Dear Mr. Bonne:
In accordance with your permit modification application received December 10, 2007, we are
forwarding herewith Permit Number WQ0018489, dated January 17, 2008, to the Town of Cary for the
continued operation of the subject wastewater treatment, reclaimed water utilization system and bulk fill
operation. Iri this permit, an average expected bulk distributed flow is increased from 100,000 to 300,000
gallons per day and being removed from the effluent limits stipulated under Condition IV.2 of this permit.
Also, the permit modification incorporated herein approves the operation of a bulk reclaimed water fill
station with approved uses limited to:
(1) Irrigation of public and private landscapes and turf;
(2) Street sweeping (not street cleaning);
(3) Sewer cleaning by the Town of Cary personnel or the Town of Cary authorized contractors;
(4) Soil compaction and dust suppression;
(5) Non -potable processes such as concrete production and cooling water;
(6) Industrial and commercial toilet flush and fire prevention systems where there are separate,
non -potable plumbing lines;
(7) Decorative ponds and fountains;
(8) Fire fighting and fire extinguishing;
(9) Power washing;
(10) Vehicle washing (municipal vehicles or commercial);
(11) Asphalt reclamation; and
(12) Saline slurry make-up water for application to roads to prevent freezing_
This permit shall be effective from the date of issuance until June 30, 2010; shall void Permit No.
WQ0018489 issued July 18, 2005 and shall be subject to the conditions and limitations as specified
therein.
Please pay particular attention to the monitoring requirements in this permit. Failure to establish an
adequate system for collecting and maintaining the required operational information will result in future
compliance problems. Of special 'interest to you may be the following:

♦ Condition V.2., If any single party obtains more than 25,000 gallons of reclaimed water from
the bulk fill operation in any single day, or more than 100,000 gallons in any single week, the
Town of Cary shall visit the sites where that party is using the reclaimed water to ensure
compliance with the conditions of this permit. The Town of Cary shall maintain records of
those site visits for at least three years
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of
this permit. This request must be in the form of a written petition, conforming to Chapter 150E of the
North Carolina General Statutes, and filed with the Office of Administrative Hearings, 6714 Mail Service
Center, Raleigh, NC 27699-6714. Unless such demands are made this permit shall be final and binding.

WATER DISTRIBUTION PERMIT
In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as
amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
continued operation of a 100,000 gallon per day (GPD) bulk reclaimed water distribution program and all
associated facilities at the South Cary Water Reclamation Facility (NPDES Permit No. NC0065102).
Bulk reclaimed water, following treatment and testing according to the water reclamation facility's
existing NPDES permit and the conditions provided herein, may be manually distributed from a two-inch
hose connected to a quick -connect coupling and gate valve tapped onto an existing four -inch non -potable
water line that serves the water reclamation facility. All reclaimed water distributed must be measured
and recorded by a flow -metering device. Bulk reclaimed water may only be distributed to approved
trucks and drivers for the following uses:
(1) Irrigation of public and private landscapes and turf;
(2) Street sweeping (not street cleaning);
(3) Sewer cleaning by the Town of Cary personnel or the Town of Cary authorized contractors;
(4) Soil compaction and dust suppression;
(5) Non -potable processes such as concrete production and cooling water;
(6) Industrial and commercial toilet flush and fire prevention systems where there are separate,
non -potable plumbing lines;
(7) Decorative ponds and fountains;
(8) Fire fighting and fire extinguishing;
(9) Power washing;
(10) Vehicle washing (municipal vehicles or commercial);
(11) Asphalt reclamation; and
(12) Saline slurry make-up water for application to roads to prevent freezing; the
continued operation of the South Cary Reclaimed Water Program. Reclaimed water, following treatment
and testing according to the most recent issuance of the South Cary Water Reclamation Facility's NPDES
permit and compliance with the conditions provided herein, may be diverted to the permitted reclaimed
water treatment and distribution facilities for the purpose of supplying a reclaimed water demand not to
exceed 864,000 gallons per peak day to residential, commercial, industrial, and institutional users (i.e.,
including Middle Creek Park and Middle Creek High School).

The reclaimed water treatment and distribution facilities associated with the South Cary Water
Reclamation Facility shall consist of the following minimum components: two (2) continuous turbidity
monitoring and recording devices with audible and visual alarms and automatic shut-off controls at the
existing ultraviolet disinfection and effluent structure; two (2) 600 gallon per minute (GPM) vertical
turbine constant speed pumps with a low water level alarm and automatic shut-off control at the existing
effluent structure wet well; a treatment system consisting of a 1,000 gallon fiberglass reinforced plastic
hypochlorite storage tank, two (2) five GPM metering pumps, two (2) 12 GPM booster pumps, and an in -
line hypochlorite static mixer; a 8,000 gallon hydropneumatic tank with a water level control system and
air compressor; a magnetic flow meter; a pressure gauge; a chlorine residual analyzer; approximately
6,235 linear feet of 12-inch distribution piping; approximately 1,531 linear feet of eight -inch distribution
piping; and all metered services, isolation valves, air release valves, blow -off assemblies, fittings, piping,
instrumentation control systems, electrical items, and other related appurtenances required to make a
complete and operational reclaimed water treatment and distribution facilities to serve residential,
commercial, industrial, and institutional users in the service area for the South Cary Reclaimed Water
Program.
South Cary Reclaimed Water Program shall be operated such that no discharge of wastes to surface
waters occurs, pursuant to the application received December 10, 2007 and in conformity with the project
plan, specifications, and other supporting data subsequently filed and approved by the Department of
Environment and Natural Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until rune 30, 2010; shall void Permit No.
WQ0018489 issued July 18, 2005 and shall be subject to the following specified conditions and
limitations:
I. SCHEDULES lease review the entire permit for Leporting, monitoring,and other on -going activities
1. No later than six months prior to the expiration of this permit, the Permittee shall request renewal of
this permit on official Division forms. Upon receipt of the request, the Division will review the
adequacy of the facilities described therein, and if warranted, will extend the permit for such period of
time and under such conditions and limitations as it may deem appropriate. Please note that Rule
15A NCAC 02T ,0105(d) requires an updated site map to be submitted with the permit renewal
application.
II. PERFORMANCE STANDARDS
The South Cary Reclaimed Water Program and all associated facilities shall be effectively
constructed, maintained, and operated at all times so that there is no discharge to surface waters, nor
any contamination of groundwater which will render them unsatisfactory for normal use. In the event
that the program and/or facilities fail to perform satisfactorily, including the creation of nuisance
conditions or failure of the application areas to adequately assimilate the reclaimed water, the
Permittee shall take immediate corrective actions including those actions that may be required by the
Division of Water Quality, such as the construction of additional or replacement reclaimed water
treatment facilities or cessation of the operation of the reclaimed water and/or bulk reclaimed water
distribution program(s).
2. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface
water or groundwater resulting from the operation of the South Cary Reclaimed Water Program and
all associated facilities.
3. The Permittee shall maintain a Spill Prevention, Countermeasures, and Control Plan for the water
reclamation facility, as well as for the bulk reclaimed water distribution program.
4. Diversion or bypassing of the untreated wastewater from the South Cary Reclaimed Water Program,
bulk reclaimed water distribution and all associated facilities shall be strictly prohibited.

The bulls reclaimed water distribution main isolation/operating valve shall be located in a below -
grade vault that shall be labeled as being of non -potable quality. The facilities shall be accessible and
operated by authorized personnel only.
6. The Permittee shall ensure that sufficient, permanent notification is posted in all use areas connected
to the South Cary Reclaimed Water Program and all associated facilities that intend to use the
reclaimed water for industrial purposes such as process or cooling water, aesthetic purposes such as
decorative ponds or fountains, dust control, soil compaction for construction purposes, and street
sweeping. The notification shall be designed to inform employees and the public of the use of
reclaimed water in the use area and that the reclaimed water is not intended for drinking.
7. The following shall be requirements for the South Cary Reclaimed Water Program and all associated
facilities:
a. All reclaimed water valves, storage facilities, and outlets shall be tagged or labeled to warn
the public or employees that the water is not intended for drinking, Where appropriate, such
warning shall inform the public or employees to avoid contact with the water.
b. All reclaimed water piping, valves, outlets, and other appurtenances shall be color -coded,
taped, or otherwise marked to identify the source of the water as being reclaimed water.
i. All reclaimed water piping and appurtenances shall be either colored purple (i.e., Pantone
522) and embossed or integrally stamped or marked "CAUTION: RECLAIMED
WATER — DO NOT DRINK" or be installed with a purple (i.e., Pantone 522)
identification tape or polyethylene vinyl wrap. The warning shall be stamped on opposite
sides of the pipe and repeated every three feet or less.
ii. Identification tape shall be at least three inches wide and have white or black lettering on
purple (i.e., Pantone 522) field stating "CAUTION: RECLAIMED WATER — DO NOT
DRINK." Identification tape shall be installed on top of reclaimed water pipelines,
fastened at least every 10 feet to each pipe length and run continuously the entire length
of the pipe.
c. All reclaimed water valves and outlets shall be of a type, or secured in a manner, that permits
operation by authorized personnel only.
d. Above -ground hose bibs (i.e., spigots or other hand -operated connections), except those
located at the South Cary Reclaimed Water Facility, shall not be present. Hose bibs shall be
located in locked below -grade vaults that shall be clearly labeled as being of non -potable
quality. As an alternative to the use of locked below -grade vaults with standard hose bibs
services, hose bibs, which can only be operated by a special tool or connected to a special
hose connection may be. placed in non -lockable underground services boxes clearly labeled as
non -potable water.
8. The Permittee shall approve all tank trucks that will use the South Cary Reclaimed Water Program
prior to their receiving reclaimed water. Tank trucks shall meet the following minimum criteria:
a. Tank trucks and other equipment used to distribute reclaimed water shall be clearly identified
with advisory signs.
b. Tank trucks used to transport reclaimed water shall not be used to transport potable water that
is used for drinking or other potable purposes.
c. Tank trucks used to transport reclaimed water shall not be filled through on -board piping or
removable hoses that may subsequently be used to fill tanks with water from a potable water
supply.
d. Tank trucks used to transport septage, raw wastewater, or wastewater residuals shall not be
used to transport reclaimed water.

9. The Permittee shall approve tank track drivers for participation in the bulk reclaimed water
distribution program prior to distribution of reclaimed water. In addition, the Permittee shall provide
bilingual (English and Spanish) training to all tank truck drivers approved to participate in the built
reclaimed water distribution program at a regular frequency. These sessions shall provide training on,
but not limited to, the following topics:
a. Reclaimed water description and safety,
b. Approved and disapproved uses of reclaimed water,
c. Procedures for the application (including buffer maintenance), uses, and storage of reclaimed
water as well as the disposal of unused reclaimed water,
d. Procedures for spill prevention, countermeasures, and control as well as notification
requirements,
e. Personal safety and hygiene issues, and
f. Interaction with the general public.
10. The Permittee shall maintain an active cross -connection control program for the South Cary
Reclaimed Water Program and all associated facilities that shall have the following minimum
requirements:
a. No direct cross -connections shall be allowed between the reclaimed water and potable water
systems.
b. A reduced pressure principle backflow preventer, an approved air gap separation, or other
device approved by the Division of Environmental Health shall be installed at the potable
water service connection to the use area where both reclaimed water and potable water are
supplied to a reclaimed water use area. The installation of the reduced pressure principle
backflow prevention device shall allow proper testing.
c. An air gap separation, approved and regularly inspected by the Permittee shall be provided
between the potable water and reclaimed water systems where potable water is used to
supplement a reclaimed water system.
11. The following setbacks shall be maintained during application or use of reclaimed water distributed
through the South Cary Reclaimed Water Program and all associated facilities:
a. 100 feet between wetted areas and water supply wells;
b. 10 feet between wetted areas and non -potable well;
c. 100 feet between wetted areas and waters classified as SA, including wetlands as delineated
and designated by the appropriate state or federal agency; and
d. 25 feet between wetted areas and surface waters not classified as SA, including wetlands as
delineated or designated by the appropriate state or federal agency or any swimming pool.
12. The Compliance Boundary and Review Boundary, as defined in 15A NCAC 2H .0219
(k)(2)(B)(i)(IV), shall be located at the property line of any use area receiving reclaimed water
through the South Cary Reclaimed Water Program and all associated facilities.
13. Public access to the reclaimed water treatment, storage, and distribution facilities associated with the
South Cary Reclaimed Water Program as well as contact with reclaimed water shall be controlled
during reclaimed water use. Such controls may include fencing as well as various educational
materials/programming.

14. The following uses of reclaimed water distributed through the South Cary Reclaimed Water Program
and all associated facilities shall be strictly forbidden by the Permittee:
a. Irrigation of direct food crops;
b. Filling of swimming pools, hot tubs, or similar uses;
c. Use as a raw potable water supply;
d. Use after 72 hours of storage (i.e., not including time spent in storage at the South Cary
Reclaimed Water Facility or in the reclaimed water distribution system); and
e. Any use that would result in runoff of reclaimed water from the location of application or
point of use.
In the event there is a desire for the permitting of additional uses, a formal permit modification
request must be submitted to the Division accompanied by an application fee and other supporting
materials as may be appropriate. The approval of this request shall be considered on its merits and
may or may not be approved.
15. The Permittee shall be approved to connect existing and new residential, commercial, industrial, and
institutional users to the South Cary Reclaimed Water Program and all associated facilities without
prior application and receipt of a permit modification from the Division. Note, however, that this
approval shall not extend to self -permitting of extensions to the reclaimed water distribution system.
As part of this approval, the Permittee shall be responsible for developing, implementing, and
maintaining the following minimum programs for ensuring the effective management of the local
approval program, as well as its compliance with the conditions of this permit:
a. An application program that would require each proposed user to gain prior approval from
the Permittee to connect to the reclaimed water distribution system or modify their existing
reclaimed water use. During the application review, the Permittee shall be responsible for
completing the following minimum tasks: reviewing the proposed reclaimed water use,
approving the design of any permanent reclaimed water distribution system within the
reclaimed water use area, ensuring that cross -connection control issues and compliance with
all applicable local ordinances are addressed within the reclaimed water use area, as well as
consulting with the user regarding allowable reclaimed water loading rates and volumes.
This application process shall also be initiated any time that a property transfers to a new
proposed user.(e.g., sale of a house, etc.).
b. A connection inspection program that would require the Permittee to perform an on -site
assessment of the proposed user's reclaimed water use area. During the connection
inspection, the Permittee shall be responsible for completing the following minimum tasks:
ensuring that no cross connections between the reclaimed water system and potable water
system exist and that the appropriate cross -connection control devices have been installed
within the reclaimed water use area and are functioning properly; verifying that any
permanent reclaimed water distribution system within the reclaimed water use area will not
result in overspray, overapplication, or runoff from the location of application or point of use;
determining that adequate notification is provided to employees and the public regarding
reclaimed water uses that are industrial in nature; as well as disseminating educational
material regarding use of the reclaimed water system and compliance with all applicable local
ordinances.
c. A follow-up inspection program that would require an on -site assessment of each residential,
commercial, industrial, and institutional user connected to the reclaimed water distribution
system once per permit cycle. The minimum, tasks associated with the follow-up inspection
shall be the sane as that associated with the connection inspection.

d. A compliance and enforcement program that would require the Permittee to ensure
compliance with the conditions of this permit as well as all applicable local ordinances. The
program shall include a component to address non-compliance with respect to the use of the
reclaimed water system by each type of user (i.e., residential, commercial, industrial, and
institutional).
e. A spill prevention, control, and notification, program that would require the Permittee to
comply with other conditions contained in this permit.
16. The Permittee shall develop, implement, and maintain an on -going, comprehensive educational
program regarding the South Cary Reclaimed Water Program and all associated facilities. This
program shall be designed to be multi -faceted in that several audiences that may use, come into
contact with, or install systems associated with reclaimed water shall be specifically targeted. Target
audiences shall include, but shall not be limited to, the following:
a. Permittee's staff (i.e., especially inspection staff);
b. Residential, commercial, industrial, and institutional users;
c. Landscaping and lawn care companies;
d. Irrigation system installers;
e. Tank track drivers; and
f. Construction companies and other contractors (i.e., especially plumbing contractors).
All educational programming and materials shall be available in English and Spanish and may be in
the form of formal training sessions, public meetings, publication of notices in local newspapers,
notification through television and radio news programs, maintenance of an informational web site, as
well as the distribution of flyers or any combination thereof. The following is a non -inclusive list of
topics that may be included in educational programming and materials (i.e., various target audiences
may have needs that are specific to their involvement with the South Cary Reclaimed Water Program
and all associated facilities):
a. Reclaimed water description and safety;
b. Review of all applicable local ordinances (i.e., "Waste While Watering," "Rain Sensor," and
"Reclaimed Water") as well as the consequences associated with violating any of the
requirements contained therein;
c, Review of application and review process, permit approval, and inspection requirements;
d. Approved and disapproved uses of reclaimed water;
e. Procedures for application (i.e., including buffer maintenance and application rate
determination), use, and storage of reclaimed water as well as the disposal of unused
reclaimed water;
£ Procedures for spill prevention, control, and notificationn requirements;
g. Personal safety and hygiene issues;
h. Description of labeling requirements and security measures (i.e., special hose fittings, locked
valve boxes, special pipe color, etc.);
i. Cross -connection control program description.
III. OPERATION AND MAINTENANCE REQUIREMENTS
1. The South Cary Reclaimed Water Program and all associated facilities shall be properly maintained
and operated at all times.

2. Upon classification of the facilities by the Water Pollution Control System Operators Certification
Commission (WPCSOCC), the Permittee shall employ a certified operator to be in responsible charge
(ORC) of the facilities. The operator shall hold a certificate of the type and grade at least equivalent to
or greater than the classification assigned to the facilities by the WPCSOCC. The Permittee shall also
employ a certified back-up operator of the appropriate type and grade to comply with the conditions
of 15A NCAC 8G .0202. The ORC of the facilities shall visit each Class I facility at least weekly and
each Class II, III, and IV facility at least daily, excluding weekends and legal holidays, shall properly
manage and document daily operation and maintenance of the facilities, and shall comply with all
other conditions of 15A NCAC 8G .0202. Once the facilities are classified, the Permittee shall submit
a letter to the WPCSOCC that designates the ORC within 30 days after the facilities are 50 percent
complete.
3. A certified operator of a grade equivalent or greater than the water reclamation facility shall be on call
24 hours per day.
4_ All wastewater shall either be routed to the headworks of the reclaimed water facility or discharged in
strict accordance with the conditions of the facility's existing NPDES permit should the limit for fecal
coliform (i.e., daily maximum concentration of 25 per 100 milliliters) or turbidity (i.e., instantaneous
maximum of 10 nephelometric turbidity units) be exceeded and not distributed into the South Cary
Reclaimed Water Program and all associated facilities, until such time that the levels have stabilized
below these maximum. levels.
5. No type of reclaimed water other than that from South Cary Water Reclamation Facility (i.e., NPDES
Permit No. NC0065102) shall be distributed through the South Cary Reclaimed Water Program and
all associated facilities.
6. The South Cary Reclaimed Water Program and all associated facilities shall be effectively maintained
and operated as a non -discharge system to prevent the discharge of any reclaimed water resulting
from the operation of the program and the facilities.
7. Reclaimed water from the South Cary Reclaimed Water Program and all associated facilities shall not
be used for land -based activities during inclement weather or when the ground is in a condition that
will cause runoff from the location of application or point of use.
8. The Permittee shall implement adequate measures to prevent reclaimed water runoff from the
application areas and points of use served by the South Cary Reclaimed Water Program and all
associated facilities.
9. All reclaimed water distributed through the South Cary Bulk Reclaimed Water Program and all
associated facilities, but not used within a period not to exceed 72 hours from the time of delivery
(i.e., not including time spent in storage at the South Cary Reclaimed Water Facility or in the
reclaimed water distribution system), shall be reintroduced at the headworks of the reclaimed water
facility for treatment or otherwise disposed in a manner that is approved by the Division.
IV. MONITORING AND REPORTING REQUIREMENTS
Any monitoring (i.e., including groundwater, surface water, soil or plant tissue analyses) deemed
necessary by the Division to ensure surface water and groundwater protection shall be established and
an acceptable sampling reporting schedule shall be followed.
2. Reclaimed water distributed as a result of the South Cary Reclaimed Water Program shall be treated
in the South Cary Water Reclamation Facility (i.e., NPDES Permit No. NC0065102) prior to
distribution. Reclaimed water shall not be distributed unless the reclaimed water meets the limits
stipulated below. Effluent not meeting these limits shall either be discharged in accordance with the
existing NPDES permit or reintroduced to the headworks of the South Cary Water Reclamation
Facility for further treatment.

The reclaimed water delivered through the South Cary Reclaimed Water Program and all associated
facilities shall be monitored by the Permittee at points of use throughout the reclaimed water
distribution system (i.e., permanently -used sampling points representative of the reclaimed water
distributed to users that have been selected at the Permittee's discretion) for the following parameters:

Samples shall be taken from a minimum number of five points of use or the number of points of use
equivalent to 25 percent of the number of service .connections to the reclaimed water distribution
system, whichever is less. In no case, however, shall less than two points of use be sampled for the
purpose of complying with this condition.
4. Should the quality of the reclaimed water sampled from the points of use, as required in Condition
IV(3), deviate substantially from the maximum daily limit, described in Condition 1V(2), for each
reclaimed water parameter sampled, the Permittee shall investigate why the deviation is occurring and
take any steps necessary to correct the deviation.
5. The Permittee shall maintain adequate records that track the amount of reclaimed water that is
distributed through the South Cary Bulk Reclaimed Water Program and all associated facilities.
These records shall include, but shall not necessarily be limited to, the following information:
a. Date and time of reclaimed water distribution;
b. Volume of reclaimed water distributed (i.e., total, by user and/or use area, as well as by tank
truck.);
c. Intended uses of reclaimed water (i.e., applicable to tank trucks only);
d. Locations of users and/or use areas;
e. Names and approval status of users, use areas, and/or tank truck operators;
f. Approval status of tank tracks;
g. Compliance status of water reclamation facility, users, and/or tank truck operators;
h. Weather conditions; and
i. Turbidity measurement results.
6. All records maintained in accordance with Conditions IV(2), IV(3) and IV(5) shall be kept for a
minimum of five years and shall be made available to the Division upon request. Three copies of all
monitoring data [as specified in Condition IV(3)] on Form NDMR-1 shall be submitted on or before
the last day of the month following the month that was monitored. All information shall be submitted
to the following address:

7. Noncompliance Notification:
The Permittee shall report by telephone to the Raleigh Regional Office's Aquifer Protection Section,
telephone number [phone], as soon as possible, but in no case more than 24 hours or on the
next working day following the occurrence or first knowledge of the occurrence of any of the
following.
a. Any occurrence at the water reclamation facility, which results in the known passage of a
slug of hazardous substance through the facility; or any other unusual circumstances.
b. Any process unit failure, due to known or unknown reasons, that render the facility incapable
of adequate wastewater treatment such as mechanical or electrical failures of pumps, aerators,
compressors, etc.
c. Any failure of a pumping station, sewer line, or treatment facility resulting in a bypass
directly to receiving waters without treatment of all or any portion of the influent to such
station or facility.
d. Any spill or runoff of reclaimed water from the South Cary Reclaimed Water Program and all
associated facilities.

e. Any spill of reclaimed water from the bulk reclaimed water distribution facilities during
filling; from tank trucks during transport; or from tank trucks during application. '
f. Any time that self -monitoring information indicates that the water reclamation facility or
overall reclaimed water program has gone out of compliance with its permit limitations.
Occurrences outside normal business hours may also be reported to the Division's Emergency
Response personnel at telephone number [phone], [phone], or [phone].
Persons reporting such occurrences by telephone shall also file a written report in letter form within
five (5) days following first knowledge of the occurrence. This report must outline the actions taken
or proposed to be taken to ensure that the problem does not recur.
V. INSPECTIONS
1. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to ensure proper
operation and management of the South Cary Reclaimed Water Program and all associated facilities.
2. if any single party obtains more than 25,000 gallons of reclaimed water from the bulk fill operation in
any single day, or more than 100,000 gallons in any single week, the Town of Cary shall visit the
sites where that party is using the reclaimed water to ensure compliance with the conditions of this
permit. The Town of Cary shall maintain records of those site visits for at least three years,
3. The Permittee or his designee shall inspect the South Cary Reclaimed Water Program and all
associated facilities to prevent malfunctions and deterioration, operator errors and discharges which
may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance.
The Permittee shall keep an inspection log or summary including at least the date and time of
inspection., observations made, and any maintenance, repairs, or corrective actions taken by the
Permittee. This log of inspections shall be maintained by the Permittee for a period of three years
from the date of the inspection and shall be made available upon request to the Division or other
permitting authority.
4. Any duly authorized officer, employee, or representative of the Division may, upon presentation of
credentials, enter and inspect any property, premises or place on or related to the South Cary
Reclaimed Water Program and all related facilities at any reasonable time for the purpose of
determining compliance with this permit; may inspect or copy any records that must be maintained
under the terms and conditions of this permit, may obtain samples of reclaimed, groundwater, surface
water, or leachate; and may interview residential, commercial, and/or industrial users approved into
this program.
V. GENERAL CONDITIONS
1. This permit shall become voidable unless the South Cary Reclaimed Water Program and all related
facilities are constructed and operated in accordance with the conditions of this permit, the approved
plans and specifications, and other supporting data.
2. This permit shall be effective only with respect to the nature and volume of reclaimed water described
in the application and other supporting data.
3. This permit shall not be transferable. In the event there is a desire for the South Cary Reclaimed
Water Program and all related facilities to change ownership, or there is a name change of the
Permittee, a formal permit request shall be submitted to the Division accompanied by documentation
from the parties involved and other supporting materials as may be appropriate. The approval of this
request shall be considered on its merits and may or may not be approved.

4. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee
to an enforcement action by the Division in accordance with North Carolina General Statutes §143-
215.6A through §143-215.6C.
The issuance of this permit shall not exempt the Permittee from complying with any and all statutes,
rules, regulations, or ordinances that may be imposed by other government agencies (i.e., local, state
and federal) which have jurisdiction, including but not limited to applicable river buffer rules in 15A
NCAC 2B .0200, erosion and sedimentation control requirements in 15A NCAC Ch. 4 and under the
Division's General Permit NCG0100000, and any requirements pertaining to wetlands under 15A
NCAC 213.0200 and 15ANCAC 211.0500,
6. The annual administering and compliance fee shall be paid by the Permittee within 30 days after
being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate
action to revoke this permit as specified by 15 NCAC 211 .0205 (c)(4).
7. This permit in no way negates, precludes, or invalidates NPDES Permit No. NC0065102, and the
Permittee shall continue to comply with all conditions provided for therein.
