This permit shall be effective from the date of issuance until June 30, 2006 and shall be subject to the conditions and limitations as specified therein.. Please take time to review this permit thoroughly. Pay particular attention to the monitoring and recordkeeping requirements in this permit, as failure to establish an adequate system for collection and maintaining the required operational information will result in future compliance problems. Please note the following with respect to the review of design and operation of the reclaimed water distribution, storage, and utilization facilities permitted herein: ♦ This permit approves the utilization of reclaimed water on the spray irrigation site known as "The Farm" only. The Division of Water Quality (Division) understands that there is a desire by the Permittee to utilize reclaimed water for irrigating the Goldsboro Municipal Golf Course. However, the Permittee must first apply for and obtain a formal permit modification from the Division prior to allowing any connection of the facilities to the existing irrigation system at the Goldsboro Municipal Golf Course. ♦ There was much discussion between the Division and the Permittee regarding potential discharge points of reclaimed water designed into the reclaimed water distribution, storage, and utilization facilities (i.e., overflow piping from the reuse storage tank, sump pumps in valve vaults, etc.). The Division highly recommends that the Permittee establish and adhere to a voluntary monitoring program that involves greater sampling frequencies and additional sampling points (i.e., especially at the reuse storage tank) to ensure that the distributed and utilized reclaimed water is of exceptional and consistent product quality. In addition, please note that the Division may choose to increase monitoring of the reclaimed water that is required by permit when the permit is modified to allow utilization of the reclaimed water at the Goldsboro Municipal Golf Course. If any parts, requirements, or Iimitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within 30 days following receipt of this permit. Reclaimed water, following treatment and testing according to the most recent issuance of the Goldsboro Water Reclamation Facility's NPDES permit and compliance with the conditions provided herein, may be diverted to the permitted reclaimed water distribution, storage, and utilization facilities for the purpose of supplying a reclaimed water demand not to exceed 495,500 gallons per peak day -to a spray irrigation site known as "The Farm." The reclaimed water distribution, storage, and utilization facilities shall consist of the following minimum components. approximately 4,900 linear feet of existing 24-inch reclaimed water distribution main (i.e., connected to the Reuse Pump Station at the Goldsboro Water Reclamation Facility that has been previously approved for construction by the Division of Water Quality (Division) on February 20, 2001 in Authorization to Construct No. 0023949ACC) and approximately 4,300 linear feet of 12-inch reclaimed water distribution main to convey reclaimed water from the Goldsboro Water Reclamation Facility to either the constructed wetlands treatment system (i.e., previously approved for construction by the Division on June 29, 2001 in Authorization to Construct No. 023949ACA) or the remote reclaimed water storage and distribution facilities; a reuse tank influent valve vault; an 300,000-gallon covered, vented, ground reuse storage tank with audible and visual high water alarms, approximately 15 linear feet of 12-inch fill piping, and approximately 100 linear feet of 12-inch suction piping; a reuse pump station with audible and visual high-water alarms and two 75-horsepower constant speed, horizontal split -casing pumps each with a design operating point of 875 gallons per minute at 201 feet of total dynamic head; a golf course reuse flow meter and valve vault (i.e., terminated with a blind flange until a modification of this permit is applied for and approved to include conveyance of reclaimed water to the Goldsboro Municipal Golf Course for spray irrigation); a spray irrigation flow meter and valve vault; approximately 2,300 linear feet of 12-inch reclaimed water distribution main to convey reclaimed water to a spray irrigation site; a 144-acre spray irrigation site consisting of approximately 91 acres of wetted area, 16 solid -set irrigation zones each containing four fully - adjustable, big gun sprinklers that are capable of delivering a maximum of 225 gallons per minute at 80 pounds per square inch to effect a maximum 308-foot diameter and are set on an overlapping pattern on five-foot high risers, approximately 9,000 linear feet of 10-inch distribution piping, approximately 3,200 linear feet of 12-inch distribution piping, and automatic irrigation control valves; flood protection of, all weather access to, and site restriction of the reclaimed water distribution, storage, and utilization facilities; as well as all meters, valves, fittings, piping, instrumentation/control systems, electrical items, structural units, and other related appurtenances required to make a complete and operational reclaimed water distribution, storage, and utilization facilities. All instrumentation, controls, and telemetry associated with the reclaimed water distribution, storage, and utilization facilities shall be connected to and automatically -activated to operate from the existing instrumentation, controls, and telemetry at the Goldsboro Water Reclamation Facility. The reclaimed water distribution, storage, and utilization facilities shall be constructed and operated such that no discharge of wastes to surface waters occurs, pursuant to the application received on December 15, 1999 as well as all additional information subsequently received, and in conformity with the project plans, specifications, and other supporting data subsequently filed and approved by the Department of Environment and Natural Resources and considered a part of this permit. This permit shall be effective from the date of issuance until .tune 30, 2006 and shall be subject to the following specified conditions and limitations: 1. PERFORMANCE STANDARDS An existing 24-inch force main that has been historically used to convey raw, municipal wastewater from the Westbrook Pump Station to the Goldsboro Water Reclamation Facility shall be properly cleaned and disinfected prior to its use for conveying reclaimed water from the Goldsboro Water Reclamation facility to the reclaimed water storage and utilization facilities. The certification from the North Carolina -licensed professional engineer required in Condition 1. 4. shall serve as proof of compliance with this condition. 2. Operation of the reclaimed water distribution, storage, and utilization facilities shall be strictly prohibited until the turbidimeter previously approved by the Division on February 20, 2001 in Authorization to Construct No. 0023949ACC has been installed at the Goldsboro Water Reclamation Facility and its operation has been successfully initiated. The certification from the North Carolina - licensed professional engineer required in Condition 1. 4. shall serve as proof of compliance with this condition. 3. At least 60 days prior to operation of the reclaimed water distribution, storage, and utilization facilities, the Permittee shall submit a report prepared as'well as signed, sealed, and dated by a North Carolina- Iicensed professional soil scientist that provides the following minimum information: a. A delineation of areas within the spray irrigation site that have been graded during construction. b. A determination of the depth of cut and fill as well as the final elevation of any graded areas within the spray irrigation site. c. A determination of the "as -built" infiltrative capacity of any graded areas within the spray irrigation site. d. A final recommendation of hydraulic loading rates (i.e., both instantaneous and cumulative) for the spray irrigation site if the "as -built" conditions require the amendment of the maximum loading rates recommended for the native soils (i.e., see Condition 11. 8.). Submit five copies of the report to the NCDENR-DWQ, Non -Discharge Permitting Unit, 1617 Mail Service Center, Raleigh, NC 27699-1617. 4. Upon completion of construction and prior to operation of the reclaimed water distribution, storage, and utilization facilities, a certification shall be received from a North Carolina -licensed professional engineer certifying that the facilities have been installed in accordance with this permit, the approved plans and specifications, and other supporting materials. If the facilities are to be completed in hases and partially certified. the Permittee shall retain the responsibility to track further construction approved under the same permit, and shall provide a final certificate of completion once all facilities have been completed. Mail the Certification to the NCDENR-DWQ, Non -Discharge Permitting Unit, 1617 Mail Service Center, Raleigh, NC 27699-1617. 2 The Division's Washington Regional Office, telephone number (252) 946-6481, shall be notified at least 48 hours in advance of operation of the reclaimed water distribution, storage, and utilization facilities so that an in -place inspection can be made. Such notification to the Regional Water Quality Supervisor shall be made during normal office hours (i.e., from 8:00 a.m. until 5:00 p.m.) on Monday through Friday, excluding State Holidays. 6. The reclaimed water distribution, storage, and utilization facilities shall be effectively constructed, maintained, and operated at all times so that there is no discharge to surface waters, nor any contamination of groundwater which will render them unsatisfactory for normal use. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions or failure of the application areas to assimilate the reclaimed water adequately, the Permittee shall take immediate corrective actions including those actions that may be required by the Division, such as the construction of additional or replacement facilities or cessation of the operation of the facilities. 7. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface water or groundwater resulting from the operation of the reclaimed water distribution, storage, and utilization facilities. 8. Diversion or bypassing of the untreated wastewater from the reclaimed water distribution, storage, and utilization facilities shall be strictly prohibited. 9. Reclaimed water shall be treated in the Goldsboro Water Reclamation Facility (i.e., NPDES Permit No. NC0023949) prior to distribution, storage, and utilization. Reclaimed water shall not be utilized unless it meets the limits stipulated below. Effluent not meeting these limits shall either be discharged in accordance with the most recent issuance of the NPDES permit or reintroduced to the headworks of the Goldsboro Water Reclamation Facility for further treatment. Up to 495,500 gallons per day may be distributed from the Goldsboro Water Reclamation Facility to the reclaimed water utilization facilities permitted. herein. Note that this volume only includes the maximum amount of reclaimed water that may be utilized on the spray irrigation site alone. Additional reclaimed water may be distributed into the reclaimed water distribution and storage facilities; however, any volume over the 495,500 gallons per day shall be discharged in strict accordance with the most recent issuance of NPDES Permit No. NC0023949, which includes the option to discharge any excess reclaimed water to the constructed wetlands treatment system approved for construction in Authorization to Construct No. 023949ACA, issued by the Division on June 29, 2001. Furthermore, note that this permit is a conjunctive permit and, as such, shall not change the hydraulic capacity of the Goldsboro Reclaimed Water Facility as permitted in the most recent issuance of NPDES Permit No. NC0023949. The monthly average concentrations for fecal coliform shall be the geometric mean of all samples collected during the reporting period (i.e., see Condition 111. 3.). 10. Should reclaimed water be stored in the reclaimed water storage facilities for a prolonged period of time such that it may be reasonably expected that it would not meet the reclaimed water quality criteria as stipulated in Condition I. S., the Permittee shall either monitor the stored reclaimed water for compliance with these criteria prior to utilization on the spray irrigation site or discharge it in strict accordance with the conditions of the most recent issuance of NPDES Permit No. NC0023949. 11. The following shall be requirements for the reclaimed water distribution, storage, and utilization facilities: a. All reclaimed water valves, storage facilities, and outlets shall be tagged or labeled to warn the public or employees that the water is not intended for drinking. Where appropriate, such warning shall inform the public or employees to avoid contact with the water. b. All reclaimed water piping, valves, outlets, and other appurtenances shall be color -coded, taped, or otherwise marked to identify the source of the water as being reclaimed water. All reclaimed water piping and appurtenances shall be either colored purple (i.e., Pantone 522) and embossed or integrally stamped or marked "CAUTION: RECLAIMED WATER -- DO NOT DRINK" or be installed with a purple (i.e., Pantone 522) identification tape or polyethylene vinyl wrap. The warning shall be stamped on opposite sides of the pipe and repeated every three feet or less. ii. Identification tape shall be at least three inches wide and have white or black lettering on purple (i.e., Pantone 522) field stating "CAUTION: RECLAIMED WATER — DO NOT DRINK." Identification tape shall be installed on top of reclaimed water pipelines, fastened at least every 10 feet to each pipe length and run continuously the entire length of the pipe. c. All reclaimed water valves and outlets shall be of a type, or secured in a manner, that permits operation by authorized personnel only. d. Above -ground hose bibs (i.e., spigots or other hand -operated connections) shall not be present. Hose bibs shall be located in locked below -grade vaults that shall be clearly labeled as being of non -potable quality. As an alternative to the use of locked below -grade vaults with standard hose bibs services, hose bibs, which can only be operated by a special tool or connected to a special hose connection may be placed in non -lockable underground services boxes clearly labeled as non - potable water. 12. The Permittee shall maintain a spill prevention, and control plan for the reclaimed water distribution, storage, and utilization facilities. 13_ The following buffers shall be maintained during utilization of reclaimed water on the spray irrigation site: a. 100 feet between wetted areas and water supply wells; b. 10 feet between wetted areas and non -potable well; c. 100 feet between wetted areas and waters classified as SA, including wetlands as delineated and designated by the appropriate state or federal agency; and d. 50 feet' between wetted areas and surface waters not classified as SA, including wetlands as delineated or designated by the appropriate state or federal agency or any swimming pool. 4 A 50-foot buffer shall be required to comply with 15A NCAC 2B .0200. The Division understands that the Perinittee has requested a variance from this regulation such that reclaimed water may be irrigated up to 25 feet from surface waters and delineated/designated wetlands not classified as SA (i.e., as allowed for by 15A NCAC 2H .0219(k)(1)(C)(W)). If this variance is granted, the Permittee shall apply for and receive a modification of this permit prior to modifying the buffers from that which is stipulated above. 14. Public access to the reclaimed water treatment, storage, and distribution facilities as well as contact with reclaimed water shall be controlled during active reclaimed water use. Such controls may include fencing and signs describing the activities taking place that have been posted in plain sight. II. OPERATION AND MAINTENANCE REQUIREMENTS The reclaimed water distribution, storage, and utilization facilities shall be properly maintained and operated at all times. 2. Upon classification of the reclaimed water distribution, storage, and utilization facilities by the Water Pollution Control System Operators Certification Conunission (WPCSOCC), the Permittee shall employ a certified operator to be in responsible charge (ORC) of the facilities. The operator shall hold a certificate of the type and grade at least equivalent to or greater than the classification assigned to the facilities by the WPCSOCC. The Permittee shall also employ a certified back-up operator of the appropriate type and grade to comply with the conditions of 15A NCAC 8G .0202. The ORC of the facilities shall visit Class I facilities at least weekly and Class II, III, and IV facilities at least daily, excluding weekends and holidays, shall properly manage and document daily operation and maintenance of the facilities, and shall comply with all other conditions of 15A NCAC 8G .0202. Once the facilities are classified, the Permittee shall submit a letter to the WPCSOCC that designates the ORC within 30 days after the facilities are 50 percent complete. 3. A certified operator of a grade equivalent to or greater than that required at the Goldsboro Water Reclaimed Water Facility shall be on call at the facility 24 hours per day_ 4. All wastewater shall either be routed to the headworks of the Goldsboro Water Reclamation Facility or discharged in strict accordance with the conditions of the most recent issuance of NPDES Permit No. NCO023949 should the limit for fecal coliform (i.e., daily maximum concentration of 25 per 100 milliliters) or turbidity (i.e., instantaneous maximum of 10 nephelometric turbidity units) be exceeded and not distributed into the reclaimed water storage and utilization facilities, until such time that the levels have stabilized below these maximum levels. 5. No type of reclaimed water other than that from the Goldsboro Water Reclamation Facility (i.e., NPDES Pen -nit No. NC0023949) shall be distributed, stored, or utilized in the reclaimed water facilities permitted under this permit. b. The reclaimed water distribution, storage, and utilization facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any reclaimed water resulting from their operation. 7. A suitable, year-round vegetative cover crop of fescue shall be established and maintained on Soil Zone No. I and Soil Zone No. 2 of the spray irrigation site. A suitable year-round vegetative cover crop of coastal bermuda and rye (i.e., winter overseed) shall be established and maintained on Soil Zone 3 of the spray irrigation site. The number before the hyphen corresponds to the irrigation zone (i.e., 16 total) as shown in the approved plans. The letter after the hyphen corresponds to the location of each of the four sprinklers within the specific irrigation zone. The letter is assigned consecutively to the sprinkler is a direction from east to west and north to south across the zone. For example, Sprinkler No. 8-a is the northernmost and easternmost sprinkler in Irrigation Zone No. 8, while Sprinkler No. 8-d is the southernmost and westernmost sprinkler in Irrigation Zone No. 8. Each sprinkler or irrigation zone shall be individually calibrated such that it does not cause the exceedance of the stipulated maximum cumulative and instantaneous application rates for the most -restrictive soil zone that it impacts (i.e., some sprinklers may impact area in more than one soil zone). The cumulative application rate shall be equivalent to the loading of reclaimed water over any 12-month period. d These sprinklers impact wetted areas in both Soil Zone No. 2 and Soil Zone No. 3. Either the individual sprinkler or the irrigation zone as a whole shall be calibrated to irrigate reclaimed water at Soil Zone No. 2 rates even though a portion of the wetted area is in Soil Zone No. 3. The wetted areas of these sprinklers shall be adjusted such that they do not impact any area that has been delineated as being within Soil Zone No. 1 - 9. Irrigation of reclaimed water shall not be performed during inclement weather or when the ground is in a condition that will cause runoff from the spray irrigation site. 10. The Permittee shall implement adequate measures to prevent reclaimed water runoff from the spray irrigation site. 11. The Permittee shall implement adequate measures to mitigate drift of airborne reclaimed water from the spray irrigation site during active use. Of special concern is the potential for drift from the site to impact vehicular traffic along Dixie Trail and Westbrook Road. Therefore, the Permittee shall take the following steps: a. PIant rapid growth vegetation (e.g. Tulip Poplar or Leland Cypress) along the perimeters of the spray irrigation site immediately adjacent to Dixie Trail and Westbrook Road. b. InstaIl wind direction and velocity meters at the Goldsboro Water Reclamation Facility. The information gathered from these meters shall be correlated with the observations/complaints of airborne reclaimed water drift. The resultant data shall be used to establish a standard operating procedure with respect to zone use and periods of irrigation. Should the above steps fail to mitigate any airborne reclaimed water drift problem identified by the Permittee or the Division, one or more of the following additional steps shall be implemented to further mitigate or eliminate this problem: a. Adjust sprinklers in those irrigation zones closest to Dixie Trail and Westbrook Road to reduce their throw diameters. b. Weave blocking slats into the fencing along the perimeters of the spray irrigation site immediately adjacent to Dixie Trail and Westbrook Road. c. Restrict irrigation periods for those irrigation zones closest to Dixie Trail and Westbrook Road to night hours and other times of minimal vehicular traffic. d. Restrict use of sprinklers in those irrigation zones closest to Dixie Trail and Westbrook Road completely. III. MONITORING AND REPORTING REQUIREMENTS I. Any monitoring (i.e., including groundwater, surface water, soil or plant tissue analyses) deemed necessary by the Division to ensure surface water and groundwater protection shall be established and an acceptable sampling reporting schedule shall be followed. 2. All flow measurement devices shall be consistent with approved engineering and scientific practices to ensure the accuracy and reliability of flow measurement. Selected devices shall be capable of measuring flows with a maximum deviation of less than 1p percent from true flow, accurately calibrated at a minimum of once per year, and maintained to ensure that the accuracy of measurement is consistent with the accepted capability of the type of device used. Records of flow measurement device calibration shall be kept on file by the Permittce for a period of at least three years. This documentation shall include the following minimum data: a. Date of calibration, b. Name of person performing the calibration, and C. Percent from true flow. 3. The two time per month sampling frequency shall be performed only during the months of April through October, inclusive. During the remainder of the year, these parameters shall be monitored monthly. Representative sampling for the listed parameters shall be required at the Reuse Storage Tank any time that reclaimed water is stored for a prolonged period of time (i.e., see Condition 1. 9.) and compliance with the reclaimed water quality criteria (i.e., see Condition 1. 8.) shall be established prior to utilizing the reclaimed water on the spray irrigation site. 4. Adequate records shall be maintained by the Permittee that tracks the amount of reclaimed water that is utilized on the spray irrigation site. These records shall include, but shall not necessarily be limited to, the following information: a. Date and time of irrigation; b. Volume of reclaimed water irrigated; C. Zone irrigated; d. Length of time that zone is irrigated; e. Continuous weekly, monthly, and year-to-date hydraulic loadings for each zone (i.e., in inches per acre); f. Maintenance of cover crops; g. Weather conditions; and h. Compliance status of water reclamation facility. Three copies of all operation and disposal records (i.e., as specified in Condition III. 4.) shall be submitted on Form NDAR-1 and three copies of all monitoring data (i.e., as specified in Condition Ill. 3.) shall be submitted on Form NDMR-1 on or before the Iast day of the month following the month that was monitored. Noncompliance Notification: The Perznittee shall report by telephone to the Washington Regional Office, telephone number (252) 946-6481, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence at the water reclamation facility which results in the treatment of significant amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a sludge digester; the known passage of a slug of hazardous substance through the facility; or any other unusual circumstances. b. Any process unit failure, due to known or unknown reasons, that render the facility incapable of adequate wastewater treatment such as mechanical or electrical failures of pumps, aerators, compressors, etc. c. Any failure of a pumping station, sewer line, or treatment facility resulting in a bypass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. d. Any spill or runoff of reclaimed water from the reclaimed water distribution, storage, and utilization facilities. e. Any time that self -monitoring information indicates that the water reclamation facility or reclaimed water distribution, storage, and utilization facilities have gone out of compliance with their permit limitations. Persons reporting such occurrences by telephone shall also file a written report in letterform within five days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. IV. GROUNDWATER REQUIREMENTS 1. Prior to beginning waste disposal activities, a piezometer well shall be constructed in Soil Zone No. 1 to monitor the level of the groundwater. The general location and name for the well shall be determined and approved by the Groundwater Section of the Division's Washington Regional Office. 2. The piezometer well shall be constructed by a North Carolina -certified well contractor, the property owner or the property lessee in accordance with North Carolina General Statute §87-94.4(b)(2). If the well construction is not performed by a North Carolina -certified well contractor, the property owner or property Iessee shall perform the actual construction activities, and the well shall be constructed in accordance with 15A NCAC 2C .0108 (i.e., "Standards of Construction for Wells Other than Water Supply") and any other state and local laws and regulations pertaining to such construction. 3. The Washington Regional Office, telephone number (252) 946-6481, shall be notified at least 48 hours prior to the construction of the piezometer well, so that an inspection can be made of its location. Such notification shall be made to the Regional Groundwater Supervisor during normal office hours (i.e., from 8:00 a.m. until 5:00 p.m.) on Monday through Friday, excluding State Holidays. 4. Within 30 days of completion of the piezometer well construction activities, a certification shall be received from a North Carolina -licensed Professional Engineer or North Carolina -licensed Professional Geologist certifying that the well is located and constructed in accordance with 15A NCAC 2C (i.e., "Well Construction Standards") and this permit. This certification shall be submitted with one copy of a GW-1 Form (i.e., "Well Completion Form") for the well. Mail this certification and the associated GW-1 Form to NCDENR-DWQ, Groundwater Section, Permits and Compliance Unit, 1636 Mail Service Center, Raleigh., NC 27699-1636. 5. For the initial monitoring of the piezometer well as specified elsewhere in this permit, the Permittee shall subunit a copy of the GW-1 Form with the GW-59 Form (i.e., "Compliance Monitoring Form") for that well. GW-59 Forms for wells that have not had a GW-1 Form previously submitted shall be returned to the Permittee without being processed. Failure to submit these forms as required by this permit may result in the initiation of enforcement actions pursuant to North Carolina General Statute § 143-215.6. 6. The piezometer well shall be monitored initially after construction and prior to initiating any waste disposal activities and monthly thereafter to determine the water level only. The depth to the water table in the well shall be measured from the surveyed point on the top of the well casing. The measuring point (i.e., top of well casing) shall be surveyed relative to a common datum. The results of the sampling and analysis shall be received on the GW-59 Form on or before the last working day of the month following the sampling month at the following address: NCDENR-DWQ Groundwater Section Permits and Compliance Unit 1636 Mail Service Center Raleigh, North Carolina 27699-1636 The data of all groundwater monitoring shall be reported using the most recent GW-59 Form. Updated forms (i.e., GW-1 Form, GW-30 Form, and GW-59 Form) may be downloaded from the website at http:llgw.ehnr.state.nc.us or requested from the address above. 7. Waste disposal activities shall not occur when the vertical separation between the land surface and the water table is less than three feet. Verification of the water table elevation shall be confirmed by water level readings obtained from the piezometer well or by auger borings, which shall be done within 24 hours, prior to any waste disposal event_ Any open borings shall be properly filled in with native soil prior to initiating the waste disposal event in order to decrease the chance of groundwater contamination. S. The COMPLIANCE BOUNDARY and REVIEW BOUNDARY for the waste disposal area shall be as specified by 15A NCAC. 2H .0219(k)(2)(B)(i)(II1). The Complianice Boundary and the Review Boundary shall be established at the property boundary. Any exceedance of groundwater quality standards at or beyond the Compliance Boundary is subject to immediate remediation action in accordance with 15A NCAC 2L .0106(d)(2). Any additional groundwater quality monitoring, as deemed necessary by the Division, shall be provided- V. INSPECTIONS 1. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to ensure proper operation and management of the distribution, storage, and utilization facilities. 2. The Permittee or his designee shall inspect the distribution, storage, and utilization facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or Iead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall keep an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for a period of three years from the date of the inspection and shall be made available upon request to the Division or other permitting authority. 10 Any duly authorized officer, employee, or representative of the Division may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the distribution, storage, and utilization facilities at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records that must be maintained under the terms and conditions of this permit, and may obtain samples of reclaimed, groundwater, surface water, or leachate. VI. GENERAL CONDITIONS This permit shall become voidable unless the distribution, storage, and utilization facilities are constructed and operated in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 2. A set of the approved plans and specifications for the distribution, storage, and utilization facilities shall be retained by the Permittee for the life of the facilities, 3. This permit shall be effective only with respect to the nature and volume of reclaimed water described in the application and other supporting data. 4. This permit shall not be transferable. In the event there is a desire for the distribution., storage, and utilization facilities to change ownership, or there is a name change of the Permittee, a formal permit request shall be submitted to the Division accompanied by documentation from the parties involved and other supporting materials as may be appropriate. The approval of this request shall be considered on its merits and may or may not be approved. 5. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statutes § 143- 215.6A through § 143-215.6C. 6. The issuance of this permit shall not exempt the Permittee from complying with any and all statutes, rules, regulations, or ordinances that may be imposed by other government agencies (i.e., local, state and federal) which have jurisdiction, including but not limited to applicable river buffer rules in 15A NCAC 2B .0200, erosion and sedimentation control requirements in 15A NCAC Ch. 4 and under the Division's General Permit NCG0100000, and any requirements pertaining to wetlands under 15A NCAC 2B .0200 and 15A NCAC 2H .0500. The annual administering and compliance fee shall be paid by the Permittee within 30 days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15 NCAC 2H .0205 (c)(4), The Permittee, at Ieast six months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Division shall review the adequacy of the distribution, storage, and utilization facilities described therein, and if warranted, will extend the permit for such period of time and under such conditions and limitations as it may deem appropriate. 9.
