In accordance with your permit renewal request received April 12,
information received August 11, 2004, we are forwarding herewith Permit No
September 1, 2004, to Mr. & Mrs. Cleveland Fogleman for the construction

Please pay particular to Condition I. 12., which stipulates the property transfer requirements for
the subject property. Note that permanent language must be added to the deed to reflect the fact that
the design of the facility is such that the State -required buffer between the wetted area and property
lines, as stipulated in 15A NCAC 2H .0219 0)(5)(i), could not be maintained with and by adjoining
lots. This condition provides that lot -specific information regarding the conveyance and receipt of
buffer waivers also be added to the deed language.
Also be aware that a formal request for reissuance-of this permit is necessary to transfer
ownership of the facilities permitted herein. Condition V. 3. details these requirements, and stipulates
that "a copy of this permit, all approved plans and specifications, final record drawings, as well as all
operation and maintenance information and log books shall be conveyed to the new owner at the time
of closing[,]" if the facilities are to change ownership. Condition V. 4. requires that the design
engineer provide comprehensive information regarding operation and maintenance of the permitted
facilities prior to wastewater being made tributary to familiarize the Permittee with the operating and
monitoring requirements stipulated by this permit Failure to establish an adequate system for
collecting and maintaining the required operational information will result in future compliance
problems.
This permit shall be effective from the date of issuance until August 31, 2009, shall void
Permit No. WQ0016495 issued March 27, 2000, and shall be subject to the conditions and limitations

the right to request an adjudicatory hearing upon written request within thirty (30) days following

PERMISSION IS HEREBY GRANTED TO

construction and operation of a 480-GPD spray irrigation wastewater treatment and disposal system
consisting of a 1,200-gallon baffled septic tank with effluent filter; a distribution box followed by one
420.5-square foot gravity -dosed sub -surface sand filter; a tablet chlorinator; one 3,000-gallon
storage/pump tank (with floats set to provide a minimum net storage volume of 2,400 gallons); a 43-
GPM pump with a high-water alarm light and buzzer and an automatic rain shut-off device; a
27,395.42-square foot spray irrigation area with eight full -circle, overlapping (set 50 feet on center),
78-foot diameter, 5.5-GPM sprinkler heads; and all associated piping, valves, and appurtenances to
serve the four -bedroom residence to be built on Lot No. 3 (Deed Book 756, Page 953) located in
Hadley Township near the intersection of Timber Ridge Road (NCSR 1547) and Lutterloh Road
(NCSR 1548) at latitude coordinate 35°48'31" and longitude coordinate 79°14'09",with no discharge
of wastes to the surface -waters, to serve the Fogleman residence, pursuant to the application received
April 12, 2004, and in conformity with the project plan, specifications, and other supporting data
subsequently filed and approved by the Department of Environment and Natural Resources and.
considered a part of this permit.
This permit shall be effective from the date of issuance until August 31, 2009, shall void Permit
No. WQ0016495 issued March 27, 2000 and shall be subject to the following specified conditions and
limitations:
I. PERFORMANCE STANDARDS
1. Upon completion of construction and prior to operation of this permitted facility, a
certification must be received from a professional engineer certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting materials. If this project is to be completed in phases
and partially certified, you shall retain the responsibility to track further construction
approved under the same permit, and shall provide a final certificate of completion once the
entire project has been completed. Mail the Certification to the Non -Discharge Permitting
Unit, 1617 Mail Service Center, Raleigh, NC 27699-1617.
2. The Raleigh Regional Office, telephone number (919) 571-4700, shall be notified at least
forty-eight (48) hours in advance of operation of the installed facilities so that an in -place
inspection can be made. Such notification to the regional supervisor shall be made during
the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday,
excluding State Holidays.
3. The surface irrigation facilities shall be effectively maintained and operated at all times so
that there is no discharge to surface waters, nor any contamination of ground waters which
will render them unsatisfactory for normal use. In the event that the facilities fail to
perform satisfactorily, including the creation of nuisance conditions or failure of the
irrigation area to adequately assimilate the wastewater, the Permittee shall take immediate
corrective actions including those actions that may be required by the Division of Water
Quality (Division), such as the construction of additional or replacement wastewater
treatment and disposal facilities.
4. The issuance of this permit shall not relieve the Permittee of the responsibility for damages
to surface or ground waters resulting from the operation of this facility.
5. The sand media of the subsurface sand filter must comply with the Division's sand
specifications. The Engineer's Certification will serve as evidence that these specifications
have been met.
6. A leakage test shall be performed on the septic tank and storage/pump tank(s) to insure that
any exfiltration occurs at a rate which does not exceed twenty (20) gallons per twenty-four
(24) hours per 1,000 gallons of tank capacity. The Engineer's Certification will serve as
proof of compliance with this condition.
7. If excavation into bedrock is required for the installation of the septic tank or sand filter,
the pit shall be lined with a 10-mil synthetic liner.
8. A sanitary tee and filter shall be installed on the effluent pipe of the septic tank. The
Engineer's Certification will serve as evidence that these specifications have been met.
9. The residuals generated from these treatment facilities must be disposed in accordance with
General Statute 143-215.1 and in a manner approved by the Division.
10. Diversion or bypassing of the untreated wastewater from the treatment facilities is
prohibited.
11. The following buffers shall be maintained:
a. 400 feet between wetted area and any residence or places of public assembly under
separate ownership,
b. 150 feet between wetted area and property lines,
c. 100 feet between wetted area, and wells,
d. 100 feet between wetted area and drainage ways or surface water bodies,
e. 50 feet between wetted area and public right of ways,
f. 100 feet between treatment/storage units and any wells, and
g. 56 feet between treatment units and property lines.
Some of the buffers specified above may not have been included in previous permits for
this waste treatment and disposal system. These buffers are not intended to prohibit or
prevent modifications, which are required by the Division, to improve performance of the
existing treatment facility. These buffers do, however, apply to modifications of the
treatment and disposal facilities that are for the purpose of increasing the flow that is
tributary to the facility. These buffers do apply to any expansion or modification of the
surface irrigation areas and apply in instances in which the sale of property would cause
any of the buffers now complied with, for the treatment and disposal facilities, to be
violated. The applicant is advised that any modifications to the existing facilities will
require a permit modification.
12. Buffers to the property line on the subject property are affected by the wetted areas of the
spray irrigation facilities proposed for Lot No. 1 and Lot No. 4 permitted under Permit No.
WQ0016493 and Permit No. WQ0016496, respectively. In addition, the wetted area of the
spray irrigation facility for the subject property affects a buffer to the property line of Lot
No. 4 permitted under Permit No. WQ0016496. The Permittee shall add the following
language to the deed to be drafted for the subject property upon its conveyance: "[i]t is
acknowledged by the Grantor and Grantee that the above described lot(s) has a wastewater
spray irrigation system which is to be installed at a distance from the property lines that is
less than the State -required minimum buffer of 150 feet as stipulated in 15A NCAC 2H
.0219 (j)(5)(i), and the Grantee accepts this systems `As Is,' and that the adjoining lot(s)
may also have less than the _ State -required minimum buffer of 150 feet." Information
regarding the lots to which the subject property has conveyed buffer waivers and from
which the subject has received buffer waivers shall be made a permanent part of the deed
language as well.
13. The pump tank(s) shall have functional audible and visual high water alarms that are
external to any structure.
14. The disposal system shall be connected to a rain or moisture sensor that shall indicate when
wastewater application is not appropriate in accordance with Condition II(4).

1. The facilities shall be properly maintained and operated at all times.
2. Upon classification of the wastewater treatment and surface irrigation facilities by the
Water Pollution Control System Operators Certification Commission (WPCSOCC), the
Permittee shall designate and employ a certified operator to be in responsible charge (ORC)
and one or more certified operator(s) to be back-up ORC(s) of the facilities in accordance
with 15A NCAC 8G .0201. The ORC shall visit the facilities in accordance with 15A
NCAC 8G .0204 or as specified in this permit and shall comply with all other conditions
specified in these rules.
3. A year-round cover crop of pine trees shall be established on the spray irrigation field.
Care shall be taken to preserve the integrity of the spray irrigation field during its
preparation. All areas cleared as a result of installation area shall be appropriately seeded,
fertilized, and mulched to establish an appropriate cover crop.
4. In the event that the sprinkler heads fail to achieve the design diameter of 78 feet due to
obstructions, the obstructions shall be removed or the sprinkler heads shall be raised and
supported to such height that the design diameter is achieved.
5. Irrigation shall not be performed during inclement weather or when the ground is in a
condition that will cause runoff.
6. Adequate measures shall be taken to prevent wastewater runoff from the irrigation field.
7. The application rate shall not exceed a cumulative loading of 13.9 inches over any twelve
(12) month period at an instantaneous application rate not to exceed 0.20 inches per hour.
S. The facilities shall be effectively maintained and operated as a non -discharge system to
prevent the discharge of any wastewater resulting from the operation of this facility.
9. No type of wastewater other than that from the Fogleman residence (a four -bedroom
residence to be built on Lot No. 3 (Deed Book 756, Page 953) located in Hadley Township near the
intersection of Timber Ridge Road (NCSR 1547) and Lutterloh Road (NCSR 1548) at latitude
coordinate 35°48'31" and longitude coordinate 79°14'09") shall be sprayed onto the irrigation
area.
10. No traffic or equipment shall be allowed on the disposal area except while installation
occurs or while normal maintenance is being performed.
11. The irrigation field shall be fenced with at least a two -strand wire fence.
12. Wastewater treatment units open to the atmosphere shall have restricted access and pump
control panels shall be locked.
13. The Permittee is responsible for the operation and maintenance of the entire treatment and
disposal system including, but not limited to, the following items:
a. The septic tank shall be checked annually and pumped out as needed. The septic tank
effluent filter shall be checked and cleaned at the same frequency of the septic tank.
b. The tablet chlorinator shall be checked every week. Tablets shall be added to provide
proper chlorination.
c. The storage, pump, and alarm systems shall be inspected monthly. The scum layer
shall be removed at the same interval as the septic tank is cleaned out.
d. The system shall be inspected monthly to make certain of the proper operation of the
spray head(s), that the vegetative growth allows a proper spray pattern, that the soil is
assimilating the disposed treated wastewater with no surface runoff, and that no
objectionable odors are being generated.
III. MONITORING AND REPORTING REQUIREMENTS
1. Any monitoring deemed necessary by the Division to insure .surface and ground water
protection will be established and an acceptable sampling reporting schedule shall be
followed.
2. The Pernttee shall maintain records of all maintenance performed on the system and \-
irrigation area, as required in Condition II(12) for a minimum of five years. This
information shall be provided to the Division upon request.
3. Noncompliance Notification:
The Permittee shall report by telephone to the Raleigh Regional Office, telephone number
(919) 571-4700, as soon as possible, but in no case more than 24 hours or on the next
working day following the occurrence or first knowledge of the occurrence of any of the
following:
a. Any process unit failure, due to known or unknown reasons, that renders the facility
incapable of adequate wastewater treatment, such as mechanical or electrical failures
of pumps, spray heads, etc.; or
b. Any failure of a pumping station or treatment facility resulting in a by-pass directly to
receiving waters without treatment of all or any portion of the influent to such station
or facility.
Occurrences outside normal business hours may also be reported to the Division's
Emergency Response personnel at telephone number (800) 858-0368 or (919) 733-3300.
Persons reporting such occurrences by telephone shall also file a written report in
letterform within five (5) days following first knowledge of the occurrence. This report
must outline the actions taken or proposed to be taken to ensure that the problem does not
recur.
IV. INSPECTIONS
1. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to
insure proper operation of the subject facilities.
2. Any duly authorized officer, employee, or representative of the Division may, upon
presentation of credentials, enter and inspect any property, premises or place on or related
to the disposal site or facility at any reasonable time for the purpose of determining
compliance with this permit, may inspect or copy any records that must be maintained
under the terms and conditions of this permit, and may obtain samples of groundwater,
surface water, or leachate.
V. GENERAL CONDITIONS
1. This permit shall become void unless the facilities are constructed in accordance with the
conditions of this permit, the approved plans and specifications, and other supporting data.
2. This permit is effective only with respect to the nature and volume of wastes described in
the application and other supporting data.
3. This permit is not transferable. In the event there is a desire for the facilities to change
ownership, or there is a name change of the Permittee, a formal permit request must be
submitted to the Division accompanied by documentation from the parties involved, and
other supporting materials as may be appropriate. Note that, if the subject facilities are to
change ownership, a copy of this permit, all approved plans and specifications, final record
drawings, as well as all operation and maintenance information and log books shall be
conveyed to the new owner at the time of closing. The approval of this request will be
considered on its merits and may or may not be approved.
4. No flow shall be made tributary to the facilities permitted herein until the design engineer
has provided the Permittee with a comprehensive description of the treatment and disposal
system as well as a guide for both its operation and maintenance
5. Upon the availability of a municipal or regional sewerage collection system, the subject
wastewater treatment facilities shall be abandoned and all wastewater discharged into the
municipal or regional sewerage system.
6. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Division in accordance with North Carolina
General Statute 143-215.6A to 143-215.6C.
7. The issuance of this permit does not preclude the Permittee from complying with any and
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
8. This permit may be revoked if the Permittee fails to abide by the conditions of the
"Operation and Maintenance Agreement" previously signed by the Permittee.
9. A set of approved plans and specifications for the subject project must be retained by the
Permittee for the life of the project.
10. The annual administering and compliance fee must be paid by the Permittee within 30 days .
after being billed by the Division. Failure to pay the fee accordingly may cause the
Division to initiate action to revoke this permit as specified by 15A NCAC 2H .0205 (c)(4).
11. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its
extension. Upon receipt of the request, the Commission will review the adequacy of the
facilities described therein, and if warranted, will extend the Permit for such period of time
and under such conditions and limitations, as it may deem appropriate.

I agree to operate and maintain the wastewater treatment system as follows: NON -DISCHARGE PERMITTING
1) The Permittee is responsible for the operation and maintenance of the entire treatment and disposal
system including, but not limited to, the following iteins:
a) The septic tank shall be checked annually and pumped out as needed. The effluent filter shall be
checked and cleaned at the same frequency of the septic tank.

months and any vegetative growth shall be removed by hand.

and/or replaced to ensure proper disinfection.

removed at the same time interval as the septic tank is pumped out.
e) The irrigation system shall be inspected monthly to make certain of proper operation, that
vegetative growth does not interfere with the system inspection or operation, that the soil is
assimilating'the disposed treated wastewater with no surface runoff, and that no objectionable
odors are being generated.
2) Failure of the Permittee to properly operate this system is subject to a penalty up to $25,000 per day.
3) Failure to meet the permit conditions or violation of the State's surface or groundwater regulations
will require evacuating the dwelling and may void the permit.
