SUBJECT: Little River Farms wetland mitigation plan; WQC Project #960980 Cr': Bobby Blanche, Robert Tresslar, Jeff Neubauer I am in receipt of your letter dated 14 October 1999 concerning the above P. 02/0'7 referenced project. In the letter, you indicated that your inquiry of 5 August 1997 had not been answered. In fact, I have sent 3 different written. responses to your, office (letter dated 7 August 1997 to you; letter dated 19 December 1997 to you; fax dated 28 September 1998 to Eric Gdlamb) and discussed this issue with members of your staff on several other occasions over the last 2 years (as recently as September 1999). 1 have enclosed a revised mitigation plan for this project. No impacts to jurisdictional wetlands have occurred. We have been involved for more than 2 years in very difficult negotiations concerning the Conservation Easement. We now appear to be close to completing the easement transaction and will begin implementing the mitigation plan this winter. Environmental Consultants 515 Midland Road, Suite F Southern Pines, North Carolina 28387 Submitted 30 October 1999 To: North Carolina Division of Water Quality DENR 4401 Reedy Creek Road Raleigh, N.C. 27626-0535 P. 03/07 NOV-02-1999 14:04 WETLANDS MITIGATION PLAN FOR LITTLE RIVER FARMS DEVELOPMENT MOORE COUNT'Y', NORTH CAROLINA INTRODUCTION P.04/07 This mitigation plan was prepared pursuant to Water Quality Certification (WQC) No. 3133 (DWQ project #960980) dated 7 March. 1997 and is based on a conceptual mitigation plan by Dr. J.H. Carter M submitted to Mr. John Domey, North Carolina Division of Water Quality (D WQ) on 6 February 1997. MITIGATION PLAN 1. All deeds to residential lots containing jurisdictional wetlands as depicted on the wetlands plat dated May 1996 and signed by Mr. Michael Hosey, U.S. Anny Corps of Engineers, on 6 June 1996, and not slated to be filled pursuant to this Water Quality Certification, will contain a "deed restriction and protective covenant", the text of which is included in "Attachment A". 2. Approximately 3.5 acres of jurisdictional wetland will be created from uplands as depicted in Attachment B in order to compensate for wetland fill (3.34 acres) authorized by WQC No. 3133. The subject area is currently fallow pasture. The terrain is flat and 0.5 to 1.0 foot higher than the surrounding wetlands. Approximately 3.5 acres will be graded to the same elevation as that of the surrounding wetlands. Spoil from the graded uplands will be used to create a low berm on uplands along the edge of, but not within, forested wetlands bordering Little River. The berm will cross jurisdictional wetlands supporting grasses, sedges and rushes northwest and southwest of, and contiguous to, the created area. The berm will be made of compacted earth and will measure approximately 6 feet wide at the base and 2.0 feet high. Excess spoil will be placed on uplands and stabilized appropriately. The berm will slow drainage of surface water into the floodplain immediately adjacent to Little River, thereby establishing wetlands hydrology in the NOO-02-1999 14:04 P.05i07 created area and enhancing hydrology in some adjacent wetlands. The berm will also help retain floodwaters that overtop it. The goal is to create is a shallow freshwater marsh vegetated with emergent wetland plants, but retaining some patches of open water (or mud during the dry season), similar to, but slightly wetter, than the wetlands being impacted under WQC No. 3133. 3. The creation area will be planted with native wetland grasses, sedges and rushes. It is believed that native herbaceous vegetation growing in the adjacent wetlands will aid in rapid revegetation of the creation site with appropriate species. No woody plantings are proposed. Wetlands impacted under WQC No. 3133 were herbaceous with no woody component. 4. Two 10x10 meter (m) vegetation monitoring plots will be established within the creation area and another plot will be established as a reference plot in adjacent jurisdictional wetlands. Each plot will have 5 1x1 m subplots. These plots will be used to determine species diversity, percent cover and prevalence. Vegetative data will be gathered annually in August/September for 5 years. 5. Three electronic monitoring wells will be established: 1 each in the creation area, reference wetland and adjacent upland. Water levels will be recorded daily for 5 years- The target hydrology in the created wetland will be within + 3 inches of that in the reference wetland. 6. Soils samples from the creation area, adjacent wetland and adjacent upland will be obtained annually and characterized as to chroma and wetland hydrology characteristics. 7. An as-built report will be submitted to DWQ within 60 days of completion of site work in the creation area. 8. Annual reports summarizing all monitoring activities will be submitted to DWQ by 31 January for 5 years. 9_ Little River Associates, owners of the subject property, will donate a Conservation Easement to the Sandhills Area Land Trust for 47.60 acres that includes the creation NOV-02-1999 14:05 P. 06/07 area (Attachments C and D). (910) 695-0903 e I received the notice of the proposed fill of 2.43 acres of wetlands adjacent to Wads Creek and Little River. It appears to me that the permit request has some shortcomings. First, the area proposed for mitigation, 6.7 acres, does not seem to be twice the area proposed to be filled (2.43 acres). The correct mitigation area would be 6.9 acres. Admittedly, this is a minor point. However, I feel my second point has more importance. In order for enhanced wetlands to mitigate for wetlands lost due to fill for a residential development, a number of things must happen. First, the wetlands enhanced for mitigation need to have permanent protection -- probably a conservation easement. In a residential subdivision another thing needs to happpr -- permanent protection needs to be effective for non-mitigation wetlands within the subdivision that are not filled, so that, as the residential subdivision matures and residents move in, no wetlands will be threatened with degradation. Therefore, the remaining wetlands in the subdivision need to have some form of permanent protection. You and I know all to well of the gradual erosion of quality wetlands that occurs within a residential subdivision after the Corps gives its initial permit. You and I could both rattle off a number of examples. I am perplexed by the questions in your letter about the Little River Farm Water Quality Certification application (DWQ #960980). I have previously addressed these issues in writing, by telephone conversations, and in meetings. (1) You list Area 4 twice, I assume you mean Areas 1 and 4. Road fill is proposed for Areas 1, 4, 14, and 28, and lot fill is proposed in areas 4 and 28. No fill is proposed for Areas 23 and 23A-- these areas were excluded in the original application. As I have discussed with your staff and you previously , potential fill outside of Area 11 was shown at the request of Mr. Michael Hosey of the Wilmington District, Corps of Engineers. Mr. Hosey asked my client to show all "potential" fill sites on the property. We cannot provide you with details on these fill sites because no detailed plans exist at this time. We explained to the Corps and your staff that proposed fill locations outside Area 11 were estimates, and likely to be "worst case scenarios". The Corps wanted us to show them anyway. It may be years before plans for these sites are created. (2) A modified map is attached that shows fill boundaries in Area 11. (3) Deed restrictions were specifically addressed in my letter to you dated 6 February 1997. Future lot fill is addressed in number (1) of that letter. I believe our intent and commitment are clear as stated therein. As far as forested wetlands outside of development pods on the property are concerned, my client intends to maintain these sites for future mitigation needs or perhaps a "mitigation bank". Deed restrictions on these wetlands would unfairly infringe on legitimate conservation interests of the owner. Endangered Species Surveys • Environmental Assessments • Land Management • Wetlands Mapping and Permitting This property is approximately 697 acres in size, with 172 acres of jurisdictional wetlands. Approximately two-thirds of the jurisdictional area is forested, the remainder is comprised of wetlands in old pastures and flooded gravel pits. My client would have preferred to develop nearly all of the jurisdictional area. Nevertheless, we have worked to produce a development plan that avoids and minimizes impacts to wetlands. Of 172 acres of wetlands, only 3.34 acres, less than 2 percent, are to be impacted. Of approximately 115 acres of forested wetlands, only 0.01 acres will be impacted. We will be mitigating all impacts to jurisdictional wetlands at the required ratios and with an approved plan. I feel that the Division of Water Quality (DWQ) has failed to appreciate the considerable time spent to develop a plan that minimizes impacts to wetlands. Rather than create "dummy" plans that showed major impacts, we concentrated on developing a plan that minimized impacts from the beginning. Instead of acknowledging this "novel" approach, DWQ has treated us as if we submitted a 25 acre fill request. Mr. Ken Averitte of your staff remarked on the low quality of the wetlands in the old pasture, a position apparently contradicted by your letters of 26 November 1996 and 27 February 1997. My client has no plans to fill any wetlands, other than those needed for utilities, beyond those in this application. However, it would be most unwise for him to give up all rights to applying for a permit in the future, when no firm development plans exist. Furthermore, insufficient evidence is present in our files to conclude that your project must be built as planned in waters and/or wetlands in accordance with 15A NCAC 2H.0506. Therefore, we are moving toward denial of your 401 Certification as required by 15A NCAC 2H.0507(e). Until we receive additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers and/or the N.C. Division of Coastal Management place your project on administrative hold. Specifically your submittal does not show the location of the proposed fills. Also we are concerned about the statement that you are unable to assure the Corps of Engineers that future fill will not be needed. This conflicts with our rule concerning cumulative impacts [(15A NCAC 2H .0506(b)( )]. Deed restrictions or conservation easements on all remaining wetlands would provide the required assurance. Any documentation such as maps and narrative that you can supply to address alternative designs for your project may be helpful in our review of your 401 Certification. Also this project will require compensatory mitigation as described in 15A NCAC 2H.0506(h). Your mitigation proposal is insufficient because you have not proposed restoration or creation at a 1:1 ratio. Enhancement will not be sufficient to meet the requirement of 15A NCAC 2H .0506 (h)(6). If these are proposed road crossings,-please provide a map at 111=100, (or larger scale) depicting these roads and the residential lots that will be accessed by these roads. This information is needed in order to decide whether additional impacts to wetlands would be dictated by the location of these roads. 2. Please provide a map at 1"=100"'(or larger scale) for Phase I of your development showing lots, roads, and wetlands with proposed fill lines. The acreage associated with each fill will also be needed. The map of Phase I provided by Jay Carter is not useful since the fill limits are not clearly shown. 3. As discussed in my 26 November 1996 letter, deed restrictions will be needed on remaining wetlands to address our concerns regarding cumulative impacts. This is especially crucial for wetlands with significant water quality values. I understand the dilemma you have regarding the uncertainty for future development patterns but our concerns for future, cumulative impacts still remain. Army Corps of Engineers on 6 June 1996, and not slated to be filled pursuant to this application, will contain a "deed restriction and protective covenant", the text of which is included as "Attachment A". (2) Approximately 3.34 acres of jurisdictional wetland will be created from uplands as depicted in the figure in "Attachment B". The subject area is currently fallow pasture. The terrain is flat, and is only a few inches higher than the surrounding wetlands. Approximately 3.34 upland acres will be graded to the same elevation as that of surrounding wetlands. Spoil will be used to create a low berm along the edge of, but not within, forested wetlands bordering Little River. The berm will be made of compacted earth, and will measure approximately 4 feet wide at the base and 1 foot high. Excess spoil will be placed on uplands. The berm is expected to slow the drainage of surface water into the floodplain immediately adjacent to Little River, thereby establishing wetlands hydrology in the created area and enhancing the hydrology in some adjacent wetlands. The berm will also help retain floodwaters that overtop it. The goal is to create a shallow freshwater marsh vegetated with emergent wetland plants, but retaining some patches of open water (or mud during the dry season). Historically, wetlands in pastures at Little River Farm have provided habitat to a wide variety of migratory birds, including wading birds (herons and egrets), shorebirds (golden plovers, upland sandpipers, pectoral sandpipers, common snipe), rails, marsh and sedge wrens, and marsh- loving sparrows (sharp-tailed and LeConte's), as well as to a diverse assemblage of other open- country birds and wildlife. Our proposal will replace wetlands with marginal hydrology with wetlands that will retain water for much longer periods. Plantings in the created area will include native wetland grasses, sedges, and rushes. The creation site will be monitored annually for 3 years in order to document the revegetation success and the establishment of wetlands hydrology. An annual report will be submitted to the Division of Water Quality (DWQ) each January. A i detailed mitigation plan will be submitted to the DWQ within 90 days of the issuance of the Water Quality Certificate. (3.) The owner of Little River Farm will covey a Conservation Easement or fee-simple title to approximately 30 acres of forested wetlands along Little River, adjacent to the creation site (see Attachment B) to a mutually agreed upon conservation entity. This agreement will be finalized within 6 months of the issuance of the Water Quality Certificate. Development plans for Little River Farm extend beyond a 10 year planning horizon. Although we have attempted to anticipate future impacts to wetlands, we cannot agree that no additional permits will be needed. In particular, the installation of underground utilities will almost certainly lead to some degree of unavoidable impact. The purpose of the work is to construct a residential subdivision, including fill for road crossings, driveways, and residential lots. Plans showing the work are included with this public notice. The wetland areas proposed to be filled are non-forested abandoned pasture, dominated by herbaceous species including Juncus ffe usus, Carex §M., Cypeus g2p., Scir us cyperinus, Diodia virginiana, and Andropogon virginicus. Soils are mapped as Wahadkee loam, Tetotum silt loam, and Mayodan fine sandy loam. During the properties 55 plus years as a farm, the wetland areas proposed to be filled have been altered by plowing, minimal filling, and minimal ditching. The areas are adjacent to portions of Wads Creek and the Little River which have previously been channelized. Cv.ea-(c. /"sivv-e- To mitigate for wetland impacts the applicant has proposed to enhanee existing jurisdictional wetlands on the site at a 2:1 ratio (6.7 acres) by plugging existing ditches and/or building low berms to lengthen the hydroperiod. They have not proposed any tree or shrub planting. They contend that the herbaceous wetlands on site provide a unique wetland habitat for the sandhills area, and alteration of this area beyond the extension of the hydroperiod would adversely affect this unique habitat. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army (DA) permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Environmental Management (NCDEM) has determined the applicability of a Water Quality Certificate as required by PL 92-500. As you recommended, the developer has tried to "forecast" 404 permit needs for the entire project in order to make this application as complete as possible. The residential development will be in "pods", which generally will be developed 1 at a time. Some pods will not be developed for several years, and the layout within the pods is subject to change. Therefore, we cannot assure the Corps that additional permits or permit modifications will not be needed. All jurisdictional areas.to be filled are currently non-forested abandoned pasture. Most of the pasture has been ditched, filled, and/or plowed over the last 55+ years, such that the natural hydrology has been seriously altered. The portion of Wad's Creek that passes through the pasture complex was channelized approximately 40 years ago. Little River from just above its confluence with Wad's Creek to the east property boundary has been channelized also. Wetlands that will be impacted are dominated by herbaceous species such as rush (Juncus effusus), sedges (Carex spp. and Cyperus spp.), wool-grass (Scirpus cyperinus), diodia (Diodia virginiana), and broom sedge (Andropogon virginicus). Soils are predominantly Wehadkee loam, Tetotum silt loam, and Mayodan fine sandy loam. The developer proposes to mitigate impacts to jurisdictional wetlands by enhancing existing jurisdictional wetlands on the site at a 2:1 ratio (or 6.7 acres) by plugging existing ditches and/or building low berms to lengthen the hydroperiod on the mitigated acres. A monitoring plan will be developed with the N.C. Division of Water Quality. No trees or shrub plantings are proposed. The herbaceous wetlands on the site, though not natural, provide a Endangered Species Surveys - Environmental Assessments - Land Management - Wetlands Mapping and Permitting unique wetland habitat for the Sandhills area, and species of plants, invertebrates, and migratory birds that occur there would be adversely affected by conversion to forested wetlands. Potential archeological issues have been addressed with Corps staff, and the area identified by the Corps as having potential cultural/historical interests has been excluded from this permit application. A thorough protected species survey was conducted of the entire property in 1994, with negative results. North Carolina. The following description of the work is taken from data provided by the applicant and from observations made during a site visit by a representative of the Corps of Engineers. Plans submitted with the application show the placement of earthen fill material into 3.43 acres of wetlands adjacent to Wads Creek and the Little River. The purpose of the work is to construct a residential subdivision, including fill for road crossings, driveways, and residential lots. Plans showing the work are included with this public notice. The wetland areas proposed to be filled are non-forested abandoned pasture, dominated by herbaceous species including Juncus ffe usus, arex s§., Cyl2erus sue, S is rpus cyoerinus, Diodia virginiana, and Andropogon virginicus. They have not proposed any tree or shrub planting. They contend that the herbaceous wetlands on site provide a unique wetland habitat for the sandhills area, and alteration of this area beyond the extension of the hydroperiod would adversely affect this unique habitat. This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this site is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act (NEPA). Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Generally, the decision whether to issue this Department of the Army (DA) permit will not be made until the North Carolina Division of Environmental Management (NCDEM) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The NCDEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the Department of the Army (DA) permit serves as application to the NCDEM for certification. Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, North Carolina Division of Water Quality (NCDWQ), Salisbury Street, Archdale Building, Raleigh, North Carolina.
