Reference your application for a Department of the Army permit
to construct a 675-foot-long breakwater structure, including the
excavation of approximately 40 cubic yards of material to place
landward of a highground bulklhead on Albemarle Sound and a
manmade canal adjacent to Lot No. 56, Sunset Drive, Holiday
Island Subdivision, Perquimans County, North Carolina.
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWC080-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the North
Carolina Division of Coastal Management prior to performing arty
such change or alteration. Such action is necessary as revised
plans must be reviewed and the authorization modified.

This permit, issued on ///2- 34/ / v __2 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) In order to protect juvenile fin fish populations, no excavation or filling
will be permitted between June 1 and September 30 of any year without the
prior approval of the Division of Coastal"Management.
(2) The breakwater structure will be positioned in strict accordance with permit
plans. Absolutely no excavated or fill material will be placed landward
of the breakwater structure.
(3) The breakwater structure will be constructed so that not less than 30 percent
of the structure will be open to' provide adequate water circulation and
ingress and egress of aquatic organisms.
(4) The bulkhead will be positioned on high ground, landward of the normal
water elevation contour and any irregularly flooded vegetated wetlands.
(5) All excavated materials will be confined landward of the high ground bulkhead.
(6) No excavated or fill materials will be placed at any time in any vegetated

or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This'petmit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 19%
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

(9) The temporary placement or double-handling of excavated or fill materials

(10) The disturbed areas will be properly graded and provided a ground cover
sufficient to restrain erosion within thirty (30) days of project completion.
(11) The activity will be conducted in such a manner as to prevent significant
increases in turbidity outside the area of construction or construction-related
discharge.
NOTE: The proposed project is certified under General Water Quality Certification
No. 1272 issued on November 10, 1978, for bulkhead construction.

Reference the application of Mr. Cecil Shaddeau and
!9s. Delores Shaddeau for a Department of the Army permit to
construct a 675-foot-long breakwater structure, including the
excavation of approximately 40 cubic yards of material to place
landward of a highground bulkhead on Albemarle Sound and a manmade
canal adjacent to Lot No. 56, Sunset Drive, Holiday Island
Subdivision, Perquimans County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and ,your -Field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. The breakwater structure will be positioned in strict
accordance with permit plans. Absolutely no excavated or fill
material .rill be placed landward of the breakwater structure.
b. `The breakwater structure will be constructed so that not
less than 30 percent of the surface area of the structure will be
open to provide adequate water circulation and ingress and egress
of aquatic organisms.
C. The bulkhead will be positioned on high ground, landward
of the nor-mal water elevation contour and any irregularly flooded
vegetated wetlands.

On February 6, 1986, we renewed general permit No. SAWCO80-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received September 22, 1987, for
a Department of the Army permit to construct a 675-foot-long
breakwater structure, including the excavation of approximately 40
cubic yards of material, and placing the excavated material
landward of a high ground bulkhead on Albemarle Sound and a
manmade canal, adjacent to Lot No. 56 on Sunset Drive, Holiday
Island Subdivision, Perquimans County, North Carolina, indicates
it to be a candidate for Federal authorization under this general
permit. Accordingly, the administrative processing of your
application will be accomplished by the North Carolina Division of
Coastal Management. Comments from Federal review agencies will be
furnished to the State.
-If your application must be withdrawn from this general permit
:.process for any reason, you will be written and informed of its-
further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State-will result in your receiving written
notice from us that your application has been successfully
processed under.our general permit. Only.after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the River and
Harbor Act, has been assigned.No. SAWC088-N-072-0015 and will be

retain the excavated wetland materials for the poacement of a 660' breakwater
at lot 56, section B, Holiday Island Subdivision in Perquimans County on the
Albemarle Sound and a man made canal.

SITE DESCRIPTION
The applicant's property is located in Perquimans County in Holiday Island
Subdivision on Sunset Circle, lot 56, section B on a man made canal and the
Albemarle Sound. The property has an existing house and a retaining wall along
the wetland line. There is a small wetland peninsula which extends into the
sound along the canal. This wetland peninsula area is vegetated with cypress
trees and other "404" species. The applicant has removed all wetland vegetation
between the existing retaining wall waterward to the canal's edge and the edge
of the wetland peninsula.
The applicant proposes to construct a high ground bulkhead along the "404"
line as designated by the COE. This bulkhead will be used to retain the spoil
materials which will be excavated along the man made canal approximately 190' X 2'
in front of the proposed breakwater. The proposed 660' breakwater is to be
constructed of salt treated timbers with openings every 3' to 4' to allow for
water circulation. The height of the proposed breakwater is 1' above NWL.
ANTICIPATED"IMPACTS
The project as proposed will result in the filling of 675 square feet of canal
and sound bottom with the placement of the breakwater. Additionally, 300 square
feet of wetlands will be excavated to allow for the placement of the breakwater.
