is classified, the
Permittee must submit a letter to the WPCSOCC which designates the operator in responsible
charge within thirty days after the wastewater treatment facilities are 50% complete.
A suitable, year-round vegetative cover of coastal bermudagrass overseeded with rye grass shall
be maintained on the irrigation areas.
4. Irrigation shall not be performed during inclement weather or when the ground is in a condition
that will cause runoff.
5. Adequate measures shall be taken to prevent wastewater runoff from the spray field.
6. The facilities shall be effectively maintained and operated as a non -discharge system to prevent
the discharge of any wastewater resulting from the operation of this facility.
7. The application rate for Goldsboro soils (Fields 3, 4, 5, 6) shall not exceed a cumulative loading of
31.27 inches over any twelve (12) month period at an instantaneous application rate not to exceed
0.5 inches per hour.
The application rate for Leon soils (Fields 1,2) shalI not exceed a cumulative loading of 66.31
inches over any twelve (12) month period at an instantaneous application rate not to exceed 0.6
inches per hour.
8. No type of wastewater other than that from Castle Bay Reclaimed Water System shall be sprayed
onto the irrigation area.
9. All wastewater shall be routed to the five-day holding pond should the limit for fecal coliform
(daily maximum concentration of 25 per 100 ml) or turbidity (instantaneous maximum of 10
NTU) be exceeded, until such time that the problems associated with the treatment capability of
the wastewater treatment plant have been corrected. The wastewater in the five-day holding pond
shall be pumped back to the treatment plant for retreatment or treated in the five-day pond prior to
discharge to the storage pond.
III. MONITORING AND REPORTING REQUIREMENTS
Any monitoring (including groundwater, surface water, soil or plant tissue analyses) deemed
necessary by the Division to insure surface and ground water protection will be established and an
acceptable sampling reporting schedule shall be followed.
2. Influent flow shall be continuously monitored and daily flow values shall be reported on Form
NDMR.
The Permittee shall install an appropriate flow measurement device consistent with approved
engineering and scientific practices to ensure the accuracy and reliability of influent flow
measurement. Flow measurement devices selected shall be capable of measuring flows with a
maximum deviation of less than 10 percent from true flow, accurately calibrated at a minimum of
once per year, and maintained to ensure that the accuracy of the measurements is consistent with
the accepted capability of that type of device. Records of flow measurement device calibration
shall be kept on file by the Permittee for a period of at least three years. At a minimum, data to be
included in this documentation shall be:
a. Date of flow measurement device calibration

3. As an indicator of proper operation and maintenance, the facility shall produce an effluent in
compliance with the following limitations:

The effluent from the subject facilities shall be monitored, by the Permittee, at the point prior to

The effluent pH shall not be less than 6.0 standard units nor greater than 9.0 standard units.

remainder of the year, these parameters shall be monitored monthly.
* TriannuaIly sampling shall be conducted during March, July, and November.
If Groundwater sampling indicates or predicts problems with the compliance with Groundwater
Standards, this permit will be modified to include additional and/or more restrictive limitations-

Adequate records shall be maintained by the Permittee tracking the amount of wastewater
disposed. These records shall include, but are not necessarily limited to the following
information:
a. date and time of irrigation,
b. volume of wastewater irrigated,
c. zone irrigated,
d. length of time zone is irrigated,
e. continuous weekly, monthly, and year-to-date hydraulic (inches/acre) loadings for each zone,
f, weather conditions, and
g. maintenance of cover crops.
4. Three (3) copies of all operation and disposal records (as specified in condition III 2) on Form
NDAR-1 and three (3) copies of all effluent monitoring data (as specified in condition III 3 and III
4) on Form NDMR-1 shall be submitted on or before the last day of the following month. All
information shall be submitted to the following address:

5. A record shall be maintained of all residuals removed from this facility. This record shall include
the name of the hauler, permit authorizing the disposal or a Ietter from a municipality agreeing to
accept the residuals, date the residuals were hauled, and volume of residuals removed.
6. A maintenance log shall be maintained at this facility including but not limited to the following
items:
a. Daily sampling results including residual chlorine, settleable matter, and dissolved oxygen in
the aeration basin and at the clarifier weir.
b. Visual observations of the plant and plant site.
c. Record of preventative maintenance (changing of filters, adjusting belt tensions, alarm testing,
diffuser inspections and cleanings, etc.).
d. Date of calibration of flow measurement device.
e. Date and results of power interruption testing on alternate power supply.
7. Noncompliance Notification:
The Permittee shall report by telephone to the Wilmington Regional Office, telephone number
(910) 395-3900, as soon as possible, but in no case more than 24 hours or on the next working day
following the occurrence or first knowledge of the occurrence of any of the following:
a. Any occurrence at the wastewater treatment facility which results in the treatment of
significant amounts of wastes which are abnormal in quantity or characteristic, such as the
dumping of the contents of a sludge digester, the known passage of a slug of hazardous
substance through the facility; or any other unusual circumstances.
b. Any process unit failure, due to known or unknown reasons, that render the facility incapable
of adequate wastewater treatment such as mechanical or electrical failures of pumps, aerators,
compressors, etc.
c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass
directly to receiving waters without treatment of all or any portion of the influent to such
station or facility.
d. Any time that self -monitoring information indicates that the facility has gone out of
compliance with its permit limitations. _
Persons reporting such occurrences by telephone shall also file a written report in letter form
within five (5) days following first knowledge of the occurrence. This report must outline the
actions taken or proposed to be taken to ensure that the problem does not recur.
IV. GROUNDWATER REQUIREMENTS
1. Prior to beginning waste disposal operations, three monitor wells shall be installed to monitor
groundwater quality in the immediate vicinity of the 13,000,000 gallon effluent storage pond. The
wells shall be constructed such that the water level in the well is never above or below the
screened (open) portion of the well at any time during the year. The general location for each well
(MW-1, MW-2, MW-3) Shall be approved by the Wilmington Regional Office prior to
installation. Each monitoring well shall be constructed in accordance with this permit, and
approved by the Wilmington Regional Office.
2. The wells must be constructed by either a North Carolina Certified Well Contractor, the property
owner, or the property lessee according to General Statutes 87-94.4(b)(2). If the construction is
not performed by a certified well contractor, the property owner or lessee must physically perform
the actual well construction activities, and the wells must be constructed according to the North
Carolina Well Construction Standards (15A NCAC 2C .0108) and the local county rules.
3. The Wilmington Regional Office, telephone number (910) 395-3900, shall be notified at least
forty-eight (48) hours prior to the construction of any monitoring well so that an inspection can be
made of the monitoring well location. Such notification to the regional groundwater supervisor
shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through
Friday, excluding state holidays.
4. Within thirty (30) days of completion of all well construction activities, a certification must be
received from a professional engineer or a licensed geologist certifying that the monitoring wells
are located according to the permit.
5. Monitor wells MW-1, MW-2, and MW-3 shall be sampled initially after construction and prior to
waste operations, and thereafter every March, July, and November for the parameters listed below.
Prior to sampling the parameters, the measurement of water levels must be taken. The depth to
water in each well shall be measured from the surveyed point on top of the casing. The measuring
points (top of well casing) of all monitoring wells shall be surveyed relative to a common datum.

If TOC concentrations greater than 10 mg/1 are detected in any downgradient monitoring well,
additional sampling and analysis must be conducted to identify the individual constituents
comprising this TOC concentration. If the TOC concentration as measured in the background
monitor well exceeds 10 mg/l, this concentration will be taken to represent the naturally occurring
TOC concentration. Any exceedances of this naturally occurring TOC concentration in the
downgradient wells shall be subject to the additional sampling and analysis as described above.
6. Any laboratory selected to analyze parameters must be Division of Water Quality (DWQ) certified
for those parameters required.

S. For the initial sampling of the wells as specified elsewhere in the permit, the permittee shall
submit a copy of the GW-1 Form (Well Completion Form) with the Compliance Monitoring Form
(GW-59) for each well to the address listed in Condition TV.7. Compliance Monitoring Forms
that do not include copies of the GW-I form will be returned to the permittee without being
processed. Failure to submit these forms as required by this permit may result in the initiation of
enforcement activities pursuant to NC General Statutes 143-215.6.
9. The results of the sampling and analysis must be received on Form GW-59 (Groundwater Quality
Monitoring: Compliance Report Form) by the Groundwater Section, on or before the last working
day of the month following the sampling month. The data of all groundwater sampling analyses
required by the permit conditions must be reported using the most recent GW-59 form along with
attached copies of the laboratory analyses. Mail this form to the Permits and Compliance Unit,
Groundwater Section, 1636 Mail Service Center, Raleigh, NC, 27699-1636.
10. Within sixty (60) days of completion of all monitoring wells, the permittee shall submit two
original copies of a scaled topographic map (scale no greater than 1":100) signed and sealed by a
professional engineer or a state licensed land surveyor that indicates all of the following
information:
a. the location and identity of each monitoring well,
b. the location of the major components of the waste disposal system,
c. the location of all property boundaries within 500 feet of the disposal areas,
d, the latitude and Iongitude of the established horizontal control monument,
e. the date of map preparation and the name of the preparer,
f. the relative elevation of the top of the well casing (which shall be known as the "measuring
point") relative to a common datum, and
g. the depth of water below the measuring point at the time the measuring point is established.
Control monuments shall be installed in such a manor and made of such materials that the
monument will not be destroyed due to activities that may take place on the property.
The maps and any supporting documentation shall be sent to the Permits and Compliance Unit,
Groundwater Section, 1636 Mail Service Center, Raleigh, NC, 27699-1636. The accuracy of the
map(s) and any supporting documentation shall be the responsibility of the permittee.
11. The COMPLIANCE BOUNDARY for the disposal system is specified by regulations in 15A
NCAC 2L, Groundwater Classifications and Standards. For disposal systems using reclaimed
water, regulation 15A 2H .0219(k) specifies that both the Compliance Boundary and the Review
Boundary are established at the property boundary. An exceedance of Groundwater Quality
Standards at or beyond the Compliance Boundary is subject to immediate remediation actio«
according to 15A NCAC 2L .0106(d)(2).
12. The 5-day upset pond shall have a liner of natural material at least one foot in thickness, with a
hydraulic conductivity of no greater than 1 x 10-6 cm/sec when compacted, or a synthetic liner of
sufficient thickness to exhibit structural integrity and an effective hydraulic conductivity of no
greater than that of the natural material liner, according to 15A NCAC 2H .0219(f). -
13. The treated wastewater shall only be applied at the recommended rates. The timing and duration
of each application shall have to be performed by the system operator and shall take into
consideration the antecedent moisture and infiltration conditions which exist at the time of the
application. Careful management of the spray applications will be necessary so as not to produce
saturated soil conditions a the surface of the ground during those times when there is high rainfall
and/or low evapotranspiration (particularly during the "wet" season).
14. Any additional groundwater quality monitoring, as deemed necessary by the Division, shall be
provided.
V. INSPECTIONS
1. Adequate inspection, maintenance, and cleaning shall be provided by the Pernaittee to insure
proper operation of the subject facilities.
2. The Permittee or his designee shall inspect the wastewater treatment and disposal facilities to
prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to
the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee
shall keep an inspection log or summary including at Ieast the date and time of inspection,
observations made, and any maintenance, repairs, or corrective actions taken by the Permittee.
This log of inspections shall be maintained by the Permittee for a period of three years from the
date of the inspection and shall be made available upon request to the Division or other permitting
authority.
Any duly authorized officer, employee, or representative of the Division may, upon presentation
of credentials, enter and inspect any property, premises or place on or related to the disposal site or
facility at any reasonable time for the purpose of determining compliance with this permit; may
inspect or copy any records that must be maintained under the terms and conditions of this permit,
and may obtain samples of groundwater, surface water, or leachate.
VI. GENERAL CONDITIONS
This permit shall become voidable unless the facilities are constructed in accordance with the
conditions of this permit, the approved plans and specifications, and other supporting data.
2. This permit is effective only with respect to the nature and volume of wastes described in the
application and other supporting data.
3. This permit is not transferable. In the event there is a desire for the facilities to change ownership,
or there is a name change of the Permittee, a formal permit request must be submitted to the
Division accompanied by an application fee, documentation from the parties involved, and other
supporting materials as may be appropriate. The approval of this request will be considered on its
merits and may or may not be approved.
4. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Division in accordance with North Carolina General
Statute 143-215.6A to 143-215.6C.
5. The issuance of this permit does not preclude the Permittee from complying with any and all
statutes, rules, regulations, or ordinances which may be imposed by other government agencies
(local, state, and federal) which have jurisdiction.
6. A set of approved plans and specifications for the subject project must be retained by the Permittee
for the life of the project.
7. The annual administering and compliance fee must be paid by the Permittee within thirty days
after being billed by the Division. Failure to pay the fee accordingly may cause the Division to
initiate action to revoke this permit as specified by 15 NCAC 2H .0205 (c)(4).
8. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its
extension. Upon receipt of the request, the Commission will review the adequacy of the facilities
described therein, and if warranted, will extend the permit for such period of time and under such
conditions and limitations as it may deem appropriate.

4. The DEVELOPER has created or shall create unit ownership in said dwelling units, other improvements, and lands
through filing of a Declaration of Unit Ownership (hereinafter Declaration), pursuant to Chapter 47C of the North
Carolina General Statutes.
a. The DEVELOPER has caused to be formed or will cause to be formed at the time of filing of the Declaration , the
Castle Bay Homeowners Association. (hereinafter ASSOCIATION) a non-profit corporation organized and existing
under and by the virtue of the lams of the State of North Carolina-, for the purpose, among others, of handling the
property. affairs_ and business of the Development of operating, maintaining, re -constructing- and repairing the
common elements of the lands and improvements subject to unit ownership, including the Disposal System; and of
collecting dues and assessments to proNzde funds for such operation, mairtenanct. re -construction- and repair-
6. The COMMMSION desires to assure that the Disposal System of the Development is properly constructed,
maintained, and operated in accordance with law and permit provisions in order to protect the quality of the waters of
the State and the public interest therein.
NOW, TtIEREFORE, in consideration of the promises and the benefits to be derived by each of the parties hereto, the
COMMISSION and DEVELOPER do hereby mutually agree as follows:
I - The DEVELOPER shall construct the Disposal System in accordance with the permit and plans and specifications
hereafter issued and approved by the COMMISSION; and shall thereafter properly operate and maintain such
systems and facilities in accordance with applicable permit provisions and Iaw.
2. The DEVELOPER shall not transfer ownership and/or control of the Disposal System to the Association until
construction has been completed in accordance with the permit and approved plans, and the staff of the Division of
Water Quality has inspected and approved of the facilities. In order to change the name of the permit holder, the
DEVELOPER must request that the permit be reissued to the Association- The request must include a copy of the
Association Bylaws and Declaration-
3 - The DEVELOPER shall not transfer, convey, assign, or otherwise relinquish or release its responsibility for the
operation and maintenance of its Disposal System until a permit has been reissued to the DEVELOPER's successor.
4. The DEVELOPER shall prmide in the Declaration and Association Bylaws that the Disposal System and
appurtenances thereto are part of the common elements and shall thereafter by properly maintained and operated in
