Sullins, Deputy Director Division of Water Quality June 11, 2004 Mr. Art Raymond The Point on Norman, LLC 2214 Brawley School Road Mooresville, North Carolina 28115 Subject: The Point pilot loading rate project Permit No. WQ0015931 Iredell County, NC Dear Mr. Raymond: The Division of Water Quality (Division) has reviewed the pilot study to increase the loading rates at the subject facility to 2"/week on average (i.e. 104"/12 month period): This pilot study will include additional soil sampling (semi-annual), monitoring of subsurface flow (Nitrate Nitrogen and Phosphorus), monitoring of cover crop, and monitoring of weather data. This pilot study will allow an exceedance of the irrigation limitation contained in condition H. 7. of the permit. All other conditions of the permit shall be met. In addition to the conditions of the pilot study provided in the correspondence from Toney Jacobs dated January 19, 2004, a narrative of visual observations of the fields and cover crop must also be maintained. The Division hereby approves the increased loading rate on a pilot basis with the following conditions: 1. All conditions of the Permit No. WQ0015931 with the exception of Condition II.7. shall remain in full force and effect. Nothing in this approval of the pilot study shall relieve the permittee from meeting all other permit conditions. 2. Irrigation rates shall not exceed 104 in/year. Fields 7 and 18 will be used initially with Fields 6 and 17 used as wastewater is available. At no times shall irrigation exceed the infiltration capacity of the soil or at a rate that results in ponding or runoff. The permittee shall review current inspection procedures and frequencies and increase as necessary to ensure prevention of ponding and/or runoff. 3. This approval shall be effective for a period of 12 months from the date of initiation. The perrnittee shall notify both the Non -Discharge Permitting Unit and the Mooresville Regional Office of the initiation of the pilot study. 4. The Division may halt the study at anytime due to non-compliance with this approval or applicable permit conditions If the study shows that a higher loading rate is applicable and the Permittee would like to increase the loading rates, then a permit modification request must be made and approved before the rate will become permanent. Such request will be reviewed in accordance with the latest Division policy.
