C. 27520 Subject: Permit No. WQ0018594 Town of Clayton Riverwood Elementary School Wastewater Pump and Haul Johnston County Dear Mr. Biggs: In accordance with the request received on May 25, 2000, we are forwarding herewith Permit No. WQ0018594, which is dated June 14, 2000, to the Town of Clayton for the operation of the subject wastewater pump and haul activities. This permit shall be effective from the date of issuance until December 14, 2000, and shall be subject to the conditions and limitations as specified therein. Please pay particular attention to the monitoring requirements in this permit. Failure to establish an adequate system for collecting and maintaining the required operational information will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. Unless such demands are made, this permit shall be final and binding. Janowski & Assoc., 105 Suite C East Victoria Ct., Greenville, NC 27858) file:h:lp&hlwq 18594.p&h NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES RALEIGH PUMP AND HAUL PERMIT In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION IS HEREBY GRANTED TO Town of Clayton Johnston County FOR THE operation of an approximately 6000 GPD wastewater pump and haul activity which consists of the pumping and hauling of domestic wastewater from Riverwood Elementary School to the Town of Clayton Little Creek Wastewater Treatment Plant; wastewater will be pumped from a 10,000 gallon buried concrete tank which will be installed at the school site, with no discharge of wastes to the surface waters, pursuant to the request received on May 25, 2000, and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Environment and Natural Resources and considered a part of this permit. This pemiit shall be effective from the date of issuance until December 14, 2000, and shall be subject to the following specified conditions and limitations: 1. This permit shall become voidable unless the subject pump and haul activities are carried out in a manner which has been approved by this Division. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. The facilities shall be properly maintained and operated at all times. Page 1 of 5 Permit No. WQ0018594 (6/1412000) 4. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 5. No type of wastewater other than the domestic wastewater from Riverwood Elementary School shall be included in these pump and haul activities. 6. This permit shall become voidable unless the agreement between the Town of Clayton and Davis Septic Tank Cleaning for the collection and transportation of the domestic wastewater is in full force and effect. 7. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall cease operation of all pump and haul activities and take such immediate corrective action as may be required by this Division. 8. The sewage and wastewater collected by this system shall be treated in the Town of Clayton Little Creek Wastewater Treatment Facility prior to being discharged into the receiving stream. 9. The Permittee is liable for any damages caused by a spill or failure of the pump and haul operations. 10. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. 11. The Permittee or his designee shall inspect the pump and haul collection facilities to prevent malfunctions and deterioration, operator errors, and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. 12. The Permittee shall keep an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for as long as the pump and haul activities are being conducted and shall be made available upon request to the Division of Water Quality or other permitting authority. 13. Any duly authorized officer, employee, or representative of the Division of Water Quality may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the pump and haul collection facilities at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records that must be maintained under the terms and conditions of this permit; and may obtain samples. An accurate record of the monthly pump and haul activities must be maintained by the Permittee, indicating: a) date wastewater is removed from the facility, b) name of facility from which wastewater is removed, C) name of facility receiving wastewater, d) volume of wastewater removed, and e) status/update on the permanent disposal option. These records shall be submitted monthly (by the fifteenth of the following month) to the Raleigh Regional Water Quality Supervisor, Department of Environment and Natural Resources, 1628 Mail Service Center, Raleigh, NC 27699-1628. If no pump and haul activities occur during a month, submit a record so stating. 15. Failure to abide by the conditions and limitations contained in this permit may subject the Pennittee to an enforcement action by the Division of Water Quality in accordance with North Carolina General Statute 143-215.6A. 16. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 17. Noncompliance Notification: The Permittee shall report by telephone to the Raleigh Regional Office, telephone no. 919/571- 4700, as soon as possible, but in no ease more than twenty-four (24) hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any process unit failure, due to known or unknown reasons, that render the facility incapable of adequate wastewater treatment such as mechanical or electrical failures of pumps, aerators, compressors, etc. b_ Any failure of a pumping station, sewer line, etc., resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. Persons reporting such occurrences by telephone shall also file a written report in letter form within fifteen (15) days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. Page 3 of 5 Permit No. WQ0018594 (6114/2000) 18. When these pump and haul activities are no longer necessary, the Town of Clayton shall provide the Division's Raleigh Regional Office with a written explanation of why the pump and haul activities are no longer necessary and a request that this permit be voided. 19. The facilities shall be inspected and pumped as often as necessary to prevent overflows and nuisances. 20. Upon completion of construction and prior to operation of these pump and haul activities, a certification must be received from a professional engineer certifying that the facilities associated with the pump and haul operation have been installed in accordance with this permit and the submitted information. Mail the certification to the Raleigh Regional Water Quality Supervisor, Raleigh Regional Office, Department of Environment and Natural Resources, 1628 Mail Service Center, Raleigh, NC 27699-1628. This Engineer's Certification includes all on-site sewer line building sewers/laterals that will convey wastewater to the pump and haul storage tank, the installation of the buried 10,000 gallon concrete storage tank with audible and visual high water alarm, and all sewers which will convey wastewater to the storage tank. SUBJECT Request for Issuance of Pump & Haul Permit Staff Report Memo -Permit No. WQ0018595 County of Edgecombe QVC Edgecombe County Attached is a draft pump and haul permit for the subject facility. As you know, the sewer extensions that will ultimately serve the QVC facility in Edgecombe County will not be constructed for awhile. We asked for guidance on the issuance of this P&H and Greg Thorpe thought that it was appropriate to issue this one. The applicant is the County of Edgecombe and the wastewater will be P&H'ed to the City of Rocky Mount's WWTF. The permit is dated 6115100, and is set to expire on 12/15100. Pumping and hauling will occur from the gravity sewers, the wetwell, and an emergency storage tank on the site.
