In accordance with your application received April 11, 2001 we are forwarding herewith Permit No. WQ0018308, dated
June 6, 2001 to Randy McCoy, Smoky Mountain Raceway for the operation of the subject wastewater pump and haul
activities.
This permit shall be effective from the date of issuance until October 1, 2002 shall void Permit No. WQ0018308 issued
April 19, 2000 and shall be subject to the conditions and limitations as specified therein. Please pay particular attention to
the monitoring requirements in this permit. Failure to establish an adequate system for collecting and maintaining the
required operational information will result in future compliance problems.
Please be aware that the Division of Water Quality (Division) will not reissue this permit after expiration on
October 1, 2002. Based on discussions between the Division and the Jackson County Health Department, sewer service
will be available in this location by October 1, 2002 and this facility should seek connection to that service. Please also
note Conditions 2 and 3 which require immediate attention.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an
adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in
the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the
Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this
permit shall be final and binding.

PUMP AND HAUL PERMIT
In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and
other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO
Smoky Mountain Raceway
Jackson County
FOR THE
operation of a 7,500 GPD wastewater pump and haul facility to serve the Smoky Mountain Raceway, with no
discharge of wastes to the surface waters, pursuant to the application received April 11, 2001 and in conformity
with the project plan, specifications, and other supporting data subsequently filed and approved by the Department
of Environment and Natural Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until October 1, 2002, shall void Permit No.
Wg0018308 issued April 19, 2000, and shall be subject to the following specified conditions and limitations:
This permit will not be renewed upon expiration.
Within thirty (30) days of issuance of this permit the standpipes to each of the underground septic tanks must
be sealed, or otherwise access limited to prevent the transmission of disease by vectors.
3. Within thirty (30) days of issuance of this permit the high water alarms in the pump tank must be made
operable and must include working visual and audible indicators.
4. This pen -nit shall become voidable unless the subject pump and haul activities are carried out in a manner that
has been approved by this Division.
This permit is effective only with respect to the nature and volume of wastes described in the application and
other supporting data.
6. The facilities shall be properly maintained and operated at all times.
T This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is
a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality
(Division) accompanied by an application fee, documentation from the parties involved, and other supporting
materials as may be appropriate. The approval of this request will be considered on its merits and may or
may not be approved.
No type of wastewater other than that from Smoky Mountain Raceway shall be included in the pump and
haul activities.
9. This permit shall become voidable unless the agreement between Smoky Mountain Raceway and the
Cherokee Tribal Water and Sewer Department for the collection, transportation, and ultimate disposal of the
wastewater is in full force and effect.

10. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the
Permittee shall cease operation of all pump and haul activities and take immediate corrective actions,
including those that may be required by this Division.
11. The sewage and wastewater collected by this system shall be treated in the Cherokee Tribal Water and Sewer
Department's Wastewater Treatment Facility prior to being discharged into the receiving stream.
12. The Asheville Regional Office, telephone number 828-251-6208 shall be notified at least forty-eight (48)
hours in advance of operation of the pump and haul activities so that an in-place inspection can be made.
Such notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m. until
5:00 p.m. on Monday through Friday, excluding State Holidays.
13. The Permittee is liable for any damages caused by a spill or failure of the pump and haul operations.
14. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation
of the subject facilities.
15. The Permittee or his designee shall inspect the Smoky Mountain Raceway collection facilities to prevent
malfunctions and deterioration, operator errors and discharges which may cause or lead to the release of
wastes to the environment, a threat to human health, or a nuisance. The Permittee shall maintain an
inspection log or summary including at least the date and time of inspection, observations made, and any
maintenance, repairs, or corrective actions. taken by the Permittee. This log of inspections shall be
maintained by the Permittee for as long as the pump and haul activities are being conducted and shall be
made available to the Division or other permitting authority, upon request.
16. Any duly authorized officer, employee, or representative of the Division,,pon presentation of
credentials, enter and inspect any property, premises or place on or related to t);�collection facilities at
any reasonable time for the purpose of determining compliance with this permit, may inspect or copy any
records that must be maintained under the terms and conditions of this permit, and may obtain samples.
17. An accurate record of the pump and haul activities must be maintained by the Permittee, indicating:
a. date and time wastewater is removed from the facility,
b. name of driver/hauler,
e. name of facility receiving the wastewater,
d. volume of wastewater removed, and
e. status of permanent disposal option.
These records shall be submitted monthly to the Asheville Regional Office on or before the fifteenth (15) day
of the following month.
18. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an
enforcement action by the Division in accordance with North Carolina General Statute 143-215.6A to 143-
215.6C.
19. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules,
regulations, or ordinances which may be imposed by other government agencies (local, state, and federal)
which have jurisdiction.
20_ The Permittee shall provide for the installation and maintenance of an audible and visual high-water alarm on
all storage and pumping facilities associated with this pump and haul operation.

21. A copy of the approved plans and specifications shall be maintained on file by the Permittee for the life of the
project.
20. Noncompliance Notification:
The Permittee shall report by telephone to the Asheville Regional Office, telephone number 828-251-6208 as
soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or
first knowledge of the occurrence of any of the following:
a. Any process unit failure, due to known or unknown reasons, that renders the facility incapable of
adequate wastewater treatment, such as mechanical or electrical failures of pumps, aerators, compressors,
etc.; or
b. Any failure of a pumping station, sewer line, etc. resulting in a by-pass directly to receiving wafters
without treatment of all or any portion of the influent to such station or facility.
Persons reporting such occurrences by telephone shall also file a written report in letter form within five (5)
days following first knowledge of the occurrence. This report must outline the actions taken orproposed to
be taken to ensure that the problem does not recur.
21. The annual administering and compliance fee must be paid by the Permittee within thirty (30) days after
being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to
revoke this permit as specified by 15A NCAC 2H.0205 (c)(4).
